which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prevent the illegal sale of firearms, and for other purposes.</official-title></form><legis-body id="H91B707F2AA984A429F5A5F4892E105C4" style="OLC"><section id="H05459FA745AB4A4B919B7FEF210A2F4D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Trafficking Reduction And Criminal Enforcement (TRACE) Act</short-title></quote>.</text></section><section id="HBEAA8A0E5B53416FA48BB5664424F11F"><enum>2.</enum><header>Regulatory requirement to mark firearms with second, hidden serial number</header><subsection id="H3163B0DB38664406B6269BCCDD631C53"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Within 12 months after the date of the enactment of this Act, the Attorney General shall promulgate final regulations that require each firearm manufactured in the United States on or after the effective date of the regulation, to be marked with a serial number that is located inside the receiver of the firearm or that is visible only in infrared light, in addition to the serial number with which the firearm is otherwise required by law to be marked.</text></subsection><subsection id="H2F726352FC9940619917B9AB67929719"><enum>(b)</enum><header>Definition of receiver</header><text display-inline="yes-display-inline">Section 921(a) of title 18, United States Code, is amended—</text><paragraph id="H032FED65489442629297030336C5E8BD"><enum>(1)</enum><text>in paragraph (3)—</text><subparagraph id="H178908BAE58943EAA03E4C2C8E4DDD45"><enum>(A)</enum><text>by inserting <quote>, including an unfinished frame or receiver</quote> after <quote>such weapon</quote>; and</text></subparagraph><subparagraph id="HE734A767351A47EDB6418407A480F823"><enum>(B)</enum><text>by striking <quote>or (D) any destructive device</quote> and inserting <quote>; (D) any destructive device; or (E) any combination of parts designed or intended for use in converting any device into a firearm and from which a firearm may be readily assembled</quote>;</text></subparagraph></paragraph><paragraph id="H6420122BF07247BC9CF6EBDCC628494E"><enum>(2)</enum><text>in paragraph (10)—</text><subparagraph id="HBB3F5A287CA84F6BBC0989B7EFF6FFE1"><enum>(A)</enum><text>by striking <quote>and the</quote> and inserting <quote>the</quote>; and</text></subparagraph><subparagraph id="H4D427C1A892C46B98B5E2757772E9B18"><enum>(B)</enum><text>by inserting <quote>; and the term <quote>manufacturing firearms</quote> shall include assembling a functional firearm from an unfinished frame or receiver or from molding, machining, or 3D printing a frame or receiver, and shall not include making or fitting special barrels, stocks, or trigger mechanisms to firearms</quote> before the period; and</text></subparagraph></paragraph><paragraph id="HAF74DFEBA27149A483FE1EB90F533415"><enum>(3)</enum><text>by inserting after paragraph (29) the following:</text><quoted-block style="OLC" id="H61B8D87FF54841849C1C94846F9186FE" display-inline="no-display-inline"><paragraph id="HFA8F455FFDF5432880CFB5FF55407452"><enum>(30)</enum><text display-inline="yes-display-inline">The term <quote>unfinished frame or receiver</quote> means any forging, casting, printing, extrusion, machined body or similar article that—</text><subparagraph id="H596CB8767F834D7DA0098ADB7FE575B8"><enum>(A)</enum><text>has reached a stage in manufacture at which it may readily be completed, assembled, or converted to be used as the frame or receiver of a functional firearm; or</text></subparagraph><subparagraph id="H54D49DB099254D0697237A83F00300E2"><enum>(B)</enum><text>is marketed or sold to the public to become or be used as the frame or receiver of a functional firearm once completed, assembled, or converted.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section display-inline="no-display-inline" id="H2EF157EAFD3D45D4867A190548CCBABD" section-type="subsequent-section"><enum>3.</enum><header>Requirement to preserve instant criminal background check records for <enum-in-header>180</enum-in-header> days</header><subsection id="HDEDA547A96B04CC58EB451C6C6F47012"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 922(t)(2)(C) of title 18, United States Code, is amended by inserting <quote>after the 180-day period that begins with the date the system complies with subparagraphs (A) and (B),</quote> before <quote>destroy</quote>.