which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><action display="yes"><action-date date="20220623">June 23, 2022</action-date><action-desc>Additional sponsors: <cosponsor name-id="S001177">Mr. Sablan</cosponsor>, <cosponsor name-id="C001117">Mr. Casten</cosponsor>, and <cosponsor name-id="C001127">Mrs. Cherfilus-McCormick</cosponsor></action-desc></action><action display="yes"><action-date date="20220623">June 23, 2022</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on January 25, 2022</action-instruction></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Higher Education Act of 1965 to prevent certain alcohol and substance misuse.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HED00" reported-display-style="italic" id="HBB4E4394542A4B95966DDF4A9F66E8AE"><section id="H05C550197B30493E98B58CCBD3058D3A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Campus Prevention and Recovery Services for Students Act of 2022</short-title></quote>.</text></section><section id="HCADD0EAFC87A494B886E42EC3B5962DD" section-type="subsequent-section"><enum>2.</enum><header>Alcohol and substance misuse prevention</header><text display-inline="no-display-inline">Section 120 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011i">20 U.S.C. 1011i</external-xref>) is amended—</text><paragraph id="H82B948E44FD046C4A42020B5CCA203B7"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">Drug and alcohol abuse</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Alcohol and substance misuse</header-in-text></quote>;</text></paragraph><paragraph id="H9FA51375266E407FB71D9A4ED7D6C063"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="H4F7BB4EFEB144A97863EA0536B117244"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>a program to prevent the use of illicit drugs and the abuse of alcohol by students and employees that,</quote> and inserting <quote>an evidence-based program to prevent alcohol and substance misuse by students and employees that,</quote>;</text></subparagraph><subparagraph id="H18A164DF7B5B41528B23CB2BE2C2F694"><enum>(B)</enum><text>by amending paragraph (1)(D) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H20FBB5D8C7664FB0B49F0DDCE0378D92" style="OLC" changed="added" reported-display-style="italic" committee-id="HED00"><subparagraph id="HF3F8B8180A2246238492B9A0BA703FD8"><enum>(D)</enum><text display-inline="yes-display-inline">a description of any alcohol or substance misuse counseling, treatment, rehabilitation, recovery, re-entry, or recovery support programs provided by the institution (including in partnership with a community-based organization) that are available to employees or students; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HF0876BD336C144E9A9DFFC77E7F9CEE2"><enum>(C)</enum><text>in paragraph (1)(E), by striking <quote>that the institution will impose</quote> and inserting <quote>of the policies of the institution regarding</quote>;</text></subparagraph></paragraph><paragraph id="H1258AEA004AA4ABD9778621CCEB38E51"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="H968D2F6E364D4170981F6927BB31EB3C"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H68386E42DC41476F8FE3224E0A296F7B"><enum>(i)</enum><text>by striking <quote>and</quote> at the end of subparagraph (A);</text></clause><clause id="H4F3712576D6A46EABE1B13AA66506057"><enum>(ii)</enum><text>in subparagraph (B), by striking the period and inserting <quote>; and</quote>; and</text></clause><clause id="HCC9A7B6D74F5428CA630B97CE0EA151E"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HB8509510114D4C1E88289325BA19B996" style="OLC" changed="added" reported-display-style="italic" committee-id="HED00"><subparagraph id="H8344DA3085C84207A624B3F5553D4E63"><enum>(C)</enum><text display-inline="yes-display-inline">compliance assistance to assist institutions in complying with the requirements of this section.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" id="HDA5E9E36A0854EEB8015C0789C45AE88"><enum>(B)</enum><text>by redesignating paragraph (2) as paragraph (4); and</text></subparagraph><subparagraph id="H414A7435F10C491EBC91E77BDFDF0F8A"><enum>(C)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block display-inline="no-display-inline" id="H27B10ABB06CF4FDC9874ECACC5B25849" style="OLC" changed="added" reported-display-style="italic" committee-id="HED00"><paragraph id="HE4E82A72FF104087B28387EF83C8509A"><enum>(2)</enum><header>Interagency agreement</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this paragraph, the Secretary shall enter into an interagency agreement with the Secretary of Health and Human Services to—</text><subparagraph