which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Congressional Accountability Act of 1995 to require the application of the administrative and judicial dispute-resolution procedures to registered lobbyists for claims alleging sexual harassment or sexual assault, and for other purposes.</official-title></form><legis-body id="H2C97FD24BB8D44EAAC818243E486A251" style="OLC"><section id="HD2A6527AB15A47C7AE2D444006EBF04B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lobbyist Accountability Act</short-title></quote>. </text></section><section id="H192FB7DDAF9A4A04A400AE7EC8DE8A19"><enum>2.</enum><header>Application of administrative and judicial dispute-resolution procedures for certain claims against registered lobbyists</header><subsection id="H7DC6FC3703A54A30BAD72D1E03A89C49"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title IV of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1401">2 U.S.C. 1401 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="H342FF50119A242ABBDA60A9286E6BA89" display-inline="no-display-inline"><section id="H4BCA44556E304E6F985CD95D1B7DF004"><enum>418.</enum><header>Application of administrative and judicial dispute-resolution procedures to registered lobbyists</header><subsection id="HE5F15DBFD79243A39782419074098106"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to a claim by a covered employee alleging sexual harassment or sexual assault by an individual who is a registered lobbyist under the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1601">2 U.S.C. 1601 et seq.</external-xref>), the lobbying firm (as such term is defined in section 3 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/1602">2 U.S.C. 1602</external-xref>)) that employs such registered lobbyist shall be deemed an employing office for the purpose of the application of the procedures under this title for the consideration of any such claim.</text></subsection><subsection id="H4B03E93CA9144954AE15E5151C42A87D"><enum>(b)</enum><header>Remedy</header><text display-inline="yes-display-inline">The remedy with respect to an allegation described in subsection (a) shall be—</text><paragraph id="HA66806D7A537443BB433AA1A5045CFB4"><enum>(1)</enum><text display-inline="yes-display-inline">such remedy as would be appropriate if awarded under section 706(g) of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-5">42 U.S.C. 2000e–5(g)</external-xref>); and</text></paragraph><paragraph id="HA914A44CFCEA4E81AA44AF14EF8BE171"><enum>(2)</enum><text display-inline="yes-display-inline">such compensatory damages as would be appropriate if awarded under section 1977 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1981">42 U.S.C. 1981</external-xref>), or as would be appropriate if awarded under sections 1977A(a)(1), 1977A(b)(2), and, irrespective of the size of the employing office, 1977A(b)(3)(D) of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/42/1981a">42 U.S.C. 1981a(a)(1)</external-xref>, 1981a(b)(2), and 1981a(b)(3)(D)).</text></paragraph></subsection><subsection id="H719FC9C1D13C42C9B85079D43196C8C9"><enum>(c)</enum><header>Reimbursement for payment of award or settlement</header><text display-inline="yes-display-inline">If a payment is made from the account described in section 415(a) for an award or settlement in connection with a claim described in subsection (a), the lobbying firm that employs such individual shall reimburse the account for the amount of the award or settlement for the claim involved.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0C0407874C564AA29F64B9A51D29D4F0"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="H361B81328D3D4308BB45F8A116BA797D"><enum>(1)</enum><header>Filing and review of claims</header><text>Section 401 of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1401">2 U.S.C. 1401</external-xref>) is amended—</text><subparagraph id="HC7480B3324CC44E2928823CD6B5F6E5B"><enum>(A)</enum><text>in subsection (a), by inserting <quote>or an allegation described in section 418(a)</quote> after <quote>part A of title II</quote>; and</text></subparagraph><subparagraph id="H03ED5F90EB5A45919651E7BD52DA5905"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (e), by inserting <quote>or an allegation described in section 418(a)</quote> after <quote>the consideration of an alleged violation of part A of title II</quote>.</text></subparagraph></paragraph><paragraph id="H34680AA69363495E8F80883190772126"><enum>(2)</enum><header>Initiation of procedures</header><text display-inline="yes-display-inline">Section 402(a)(1) of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1402">2 U.S.C. 1402(a)(1)</external-xref>) is amended by inserting <quote>or an allegation described in section 418(a)</quote> after <quote>under part A of title II</quote>.</text></paragraph><paragraph id="HCB62A0BFC86444A8AA7B5B7845679F4F"><enum>(3)</enum><header>Judicial review</header><text display-inline="yes-display-inline">Section 407(a)(1)(A) of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1407">2 U.S.C. 1407(a)(1)(A)</external-xref>) is amended by inserting <quote>or an allegation described in section 418(a)</quote> after <quote>arising under part A of title II</quote>.</text></paragraph></subsection><subsection id="H5D80EDD386014ED08F0C594CB6E0A582"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents of such Act is amended by inserting after the item relating to section 417 the following new item:</text><quoted-block style="OLC" id="H8A4709490D7848538D9F14FECEE14E54" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 418. Application of administrative and judicial dispute-resolution procedures to registered lobbyists.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H57D8A4C4A9D748F2B8A4470A8630A102"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section and the amendments made by this section shall apply to any claims filed or payments made on or after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
