and</text></subparagraph><subparagraph id="HA279E6EE472843E1BDAFABF42B0ACA42" commented="no"><enum>(B)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" id="HC1DF60B97B844405BF27D5C7F0A39E80" display-inline="no-display-inline" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><paragraph id="H15DA347734064B6194A03FDC84035512" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">determined by the Secretary to be at risk of terrorist attacks and threats.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3D2DB1DC7395486C91A49745B8BB2424"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="HF665AA79496046EF9E4EF757AC0ABE89"><enum>(A)</enum><text>by redesignating paragraphs (1), (2), and (3) as subparagraphs (A), (B), and (E), respectively, and moving such subparagraphs, as so redesignated, two ems to the right;</text></subparagraph><subparagraph id="H94ABAE063A3A43DBBFCA5C10851604E1"><enum>(B)</enum><text>in the matter preceding subparagraph (A), as so redesignated, by striking <quote>The recipient</quote> and inserting the following:</text><quoted-block style="OLC" id="H7ACC5D21FDDB491B9A59B8FD168E9D9E" display-inline="no-display-inline" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><paragraph id="H191852870EC24E25A30734785C755A87"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The recipient</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H307B995105F243F39967149608238857"><enum>(C)</enum><text>in subparagraph (A), as so redesignated, by striking <quote>equipment and inspection and screening systems</quote> and inserting <quote>equipment, inspection and screening systems, and alteration or remodeling of existing buildings or physical facilities</quote>;</text></subparagraph><subparagraph id="HAB169C2C7C944E45B10E178B89143A39"><enum>(D)</enum><text>by inserting after subparagraph (B), as so redesignated, the following new subparagraphs:</text><quoted-block id="H89FF11FAC8664BAD9561A9A7FF2BFC9F" style="OLC" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><subparagraph id="H57E373BC486B4DBCB615684D9EC033F2"><enum>(C)</enum><text>Facility security personnel costs, including costs associated with contracted security.</text></subparagraph><subparagraph id="H237E9D1DCF1C4490B6E1AA0C6B2D36DB"><enum>(D)</enum><text>Expenses directly related to the administration of the grant, except that such expenses may not exceed five percent of the amount of the grant.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H6EDF239DAA57447491A19E0808B6B0A9"><enum>(E)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="H63B9DADAA93540FE8C9BB91BF6138D1D" style="OLC" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><paragraph id="HF49F49BE927647B586E28B985CCE0871"><enum>(2)</enum><header>Retention</header><text>Each State through which a recipient receives a grant under this section may retain up to five percent of each grant for expenses directly related to the administration of the grant.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HFBBCEAA05FC84FACB6F55F6E7E6A2E72"><enum>(4)</enum><text>in subsection (e)—</text><subparagraph id="H80FB9B7D673F49E183DCA0F5FC34450E"><enum>(A)</enum><text>by striking <quote>2020 through 2024</quote> and inserting <quote>2022 through 2028</quote>; and</text></subparagraph><subparagraph id="H3EFF17C15F204E019A23C3E18FFD5622" commented="no"><enum>(B)</enum><text>by adding at the end the following new sentence: <quote>Each such report shall also include information on the number of applications submitted by eligible nonprofit organizations to each State, the number of applications submitted by each State to the Administrator, and the operations of the Nonprofit Security Grant Program Office, including staffing resources and efforts with respect to subparagraphs (A) through (E) of subsection (c)(1).