R. 654</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210201">February 1, 2021</action-date><action-desc><sponsor name-id="J000295">Mr. Joyce of Ohio</sponsor> (for himself and <cosponsor name-id="K000381">Mr. Kilmer</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide the Administrator of the Drug-Free Communities Support Program the authority to waive the Federal fund limitation for the Drug-Free Communities Support Program.</official-title></form><legis-body id="HD1C81A29335A48EDABD5369E329B68E5" style="OLC"><section id="H5747B4EF1F984D729F9A782FF053917F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Drug-Free Communities Pandemic Relief Act</short-title></quote>.</text></section><section id="HF0123F3FCED74DCDA208C8BC117C2ED6"><enum>2.</enum><header>Waiver of Federal fund limitation for the Drug-Free Communities Support Program</header><subsection id="H1D2EDF01AA4A4F998CD4703AA3434C1B"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), if the Administrator of the Drug-Free Communities Support Program determines that, as a result of the public health emergency declared pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) as a result of COVID–19, an eligible coalition is unable to raise the amount of non-Federal funds, including in-kind contributions, agreed to be raised by the coalition for a fiscal year under an agreement entered into with the Administrator pursuant to paragraph (1)(A) or (3) of section 1032(b) of the Anti-Drug Abuse Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/21/1532">21 U.S.C. 1532(b)</external-xref>), the Administrator may, notwithstanding such paragraphs, provide to the eligible coalition the grant or renewal grant, as applicable, for that fiscal year in an amount—</text><paragraph id="H4584F7BFC598488CB2B4F80F44516CFC"><enum>(1)</enum><text>with respect to an initial grant or renewal grant described under paragraph (1)(A) or (3)(A) of such section, that exceeds the amount of non-Federal funds raised by the eligible coalition, including in-kind contributions, for that fiscal year;</text></paragraph><paragraph id="HB1635873D0334343B76E9319905791C8"><enum>(2)</enum><text>with respect to a renewal grant described under paragraph (3)(D)(i) of such section, that exceeds 125 percent of the amount of non-Federal funds raised by the eligible coalition, including in-kind contributions, for that fiscal year; and</text></paragraph><paragraph id="HFE98565FB6B149A79D535077B5656D15"><enum>(3)</enum><text>with respect to a renewal grant described under paragraph (3)(D)(ii) of such section, that exceeds 150 percent of the amount of non-Federal funds raised by the eligible coalition, including in-kind contributions, for that fiscal year.</text></paragraph></subsection><subsection id="H8681CE67F4EC432BB4F3B9B646DF79A0"><enum>(b)</enum><header>Limitation</header><text>The Administrator may not provide a grant or renewal grant to an eligible coalition in an amount exceeding the amount of funds initially agreed to be provided by the Administrator under the applicable agreement.</text></subsection></section></legis-body></bill>