</text></subsection><subsection id="HA9A42DB4A6E349B39507558C2D37EF73"><enum>(b)</enum><header>Conforming amendment</header><text>Section 511 of division B of the Consolidated and Further Continuing Appropriations Act, 2012 (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/112/55">Public Law 112–55</external-xref>; 125 Stat. 632) is amended—</text><paragraph id="H74ABBD0B08EE434DABB0020DCD3E9CA1"><enum>(1)</enum><text>by striking <quote>for—</quote> and all that follows through <quote>(1)</quote>; and</text></paragraph><paragraph id="H04E1581303164A88939E06C3BA9966A7"><enum>(2)</enum><text>by striking the semicolon and all that follows and inserting a period.</text></paragraph></subsection><subsection id="HA8768EEA5C9D45AF8589D0163E16711C"><enum>(c)</enum><header>Regulations</header><text>Within 180 days after the date of the enactment of this Act, the Attorney General shall prescribe regulations to implement the amendments made by this section.</text></subsection></section><section id="H4E820B72FD494DE3817D87C1A1EDD9A9"><enum>4.</enum><header>Requirement that licensed firearms dealers conduct physical check of their firearms business inventory</header><subsection id="HD9C8ABFADA604BFFAC49D7CAFEA593B0"><enum>(a)</enum><header>In general</header><text>Section 923(g) of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H08323016435240A3BCCF24BBA1F633C2" style="OLC"><paragraph id="H6A7A4E968E624E40BB2D7A508B50DE8B" indent="up1"><enum>(8)</enum><text display-inline="yes-display-inline">Each licensee shall conduct a physical check of the firearms inventory of the business of the licensee licensed under this chapter, in accordance with regulations which shall be prescribed by the Attorney General.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H90ACA95FE31747B9AB17749C65CB146B"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">The matter under the heading <quote><header-in-text level="appropriations-intermediate" style="appropriations">Bureau of Alcohol, Tobacco, Firearms and Explosives</header-in-text>—<header-in-text level="appropriations-small" style="appropriations">Salaries and Expenses</header-in-text></quote> in title II of division B of the Consolidated and Further Continuing Appropriations Act, 2013 (<external-xref legal-doc="usc" parsable-cite="usc/18/923">18 U.S.C. 923</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/113/6">Public Law 113–6</external-xref>; 127 Stat. 247–248) is amended by striking the 5th proviso.</text></subsection><subsection id="HB75358E1DBB6486380F37DA827E8534F"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">Within 180 days after the date of the enactment of this Act, the Attorney General shall prescribe regulations to implement section 923(g)(8) of title 18, United States Code.</text></subsection></section><section id="H8BC3A62860F54939BB403749A6BA4243"><enum>5.</enum><header>Elimination of certain limitations</header><subsection id="HDA7060D728434932ADABC3517A56FC2C"><enum>(a)</enum><header>Consolidated and Further Continuing Appropriations Act, <enum-in-header>2012</enum-in-header></header><text display-inline="yes-display-inline">Title II of division B of the Consolidated and Further Continuing Appropriations Act, 2012 (<external-xref legal-doc="usc" parsable-cite="usc/18/923">18 U.S.C. 923</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/112/55">Public Law 112–55</external-xref>; 125 Stat. 609–610) is amended in the matter under the heading <quote><header-in-text level="appropriations-intermediate" style="appropriations">Bureau of Alcohol, Tobacco, Firearms and Explosives</header-in-text>—<header-in-text level="appropriations-small" style="appropriations">Salaries and Expenses</header-in-text></quote> by striking the 1st, 6th, and 7th provisos.</text></subsection><subsection id="H1BC683B2742743ACA2517F0846A3D4CB"><enum>(b)</enum><header>Consolidated Appropriations Act, <enum-in-header>2010</enum-in-header></header><text display-inline="yes-display-inline">Division B of the Consolidated Appropriations Act, 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/117">Public Law 111–117</external-xref>) is amended—</text><paragraph id="H64222AB1B60E457B99D608CF7A8437E7"><enum>(1)</enum><text>in title II—</text><subparagraph id="H2935A6C519B243F598BF48F98F8BE174"><enum>(A)</enum><text>in the 6th proviso under the heading <quote><header-in-text level="appropriations-intermediate" style="appropriations">Bureau of Alcohol, Tobacco, Firearms and Explosives</header-in-text>—<header-in-text level="appropriations-small" style="appropriations">Salaries and Expenses</header-in-text></quote> by striking <quote>beginning in fiscal year 2010 and thereafter</quote> and inserting <quote>in fiscal year 2010</quote>;