</quote>;</text></subparagraph></paragraph><paragraph id="HA56D65B3DCAB41C99A0AE0EF7246751F"><enum>(5)</enum><text display-inline="yes-display-inline">by redesignating subsection (f) as subsection (j);</text></paragraph><paragraph id="H285FF597890440A69B7CD4C00832B5F1"><enum>(6)</enum><text>by inserting after subsection (e) the following new subsections:</text><quoted-block id="H545922E952CE4A8C87D388C0118F311D" style="OLC" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><subsection id="H72908CB71D7548AC93EEFE9978297B55" commented="no"><enum>(f)</enum><header>Administration</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this subsection, the Administrator shall establish within the Federal Emergency Management Agency a program office for the Program (in this section referred to as the <quote>program office</quote>). The program office shall be headed by a senior official of the Agency. The Administrator shall administer the Program (including, where appropriate, in coordination with States), including relating to the following:</text><paragraph id="H501FC955F1644DEE91BB204EB0F5BFEB" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Outreach, engagement, education, and technical assistance and support to eligible nonprofit organizations described in subsection (b), with particular attention to such organizations in underserved communities, prior to, during, and after the awarding of grants, including web-based training videos for eligible nonprofit organizations that provide guidance on preparing an application and the environmental planning and historic preservation process.</text></paragraph><paragraph id="HA4260FF93E0E4E1982BC1C4D4BE72B7B" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Establishment of mechanisms to ensure program office processes are conducted in accordance with constitutional, statutory, regulatory, and other legal and agency policy requirements that protect civil rights and civil liberties and, to the maximum extent practicable, advance equity for members of underserved communities.</text></paragraph><paragraph id="HA2591661C6A94057BD958C42A1BA7286" commented="no"><enum>(3)</enum><text>Establishment of mechanisms for the Administrator to provide feedback to eligible nonprofit organizations that do not receive grants.</text></paragraph><paragraph id="H7F8F0C5433C64DEA94CE04A857947F7D" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">Establishment of mechanisms to collect data to measure the effectiveness of grants under the Program.</text></paragraph><paragraph id="HCEA5B0827C20412D8074FDB46380EF63" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">Establishment and enforcement of standardized baseline operational requirements for States, including requirements for States to eliminate or prevent any administrative or operational obstacles that may impact eligible nonprofit organizations described in subsection (b) from receiving grants under the Program.</text></paragraph><paragraph id="H4FA0764D0EFA42F7B5129DEA1AD5153E" commented="no"><enum>(6)</enum><text>Carrying out efforts to prevent waste, fraud, and abuse, including through audits of grantees.</text></paragraph></subsection><subsection id="HDE519FDBBC2A403788DB4171C39B0991" commented="no"><enum>(g)</enum><header>Grant guidelines</header><text>For each fiscal year, prior to awarding grants under this section, the Administrator—</text><paragraph id="H122402B657224A75A8997B3171DF4E20" commented="no"><enum>(1)</enum><text>shall publish guidelines, including a notice of funding opportunity or similar announcement, as the Administrator determines appropriate; and</text></paragraph><paragraph id="HF25FBDA8A93E4EECBE113FFDC39392F0" commented="no"><enum>(2)</enum><text>may prohibit States from closing application processes prior to the publication of such guidelines.</text></paragraph></subsection><subsection id="H8DDF112219634304A6F71AED991E95D6"><enum>(h)</enum><header>Allocation requirements</header><paragraph id="H2C1247CE6A044E4AA741F56457946AFE" commented="no"><enum>(1)</enum><header>In general</header><text>In awarding grants under this section, the Administrator shall ensure that—</text><subparagraph id="H662AA192CFF545BBBBCAC92CF3B39438" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">50 percent of amounts appropriated pursuant to the authorization of appropriations under subsection (k) is provided to eligible recipients located in high-risk urban areas that receive funding under section 2003 in the current fiscal year or received such funding in any of the preceding ten fiscal years, inclusive of any amounts States may retain pursuant to paragraph (2) of subsection (c); and</text></subparagraph><subparagraph id="HD97F5F081636410FB5D04514AB8DFC81" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">50 percent of amounts appropriated pursuant to the authorizations of appropriations under subsection (k) is provided to eligible recipients located in jurisdictions not receiving funding under section 2003 in the current fiscal year or have not received such funding in any of the preceding ten fiscal years, inclusive of any amounts States may retain pursuant to paragraph (2) of subsection (c).