which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name>, and in addition to the Committees on <committee-name committee-id="HSY00">Science, Space, and Technology</committee-name>, and <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To improve commercialization activities in the SBIR and STTR programs, and for other purposes.</official-title></form><legis-body id="HE89F5B39820E4B82A988471AD7E7B8E9" style="OLC"><section id="H43AF8AD555B14A719ADD9EAAF964DB06" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Research Advancing to Market Production for Innovators Act</short-title></quote>.</text></section><section id="H6E52F0037FD44029BC60D2C7DB93C101"><enum>2.</enum><header>Improvements to commercialization selection</header><subsection id="HF1BA74E084EE4DF6B7F349E8AB23EE1E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is amended—</text><paragraph id="HBC261411653C47508A361692F905E02E"><enum>(1)</enum><text>in subsection (g)—</text><subparagraph id="H35EAB1D6062E406998BE625FD587B124"><enum>(A)</enum><text>in paragraph (4)(B)(i), by striking <quote>1 year</quote> and inserting <quote>180 days</quote>;</text></subparagraph><subparagraph id="HB2C3022015FE4B1EAD8411D77060F6FE"><enum>(B)</enum><text>in paragraph (11), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H21F1AF9905FB4C19B7422ED36D03D2EA"><enum>(C)</enum><text>in paragraph (12), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H562561C05AD74383823212E5D1E1851D"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H379EE413554948299394A5EB5715D4BE" style="OLC"><paragraph id="HD3B0A9087D404A69816B48CD280B96E3"><enum>(13)</enum><text>with respect to peer review carried out under the SBIR program, to the extent practicable, include in the peer review—</text><subparagraph id="HE90A99CFCB3F47A5B26924590C12E828"><enum>(A)</enum><text>the likelihood of commercialization in addition to scientific and technical merit and feasibility; and</text></subparagraph><subparagraph id="HAFFC878454734E818283F408A230477E"><enum>(B)</enum><text>not less than 1 reviewer with commercialization expertise who is capable of assessing the likelihood of commercialization.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HC65F69969D2444EDB2CCEA1B6DD1AA53"><enum>(2)</enum><text>in subsection (o)—</text><subparagraph id="HA68D8BBE91624CBD8300B2C31292FEB1"><enum>(A)</enum><text>in paragraph (4)(B)(i), by striking <quote>1 year</quote> and inserting <quote>180 days</quote>;</text></subparagraph><subparagraph id="HF4606C41D1884324B1EBE228A001F96F"><enum>(B)</enum><text>in paragraph (15), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HC72AD418CB8F49DEB4F7CCAF0EAFF677"><enum>(C)</enum><text>in paragraph (16), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HAECC9702C1ED4717BCAD9C987B1B58D0"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5681611C0E6F4260A3F88AC0E3690AA1" style="OLC"><paragraph id="H45943FBBCF8040B38BF1329582E5A49F"><enum>(17)</enum><text>with respect to peer review carried out under the STTR program, to the extent practicable, include in the peer review—</text><subparagraph id="H711345FC13A843A9B9FA0B30066D0E83"><enum>(A)</enum><text>the likelihood of commercialization in addition to scientific and technical merit and feasibility; and</text></subparagraph><subparagraph id="H96399CBA60AA45E784C01EC21D6AB8E3"><enum>(B)</enum><text>not less than 1 reviewer with commercialization expertise who is capable of assessing the likelihood of commercialization.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H1F2F82103E1C4DD69ECF3B7E6454844D"><enum>(3)</enum><text>in subsection (cc)—</text><subparagraph id="H458E4B85083F457DA9AB3AF57812B878"><enum>(A)</enum><text>by striking <quote>During fiscal years 2012 through 2022, the National Institutes of Health, the Department of Defense, and the Department of Education</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HF2AB70FFC2E94FF1979904C367B515D0" style="OLC"><paragraph id="H270B2C26055449C9A0036859D7002281"><enum>(1)</enum><header>In general</header><text>During fiscal years 2022 through 2027, each Federal agency with an SBIR or STTR program</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HFB209EC6A7594712AAE861F0D450D6DD"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H050D2F61024247A89244A80C876CCB99" style="OLC"><paragraph id="HD77502ADC6014BA0A3DD20B30CA41013"><enum>(2)</enum><header>Limitation</header><text>The total value of awards provided by a Federal agency under this subsection in a fiscal year shall be—</text><subparagraph id="HDF086ABD345D4C89ADCD74464CAB8214"><enum>(A)</enum><text>except as provided in subparagraph (B), not more than 10 percent of the total funds allocated to the SBIR and STTR programs of the Federal agency during that fiscal year; and</text></subparagraph><subparagraph id="H231B0B019E9D4725B32D5FE77030FE72"><enum>(B)</enum><text>with respect to the National Institutes of Health, not more than 15 percent of the total funds allocated to the SBIR and STTR programs of the National Institutes of Health during that fiscal year.