which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Workforce Innovation and Opportunity Act to direct the Secretary of Labor to award grants for workforce grants to assist incarcerated or previously incarcerated individuals.</official-title></form><legis-body id="HC4572D24F5264D95A7E3F6504C06B330" style="OLC"><section id="H4850318D43D04ED292BE6BCFD5B7B993" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Workforce Opportunity for Returning Citizens Act</short-title></quote> or the <quote><short-title>WORC Act</short-title></quote>.</text></section><section id="HE66FF0AA085D482E9F6003BCD1B7B8B5"><enum>2.</enum><header>Grants to assist incarcerated or previously incarcerated individuals</header><text display-inline="no-display-inline">Subtitle D of title I of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3221">29 U.S.C. 3221 et seq.</external-xref>) is amended—</text><paragraph id="H342EDDEC51F1406887D51F9647DE8D36"><enum>(1)</enum><text>by redesignating section 172 as section 173; and</text></paragraph><paragraph id="H5AF3D1E650C34E0F9927BF280E9007FE"><enum>(2)</enum><text>by inserting after section 171, the following:</text><quoted-block style="OLC" id="HFEB78EC8C44845ACA64A63F804F395EC" display-inline="no-display-inline"><section id="HAD6195549C06479285AC36B5271896BE"><enum>172.</enum><header>Grants to assist incarcerated or previously incarcerated individuals</header><subsection id="H5E5A4052935B42939CA005898B10D011"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From the amounts appropriated under subsection (g), the Secretary shall award grants to eligible entities to develop or expand education or workforce training programs that lead to employment opportunities for incarcerated individuals or previously incarcerated individuals and reduce recidivism.</text></subsection><subsection id="H208C8E4A136A49E0A97A44DCB8C5C03A"><enum>(b)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding grants under this Act, the Secretary shall give priority to eligible entities that will use the grants to develop or expand training programs described in subsection (a) that will lead participants of such programs—</text><paragraph id="H228229A06AFC4F2FB5CDDCABDAE416C1"><enum>(1)</enum><text>to jobs in skilled trade (such as jobs in construction, plumbing, welding, heating and air conditioning, or masonry); or</text></paragraph><paragraph id="HBD299FBBD02C4BD8BA196BB9DEE3CE90"><enum>(2)</enum><text display-inline="yes-display-inline">to the attainment of recognized postsecondary credentials. </text></paragraph></subsection><subsection id="HC52022DE6E114B9888AF0D5278D5D97B"><enum>(c)</enum><header>Application requirements</header><text>To receive a grant under this section, an eligible entity shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="HD14B531400E14A178F481BECED72B8D8"><enum>(d)</enum><header>Uses of funds</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section shall use such grant to develop or expand a training program described in subsection (a). </text></subsection><subsection id="H3E223FD6E6024F21A381C91763A0746B"><enum>(e)</enum><header>Reports</header><text>Each eligible entity that receives a grant under this section shall annually prepare and submit to the Secretary a report on—</text><paragraph id="HC74888B5132E4AA389639BA1F7E7378F"><enum>(1)</enum><text>the amount of the grant awarded to the eligible entity for the preceding grant year, and how such grant was used; and</text></paragraph><paragraph id="HE8CE3CCA5D3D4F7BA2B7459DD88925BE" commented="no"><enum>(2)</enum><text>the progress, as described in section 116, of the eligible entity with respect to the training program developed or expanded with such grant, including the relative rate of recidivism of the participants of such program.</text></paragraph></subsection><subsection id="H2F6CF3A31C354CE0B54385F4F97ECAF9"><enum>(f)</enum><header>Definitions</header><paragraph id="H3FAFD1B0AF57428686602F15214ADE52"><enum>(1)</enum><header>Correctional institution</header><text display-inline="yes-display-inline">The term <quote>correctional institution</quote> has the meaning given the term in section 225(e)(1).</text></paragraph><paragraph id="HD40E1FD3345D427F96B0C2ABBF532AF8" commented="no"><enum>(2)</enum><header>Education or workforce training program</header><text>The term <quote>education or workforce training program</quote> includes—</text><subparagraph id="H12BA0E7DCF00474098E075E7597187E8" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">an apprenticeship program;</text></subparagraph><subparagraph id="H24AFDB17D6B64990A120B894BC564041" commented="no"><enum>(B)</enum><text>an on-the-job training program, or</text></subparagraph><subparagraph id="H09992C006146492C92A25BDA569C0161" commented="no"><enum>(C)</enum><text>a program providing classroom instruction.</text></subparagraph></paragraph><paragraph id="HB5D896854EF74121AC280948D6BB6A50"><enum>(3)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means—</text><subparagraph id="H73644325E6FD44CFB644811BCBB07D49"><enum>(A)</enum><text>a local board;</text></subparagraph><subparagraph id="H1124C7740A234C75A240E1F14399D643"><enum>(B)</enum><text display-inline="yes-display-inline">an area career and technical education school; </text></subparagraph><subparagraph id="H7C344E1792C14D6F93CAA83B4380EBD4"><enum>(C)</enum><text display-inline="yes-display-inline">an intermediary;</text></subparagraph><subparagraph id="HA51763FBF09E49DAA575C7AA30C6A8DE"><enum>(D)</enum><text>an institution of higher education, including a 2-year institution of higher education; or</text></subparagraph><subparagraph id="H0AC3E5B20A5644DD9963FC7BDBC0DE43"><enum>(E)</enum><text>a consortium of the entities described in subparagraphs (A) through (D).</text></subparagraph></paragraph><paragraph id="HA052B99B64734C3386A5F4041C0008C6"><enum>(4)</enum><header>Incarcerated individual</header><text display-inline="yes-display-inline">The term <quote>incarcerated individual</quote> means an adult or juvenile who is in the custody of a correctional institution.</text></paragraph><paragraph id="HD67E95C0F7C94F34B399E5E1AEBF99A4"><enum>(5)</enum><header>Previously incarcerated individual</header><text display-inline="yes-display-inline">The term <quote>previously incarcerated individual</quote> means an adult or juvenile who has been an incarcerated individual at any time during the preceding 36-month period.</text></paragraph></subsection><subsection id="H8DAB78656430424FBABAA47EA762235B"><enum>(g)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section $10,000,000 for each of fiscal years 2023 through 2027.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HED8F3633D8134E13819AD0DCE7622879"><enum>3.</enum><header>Table of contents</header><text display-inline="no-display-inline">The table of contents in section 1(b) of the Workforce Innovation and Opportunity Act is amended by striking the item relating to section 172 and inserting the following: </text><quoted-block style="OLC" id="HB47E9CDC18CD4EABADD10EFDC8580704" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 172. Grants to assist incarcerated or previously incarcerated individuals. </toc-entry><toc-entry level="section">Sec. 173.
