which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HSY00">Science, Space, and Technology</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To identify barriers to the deployment of hydrogen as a fuel source, and for other purposes.</official-title></form><legis-body id="H636F31217E96436A9D48D17C7BADFE3E" style="OLC"><section id="H2BDFBC94196746D6A3237DE1B5649117" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advancing Hydrogen Power Research and Development Act</short-title></quote>.</text></section><section id="H1E80C0012A7E49838A43B50992180E40"><enum>2.</enum><header>Identifying and removing market and regulatory barriers to hydrogen energy</header><subsection id="HB801DE9764634574BD710FC9BCB39EE2"><enum>(a)</enum><header>Report on hydrogen energy barriers</header><paragraph id="H93BF43CDF29B416AA8AB11C886862C7B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this section, the Department of Energy and the Federal Energy Regulatory Commission (in this section referred to as the <quote>Commission</quote>) shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives a report—</text><subparagraph id="H4180A7E980234137B28CFE3A816D1F8D"><enum>(A)</enum><text display-inline="yes-display-inline">describing any barriers to the development, deployment, and use of hydrogen as a fuel source for residential, commercial, industrial, and electric power uses, including barriers to the development and deployment of hydrogen transportation and storage infrastructure, caused by—</text><clause id="H6F685E7F0D324421BA34E631EF433CAB"><enum>(i)</enum><text display-inline="yes-display-inline">the rules of a Transmission Organization (as defined in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>));</text></clause><clause id="H1E1E09EFE9FF4097A20858616FB59E6F"><enum>(ii)</enum><text display-inline="yes-display-inline">any order, regulation, or policy—</text><subclause id="H19EEEFC6E15843C580AE0E7522071421"><enum>(I)</enum><text display-inline="yes-display-inline">of the Commission; and</text></subclause><subclause id="H2F871B6AF50B43F9B8A6FA3ED3D4E2E6"><enum>(II)</enum><text display-inline="yes-display-inline">issued pursuant to the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/791a">16 U.S.C. 791a et seq.</external-xref>) or the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717">15 U.S.C. 717 et seq.</external-xref>); and</text></subclause></clause><clause id="H2D2B9C9E2E18465AB7E63B959D23CCE2" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">any other Federal or State law, regulation, or policy;</text></clause></subparagraph><subparagraph id="H7853438D9F844763829922C258E8FE9C" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">containing recommendations of the Commission for reducing the barriers described in subparagraph (A); and</text></subparagraph><subparagraph id="H0FE1AEF90C9E4BA189C0730D0F8BC365"><enum>(C)</enum><text display-inline="yes-display-inline">identifying any regulatory, market, procurement, or cost recovery mechanisms that would encourage the development, deployment, and use of hydrogen as a fuel source for residential, commercial, industrial, and electric power uses.</text></subparagraph></paragraph><paragraph id="H595BBA96735C4568B63253A06029569D"><enum>(2)</enum><header>Public input and technical conference</header><text display-inline="yes-display-inline">In preparing the report under paragraph (1), the Commission shall solicit public input, including by convening a technical conference and providing an opportunity for public submission of written comments on a draft report.</text></paragraph></subsection><subsection id="H90ACBDCBCD9E4A77BF37858307EE6251"><enum>(b)</enum><header>Hydrogen blending pilot program</header><paragraph id="H28F1A72A8264489786F8B169C16434CE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall establish and carry out a pilot program for hydrogen blending projects in accordance with the Natural Gas Act (<external-xref legal-doc="usc" parsable-cite="usc/15/717">15 U.S.C. 717 et seq.</external-xref>).</text></paragraph><paragraph id="H70DB71664F7A4042BF3F9CCC9E246ED3"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">In carrying out the pilot program under paragraph (1), the Commission shall—</text><subparagraph id="H1FCF990F52BE4036B659E21255319A81"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 60 days after the date of enactment of this section, hold an initial workshop to solicit public comments and recommendations on how to carry out the pilot program;</text></subparagraph><subparagraph id="H67535752A4154F13A6ED9988F6869175"><enum>(B)</enum><text display-inline="yes-display-inline">establish an application process to determine which hydrogen blending projects may participate in the pilot program;</text></subparagraph><subparagraph id="HE9C1D550304C4A779199DE60456509FE"><enum>(C)</enum><text display-inline="yes-display-inline">not later than 180 days after the date of enactment of this section, issue any licenses, permits, or other authorizations necessary for participation in the pilot program; and</text></subparagraph><subparagraph id="H35B7842FEF804A5FBA3D783E59A70D77"><enum>(D)</enum><text>not later than 2 years after the date on which the final hydrogen blending project is implemented, hold a final workshop to solicit public comment on the effectiveness of the pilot program.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
