which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 23 and title 49, United States Code, to remove transit-oriented development projects as projects eligible for assistance under the transportation infrastructure finance and innovation program and the railroad rehabilitation and improvement financing program, and for other purposes.</official-title></form><legis-body id="H945A602BEDA94A20A2E8C324C7BBC1C9" style="OLC"><section id="H5904381E21E94ADE8C9A67A75ADD2357" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Negating Obligations for Transit-Oriented Developments Act</short-title></quote> or the <quote><short-title>NO TOD Act</short-title></quote>.</text></section><section id="H536A042EEF354D8DA264A78F63B1AF3D" section-type="subsequent-section"><enum>2.</enum><header>Transportation infrastructure finance and innovation program</header><subsection id="H239BDD64D43B422C8B9E849AAD545E80" commented="no"><enum>(a)</enum><header>Generally applicable provisions</header><text display-inline="yes-display-inline">Section 601(a)(12) of title 23, United States Code, is amended—</text><paragraph id="HC1DF68A35DA3429788A269B237C20C0D" commented="no"><enum>(1)</enum><text>by striking subparagraph (E); and</text></paragraph><paragraph id="H66346DA3E1C148B5A03685E066F7E51B" commented="no"><enum>(2)</enum><text>by redesignating subparagraphs (F) through (H) as subparagraphs (E) through (G), respectively.</text></paragraph></subsection><subsection id="H84B5069BDDDD406DAEA5037E8052FAE5"><enum>(b)</enum><header>Determination of eligibility and project selection</header><text display-inline="yes-display-inline">Section 602(a) of title 23, United States Code, is amended—</text><paragraph id="HF90227B61286447EA1591E1E54870A43"><enum>(1)</enum><text>in paragraph (5)(B)—</text><subparagraph id="HEDBE653315954F15B59563D20B20BB67"><enum>(A)</enum><text>by striking clause (ii); and</text></subparagraph><subparagraph id="HD8FDFED219F54156B16DA54C5BD7453E"><enum>(B)</enum><text>by redesignating clauses (iii) and (iv) as clauses (ii) and (iii), respectively; and</text></subparagraph></paragraph><paragraph id="HC3BFE2DD799F4CB4AABD999D9F69A06B"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="HCDE6ABB45BCF45E7B1ECB516BD73BBA3" display-inline="no-display-inline"><paragraph id="H1CCD509CA8494D5D8C46C73C6B87F661"><enum>(12)</enum><header>Ineligible projects</header><subparagraph id="HDEADA2C266FE48B087A166428863059A"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, a transit-oriented development project shall not be eligible to receive assistance under the TIFIA program.</text></subparagraph><subparagraph id="HC5C4F9F7CAA3432C9FD1CE3552C7B6E6"><enum>(B)</enum><header>Definition</header><text display-inline="yes-display-inline">In this paragraph, the term <quote>transit-oriented development project</quote> means a project or components of a project designed for commercial or residential use.</text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="H60053B69C2EE4CF49B16330E79B129AA"><enum>(c)</enum><header>Conforming amendment</header><text>Section 608(a)(4) of title 23, United States Code, is amended by striking <quote><header-in-text level="paragraph" style="USC"><enum-in-header>(A) </enum-in-header>Transit-oriented development projects.—</header-in-text></quote> and all that follows through <quote><header-in-text level="paragraph" style="USC"><enum-in-header>(B) </enum-in-header>Airport-related projects</header-in-text>.—</quote>.</text></subsection><subsection id="HD1430F937DF24B33B7B25F492E0D3DD2" commented="no"><enum>(d)</enum><header>Applicability</header><text>This section and the amendments made by this section shall apply to project applications submitted on or after the date of enactment of this Act. </text></subsection></section><section id="HEE9A439A90FC4489936146BEBC3E7BFE"><enum>3.</enum><header>Railroad rehabilitation and improvement financing</header><subsection id="HE3EC25761E5942A6B1ACBA8BA641B3B8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 22402 of title 49, United States Code, is amended—</text><paragraph id="H9C7D0912A0C141998E49BA02F1172834"><enum>(1)</enum><text>in subsection (b)(1)—</text><subparagraph id="H0E17FF2A4C3F4558A04DE7E4245BAA55"><enum>(A)</enum><text>in subparagraph (D) by inserting <quote>or</quote> at the end;</text></subparagraph><subparagraph id="HCE8206E88B4D4170A70885CD5FF2CEBE"><enum>(B)</enum><text>in subparagraph (E) by striking <quote>; or</quote> and inserting a period at the end; and</text></subparagraph><subparagraph id="H1BEE64BC43DC46EAA6EED8497D3D3FBD"><enum>(C)</enum><text>by striking subparagraph (F); and</text></subparagraph></paragraph><paragraph id="HDAB10119495D4D95B478E65B67DD89F3"><enum>(2)</enum><text>in subsection (c)(6) by striking <quote>and increase transit-oriented development</quote>.</text></paragraph></subsection><subsection id="H6E0CCAB025E74067AA3A4C4EE3FF0D54" commented="no"><enum>(b)</enum><header>Applicability</header><text>This section and the amendments made by this section shall apply to applications for direct loans or guaranteed loans submitted on or after the date of enactment of this Act. </text></subsection></section><section id="H3CF3C33D08364710868F2D3D1DC4BBA0"><enum>4.</enum><header>Elimination of transit-oriented development planning pilot program</header><text display-inline="no-display-inline">Section 20005 of MAP–21 (<external-xref legal-doc="usc" parsable-cite="usc/49/5303">49 U.S.C. 5303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>) is amended by striking subsection (b).</text></section></legis-body></bill>