</text></subparagraph></paragraph><paragraph id="H19714E8C9F6C457B962D48757E9603D6"><enum>(3)</enum><header>Extension</header><text>During fiscal years 2023 and 2024, each Federal agency with an SBIR or STTR program may continue phase flexibility as described in this subsection only if the reports required under subsection (tt)(1)(B) have been submitted to the appropriate committees.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE8D8DB4EC6074ADDAFB244A433F09F0D"><enum>(4)</enum><text>in subsection (hh)(2)(A)(i), by inserting <quote>application process and requirements</quote> after <quote>simplified and standardized</quote>; and</text></paragraph><paragraph id="H0D6CB9FD2F294ECF8AE922ED247DB249"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5EFBF96FFC024436A7FCCBFA736DF59C" style="OLC"><subsection id="H2FBBE49E361148C9B964D36110EC7B22"><enum>(vv)</enum><header>Technology Commercialization Official</header><text>Each Federal agency participating in the SBIR or STTR program shall designate a Technology Commercialization Official in the Federal agency, who shall—</text><paragraph id="H632C0B6D96A84470A3681BC337A3AF35"><enum>(1)</enum><text>have sufficient commercialization experience;</text></paragraph><paragraph id="HC7CFA49BD6954D81AFF8375972CEAF77"><enum>(2)</enum><text>provide assistance to SBIR and STTR program awardees in commercializing and tran­si­tion­ing technologies;</text></paragraph><paragraph id="H07EEB5F30C8A4C06BE6CEBA239ABE5AE"><enum>(3)</enum><text>identify SBIR and STTR program technologies with sufficient technology and commercialization readiness to advance to Phase III awards or other non-SBIR or STTR program contracts;</text></paragraph><paragraph id="HD8C903C6D3374DB985F489DEE4459ABF"><enum>(4)</enum><text>coordinate with the Technology Commercialization Officials of other Federal agencies to identify additional markets and commercialization pathways for promising SBIR and STTR program technologies;</text></paragraph><paragraph id="H7FB14C6F3A1044D385E29E855F895021"><enum>(5)</enum><text>submit to the Administration an annual report on the number of technologies from the SBIR or STTR program that have advanced commercialization activities, including information required in the commercialization impact assessment under subsection (xx);</text></paragraph><paragraph id="H914C1DEE57C04096861FD2E64D21E471"><enum>(6)</enum><text>submit to the Administration an annual report on actions taken by the Federal agency, and the results of those actions, to simplify, standardize, and expedite the application process and requirements, procedures, and contracts as required under subsection (hh) and described in subsection (xx)(E); and</text></paragraph><paragraph id="HC5FB289639C641B5928B9ABA60DA9B9D"><enum>(7)</enum><text>carry out such other duties as the Federal agency determines necessary.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HFBB6A988D43C4DC2A42A4CF601FE7E7B"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator of the Small Business Administrator shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives summarizing the metrics relating to and an evaluation of the authority provided under section 9(cc) of the Small Business Act, as amended by subsection (a), which shall include the size and location of the small business concerns receiving awards under the SBIR or STTR program.</text></subsection></section><section id="H2CAD3D1D208A4E9EA043DCDC4EBD2179"><enum>3.