</text></subparagraph></paragraph><paragraph id="H7BA6835DB5784D9A9B69DD57E9D3B48D" commented="no"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), the Administrator may allocate a different percentage if the Administrator does not receive a sufficient number of applications from eligible recipients to meet the allocation percentages described in either subparagraph (A) or (B) of such paragraph. If the Administrator exercises the authorization under this paragraph, the Administrator shall, not later than 30 days after such exercise, report to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate regarding such exercise.</text></paragraph></subsection><subsection id="H6F304AE8B8BF4D3A898A3ADC0E8CD1E5"><enum>(i)</enum><header>Paperwork Reduction Act</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>), shall not apply to any changes to the application materials, Program forms, or other core Program documentation intended to enhance participation by eligible nonprofit organizations in the Program.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H08B6852D16E84A768D286C5D068D5982"><enum>(7)</enum><text>in subsection (j), as so redesignated—</text><subparagraph id="H9FD6A78998274DDD83BF4F1ACB3DF40C"><enum>(A)</enum><text>in paragraph (1), by striking <quote>$75 million for each of fiscal years 2020 through 2024</quote> and inserting <quote>$75,000,000 for fiscal year 2022 and $500,000,000 for each of fiscal years 2023 through 2028</quote>; and</text></subparagraph><subparagraph id="H83D0024F274340C9A9591B09C9DADB24"><enum>(B)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" id="H2DE2D9F049A7426ABC8B7265D3E3670A" display-inline="no-display-inline" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><paragraph id="HFDE93F4D016047BC82FE29B682271F23" commented="no"><enum>(2)</enum><header>Operations and maintenance</header><text display-inline="yes-display-inline">Of the amounts authorized to be appropriated pursuant to paragraph (1), not more than five percent is authorized—</text><subparagraph id="HC556B42368E1472E90E9EA8286B2FEA2" commented="no"><enum>(A)</enum><text>to operate the program office; and</text></subparagraph><subparagraph id="H16ABA26B54754DFA8241DDD89B8FAC7A" commented="no"><enum>(B)</enum><text>for other costs associated with the management, administration, and evaluation of the Program.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H2743C060A2B34984856CC0490EDC91B7"><enum>(8)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HB0484D520A1E421FB8D271A9BD326387" display-inline="no-display-inline" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><subsection id="HAA0D392F860044DC96F8D0782F975CD6"><enum>(k)</enum><header>Treatment</header><text display-inline="yes-display-inline">Nonprofit organizations determined by the Secretary to be at risk of extremist attacks other than terrorist attacks and threats under subsection (a) are deemed to satisfy the conditions specified in subsection (b) if protecting such organizations against such other extremist attacks would help protect such organizations against such terrorist attacks and threats.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H91156787F38F4AB3B06545FB58E5E049"><enum>(b)</enum><header>Plan</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Administrator of the Federal Emergency Management Agency shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a plan for the administration of the program office for the Nonprofit Security Grant Program established under subsection (f) of section 2009 of the Homeland Security Act 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/609a">6 U.S.C. 609a</external-xref>), as amended by subsection (a), including a staffing plan for such program office.</text></subsection><subsection id="H12EA178F38554FE68EA22E7CA1C5BF62"><enum>(c)</enum><header>Conforming amendment</header><text>Section 2008 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/609">6 U.S.C. 609</external-xref>) is amended—</text><paragraph id="HF8625317DAB04DA5BC911CDC6AABC64C"><enum>(1)</enum><text>in subsection (c) by striking <quote>sections 2003 and 2004</quote> and inserting <quote>sections 2003, 2004, and 2009</quote>; and </text></paragraph><paragraph id="HA0282BE14ADF48BCA8D174DD7FFD246F"><enum>(2)</enum><text>in subsection (e), by striking <quote>section 2003 or 2004</quote> and inserting <quote>sections 2003, 2004, or 2009</quote>.