which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name>, and in addition to the Committees on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, and <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To promote the production of hemp and hemp products, and for other purposes.</official-title></form><legis-body id="HA671C1106B2D4CBFBF0A99166132A621" style="OLC"><section id="HE0A6C00BAA124504A7E77221C7E2C4E6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hemp Advancement Act of 2022</short-title></quote>.</text></section><section id="H1395A2872992429DAA9BEEDDCF26D729"><enum>2.</enum><header>Modifications to definitions in the Agricultural Marketing Act of<enum-in-header> 1946</enum-in-header></header><text display-inline="no-display-inline">Section 297A of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639o">7 U.S.C. 1639o</external-xref>) is amended—</text><paragraph id="H7F08349297C3490091AD4F4B17AD093A"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (6) as paragraph (8);</text></paragraph><paragraph id="H236B9451CF6849BAA202D3477A902E06"><enum>(2)</enum><text>by redesignating paragraphs (2) through (5) as paragraphs (3) through (6), respectively;</text></paragraph><paragraph id="HC3E44512D8454F57B09CD7FB338E88FF"><enum>(3)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" id="HBF22FA0A58C74FCC8FDD743379070163" display-inline="no-display-inline"><paragraph id="H495B2806C0204372912B57A02C6DE10F"><enum>(1)</enum><header>Hemp</header><text display-inline="yes-display-inline">The term <quote>hemp</quote> means—</text><subparagraph id="H0984234D406C443DAA9BFE1A67B2B941"><enum>(A)</enum><text display-inline="yes-display-inline">the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers thereof, whether growing or not, with a total tetrahydrocannabinol concentration of not more than 1 percent on a dry weight basis, that is not intended for sale to consumers; and</text></subparagraph><subparagraph id="H53611918DE7843069C9CB44E7D4BBC96"><enum>(B)</enum><text display-inline="yes-display-inline">hemp extract that—</text><clause id="H4ACE686E41F84D16B211FCAB2B1E5242"><enum>(i)</enum><text>is to be used in the making of a hemp product; </text></clause><clause id="HB3720F24F3ED40928814E51BED2CE239"><enum>(ii)</enum><text>has not been packaged as a finished product;</text></clause><clause id="HFA877B30E0134EB6A943EE81A97C9CFB"><enum>(iii)</enum><text>is not intended for sale to consumers;</text></clause><clause id="H9EB9382985B840ACAFA3B197FF593A8A"><enum>(iv)</enum><text>has a total tetrahydrocannabinol concentration that exceeds 1 percent on a dry weight basis; and</text></clause><clause id="H798CC753043E4CF8B5681ACE39B9BC6F"><enum>(v)</enum><text>is stored, transported, and processed in accordance with section 297F.</text></clause></subparagraph></paragraph><paragraph id="HC5B770861ED342CABC04DDF35C5E2A97"><enum>(2)</enum><header>Hemp product</header><text>The term <quote>hemp product</quote> means a finished product that—</text><subparagraph id="HF2ACCD8CD49146AFBA3A8F13A14F7172"><enum>(A)</enum><text display-inline="yes-display-inline">is derived from, or made by, processing hemp; and</text></subparagraph><subparagraph id="H62FE946F2E864689AAF92634337D7E33"><enum>(B)</enum><text display-inline="yes-display-inline">has a total tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H777E33B10B6047F68D044B8A1B804D01"><enum>(4)</enum><text>by inserting after paragraph (6) (as so redesignated by paragraph (1) of this subsection) the following:</text><quoted-block style="OLC" id="H30947A40C6DC4C4AB3D5DB3CBDD50750" display-inline="no-display-inline"><paragraph id="H3E9C833695084DADBD21075C4F8E19F8"><enum>(7)</enum><header>Total tetrahydrocannabinol concentration</header><text display-inline="yes-display-inline">The term <quote>total tetrahydrocannabinol concentration</quote> means the aggregate concentration of delta-8 tetrahydrocannabinol, delta-9 tetrahydrocannabinol, delta-10 tetrahydrocannabinol, and the optical isomers of such substances.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H883C22F33EEC4C92B18BCDA201133FAD"><enum>3.</enum><header>State and tribal plans</header><text display-inline="no-display-inline">Section 297B of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639p">7 U.S.C. 1639p</external-xref>) is amended—</text><paragraph id="H6158F97FB8194219A6A522910FF6335D"><enum>(1)</enum><text>in subsection (a)(2)(A)—</text><subparagraph id="HFD8E9205B2BD430D89B7CFC14B4E935B"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>testing</quote> and all that follows through <quote>methods,</quote> and inserting <quote>a laboratory accredited under criteria established by the Secretary under section 297D(a)(1)(C) to use post-decarboxylation or other similarly reliable methods to test</quote>; and</text></subparagraph><subparagraph id="H5EC2E91F8FBC42FAA6C86E1E6E197F93"><enum>(B)</enum><text>in clause (iii)—</text><clause id="HC1618E3EF5CA421595AB4A1C41C228A6"><enum>(i)</enum><text display-inline="yes-display-inline">in