which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to direct the Secretary of Veterans Affairs to furnish headstones, markers, and medallions for graves of certain enslaved individuals and individuals who performed military functions despite ineligibility to serve in the Armed Forces.</official-title></form><legis-body id="HC5065864FD0D48DEBD173CD2B380B483" style="OLC"><section id="HC720524AB69C4121B0C46A57DDCFE23B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Headstones for Honor Act</short-title></quote>.</text></section><section id="HE8FE18685A054B8596DAE342B2634475"><enum>2.</enum><header>Eligibility for headstones, markers, and medallions, furnished by the Secretary of Veterans Affairs, for graves of certain enslaved individuals and individuals who performed military functions despite ineligibility to serve in the Armed Forces</header><subsection id="HDFF661F047A94D898D0D0D6B52DB606D"><enum>(a)</enum><header>Establishment</header><text>Section 2306 of title 38, United States Code, is amended—</text><paragraph id="H29AECA888F3F4ADFBC6199A370501DD2"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HF05AD037082D482F8242500462A70139"><enum>(A)</enum><text>in paragraph (3), by inserting <quote>and Navies</quote> after <quote>Armies</quote>; and</text></subparagraph><subparagraph id="H7283ACDA5507403C8BF79EF7D508A41E"><enum>(B)</enum><text>by inserting, after paragraph (5), the following new paragraphs:</text><quoted-block id="H973BC40734E046C5A2C0BA16181D37FB" style="OLC"><paragraph id="H1CAC9FA524B048B888F7A0B673EAB92B"><enum>(6)</enum><text>Any enslaved individual, determined by the Secretary to have—</text><subparagraph id="H0350FD320D854A83846B8537AEBD0063"><enum>(A)</enum><text display-inline="yes-display-inline">accompanied a member of the Armed Forces or a Civil War veteran (as that term is defined in section 1501 of this title) during active military or naval service of such member or Civil War veteran; or</text></subparagraph><subparagraph id="H4735CF5EB4E248FEAAA6B0AF7DE1800F"><enum>(B)</enum><text>served in the Armed Forces (or Confederate Army or Navy) in lieu of another individual.</text></subparagraph></paragraph><paragraph id="H0905BA44EE4840CBA09C59B8E5714038"><enum>(7)</enum><text display-inline="yes-display-inline">Any individual determined by the Secretary to have performed a military function while prohibited from serving as a member of the Armed Forces—</text><subparagraph id="HD4471CFFF5264B96BEB9B385AA48CF16"><enum>(A)</enum><text>by Federal, State, or Tribal law; and</text></subparagraph><subparagraph id="H5A8A9AEB28154A29B78F190985AE122B"><enum>(B)</enum><text>on the basis of race, gender, sex, or ethnicity.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD8D5417A9E044BD58F62E54524D177C3"><enum>(2)</enum><text>in subsection (d)(1), by striking <quote>or (5)</quote> and inserting <quote>(5), (6), or (7)</quote>;</text></paragraph><paragraph id="H89DA3B51AA6B42EFAEA9A19C9A7EF1D6"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating subsection (j) as subsection (l); and</text></paragraph><paragraph id="H59092590133842AABBD5472AF8F8097F"><enum>(4)</enum><text>by inserting, after subsection (i), the following new subsections (j) and (k):</text><quoted-block id="HA78E6B4EED15454C9EB004F9D629685F" style="OLC"><subsection id="HFF361B8D25F34733969C3CA99D747A16"><enum>(j)</enum><text display-inline="yes-display-inline">With respect to an individual described in paragraph (6) of subsection (a), who served in the military or naval forces of the Confederate States of America during the Civil War, a headstone, marker, or medallion, furnished by the Secretary, shall include language that denotes such individual was forced to support their own enslavement.</text></subsection><subsection id="H0FDCB461F0EE4D89896492FFF0751011"><enum>(k)</enum><text>With respect to an individual described in paragraph (6) or (7) of subsection (a), a request to the Secretary for a headstone, marker, or medallion may be made only by—</text><paragraph id="HF90F67B7A9D04809A7AD25DFBC22B464"><enum>(1)</enum><text>a direct descendant of the individual described in such paragraph; or</text></paragraph><paragraph id="HB7D639AEC0644F8FAF4B808E39ED050E"><enum>(2)</enum><text display-inline="yes-display-inline">an individual whom the Secretary determines has made a sufficiently reasonable attempt to solicit, from such a known direct descendant, consent to make such request on behalf of such direct descendant.