R. 6793</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220218">February 18, 2022</action-date><action-desc><sponsor name-id="S000185">Mr. Scott of Virginia</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 28, United States Code, to include a Federal Public or Community Defender as a nonvoting member of the United States Sentencing Commission, and for other purposes.</official-title></form><legis-body id="HB95E5739378046F8AE6BE10173C39158" style="OLC"><section id="H924CD101C6904837A3FE11DC080F4CA4" section-type="section-one"><enum>1.</enum><header>Federal defender as a nonvoting member of the United States Sentencing Commission</header><subsection id="HE3D36A1B0C9948CDBFEC5AD8DC81287E"><enum>(a)</enum><header>In general</header><text>Section 991(a) of title 28, United States Code, is amended—</text><paragraph id="H175B616F263944648EB43EC1F135B962"><enum>(1)</enum><text>in the first sentence, by striking <quote>one nonvoting member.</quote> and inserting <quote>2 nonvoting members.</quote>; and</text></paragraph><paragraph id="H87830CA475294CADACD337B5F5FAE10C"><enum>(2)</enum><text>in the fifth sentence, by striking <quote>shall be an ex officio, nonvoting member</quote> and inserting <quote>and a Federal Public or Community Defender designated by the Defender Services Advisory Group, shall be ex officio, nonvoting members of the Commission.</quote>.</text></paragraph></subsection><subsection id="HC03C8FBEB24A478A980CA9418BD87B0A"><enum>(b)</enum><header>Conforming amendment</header><text>Section 235(b)(5) of the Sentencing Reform Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/18/3551">18 U.S.C. 3551</external-xref> note) is amended, in the last sentence, by striking <quote>nine members, including two ex officio, nonvoting members</quote> and inserting <quote>10 members, including 3 ex officio, nonvoting members.</quote>.</text></subsection></section></legis-body></bill>