</enum><header>Improvements to technical and business assistance; commercialization impact assessment; patent assistance</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as amended by section 2, is amended—</text><paragraph id="HD59CC417D16A4A80A384D2F5781C0453"><enum>(1)</enum><text>in subsection (q)—</text><subparagraph id="HF55A59D837EB4672A3765DF202E7CE0D"><enum>(A)</enum><text>in paragraph (1), in the matter preceding subparagraph (A)—</text><clause id="HF07D66B0D22A40289F01874498B68BE6"><enum>(i)</enum><text>by striking <quote>may enter into an agreement with 1 or more vendors selected under paragraph (2)(A)</quote> and inserting <quote>shall authorize recipients of awards under the SBIR or STTR program to select, if desired, commercialization activities provided under subparagraph (A), (B), or (C) of paragraph (2)</quote>; and</text></clause><clause id="H22DB9029C0BE4DE7A9BE9D7CBA40D1E1"><enum>(ii)</enum><text>by inserting <quote>, cybersecurity assistance</quote> after <quote>intellectual property protections</quote>;</text></clause></subparagraph><subparagraph id="HF50FDD7612074227B76EBC8EB63429CC"><enum>(B)</enum><text>in paragraph (2), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H1CD141B8437C40DBA9480E268746A2A9" style="OLC"><subparagraph id="HC3BDC5DE2CE3485C8D31D2A2D2FDA8AC"><enum>(C)</enum><header>Staff</header><text>A small business concern may, by contract or otherwise, use funding provided under this section to hire new staff, augment staff, or direct staff to conduct or participate in training activities consistent with the goals listed in paragraph (1).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HFC9FD818C3B44D46AB2FFE62F437133F"><enum>(C)</enum><text>in paragraph (3), by striking subparagraphs (A) and (B) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HFEBD373DD3094E63B1B56791BDC0A205" style="OLC"><subparagraph id="HFF19A923FCFE44FD99832639375C318A"><enum>(A)</enum><header>Phase I</header><text>A Federal agency described in paragraph (1) shall authorize a recipient of a Phase I SBIR or STTR award to utilize not more than $6,500 per project, included as part of the award of the recipient or in addition to the amount of the award of the recipient as determined appropriate by the head of the Federal agency, for the services described in paragraph (1)—</text><clause id="H04E712CF35704570A6A3CDA78C29D781"><enum>(i)</enum><text>provided through a vendor selected under paragraph (2)(A);</text></clause><clause id="H971223CBA3794ADBB5BD5685A8C6BBA1"><enum>(ii)</enum><text>provided through a vendor other than a vendor selected under paragraph (2)(A);</text></clause><clause id="HF631A84F30FE4C9DAC2E04BA70223EA4"><enum>(iii)</enum><text>achieved through the activities described in paragraph (2)(C); or</text></clause><clause commented="no" display-inline="no-display-inline" id="HD90C038D933C4A958116157C8916D3FF"><enum>(iv)</enum><text display-inline="yes-display-inline">provided or achieved through any combination of clauses (i), (ii), and (iii).</text></clause></subparagraph><subparagraph id="HD63810F2C0F641A3AB8A57A98CBBE84B"><enum>(B)</enum><header>Phase II</header><text>A Federal agency described in paragraph (1) shall authorize a recipient of a Phase II SBIR or STTR award to utilize not more than $50,000 per project, included as part of the award of the recipient or in addition to the amount of the award of the recipient as determined appropriate by the head of the Federal agency, for the services described in paragraph (1)—</text><clause id="H5DFD8CDDA21B46539E866DF697196897"><enum>(i)</enum><text>provided through a vendor selected under paragraph (2)(A);</text></clause><clause id="HFF77FB3FC43C49759B04E3499A722655"><enum>(ii)</enum><text>provided through a vendor other than a vendor selected under paragraph (2)(A);</text></clause><clause id="H4528F0C885AC43FDBFA3B2A634C9E5CC"><enum>(iii)</enum><text>achieved through the activities described in paragraph (2)(C); or</text></clause><clause id="H6F6A1F942539438EAD4E1B74B6EA864D"><enum>(iv)</enum><text>provided or achieved through any combination of clauses (i), (ii), and (iii).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H2E11292B73964DAEA8EFA532ABE63759"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HC26D818002384712B3FC290BE91A9562" style="OLC"><paragraph id="HA8CE9446C7354D7B9575CE1962562289"><enum>(5)</enum><header>Targeted review</header><text>A Federal agency may perform targeted reviews of technical and business assistance funding as described in subsection (mm)(1)(F).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD6EF74E3442246D183EF639EA9CF66FE"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H7D8743AAAA55400693613FBFEA52BA1B" style="OLC"><subsection id="H095CFF6402094A3F8229DF222A826768"><enum>(ww)</enum><header>I–Corps participation</header><paragraph id="H51CD417BD8A54FDC8897BB3071906FD0"><enum>(1)</enum><header>In general</header><text>Each Federal agency that is required to conduct an SBIR or STTR program with an Innovation Corps (commonly known as <quote>I–Corps</quote>) program shall—</text><subparagraph id="H4DBD628D31324BD98FF732513DD5859D"><enum>(A)</enum><text>provide an option for participation in an I–Corps teams course by recipients of an award under the SBIR or STTR program; and</text></subparagraph><subparagraph id="HA75E1563082D4BE9A2E3ECB837E58ADC"><enum>(B)</enum><text>authorize the recipients described in subparagraph (A) to use an award provided under subsection (q) to provide additional technical assistance for participation in the I–Corps teams course.