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA60DCE39D52B441380F42BAABC5ECB47" display-inline="no-display-inline"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 2207(a)(1) of the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>) is amended by striking <quote>subsections (h), (i), and (j) as subsections (i), (j), and (k)</quote> and inserting <quote>subsections (h) through (l) as subsections (i) through (m)</quote>.</text></subsection><subsection id="HAFC62031F74E40A8BA194DCF224E428E"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the earlier of the following:</text><paragraph id="H3EC70650A2E441F699A9F9DF6CF7D526"><enum>(1)</enum><text>The day on which the Secretary prescribes regulations under subsection (d).</text></paragraph><paragraph id="H117D660B1B3940BCADBFB33091E4CF49"><enum>(2)</enum><text>The day that is one year after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="H3BD93EC0E49E4B988604A2624429A1DE"><enum>(d)</enum><header>Regulations</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall prescribe regulations to carry out the amendments made by subsection (a), that—</text><paragraph id="H561C61F8E9764766980608223BD56161"><enum>(1)</enum><text display-inline="yes-display-inline">are informed by comment, solicited by the Secretary, from—</text><subparagraph id="H3C2C20DBC0FE4F569D8BD336F03E7A16"><enum>(A)</enum><text>Civil War historians;</text></subparagraph><subparagraph id="H38F21DBBDD274B528E5CEF22899EB708"><enum>(B)</enum><text>civil rights organizations; and</text></subparagraph><subparagraph id="H0B7D250216CD4D86A6B3CC3C66DFDB32"><enum>(C)</enum><text>direct descendants of individuals described in under paragraphs (6) and (7) of section 2306(a) of title 38, United States Code, as added by such amendments; </text></subparagraph></paragraph><paragraph id="H565B840319414AB795C47498925A4686"><enum>(2)</enum><text>define the term <quote>military function</quote> for purposes of such section, as amended; and</text></paragraph><paragraph id="HF30A5FC182CB49C0A73B95180A22ACBC"><enum>(3)</enum><text display-inline="yes-display-inline">establish what evidence the Secretary may consider when determining performance of military functions of such individuals or family relationships to such individuals. Such evidence shall include the following:</text><subparagraph id="H2D2FF162DC724D7994E4D0664F52D4C2"><enum>(A)</enum><text>Federal or State pay records.</text></subparagraph><subparagraph id="HB277A8F7441B4B6A8CDF1987A68878D1"><enum>(B)</enum><text>Federal or State pension records.</text></subparagraph><subparagraph id="H44A55E272DB847E7B7BCD849BA73983B"><enum>(C)</enum><text>Confederate pay records.</text></subparagraph><subparagraph id="HF6B77CBE2BD84E778A8062E3D1C0EED1"><enum>(D)</enum><text display-inline="yes-display-inline">Regimental histories.</text></subparagraph><subparagraph id="H93DBE941E8B04653A441EFF6C198FEDE"><enum>(E)</enum><text>Newspapers.</text></subparagraph><subparagraph id="HA8EC8F927A064FFFA99146BD62F904E6"><enum>(F)</enum><text>Photographs.</text></subparagraph><subparagraph id="H7F5F9B9FD7D145EAA6B63BF96036D2BB"><enum>(G)</enum><text>Ship logs.</text></subparagraph><subparagraph id="H0DD54A7D19E947509A6F264DB7A2B352"><enum>(H)</enum><text>Diaries.</text></subparagraph><subparagraph id="H1FD79307FF4F462985CF14EAB36CDC56"><enum>(I)</enum><text>Family records, including bibles.</text></subparagraph><subparagraph id="H7118C03857F446DEB8D01D318626C508"><enum>(J)</enum><text>Church records.</text></subparagraph></paragraph></subsection><subsection id="H942E7BCFD2F8464FB4E911AAF614CAD3"><enum>(e)</enum><header>Report</header><text>Not later than 15 months after the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committees on Veterans’ Affairs of the Senate and the House of Representatives a report on the implementation of the amendments made by subsection (a) and the regulations prescribed under subsection (d).</text></subsection></section></legis-body></bill>
