<section id="H2F199122C1914A6383E4128C5F6ADEF6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Access to AEDs Act</short-title></quote>.</text></section> <section id="HA53DA6E61C3F45AAB4A2703210A43B5D"><enum>2.</enum><header>Findings; purpose</header><text display-inline="no-display-inline">The Congress makes the following findings:</text> 
<paragraph id="H728C5A075F42463E8FADBC15EF66A080"><enum>(1)</enum><text>Heart disease is the leading cause of death in the United States.</text></paragraph> <paragraph id="H0D6320A886194430B5EA644B75E878FC"><enum>(2)</enum><text display-inline="yes-display-inline">Sudden cardiac arrest (SCA) is a life-threatening emergency that is caused by a malfunction in the heart’s electrical system or structure, which is caused by an abnormality from birth or one that develops over time.</text></paragraph> 
<paragraph id="HC309FE9797044278AE3DFC36A0D8CD8A"><enum>(3)</enum><text display-inline="yes-display-inline">Studies show that 1 in 300 youth has an undetected heart condition that puts them at risk.</text></paragraph> <paragraph id="HA3C2F30E00EA4D1698B3DB985A01FDDB"><enum>(4)</enum><text>SCA is the leading cause of death for student athletes.</text></paragraph> 
<paragraph id="H3E52D40388A24D3CB510E27D21072D0C"><enum>(5)</enum><text display-inline="yes-display-inline">Sports-related SCA accounted for 39 percent of SCAs among children 18 years old or younger.</text></paragraph> <paragraph id="H5BE9B9DC74E0445FAF97894700476B10"><enum>(6)</enum><text>In 2018, there were nearly 394,000 sudden cardiac arrests that occurred in the United States, with 9 out of 10 being fatal. Only 1 in 10 victims survive a sudden cardiac arrest.</text></paragraph> 
<paragraph id="HDA0493E95F5E42FF9888733F0B75BF38"><enum>(7)</enum><text display-inline="yes-display-inline">An estimated 7,000 to 23,000 young people are stricken by SCA annually. </text></paragraph> <paragraph id="H84FF7E10D092429DA3F3240967E6AA24"><enum>(8)</enum><text>The American Heart Association estimates that 5 in 10 victims of SCA could survive if bystanders gave CPR and used an AED immediately.</text></paragraph> 
<paragraph id="H0E668750F5444447BEF2642654B8FD46"><enum>(9)</enum><text>The chain of survival includes prompt notification of emergency services and early CPR, defibrillation, and advanced cardiac life support.</text></paragraph> <paragraph id="H3DD8F8A167BE4FA8BDC3F9559EB97795"><enum>(10)</enum><text>Health education should include basic emergency lifesaving skills. Incorporating these lifesaving training programs into the health curriculum of elementary and secondary schools will give school children these skills.</text></paragraph></section> 
<section id="H1D867B9A8DB14B17B12390840F98B5E4"><enum>3.</enum><header>Promoting student access to defibrillation</header> 
<subsection id="H3FA15A4AC33A4DF3B75DF5D8C6AA9524"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall award grants to local educational agencies and private elementary and secondary schools, in partnership with a public or nonprofit private health care entity, to develop and implement a comprehensive program to promote student access to defibrillation in elementary schools and secondary schools by—</text> <paragraph id="HDB6D151AC5B54114BA821DF5FDB31C3F"><enum>(1)</enum><text display-inline="yes-display-inline">developing and providing comprehensive materials to establish AED and CPR programs in such schools;</text></paragraph> 
<paragraph id="HEAE21497C81F4E30B64F41B4815D8119"><enum>(2)</enum><text display-inline="yes-display-inline">providing support for CPR and AED training programs in such schools for students, staff, and related sports volunteers;</text></paragraph> <paragraph id="HAC16EC8BA536410EB364D187884B777D"><enum>(3)</enum><text display-inline="yes-display-inline">providing support for developing a cardiac emergency action plan within such schools;</text></paragraph> 
<paragraph id="H395D02C464FB44F9A2342D2F3C06343D"><enum>(4)</enum><text display-inline="yes-display-inline">purchasing AEDs that have been approved, or cleared for marketing, by the Food and Drug Administration;</text></paragraph> <paragraph id="H3F46D6C37825402DA4E1D5021E2FBD38"><enum>(5)</enum><text>purchasing necessary AED batteries and performing necessary AED maintenance according to AED manufacturers;</text></paragraph> 
<paragraph id="H92E671D70C544A208B9BB874BFB704FA"><enum>(6)</enum><text>replacing old and outdated AED and CPR equipment, machinery, and educational materials;</text></paragraph> <paragraph id="HAAA0EA13E81C450CAEA269C0E5D175EF"><enum>(7)</enum><text>fostering new and existing community partnerships with and among local educational agencies, private schools, nonprofit organizations, public health organizations, emergency medical service providers, fire and police departments, and parent-teacher associations to promote the importance of defibrillation in elementary and secondary schools;</text></paragraph> 