</text></paragraph></subsection></section></legis-body><legis-body style="OLC" display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="idbf2ca324-d2e9-4fe8-a8b1-fa72a6a4f48c" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nonprofit Security Grant Program Improvement Act of 2022</short-title></quote>.</text></section><section id="H265123DE1FA64D18BBEC4A4A7CE18235" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Enhancements to funding and administration of Nonprofit Security Grant Program of the Department of Homeland Security</header><subsection id="H8AF22FD9685B4FDDB4437E09057E0907"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2009 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/609a">6 U.S.C. 609a</external-xref>) is amended—</text><paragraph id="id891AB88DCC524C0AB912FDA078CB349B"><enum>(1)</enum><text>in subsection (a), by inserting <quote>and other threats</quote> before the period at the end;</text></paragraph><paragraph id="idBC73AB4F576746BC94534CC791D1071B"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="id647A899ED5BC4C0BBB079F67725F1728"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>(a)</quote>; and</text></subparagraph><subparagraph id="idC1AB98AC7F0D40D99B3F6619E4213A97"><enum>(B)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id715C1371790D44F2AB198615F7EF1BEF" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph id="id110A38F29FA643318A9F6B8EC0E78779"><enum>(2)</enum><text>determined by the Secretary to be at risk of terrorists attacks and other threats.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD6CBA119D36049AAAFEDAC389E71B7BF"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="HF7A0ADF7C0324418B049EBC357CEC701"><enum>(A)</enum><text>by redesignating paragraphs (1), (2), and (3) as subparagraphs (A), (B), and (E), respectively, and adjusting the margins accordingly;</text></subparagraph><subparagraph id="H4A92F3E042924B24AE9D4CD2945677C7"><enum>(B)</enum><text>in the matter preceding subparagraph (A), as so redesignated, by striking <quote>The recipient</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC05DE053235F4E6FA35CB6464F0944C6" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph id="H6EFD971FBAF94FC2AE60E9080384CD60"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The recipient</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H1DA185F98D8F4565A917BBA5F5FCC827"><enum>(C)</enum><text>in subparagraph (A), as so redesignated, by striking <quote>equipment and inspection and screening systems</quote> and inserting <quote>equipment, inspection and screening systems, and alteration or remodeling of existing buildings or physical facilities</quote>;</text></subparagraph><subparagraph id="H9C19210CA6154C52A2508794977561B6"><enum>(D)</enum><text>by inserting after subparagraph (B), as so redesignated, the following:</text><quoted-block style="OLC" id="H2C25B5BC98A9451C9FB5084CC7C27D14" changed="added" reported-display-style="italic" committee-id="SSGA00"><subparagraph id="HCCF1ADE044FC40A0A50E2527D887841C"><enum>(C)</enum><text>Facility security personnel costs, including contracted security.</text></subparagraph><subparagraph id="idB2996B9EE3344ABB9FD0E041247E5FA8"><enum>(D)</enum><text>Expenses directly related to the administration of the grant, except that those expenses may not exceed 5 percent of the amount of the grant.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H4CCEA1E12E2043628513A2A1C1D24420"><enum>(E)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H42FF903607FF40ACA341BED34CB5DC05" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph id="HB830637A8D5641EE833210B627129675"><enum>(2)</enum><header>Retention</header><text>Each State through which a recipient receives a grant under this section may retain not more than 5 percent of each grant for expenses directly related to the administration of the grant.