Davis of Illinois</cosponsor>, <cosponsor name-id="G000586">Mr. García of Illinois</cosponsor>, and <cosponsor name-id="P000617">Ms. Pressley</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XIX of the Social Security Act to repeal the requirement that States establish a Medicaid Estate Recovery Program and to limit the circumstances in which a State may place a lien on a Medicaid beneficiary’s property.</official-title></form><legis-body id="H3417353145BD4828B528A3E26832F633" style="OLC"><section id="H50E63A4B2FF74037B00B2A94B90FF752" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Unfair Medicaid Recoveries Act of 2022</short-title></quote>.</text></section><section id="HD1B01B071C274A4D8FB83BDE20BAF664"><enum>2.</enum><header>Liens, adjustments, and recoveries for medical assistance</header><subsection id="HC6A964241F474D20816676AAC82A751C"><enum>(a)</enum><header>Liens</header><text display-inline="yes-display-inline">Section 1917(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396p">42 U.S.C. 1396p(a)</external-xref>) is amended—</text><paragraph id="H5987FF26649F43139D55BCC5535EE122"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="HA7734F686E2C43A686E1B00DE24917D5"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>plan, except—</quote> and inserting <quote>plan, except, subject to paragraph (4),—</quote>; and</text></subparagraph><subparagraph id="H7E52D34BAF104A1D887D99B6372341FF"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>in the case of</quote> and inserting <quote>with respect to liens imposed before the date of the enactment of the Stop Unfair Medicaid Recoveries Act of 2022, in the case of</quote>; and</text></subparagraph></paragraph><paragraph id="HE2832CD401A24F8A8DA7AF20B5FAC681"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H81F651A499A04401AF86585927C43C5E" display-inline="no-display-inline"><paragraph id="H90DB750B48AF416BBA4D79C66158467A" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Notwithstanding any preceding provision of this subsection, not later than 90 days after the date of the enactment of this paragraph, a State shall withdraw any lien imposed under paragraph (1)(B) that is in effect as of such date.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8DE3B1F13325467687A1F3A92DE77E12"><enum>(b)</enum><header>Adjustments and recoveries</header><text display-inline="yes-display-inline">Section 1917(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396p">42 U.S.C. 1396p(b)</external-xref>) is amended—</text><paragraph id="H5008F592ACDA45D59FF6DAA50EF6DADB"><enum>(1)</enum><text>in paragraph (1), by striking <quote>except that</quote> and inserting <quote>except that, subject to paragraph (6),</quote>; and</text></paragraph><paragraph id="HBA3135A7F0ED4C9F90ABD14D11085325"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H6FC6424F0848442E97E5D82CA6932CF9" display-inline="no-display-inline"><paragraph id="HF3A762AAF64641559A99F5A3C8307ADF" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">Notwithstanding any preceding provision of this subsection, no adjustment or recovery of any medical assistance correctly paid on behalf of an individual under the State plan may be initiated, maintained, or collected on or after the date of the enactment of this paragraph. Not later than 90 days after such date, a State shall withdraw any lien in effect as of such date with respect to such medical assistance correctly paid.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