</text></subparagraph></paragraph><paragraph id="H58A0D3E5AD9B4970A8540EC8647623A2"><enum>(2)</enum><header>Cost of participation</header><text>The cost of participation by a recipient described in paragraph (1)(A) in an I–Corps course may be provided by—</text><subparagraph id="HA680461FAB50421CBBFD035E2D29A19B"><enum>(A)</enum><text>an I–Corps team grant;</text></subparagraph><subparagraph id="H67A8ACF228E5498AAEA85C7C5B4E90D0"><enum>(B)</enum><text>funds awarded to the recipient under subsection (q);</text></subparagraph><subparagraph id="H3EBCBCEF526A4BAEAE4ED391BC70D2BD"><enum>(C)</enum><text>the participating teams or other sources as appropriate; or</text></subparagraph><subparagraph id="H69C4C76083E041B8A3AC0E7FB6254D4D"><enum>(D)</enum><text>any combination of sources described in subparagraphs (A), (B), and (C).</text></subparagraph></paragraph></subsection><subsection id="H314E621CB3764FCA9530D6091652336E"><enum>(xx)</enum><header>Commercialization impact assessment</header><paragraph id="H20545702090A4677B0DCD063BB5B12BD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall coordinate with each Federal agency with an SBIR or STTR program to develop an annual commercialization impact assessment report of the Federal agency, which shall measure, for the 5-year period preceding the report—</text><subparagraph commented="no" id="H88F1BFC011D84180AAA0EA62D28F513A"><enum>(A)</enum><text display-inline="yes-display-inline">for Phase II contracts—</text><clause id="H621CA279DA79432DA6801CA5E9634A5E"><enum>(i)</enum><text>the total amount of sales of new products and services to the Federal Government or other commercial markets;</text></clause><clause id="HCC477CFEF2AE4752AEB10B9E0799C829"><enum>(ii)</enum><text>the total outside investment from partnerships, joint ventures, or other private sector funding sources;</text></clause><clause id="HC4C316D5C7C34A33A11D8BF751E966B2"><enum>(iii)</enum><text>the total number of technologies licensed to other companies;</text></clause><clause id="H419E2670F3624AEE9D8B532AD14AD406"><enum>(iv)</enum><text>the total number of acquisitions of small business concerns participating in the SBIR program or the STTR program that are acquired by other entities;</text></clause><clause id="H83644E47E0C74C83B6162B092C92D996"><enum>(v)</enum><text>the total number of new spin-out companies;</text></clause><clause id="H871A23D1CBB54C6C8C7F81E5A6E7AE33"><enum>(vi)</enum><text>the total outside investment from venture capital or angel investments;</text></clause><clause id="H915B472ECE664E2C8A5A55F46A9E76C5"><enum>(vii)</enum><text>the total number of patent applications;</text></clause><clause id="H1638025AAE814D71A862876EB2F86D4D"><enum>(viii)</enum><text>the total number of patents acquired;</text></clause><clause id="H78A6BE1D5B9A4BD08921D31EB7BAC182"><enum>(ix)</enum><text>the year of first Phase I award and the total number of employees at time of first Phase I award;</text></clause><clause id="H6411411D7F664B4A898510AD0F666FBA"><enum>(x)</enum><text>the total number of employees from the preceding completed year; and</text></clause><clause id="H45B599E330634F518D89E316DEE56FB5"><enum>(xi)</enum><text>the percent of revenue, as of the date of the report, generated through SBIR or STTR program funding;</text></clause></subparagraph><subparagraph id="HB4580EE103A24CB5B6F83ED70103334D"><enum>(B)</enum><text>the total number and value of subsequent Phase II awards, as described in subsection (bb), awarded for each particular project or technology;</text></subparagraph><subparagraph id="H83F9DD2FF62C4C8FB7984CC8D27C9A98"><enum>(C)</enum><text>the total number and value of Phase III awards awarded subsequent to a Phase II award;</text></subparagraph><subparagraph id="HDBA46A760C814D9DA128CC0FC068E857"><enum>(D)</enum><text>the total number and value of non-SBIR and STTR program Federal awards and contracts; and</text></subparagraph><subparagraph id="H16676DF6F48D4B12B31C679F2EB48430"><enum>(E)</enum><text>actions taken by the Federal agency, and the results of those actions, relating to developing a simplified and standardized application process and requirements, procedures, and model contracts throughout the Federal agency for Phase I, Phase II, and Phase III SBIR program awards in subsection (hh).