</text></paragraph><paragraph id="id4E24C35310B744E398EE5921BE036F22"><enum>(3)</enum><header>Outreach and technical assistance</header><subparagraph id="id19467a220c504bd6b02394a82c20526c"><enum>(A)</enum><header>In general</header><text>If the Administrator establishes target allocations in determining award amounts under the Program, a State may request a project to use some of the target allocation for outreach and technical assistance if the State does not receive enough eligible applications from nonprofit organizations located outside high-risk urban areas.</text></subparagraph><subparagraph id="id51f62f2cdf2c49e89a46f9d61ab90ba0"><enum>(B)</enum><header>Priority</header><text>Any outreach or technical assistance described in subparagraph (A) should prioritize underserved communities and nonprofit organizations that are traditionally underrepresented in the Program.</text></subparagraph><subparagraph id="idce9169d2ad414d6b8b6e516458ebaa4e"><enum>(C)</enum><header>Parameters</header><text>In determining grant guidelines under subsection (g), the Administrator may determine the parameters for outreach and technical assistance.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H5AB136A9DA9C4FEB99D436DA1D96C599"><enum>(4)</enum><text>in subsection (e)—</text><subparagraph id="HE2FAA1DE7D674EAB86731B26475E2773"><enum>(A)</enum><text>by striking <quote>2020 through 2024</quote> and inserting <quote>2022 through 2028</quote>; </text></subparagraph><subparagraph id="idB7717B3180E54E4E9D28B26A4B167AD0"><enum>(B)</enum><text>by striking <quote>on the expenditure</quote> and inserting </text><quoted-block style="OLC" display-inline="yes-display-inline" id="id27CDBF3A77E743ABAB1F338CA914E0B0" changed="added" reported-display-style="italic" committee-id="SSGA00"><text>on—</text><paragraph id="id1DB98EE668C84A589CF81AEEE4355AD5"><enum>(1)</enum><text>the expenditure</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="idFB95217114154BB78946268249BC82C7"><enum>(C)</enum><text>in paragraph (1), as so designated, by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="id41A492FD32A94135AD2D6D8A77BFF687"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD176B809A61440339AF508BC58C95071" changed="added" reported-display-style="italic" committee-id="SSGA00"><paragraph commented="no" id="HC710F3C9E5FC49D483735299A0A7AE66"><enum>(2)</enum><text>the number of applications submitted by eligible nonprofit organizations to each State;</text></paragraph><paragraph commented="no" id="id654B8EC110CE443B9141049382498E78"><enum>(3)</enum><text>the number of applications submitted by each State to the Administrator; and</text></paragraph><paragraph commented="no" id="id2925F204C5564997B1151F4ECC333552"><enum>(4)</enum><text>the operations of the program office of the Program, including staffing resources and efforts with respect to subparagraphs (A) through (D) of subsection (c)(1).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H166EBE63BA594C92809E7D20491E8279"><enum>(5)</enum><text>by striking subsection (f) and inserting the following:</text><quoted-block style="OLC" id="H37C3DD1A07304451BC46B003D427E915" changed="added" reported-display-style="italic" committee-id="SSGA00"><subsection id="H8ABE2BE327BA4A6F9445E309137819B4"><enum>(f)</enum><header>Administration</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of the <short-title>Nonprofit Security Grant Program Improvement Act of 2022</short-title>, the Administrator shall ensure that within the Federal Emergency Management Agency, a program office for the Program (in this subsection referred to as the <quote>program office</quote>) shall—</text><paragraph id="idB5FEF77D2F7A4FEBA077820284F87594"><enum>(1)</enum><text display-inline="yes-display-inline">be headed by a senior official of the Agency; and</text></paragraph><paragraph id="id692E7D4BD8B74BEEB6FDDC19C5670567"><enum>(2)</enum><text display-inline="yes-display-inline">administer the Program (including, where appropriate, in coordination with States), including relating to—</text><subparagraph commented="no" id="H8CEE795D24B7414B91B734F96A798D74"><enum>(A)</enum><text display-inline="yes-display-inline">outreach, engagement, education, and technical assistance and support to eligible nonprofit organizations described in subsection (b), with particular attention to those organizations in underserved communities, before, during, and after the awarding of grants, including web-based training videos for eligible nonprofit organizations that provide guidance on