the matter preceding subclause (i) by inserting <quote>, including by pyrolysis,</quote> after <quote>disposal</quote>; and</text></clause><clause id="H89CCCD7EFE704AC286F3E5D4CBA60AE3"><enum>(ii)</enum><text display-inline="yes-display-inline">in subclause (II), by inserting <quote>, except that products derived from pyrolysis disposal may enter the stream of commerce</quote> after <quote>plants</quote>;</text></clause></subparagraph></paragraph><paragraph id="H740717B95B534AB199EDE8895E955299"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e)(2)(A)(iii)—</text><subparagraph id="HBD9FE856378748EC9CAD6A6B85E5A916"><enum>(A)</enum><text>by striking <quote>0.3</quote> and inserting <quote>1</quote>; and</text></subparagraph><subparagraph id="H736BC7E5A908494E9D5FD549246C74FF"><enum>(B)</enum><text>by striking <quote>delta-9</quote> and inserting <quote>total</quote>; and </text></subparagraph></paragraph><paragraph id="HAA08ABE58F7C4F68943F065F091D790D"><enum>(3)</enum><text>in subsection (e)(3), by striking subparagraph (B) and redesignating subparagraph (C) as subparagraph (B).</text></paragraph></section><section id="H111FC3C68D1947A083E6D705767D77D0"><enum>4.</enum><header>Reinstatement of formerly ineligible individuals</header><text display-inline="no-display-inline">Any individual excluded under section 297B(e)(3)(B) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639p">7 U.S.C. 1639p(e)(3)(B)</external-xref>, as in effect before the amendments made by section 3 of this Act, from—</text><paragraph id="H6F8E7A09D186439C838BFA91B2E17097"><enum>(1) </enum><text display-inline="yes-display-inline">the programs established under sections 297B (<external-xref legal-doc="usc" parsable-cite="usc/7/1639p">7 U.S.C. 1639p</external-xref>) and 297C (<external-xref legal-doc="usc" parsable-cite="usc/7/1639q">7 U.S.C. 1639q</external-xref>) of such Act of 1946; or</text></paragraph><paragraph id="H34EF1637CD80456C8A5C39557D854C02"><enum>(2)</enum><text display-inline="yes-display-inline">any program established through a regulation or guideline issued under section 297D(a) of such Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639r">7 U.S.C. 1639r(a)</external-xref>),</text></paragraph><continuation-text continuation-text-level="subsection">shall not be excluded from participation in such programs on these grounds. </continuation-text></section><section id="H64E48817D0C246F4BEFF8E65DEFC6523"><enum>5.</enum><header>Amendments to regulation of hemp by Department of Agriculture</header><text display-inline="no-display-inline">Section 297C(a)(2) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639q">7 U.S.C. 1639q(a)(2)</external-xref>) is amended—</text><paragraph id="H0522FD221830439F9DD1AC81DEACECEA"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>testing</quote> and all that follows through <quote>methods,</quote> and inserting <quote>a laboratory accredited under criteria established by the Secretary under section 297D(a)(1)(C) to use post-decarboxylation or other similarly reliable methods to test</quote>; and</text></paragraph><paragraph id="H5B9C720586A940DB911FC7284A14490A"><enum>(2)</enum><text>in subparagraph (C)—</text><subparagraph id="H127308CCBA1E4123A50006E8BDD96CA7"><enum>(A)</enum><text>by inserting <quote>, including by pyrolysis,</quote> after <quote>disposal</quote>; and</text></subparagraph><subparagraph id="H84B2A7BF61B84A6583295BE4146040D5"><enum>(B)</enum><text>in clause (ii), by inserting <quote>, except that products derived from pyrolysis disposal may enter the stream of commerce</quote> after <quote>plants</quote>.</text></subparagraph></paragraph></section><section id="HA7CDA45277BD4323A0E78FCEC42551A0"><enum>6.</enum><header>Criteria for laboratory accreditation</header><text display-inline="no-display-inline">Section 297D(a)(1) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639r">7 U.S.C. 1639r(a)(1)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H7347221B637E45DCA0DEBF4D9EBC913F" display-inline="no-display-inline"><subparagraph id="H3755F1D103C74DCF95CF5573C42A9E33"><enum>(C)</enum><header>Criteria for laboratory accreditation</header><text display-inline="yes-display-inline">The Secretary shall establish criteria by which a laboratory may be accredited for purposes of testing hemp, in accordance with sections 297B(a)(2)(A) and 297C(a)(2). Such criteria shall not require that a laboratory be registered with the Attorney General, acting through the Administrator of the Drug Enforcement Administration.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H09B189D29CEC417AAA22411D509F49FE"><enum>7.</enum><header>In-process hemp extract</header><text display-inline="no-display-inline">The Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H10C197B510D84167B79F0A5BED77F1E4" display-inline="no-display-inline"><section id="H52CB17613C30459EA4440320F9169776"><enum>297F.