R. 6517</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220128">January 28, 2022</action-date><action-desc><sponsor name-id="D000623">Mr. DeSaulnier</sponsor> (for himself and <cosponsor name-id="W000798">Mr. Walberg</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name>, and in addition to the Committees on <committee-name committee-id="HED00">Education and Labor</committee-name>, and <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Act of March 4, 1913, to establish the Bureau of International Labor Affairs within the Department of Labor, and for other purposes.</official-title></form><legis-body id="H47A4C01D92FF494C995768D0D0BC58C6" style="OLC"><section id="HCA691D287D5449BA9805639E71465DD6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bureau of International Labor Affairs Authorization Act of 2022</short-title></quote>.</text></section><section id="H80E4E49DB5774FB494915F2142C30600" commented="no"><enum>2.</enum><header>Establishment</header><text display-inline="no-display-inline">The Act of March 4, 1913 (37 Stat. 736, chapter 141; <external-xref legal-doc="usc" parsable-cite="usc/29/551">29 U.S.C. 551 et seq.</external-xref>), is amended by adding at the end the following:</text><quoted-block id="H6693322371844236A00BE7ABD5386397" style="OLC"><section display-inline="no-display-inline" id="H232D348A7C644BE6A30D75F50F76F234" commented="no"><enum>12.</enum><header>Bureau of International Labor Affairs</header><subsection id="H3F07806372064698A43F3515FB5BA3BC" commented="no"><enum>(a)</enum><header>Establishment of the bureau of international labor affairs</header><paragraph id="H9FE6692EB1194803AC76FAF64D81B3C4" commented="no"><enum>(1)</enum><header>In general</header><text>There is established within the Department of Labor a Bureau of International Labor Affairs (referred to in this section as the <quote>Bureau</quote>). The Bureau shall include offices to carry out functions related to—</text><subparagraph id="HCEB6C1EA31A44B349F6EDA2978AD2340" commented="no"><enum>(A)</enum><text>trade and labor affairs;</text></subparagraph><subparagraph id="HD9FBD96EC3C74C14B3D9493700C8F36D" commented="no"><enum>(B)</enum><text>child labor, forced labor, and human trafficking;</text></subparagraph><subparagraph id="H7298146FDC604AF88BCC3ECB0D6EBB46" commented="no"><enum>(C)</enum><text>international relations and economic affairs; and</text></subparagraph><subparagraph id="HACCA3CBE219043308938437B5971F748" commented="no"><enum>(D)</enum><text>other functions and activities as designated by the Secretary of Labor.</text></subparagraph></paragraph><paragraph id="H818868E9663D44E5A67FCB899B860027" commented="no"><enum>(2)</enum><header>Deputy undersecretary</header><text>The Secretary of Labor shall appoint a Deputy Undersecretary for International Affairs to head the Bureau. The Deputy Undersecretary for International Affairs shall continue to carry out all duties assigned to the Deputy Undersecretary for International Affairs as of the day before the date of enactment of the <short-title>Bureau of International Labor Affairs Authorization Act of 2022</short-title> and other duties and functions, as appropriate, to fulfill the mission of the Bureau.</text></paragraph><paragraph id="H209558A7E3DD49CEADC3679D44234B71" commented="no"><enum>(3)</enum><header>Functions</header><text>The functions of the Bureau on and after the date of enactment of the <short-title>Bureau of International Labor Affairs Authorization Act of 2022</short-title> shall include the responsibilities and functions of the Bureau on the day before the date of enactment of the <short-title>Bureau of International Labor Affairs Authorization Act of 2022</short-title>, and include all of its personnel, assets, authorities, liabilities, and other resources, including representational funds, required to support such functions.</text></paragraph><paragraph id="H0CE87D9FC00D40C1BB4DB53DEDE6A4FD" commented="no"><enum>(4)</enum><header>Mission</header><text>The mission of the Bureau shall be to—</text><subparagraph id="H9BF329EC521A4B5AA840815CEB719996" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">promote labor rights and a fair global playing field for workers and businesses in the United States and around the world by strengthening international labor standards, supporting enforcement of trade commitments, empowering workers, and combating international child labor, forced labor, and human trafficking;</text></subparagraph><subparagraph id="H5481BF60E4DA40919E9450DDF0AE8E8C" commented="no"><enum>(B)</enum><text>assist trading partners, through technical assistance and capacity building, in improving working conditions, combating child labor, forced labor, and human trafficking, raising living standards, and protecting the ability of workers to exercise their internationally recognized labor rights;</text></subparagraph><subparagraph id="HE300045A4E5D43409CB91FABFA22589E" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">support negotiations and enforcement, and conduct monitoring and administration, of labor commitments in trade agreements and preference programs;</text></subparagraph><subparagraph id="H2AF7340A59B04D83B55C9A31EFE30101" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">hire and designate labor attachés to serve at United States diplomatic and consular posts to assess working conditions, advance worker rights, support trade enforcement, address the workplace exploitation of children and other vulnerable populations, and serve as authoritative experts on labor policies and practices;</text></subparagraph><subparagraph id="H1B9D256D5B0E49D6BF0E62198F281B35" commented="no"><enum>(E)</enum><text>carry out representational activities, research, and other functions as designated by the Secretary of Labor; and</text></subparagraph><subparagraph id="HCA26A6CD92E541EA90BD1727761FA093" commented="no"><enum>(F)</enum><text>implement the duties and responsibilities assigned to the Department of Labor under the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7101">22 U.S.C. 7101 et seq.</external-xref>), the Trade and Development Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/19/3701">19 U.S.C. 3701 et seq.</external-xref>), the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/113">Public Law 116–113</external-xref>), and other Acts, and executive orders, as appropriate.</text></subparagraph></paragraph></subsection><subsection id="H204457773F534296B1E7426B5193FB0D" commented="no"><enum>(b)</enum><header>Grants, Contracts, and Cooperative Agreements</header><text>The Secretary of Labor may utilize funds made available to the Bureau to administer international labor programs and provide bilateral and multilateral technical assistance by or through contracts, grants, cooperative agreements, and other arrangements to carry out the mission and functions set forth in this section.</text></subsection><subsection id="H3B92D3BE888343A48495D326A76A57EC" commented="no"><enum>(c)</enum><header>Report to Congress</header><text>The Secretary shall submit to Congress on an annual basis a report on the activities of the Bureau during the previous year, including—</text><paragraph id="H11A66A5014214036AAC1809F8E2BC5A2" commented="no"><enum>(1)</enum><text>activities to prevent forced and child labor;</text></paragraph><paragraph id="H3EABDF16EBA648A0800942C549AC096F" commented="no"><enum>(2)</enum><text>support for trade agreement monitoring and enforcement activities;</text></paragraph><paragraph id="HAF0FE557CD134C65855BC2467A1D14CD" commented="no"><enum>(3)</enum><text>the location and activities of labor attachés; and</text></paragraph><paragraph id="H98BA0F6BDB0C4C638CC9459EAADB8BAF" commented="no"><enum>(4)</enum><text>the use of funds for contracts, grants, cooperative agreements and other funding arrangements.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
