<section id="H0D6861B0ABB84BA4B52E965134728C3E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Freedom to Repair Act of 2022</short-title></quote>.</text> </section> <section id="H5BC24FD5270547838D30EDC9D460D041"><enum>2.</enum><header>Diagnosis, maintenance, and repair of certain digital electronic equipment</header><text display-inline="no-display-inline">Section 1201 of title 17, United States Code, is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H866EC0027ADD4D70BF5636DEE161EDB7" display-inline="no-display-inline"> 
<subsection id="H1EEF28C1879F4F8EB33400847E23346E"><enum>(l)</enum><header>Diagnosis, maintenance, and repair of digital electronic equipment</header> 
<paragraph id="H6574CF51026945968249FBB5C66211A6" display-inline="yes-display-inline"><enum>(1)</enum><text>Notwithstanding the provisions of subsection (a)(1)(A), it is not a violation of that subsection for a person, for the purpose of the diagnosis, maintenance, or repair of digital electronic equipment, to circumvent a technological measure that effectively controls access to a work protected under this title.</text></paragraph> <paragraph id="HC98F65571894469AA21325C8A8577D5C" indent="up1"><enum>(2)</enum><text>Notwithstanding the provisions of subsection (a)(2), it is not a violation of that subsection for a person, for the purpose of the diagnosis, maintenance, or repair of digital electronic equipment, to manufacture, import, offer to the public, provide, or otherwise traffic in any technology, product, service, device, component, or part thereof described in that subsection.</text></paragraph> 
<paragraph id="HE5BCF49B099A40C19EB726A1E02808E5" indent="up1"><enum>(3)</enum><text>Notwithstanding the provisions of subsection (b)(1), it is not a violation of that subsection for a person, for the purpose of the diagnosis, maintenance, or repair of digital electronic equipment, to manufacture, import, offer to the public, provide, or otherwise traffic in any technology, product, service, device, component, or part thereof described in that subsection.</text></paragraph> <paragraph id="HB34192AD50B2437892C2868B68F6C261" indent="up1"><enum>(4)</enum><text>Nothing in this subsection applies to manufacturers or distributors of a medical device as defined in the Federal Food, Drug, and Cosmetic Act (21 U.S.C. Sec. 321(h)) or a digital electronic product or embedded software manufactured for use in a medical setting including diagnostic, monitoring, or control equipment or any product or service that they offer.</text></paragraph> 
<paragraph id="H1382914B251D45639CC5F3E993B38B7D" indent="up1"><enum>(5)</enum><text>For the purposes of this subsection, the term <quote>digital electronic equipment</quote> means any product dependent, in whole or in part, upon attached or embedded digital electronics to function.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