</text></subparagraph></paragraph><paragraph id="H6491160647D749D9858F73D625EE22B3"><enum>(2)</enum><header>Publication</header><text>A commercialization impact assessment report described in paragraph (1) of a Federal agency shall be—</text><subparagraph id="HD0C084A1E42B40F4806D5F540C0FDEF6"><enum>(A)</enum><text>included in the annual report of the Federal agency required under this section; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H18D7A95DDAF74CC6B8EE87FD29E22230"><enum>(B)</enum><text>published on the website of the Administration.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H86F3003C407D4721A1483DAB2A3D2592"><enum>(yy)</enum><header>Patent assistance</header><paragraph commented="no" display-inline="no-display-inline" id="H615EC0BA01364B8FADACAB260B3681A6"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="H7DFD9427D0B345DAA5924A3549258A95"><enum>(A)</enum><text>the term <term>low bono services</term> means services provided at a reduced fee; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H98D3217FFBBF4E93A5630E5D7902FDFD"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>USPTO</term> means the United States Patent and Trademark Office.</text></subparagraph></paragraph><paragraph id="H33EA7779E4E94D0D90E7D12A8BD1B017"><enum>(2)</enum><header>Assistance</header><text>The Administrator shall enter into an interagency agreement with the USPTO to assist recipients of an award under the SBIR or STTR program (in this paragraph referred to as <term>SBIR and STTR recipients</term>) relating to intellectual property protection through—</text><subparagraph id="H150279178B9A4191A96BC5E250ED94CA"><enum>(A)</enum><text>track one processing, under which the USPTO may—</text><clause id="H9A25E91F550648639429EABBF98C030A"><enum>(i)</enum><text>allocate—</text><subclause id="HD4C98A3674E6437CA624E42B49D1F675"><enum>(I)</enum><text>not less than 5 percent or 500 track one requests, whichever is greater, per year to SBIR and STTR recipients on a first-come, first-served basis; and</text></subclause><subclause id="HAE0D05CF0EBC43F1A0FD4EA0ABAC01EF"><enum>(II)</enum><text>not more than 2 track one requests to an individual SBIR and STTR recipient, to expedite final disposition on SBIR and STTR program patent applications; and</text></subclause></clause><clause id="H8CB0406C475E415AA9DBE074B5995C9A"><enum>(ii)</enum><text>waive the track one fee requirement for SBIR and STTR recipients; and</text></clause></subparagraph><subparagraph id="HAD826D5952264CFC9D44131A4E5ABF08"><enum>(B)</enum><text>through the USPTO Patent Pro Bono Program, providing SBIR and STTR recipients—</text><clause id="H06E4B74C550846429FA4F4D4C4E76454"><enum>(i)</enum><text>pro bono services if the recipient—</text><subclause id="HDCCEFB147D2941EF91B36D7C0DA8878A"><enum>(I)</enum><text>had a total gross income of more than $150,000 but less than $5,000,000 in the preceding calendar year, and expects a total gross income of more than $150,000 but less than $5,000,000 in the current calendar year;</text></subclause><subclause id="H015267298A4244E5A2E73B2249E5EA5C"><enum>(II)</enum><text>is not under any obligation to assign the rights to the invention to another entity other than the Federal Government; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H8B0292AC89EF4D2F92021C756F63E3E8"><enum>(III)</enum><text>has not previously received USPTO pro bono or low bono services; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HE039A9F031A64C0C8065FED606D8D515"><enum>(ii)</enum><text>low bono services if the recipient—</text><subclause id="H1D372C3051654EED9E574B9EF4494345"><enum>(I)</enum><text>had a total gross income of more than $5,000,000 but less than $10,000,000 in the preceding calendar year, and expects a total gross income of more than $5,000,000 but less than $10,000,000 in the current calendar year;</text></subclause><subclause id="HA52D3A1960104656AB0E3145E54CF4C6"><enum>(II)</enum><text>is not under any obligation to assign the rights to the invention to another entity other than the Federal Government; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H5ACD7B0342D34CCDB1F24396EB9C9F8A"><enum>(III)</enum><text>has not previously received USPTO pro bono or low bono services.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD6135C4A37ED473A9F9AFCB7535EF698"><enum>(3)</enum><header>Outreach</header><text>The Administrator shall coordinate with the USPTO to provide outreach regarding the pro se assistance program and scam prevention services of the USPTO.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
