R. 6685</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220209">February 9, 2022</action-date><action-desc><sponsor name-id="L000593">Mr. Levin of California</sponsor> (for himself, <cosponsor name-id="I000056">Mr. Issa</cosponsor>, <cosponsor name-id="P000608">Mr. Peters</cosponsor>, <cosponsor name-id="S001135">Mrs. Steel</cosponsor>, <cosponsor name-id="P000618">Ms. Porter</cosponsor>, and <cosponsor name-id="K000397">Mrs. Kim of California</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Nuclear Waste Policy Act of 1982 to prioritize the acceptance of high-level radioactive waste or spent nuclear fuel from certain civilian nuclear power reactors, and for other purposes.</official-title></form><legis-body id="H81B0C524A5CD46989CE3C5555D4D4671" style="OLC"><section id="H4703E68A68834AD3A5FCA5ABF5DA70F8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Spent Fuel Prioritization Act of 2022</short-title></quote>.</text></section><section id="HB9E82C10D55D4CA6A4677EE2C9BCFE77"><enum>2.</enum><header>Acceptance priority for high-level radioactive waste and spent nuclear fuel</header><text display-inline="no-display-inline">Section 302(a) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H783A1C37A7BE4DAAB323AA8CDDBEEC06" style="OLC"><paragraph id="H8FD3D78414304A37BBF3A017FE323AC9" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">In determining the order in which the Secretary will accept high-level radioactive waste or spent nuclear fuel for disposal or storage, the Secretary shall prioritize high-level radioactive waste or spent nuclear fuel from a civilian nuclear power reactor based on the operating status of the civilian nuclear power reactor, the population of the area in which the civilian nuclear power reactor is located, the earthquake hazard of the area in which the civilian nuclear power reactor is located, and national security risk related to the continued storage of high-level radioactive waste or spent nuclear fuel in the area in which the civilian nuclear power reactor is located, giving highest priority to a civilian nuclear power reactor that is—</text><subparagraph id="HA7F375C8119841B6AC87B959D7621473"><enum>(A)</enum><text>decommissioned or decommissioning;</text></subparagraph><subparagraph id="H9991217F66F0403BA3E910A3C609B87A"><enum>(B)</enum><text>located in an area, as determined by the Secretary, the population of which is the largest; </text></subparagraph><subparagraph id="HD9DA99F4ACEF43FCAC2AEE5CB0E27CAC"><enum>(C)</enum><text display-inline="yes-display-inline">located in an area with the highest hazard of an earthquake, as indicated by the Seismic Hazard Maps published by the Director of the United States Geological Survey pursuant to section 5(b)(3)(J) of the Earthquake Hazards Reduction Act of 1977; and</text></subparagraph><subparagraph id="HB779C0C135E84B41BC39B398F25784B1"><enum>(D)</enum><text display-inline="yes-display-inline">located in an area, as determined by the Secretary (in consultation with the Secretary of Defense and the Secretary of Homeland Security), where the continued storage of high-level radioactive waste or spent nuclear fuel poses a significant national security concern.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