id="H494FA4C77BA34F8BBE71305A539B3210"><enum>(A)</enum><text display-inline="yes-display-inline">develop best practices that inform criteria which satisfy the requirement under subsection (a) that an institution of higher education has adopted and has implemented an evidence-based program described in such subsection;</text></subparagraph><subparagraph id="H2D1FD93507B74E968B8EE96FE86F00F0"><enum>(B)</enum><text>establish a process for disseminating the best practices for adopting and implementing such an evidence-based program; and</text></subparagraph><subparagraph id="HA2446DDB76D5498492BE07B5BD978C94"><enum>(C)</enum><text display-inline="yes-display-inline">establish a process that promotes coordination and collaboration between institutions of higher education and the respective State agencies that administer the Substance Abuse Prevention and Treatment Block Grants pursuant to subpart II of part B of title XIX of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-21">42 U.S.C. 300x–21</external-xref>).</text></subparagraph></paragraph><paragraph id="H0A142EE9C0304A23AA4C7AEF226DA7C7"><enum>(3)</enum><header>Guidance</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this paragraph, the Secretary shall, in coordination with the Secretary of Health and Human Services, issue guidance with respect to the criteria described in paragraph (2)(A).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H14303EBF4B274992858D1CEB850C394F"><enum>(4)</enum><text>in subsection (e)—</text><subparagraph id="H4AD73EDB99494B8BA75EB3086019107C"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text level="section" style="OLC">drug abuse</header-in-text></quote> in the heading and inserting <quote><header-in-text level="section" style="OLC">substance misuse</header-in-text></quote>;</text></subparagraph><subparagraph id="H817E1E5B27064D5898DCFFF536E177FA"><enum>(B)</enum><text>in paragraph (1)—</text><clause id="H27045AB1A40F416CAACADC757E38EF88"><enum>(i)</enum><text>by striking <quote>other organizations</quote> and inserting <quote>community-based organizations that partner with institutions of higher education</quote>;</text></clause><clause id="HA300B6E05EE34E419C37EF7EDD713543"><enum>(ii)</enum><text>by striking <quote>programs of prevention, and education (including treatment-referral) to reduce and eliminate the illegal use of drugs and alcohol and the violence associated with such use</quote> and inserting <quote>evidence-based programs of alcohol and substance misuse prevention and education (including programs to improve access to treatment, referral for treatment services, or crisis intervention services) to eliminate illegal substance use, decrease substance misuse, and improve public health and safety</quote>; and</text></clause><clause id="H877FC7EBA2144330BDF56AB978F1E6B4"><enum>(iii)</enum><text>by striking <quote>alcohol and drug abuse</quote> and inserting <quote>substance use disorder</quote>;</text></clause></subparagraph><subparagraph id="HBAD383545DC94DD1983B78F1B876C7C7"><enum>(C)</enum><text>by redesignating paragraphs (2) through (5) as paragraphs (3) through (6), respectively; and</text></subparagraph><subparagraph id="H374282CCF1F842268FDBB71CCE49EC69"><enum>(D)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block display-inline="no-display-inline" id="H4E810D0B689A46498CB305ADD18007E9" style="OLC" changed="added" reported-display-style="italic" committee-id="HED00"><paragraph id="HDCB8FFBBC23E40668726F0E4A4B069A7"><enum>(2)</enum><header>Additional uses</header><text>In addition to the activities described in paragraph (1), a grant or contract awarded under paragraph (1) may be used to carry out one or more of the following evidence-based programs or activities:</text><subparagraph id="HBC43A19808274391B9008F1F372ABFB7"><enum>(A)</enum><text display-inline="yes-display-inline">Providing programs for recovery support services, and peer-to-peer support services and counseling for students with a substance use disorder.</text></subparagraph><subparagraph commented="no" id="HFF66091D6E92470782353359D40FDFA8"><enum>(B)</enum><text display-inline="yes-display-inline">Promoting integration and collaboration in campus-based health services between primary care, substance use disorder services, and mental health services.</text></subparagraph><subparagraph id="H804482AC8D2C4565837CE19B95E02D4B"><enum>(C)</enum><text display-inline="yes-display-inline">Promoting integrated care services for students related to screening, diagnosis, prevention, and treatment of mental, behavioral, and substance use disorders.