which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 46, United States Code, to establish a grant program for the procurement of megacranes for use at United States ports, and for other purposes.</official-title></form><legis-body id="H2ED36B72239346C09A940B907282F21E" style="OLC"><section id="HE91813F0E3E94E2F8256A4A1FCB1AE8F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Port Cranes for America Act</short-title></quote>.</text></section><section id="HC2FAA41DDB3B400E96D30F7CA89F8209" section-type="subsequent-section"><enum>2.</enum><header>Megacrane procurement grant program</header><text display-inline="no-display-inline">Section 50302 of title 46, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H1CDC707FB5934D48ABFC0460E2F3338B" display-inline="no-display-inline"><subsection id="H4AAFEE16CC2F40FA93DED054083F06E9"><enum>(f)</enum><header>Megacrane procurement grant program</header><paragraph id="HFF5BF3C6B7C846DEA8D8403AF72FF9D9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Maritime Administration shall provide grants to eligible applicants for the procurement of certain megacranes for use at ports located in the United States.</text></paragraph><paragraph id="HAC984CC6144F41D68B92EE76AF748560"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible for a grant under this subsection, an eligible applicant shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator considers appropriate, including any information related to the purchase of a megacrane.</text></paragraph><paragraph id="H97275A98B6FF4726906A2F4B8FCA19C2"><enum>(3)</enum><header>Use of funds</header><text>An eligible applicant receiving a grant under this subsection shall use the funds provided under the grant only to—</text><subparagraph id="HB2975F389CBA4B7A9CE37749F5365A52"><enum>(A)</enum><text>procure a megacrane, including to pay for any manufacturing costs associated with procuring a megacrane; or</text></subparagraph><subparagraph id="H89BB241427D8440CBC9663671B030E61"><enum>(B)</enum><text>replace foreign software on a megacrane in use before the date of enactment of the <short-title>Port Cranes for America Act</short-title>.</text></subparagraph></paragraph><paragraph id="H3081149401394A96B438A85F9D714012"><enum>(4)</enum><header>Federal match</header><text display-inline="yes-display-inline">The Federal share of the cost of procurement of a megacrane or the replacement of foreign software on a megacrane in service before the date of enactment of the <short-title>Port Cranes for America Act</short-title> for which a grant is awarded under this subsection shall be not more than 80 percent.</text></paragraph><paragraph id="H5BA0A6F21A4C4DD7B56FF5D722E22E17"><enum>(5)</enum><header>Restriction</header><text>An eligible applicant receiving a grant under this subsection may not procure a foreign crane.</text></paragraph><paragraph id="HB8321A323E1A43D8B0886408FDE9727F"><enum>(6)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H701E689A8E8F4828ABD53C84A78485CF"><enum>(A)</enum><header>Eligible applicant</header><text>The term <quote>eligible applicant</quote> has the meaning given such term in section 50302.</text></subparagraph><subparagraph id="H742506C97A7E408EBAB2ECE5C97D1251"><enum>(B)</enum><header>Foreign crane</header><text display-inline="yes-display-inline">The term <quote>foreign crane</quote> means a crane that is, in whole or in part, manufactured by an entity that is owned or controlled by, is a subsidiary of, or is otherwise related legally or financially to a corporation based in a country that—</text><clause id="HE46084A4EF3749279830F104E28C3756"><enum>(i)</enum><text display-inline="yes-display-inline">is identified as a nonmarket economy country (as defined in section 771(18) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1677">19 U.S.C. 1677(18)</external-xref>)) as of the date of enactment of the <short-title>Port Cranes for America Act</short-title>;</text></clause><clause id="H343E7A621A0A461598C3075286D5EF00"><enum>(ii)</enum><text>was identified by the United States Trade Representative in the most recent report required by section 182 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2242">19 U.S.C. 2242</external-xref>) as a foreign country included on the priority watch list defined in subsection (g)(3) of such section; and</text></clause><clause id="H8C9B53034CC74A128B442EC482B8E0A6"><enum>(iii)</enum><text>is subject to monitoring by the Trade Representative under section 306 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2416">19 U.S.C. 2416</external-xref>).</text></clause></subparagraph><subparagraph id="H5C97E6AFF55548CFB29E3B4901750D39"><enum>(C)</enum><header>Megacrane</header><text>The term <quote>megacrane</quote> means a container crane that has a lifting capacity in excess of 50 tons and that is not a foreign crane.</text></subparagraph><subparagraph id="H0115F2A1291D4EE8A616219B1069D6D5"><enum>(D)</enum><header>United States</header><text>The term <quote>United States</quote> includes any territory of the United States.</text></subparagraph></paragraph></subsection><subsection id="H7BCB7AD23F284B8DBD3AFC929B0A4746"><enum>(g)</enum><header>Buy America</header><text display-inline="yes-display-inline">The requirements of section 54101(d)(2) shall apply to any grant provided under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF9684426CA44475E9F5B57B6C8C75954" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header>Foreign crane acquisition prohibition</header><subsection id="HC53E3ECE6DA647C08CED52CE3C2C68E7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/701">chapter 701</external-xref> of title 46, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="H1E5291BB08814B2689C330647FAFDB3E"><section id="H380E838118F0491E820E1445538C35F9"><enum>70126.</enum><header>Foreign crane acquisition prohibition</header><subsection id="H949F091FC4E24BB282B8E09A17A3F011"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a foreign crane may not be acquired for operation in the United States.</text></subsection><subsection id="H78E31229E03E48DD8F9DCD46B39C7FB3"><enum>(b)</enum><header>Foreign crane defined</header><text>In this section, the term <quote>foreign crane</quote> has the meaning given such term in section 50302(f) of title 46, United States Code. </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD1BB4F93E09B4A54BD64FB142BA9BD2D"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/701">chapter 701</external-xref> of title 46, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/46/70125">section 70125</external-xref> the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="H142D6689DA2B43FAAFBD184120D1E4D7"><toc regeneration="no-regeneration"><toc-entry level="section">70126. Foreign crane acquisition prohibition.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCE412D7648EC4DFDBF871C1EF3A17054"><enum>(c)</enum><header>Applicability</header><text>This section, including the amendments made by this section, applies beginning on the date that is 3 years after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