<paragraph id="H51995783C5374FD482BC24896A5E3283"><enum>(8)</enum><text display-inline="yes-display-inline">aiding school athletic departments seeking to develop programs to screen student athletes for risk of sudden cardiac arrest; and</text></paragraph> <paragraph id="HB4FBC64F76554DDBAC42D868B3542EFF"><enum>(9)</enum><text display-inline="yes-display-inline">further developing strategies to improve access to AEDs in elementary and secondary schools.</text></paragraph></subsection> 
<subsection id="HCB95DA621F1342A493D4C6E97FF7CD5A"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible for a grant under subsection (a), a local educational agency or a private elementary or secondary school shall submit an application to the Secretary—</text> <paragraph id="HF665BFB9BAED49D58B20D4D5E6E84AA0"><enum>(1)</enum><text>at such time, in such manner, and containing such information as the Secretary may reasonably require; and</text></paragraph> 
<paragraph id="HBD64ED24ADFB4CD68D1517D96F9D6EEF"><enum>(2)</enum><text>in partnership with a public or private nonprofit health care entity that—</text> <subparagraph id="HB02AF280ACA147ADB9AF5FCFDC65694D"><enum>(A)</enum><text>demonstrates an ability to develop, train, and implement a comprehensive program to promote student access to defibrillation in elementary and secondary schools; and</text></subparagraph> 
<subparagraph id="H42A77ECAB3D146ECA89FB1BC2CECDB01"><enum>(B)</enum><text>is qualified in providing technical assistance in AED and CPR training.</text></subparagraph></paragraph></subsection> <subsection id="HFC7AB455B9ED4F67B7432FF0A22C8FE6" commented="no"><enum>(c)</enum><header>Clearinghouse</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall establish a clearinghouse database—</text> 
<paragraph id="H1DC0C14106344E03895506C7592DC048" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">to collect and make available information, including through voluntary reporting by local educational agencies, schools, and manufacturers, relating to student access to defibrillation in elementary schools and secondary schools, including with respect to the costs of providing AEDs and CPR training; and</text></paragraph> <paragraph id="H6519C4746E4C489CAA4144CD01A17311" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">to gather information in a central location to facilitate research regarding sudden cardiac arrest in the pediatric population.</text></paragraph></subsection> 
<subsection id="HDBC6B3AA66C74C53B61FBCCF08ABA7D4"><enum>(d)</enum><header>Reports</header> 
<paragraph id="H2D63195585504651AC58B2CB57B14283"><enum>(1)</enum><header>By grantee</header><text>Not later than 4 years after receipt of a grant under this section, the recipient of the grant shall submit to the Secretary a report that describes the activities carried out with funds received through the grant.</text></paragraph> <paragraph id="HBA876053B736497F825DDAA3D7E13ABF"><enum>(2)</enum><header>By Secretary</header><text display-inline="yes-display-inline">Not later than one year after receiving the reports required by paragraph (1), the Secretary shall submit to the appropriate congressional committees a consolidated evaluation of the activities carried out pursuant to grants under this section.</text></paragraph></subsection> 
<subsection id="H291DCEE43D734477812D549340D99818"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HC3506B9902A44CC2A3ED127721651D82"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>AED</term> means an automated external defibrillator.</text></paragraph> 
<paragraph id="H5C1EB7B4D0134B2AA6FD7BCE89172B67"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>CPR</term> means cardiopulmonary resuscitation.</text></paragraph> <paragraph id="HE60DDE70F3E24E70BA7D3EB6F2D0DE12"><enum>(3)</enum><text>The terms <term>elementary school</term>, <term>local educational agency</term>, and <term>secondary school</term> have the meanings given to such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph> 
<paragraph id="HF1187C11909C4318BC52DC1BBDCCDDD0"><enum>(4)</enum><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph></subsection> <subsection id="HDBFEA6B7896B4AA7AFF74439064016C9"><enum>(f)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $1,800,000 for the period of fiscal years 2023 through 2027.</text></subsection></section>