</enum><header>In-process hemp extract</header><subsection id="H46DC07C8EE324B898596347D0F84E4BA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The requirements of this section for in-process hemp extract are the following:</text><paragraph id="H094BA682390B4A58820CBC1FBC29D823"><enum>(1)</enum><text>The hemp extract is derived from hemp produced in accordance with this Act.</text></paragraph><paragraph id="HAACA3436BDE540B3A7D230B4FC1793C9"><enum>(2)</enum><text display-inline="yes-display-inline">The hemp extract is processed further or incorporated into another product.</text></paragraph><paragraph id="H5CA0BC7A3F59403DB356A980EB5DE408"><enum>(3)</enum><text display-inline="yes-display-inline">The hemp extract is not packaged as a hemp product and is not sold or offered for sale to consumers.</text></paragraph><paragraph id="HABCA6D516E0A449E90C05EC697D354DF"><enum>(4)</enum><text display-inline="yes-display-inline">The hemp extract is not used to produce a hemp product that has a total tetrahydrocannabinol concentration that exceeds 0.3 percent on a dry weight basis.</text></paragraph><paragraph id="H634A3961BE514CE38E91631E2DB5ECC5"><enum>(5)</enum><text display-inline="yes-display-inline">The hemp extract is produced, stored, transported, and processed in a facility bonded under regulations issued in accordance with subsection (b).</text></paragraph></subsection><subsection id="H5654D89995994107AD744D1BBAF2165E"><enum>(b)</enum><header>Regulations</header><paragraph id="HA8244FF37C9A486894BA99D2AA86ED7E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall issue regulations for facilities that produce, store, transport, or process in-process hemp extract, which shall include—</text><subparagraph id="H01D99FFB9CFA4DBC8C1D0EB0B341F5F8"><enum>(A)</enum><text>procedures to ensure the secure transportation of in-process hemp extract;</text></subparagraph><subparagraph id="H8499D2EAE4924D6DBD45743538A30311"><enum>(B)</enum><text>procedures for the documentation and secure disposal (rendering the by-product unusable for any intoxicating purpose) of any by-product from the extraction and manufacture of in-process hemp extract that—</text><clause id="H8968DF74EE064288B8A3B99E123035B4"><enum>(i)</enum><text>has a total tetrahydrocannabinol concentration of more than 0.3 percent on a dry weight basis; and</text></clause><clause id="HCA12E259CCA74C82B17016C4E9CC0D10"><enum>(ii)</enum><text>will not be used in, or subject to, further processing; and</text></clause></subparagraph><subparagraph id="HC78FC424CA074E1E82E532775F827033"><enum>(C)</enum><text>such other procedures or practices, consistent with this title, as the Secretary considers to be appropriate.</text></subparagraph></paragraph><paragraph id="H8A9003516F5B48259C434718A5A75EEB"><enum>(2)</enum><header>State regulations</header><text>A State or political subdivision may not impose or continue in effect any requirement for disposal or documentation of in-process hemp extract that is different from any requirement imposed under this section. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H71A05472154E40439CEE7113540E308C"><enum>8.</enum><header>Synthetic cannabinoids</header><text display-inline="no-display-inline">Section 10114(a) of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639o">7 U.S.C. 1639o</external-xref> note) is amended by inserting <quote>, or permits interstate commerce of products containing cannabinoids that are not naturally occurring in the plant Cannabis sativa L. or that are manufactured by means of chemical synthesis</quote> before the period.</text></section><section id="H2BB3AC28D53D4C358F7FFCE5999C0A76"><enum>9.</enum><header>Conforming amendments to the Controlled Substances Act</header><subsection id="H94F868255E9F47FB8DFC7121AED700CE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 102(16)(B) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(16)(B)</external-xref>) is amended—</text><paragraph id="H325DC37EEFB44221A19BD3F0826B90CD"><enum>(1)</enum><text>in clause (i), by striking <quote>or</quote>;</text></paragraph><paragraph id="H78926C17430C497D8F6D948A8947ECFC"><enum>(2)</enum><text>in clause (ii), by striking the period and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HD039DCEB31454389B91D9B9F68E1F16B"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H4A8E4DC082F245BF93E3179408EC7B2C" display-inline="no-display-inline"><clause id="HDB2B2011D0F344E6939F578376D01E03"><enum>(iii)</enum><text display-inline="yes-display-inline">hemp products, as defined in section 297A of the Agricultural Marketing Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639o">7 U.S.C. 1639o</external-xref>).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF2D08D0609C9405EAB8B427FD20E3CDD"><enum>(b)</enum><header>Tetrahydrocannabinol</header><text>Schedule I, as set forth in section 202(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812(c)</external-xref>), is amended in subsection (c)(17) by inserting <quote>, in-process hemp extract, or hemp products</quote> after <quote>hemp</quote>.</text></subsection></section></legis-body></bill>