preparing an application and the environmental planning and historic preservation process;</text></subparagraph><subparagraph commented="no" id="id295AA8BC37B340EA890AAFAABFB78936"><enum>(B)</enum><text>the establishment of mechanisms to ensure program office processes are conducted in accordance with constitutional, statutory, and regulatory requirements that protect civil rights and civil liberties and advance equal access for members of underserved communities;</text></subparagraph><subparagraph id="HDCF2B626D63E49C0B6389A2AC5273C45"><enum>(C)</enum><text>the establishment of mechanisms for the Administrator to provide feedback to eligible nonprofit organizations that do not receive grants;</text></subparagraph><subparagraph id="HBCCEBB0ACE744D63A311C878DAE39706"><enum>(D)</enum><text display-inline="yes-display-inline">the establishment of mechanisms to identify and collect data to measure the effectiveness of grants under the Program;</text></subparagraph><subparagraph commented="no" id="H33AF07C75151440CB38A4D1D7A131309"><enum>(E)</enum><text display-inline="yes-display-inline">the establishment and enforcement of standardized baseline operational requirements for States, including requirements for States to eliminate or prevent any administrative or operational obstacles that may impact eligible nonprofit organizations described in subsection (b) from receiving grants under the Program; </text></subparagraph><subparagraph id="HD6BA6B1AFC4B465B91721A66BFF2BDC3"><enum>(F)</enum><text>carrying out efforts to prevent waste, fraud, and abuse, including through audits of grantees; and</text></subparagraph><subparagraph id="id03E58B6E488E4024A0063D4C0E8AEE81"><enum>(G)</enum><text>promoting diversity in the types and locations of eligible nonprofit organizations that are applying for grants under the Program.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HBD6E695BA6CD4C22B4EE4B4F2931B673"><enum>(g)</enum><header>Grant guidelines</header><text>For each fiscal year, before awarding grants under this section, the Administrator—</text><paragraph commented="no" id="H550FD062704543039FCE6942FBAC35B2"><enum>(1)</enum><text>shall publish guidelines, including a notice of funding opportunity or similar announcement, as the Administrator determines appropriate; and</text></paragraph><paragraph commented="no" id="H65DCA36E943B45A2A5A4DF679B8032F5"><enum>(2)</enum><text>may prohibit States from closing application processes before the publication of those guidelines.</text></paragraph></subsection><subsection id="HFECD654C303142D5ACDB8B8C98CD8859"><enum>(h)</enum><header>Paperwork Reduction Act</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>), shall not apply to any changes to the application materials, Program forms, or other core Program documentation intended to enhance participation by eligible nonprofit organizations in the Program.</text></subsection><subsection id="idc645b37df23e4f3f90437d6ad1c37be3"><enum>(i)</enum><header>Allocation requirements</header><paragraph id="idffc1b38aaf8042be81c6c801b1e30310"><enum>(1)</enum><header>In general</header><text>In awarding grants under this section, the Administrator shall ensure that—</text><subparagraph id="idb422c0af02dc4ac7a9cb7a6d3479bbf2"><enum>(A)</enum><text>50 percent of amounts appropriated pursuant to the authorization of appropriations under subsection (j) is provided to eligible recipients located in high-risk urban areas that receive funding under section 2003 in the current fiscal year or received such funding in any of the preceding 10 fiscal years, inclusive of any amounts States may retain pursuant to subsection (c)(2); and</text></subparagraph><subparagraph id="ida8ff627639c74491b10e2be2fe75105a"><enum>(B)</enum><text>50 percent of amounts appropriated pursuant to the authorizations of appropriations under subsection (j) is provided to eligible recipients located in jurisdictions not receiving funding under section 2003 in the current fiscal year or have not received such funding in any of the preceding 10 fiscal years, inclusive of any amounts States may retain pursuant to subsection (c)(2).