</text></subparagraph><subparagraph commented="no" id="H01D4531FD9AE4474BCBDD974E156E2E9"><enum>(D)</enum><text display-inline="yes-display-inline">Providing re-entry assistance for students on academic probation due to their substance use disorder.</text></subparagraph><subparagraph id="H34EB3CFDB7424D6A8AF35E709494D507"><enum>(E)</enum><text display-inline="yes-display-inline">Preventing fatal and nonfatal overdoses, including restoring existing mental health and substance use disorder services after a natural disaster or public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>).</text></subparagraph><subparagraph id="HF764E71929E84CB9BED3FCBA4DAB1A8C"><enum>(F)</enum><text display-inline="yes-display-inline">Providing education to students, faculty, or other personnel on—</text><clause id="HB8F8D66AB4BB4B538B694F977BF55376"><enum>(i)</enum><text>recognizing the signs and symptoms of substance use disorder, and how to engage and support a person in a crisis situation;</text></clause><clause id="H1ACC71B6B74441E2AFFF059DE21BD0D1"><enum>(ii)</enum><text>resources available in the community, within the institution of higher education, and other relevant resources for individuals with a substance use disorder; and</text></clause><clause id="H56C3D2C64E10414CB66449196D6EBDEC"><enum>(iii)</enum><text>safely de-escalating crisis situations involving individuals with a substance use disorder.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H6AE98552318447319531B8A81D5E9887"><enum>(E)</enum><text>by amending paragraph (6), as redesignated by subparagraph (C), to read as follows:</text><quoted-block display-inline="no-display-inline" id="H1603FB9E60004B76B84623232FB9BA65" style="OLC" changed="added" reported-display-style="italic" committee-id="HED00"><paragraph id="H66E9A7A0839146DF8B327F4E85FB7B93"><enum>(6)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $15,000,000 for fiscal year 2023 and each of the 5 succeeding fiscal years.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H87EF7F3705754A7AAFBDAD770E4E20E9"><enum>3.</enum><header>Program participation agreements</header><text display-inline="no-display-inline">Section 487(a)(10) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)(10)</external-xref>) is amended—</text><paragraph id="HC8ECA358E3C542D9A080B55CAF5A0541"><enum>(1)</enum><text>by striking <quote><header-in-text level="paragraph" style="traditional"><enum-in-header>(10)</enum-in-header></header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="traditional"><enum-in-header>(10)(A)</enum-in-header></header-in-text></quote>;</text></paragraph><paragraph id="HABC678685DD54D079FEE245CC3604F9F"><enum>(2)</enum><text>by striking <quote>a drug abuse prevention program</quote> and inserting <quote>an alcohol and substance misuse prevention program in accordance with section 120</quote>; and</text></paragraph><paragraph id="HBEEB8668696E4DEA80AAB03474E308B7"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="traditional" id="H176FD6CB783F4FD5B62EF21E58021D05" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HED00"><subparagraph id="H8F9BEF4FC3A34345BA0F9EDC6833B792" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The institution shall be considered in compliance with the requirements of subparagraph (A) unless there is a showing that the institution knowing and willfully did not implement a prevention program described in such subparagraph.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H13643AEEBA8049FB85B25E030DE3942B"><enum>4.</enum><header>Report</header><text display-inline="no-display-inline">The Secretary of Education shall report to the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate on the efforts of the Secretary carried out under the amendments made by this Act, and best practices from institutions receiving a grant under section 120(e) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011i">20 U.S.C. 1011i(e)</external-xref>), as amended by section 2 of this Act—</text><paragraph id="H9F2E50A5E6F64C7092BF41977D7E6D8D"><enum>(1)</enum><text>not later than one year after the date of enactment of this Act; and</text></paragraph><paragraph id="H9EA1525724A04366918EC9274EA8D99F"><enum>(2)</enum><text>three years after the date of enactment of this Act.</text></paragraph></section><section id="H9FB6EC398C9A44918104077E51C7BB44"><enum>5.</enum><header>Applicability</header><text display-inline="no-display-inline">The amendments made by sections 2(2) and 3 shall apply to institutions of higher education beginning on the date that is 2 years after the date of the enactment of this Act.</text></section></legis-body><endorsement display="yes"><action-date date="20220623">June 23, 2022</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