</text></subparagraph></paragraph><paragraph id="id8dbb55c962144e8f8ae1407cf2c64eaf"><enum>(2)</enum><header>Exception</header><subparagraph id="idF07377145A8D43E0AFB7FE7E6CE1F652"><enum>(A)</enum><header>In general</header><text>Notwithstanding paragraph (1), the Administrator may allocate a different percentage if the Administrator does not receive a sufficient number of applications from eligible recipients to meet the allocation percentages described in subparagraph (A) or (B) of such paragraph. </text></subparagraph><subparagraph id="id98F6FDACBB52492CA0756956800EE9E0"><enum>(B)</enum><header>Report</header><text>If the Administrator exercises the authorization under subparagraph (A), the Administrator shall, not later than 30 days after the exercise, report to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives regarding the exercise. </text></subparagraph></paragraph></subsection><subsection id="id85FAFDE094A34D51AD6F33D14CC30739"><enum>(j)</enum><header>Authorization of appropriations</header><paragraph id="id4628DE654DE34D39A5CAADE8494EA030"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated $360,000,000 for each of fiscal years 2023 through 2028 to carry out this section.</text></paragraph><paragraph id="idD9E0F2D8A4884038A6945BA7912F5EAE" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Transfers authorized</header><text display-inline="yes-display-inline">During a fiscal year, the Administrator may transfer not more than 5 percent of amounts appropriated under this subsection or other amounts appropriated or otherwise made available to carry out the Program for the fiscal year to an account of the Federal Emergency Management Agency for costs incurred for the management, administration, or evaluation of this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id178070F2C4C048FC895CCD9B9EBC87D9"><enum>(b)</enum><header>Report</header><paragraph id="id6c2253cd2c13464f9be1f90311ce1584"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall seek to enter into a contract or other agreement with an independent research organization pursuant to which the organization will conduct a study that analyzes and reports on—</text><subparagraph id="id4e153268c44049fe9bda09e0b1f05900"><enum>(A)</enum><text>the effectiveness of the Nonprofit Security Grant Program established under section 2009(a) of the Homeland Security Act 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/609a">6 U.S.C. 609a(a)</external-xref>), as amended by subsection (a), for preparedness against terrorism and other threats;</text></subparagraph><subparagraph id="id0e6e19d63c1d40de8e8b929d4654061d"><enum>(B)</enum><text>the risk-based formula and allocations under that program; and</text></subparagraph><subparagraph id="id355cbb8bb8b64527b3e95eb88ae77839"><enum>(C)</enum><text>the risk profile of and any identifiable factors leading to the low participation of traditionally underrepresented groups and States under that program.</text></subparagraph></paragraph><paragraph id="iddfb77af85f244763881dbb3e7dbe72af"><enum>(2)</enum><header>Submission</header><text>The final report required under paragraph (1) shall be submitted to the Committee on Homeland Security and Governmental Affairs of the Senate, the Committee on Homeland Security of the House of Representatives, and the Committees on Appropriations of the Senate and the House of Representatives.</text></paragraph><paragraph id="ida89ee9916602413eb3605d1f9760d699"><enum>(3)</enum><header>Funding</header><text>The Administrator may use funding authorized under subsection (j) of section 2009 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/609a">6 U.S.C. 609a</external-xref>)), as amended by subsection (a), to carry out this subsection.</text></paragraph></subsection><subsection id="id247b897226da48caa3c987fef502afd5"><enum>(c)</enum><header>Technical and conforming amendments</header><text>Section 2008 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/609">6 U.S.C. 609</external-xref>) is amended—</text><paragraph id="id5da5cee2b37d43a1ac04b71fe41c41a8"><enum>(1)</enum><text>in subsection (c) by striking <quote>sections 2003 and 2004</quote> and inserting <quote>sections 2003, 2004, and 2009</quote>; and</text></paragraph><paragraph id="id03ddfa4e0d884e3ab4f45cef4fbf16a4"><enum>(2)</enum><text>in subsection (e), by striking <quote>section 2003 or 2004</quote> and inserting <quote>section 2003, 2004, or 2009</quote>. </text></paragraph></subsection></section></legis-body><endorsement><action-date date="20220927">September 27, 2022</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
