which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a Housing Stabilization Fund to provide emergency housing assistance to extremely low-income renters and homeowners, and for other purposes.</official-title></form><legis-body id="HF61FDCA973564BF184B9D42277AF024C" style="OLC"><section id="H7B54EF5CE32D45CC828F3AEF8674A1BF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prevent Homelessness Act of 2022</short-title></quote>.</text></section><section id="H32ECCADE63DA4180A06241C0D4567CF4"><enum>2.</enum><header>Housing Stabilization Fund</header><subsection id="H7FDAC0337F1D45299C557672E04CFD0B"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development, acting through the Office of Special Needs Assistance Programs of the Office of Community Planning and Development, shall establish and administer a fund to be known as the Housing Stabilization Fund.</text></subsection><subsection id="H87ADEDBEB789458683EB528968435AF7"><enum>(b)</enum><header>Grants</header><text display-inline="yes-display-inline">Amounts in the Fund shall be available, to the extent provided in advance in appropriations Acts, only for making annual grants under this section, in the amount determined pursuant to subsection (f), to continua of care to provide short-term assistance under emergency housing assistance programs that the Secretary determines, pursuant to applications under subsection (e), meet the requirements of subsection (c).</text></subsection><subsection id="HE9B30E618D7A4BA7A287A0119F332ACF"><enum>(c)</enum><header>Emergency housing assistance program requirements</header><text>An emergency housing assistance program shall be considered to meet the requirements of this subsection only if the program—</text><paragraph id="H7AD4A36CE69049FE8A491E724FABF522"><enum>(1)</enum><text>is carried out by a continuum of care or other agency, organization, or entity selected by a continuum of care;</text></paragraph><paragraph id="HA4D58E6E0BFB49A381E98FD40626B358"><enum>(2)</enum><text>operates within the geographical area served by the continuum of care;</text></paragraph><paragraph id="HF50B599C30FC4CBABCEF302716260BAF"><enum>(3)</enum><text display-inline="yes-display-inline">provides financial assistance only on behalf of extremely low-income families who—</text><subparagraph id="H87C819F3502243F4B41DE2858CDC357C"><enum>(A)</enum><text>are unable to meet housing-related obligations (as described in subsection (d) of this section) due to a financial hardship, which shall include the situations described in clause (i) of section 3(a)(3)(B) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(a)(3)(B)(i)</external-xref>), a family or health crisis, unexpected expenses, unsafe or unhealthy living conditions, and such other situations as the Secretary may provide; and</text></subparagraph><subparagraph id="H3BB493AA00274F54B5A9CAC6BC04A38F"><enum>(B)</enum><text display-inline="yes-display-inline">provide evidence of such inability to meet housing related obligations, which may include past-due utilities or rent notices, eviction notices, and such other evidence as the Secretary may provide, except that a continuum of care may, in consultation with the Secretary, provide for additional manners of identifying inability to meet housing related obligations in situations in which such notices are not available;</text></subparagraph></paragraph><paragraph id="H3C2E459240D946C2AD1DECBE9D0A3DEF"><enum>(4)</enum><text display-inline="yes-display-inline">provides for coordination with any local homeless prioritization criteria, including the Coordinated Entry System or any other evidence-based analytic targeting tool, applicable within the area in which the program will be carried out, in accordance with such requirements as the Secretary shall provide; and</text></paragraph><paragraph id="H44C76E1CAEB4451E9A074F1036C4B374"><enum>(5)</enum><text>meets such other requirements as the Secretary may establish.</text></paragraph></subsection><subsection id="HEDA2801C23434260AD620F459099AB7A"><enum>(d)</enum><header>Eligible financial assistance</header><text>Amounts from grants under this section for an emergency housing assistance program shall be used to provide financial assistance only to meet housing-related obligations, including—</text><paragraph id="HC9A6FA8CE0014B85837476F530AB7D04"><enum>(1)</enum><text display-inline="yes-display-inline">rent due, including amounts past due, except that such assistance may not—</text><subparagraph id="H96115AD4FCEF4129A295C6ED810D807C"><enum>(A)</enum><text display-inline="yes-display-inline">be provided for a family for more than 8 months (whether consecutive or not) within the preceding 12 months; and </text></subparagraph><subparagraph id="H14D5ED796F6B4AD2A67823FE1F77D56D"><enum>(B)</enum><text>may not exceed on a monthly basis the amount that the Secretary determines is reasonable in comparison with rents charged for comparable dwelling units located in the same area in the private, unassisted local market; </text></subparagraph></paragraph><paragraph id="H436F83CA19874D8080526009C135CAD5"><enum>(2)</enum><text display-inline="yes-display-inline">mortgage payments due, including amounts past due, except that such assistance may not be provided for a household for more than 8 months (whether consecutive or not) within the preceding 12 months and may not exceed on a monthly basis such amount as the Secretary shall determine;</text></paragraph><paragraph id="H070CBBF2D1F147EF94ED7603DA4934EF"><enum>(3)</enum><text>utility payments due, including amounts past due;</text></paragraph><paragraph id="H23B94D2BCC6740E8BA6A991721891992"><enum>(4)</enum><text display-inline="yes-display-inline">housing repairs necessary to make the premises habitable, including installing insulation, window repair, door repair, roof repair, and other repairs;</text></paragraph><paragraph id="HCB46B1BD409B437EBCDE57BA754F2DAA"><enum>(5)</enum><text display-inline="yes-display-inline">costs of obtaining services for behavioral, emotional, and mental health issues, domestic violence issues, child welfare issues, employment counseling, substance abuse treatment, or other services;</text></paragraph><paragraph id="H4B4546966611473EA3D661C2AA77A1EC"><enum>(6)</enum><text>costs of obtaining housing counseling or advice, including outreach, mediation, and case management;</text></paragraph><paragraph id="H6055D97947634CE28D62A99B93FCDD1A"><enum>(7)</enum><text>costs of obtaining legal assistance relating to eviction, foreclosure, and other issues relating to a family retaining its housing; and</text></paragraph><paragraph id="HA8E0664E790147E6A664F0B4CC14AFF4"><enum>(8)</enum><text>other short-term costs the payment of which increase housing stability for an extremely low-income family, including costs for gas, groceries, automotive repair, public transportation, furniture, application fees, reunification services, and such other costs as the Secretary may provide.</text></paragraph></subsection><subsection id="HF3516D3B0C004CA5A87D37DF753BE41F"><enum>(e)</enum><header>Applications</header><text display-inline="yes-display-inline">The Secretary shall require, for a continuum of care to receive a grant under this section for a fiscal year, that the continuum of care submit to the Secretary, and the Secretary approve, an application containing such information as the Secretary considers necessary to ensure that grant amounts are used in accordance with this section.</text></subsection><subsection id="H0C318191DC074FC3BA2848E4DD196D4F"><enum>(f)</enum><header>Amount of grants</header><paragraph id="H81DB635CCE28456C8481CD2E0B32719C"><enum>(1)</enum><header>Allocation</header><subparagraph id="HDA9E0EAAFFA2495CBFCC040F494694B9"><enum>(A)</enum><header>Fiscal year 2023</header><text display-inline="yes-display-inline">For fiscal year 2023, any amounts made available from the Fund for grants under this section shall be allocated for grants to continua of care according to the formula established pursuant to paragraph (2).</text></subparagraph><subparagraph id="H3DD32643E52848E79ABA56438FCC0BD1"><enum>(B)</enum><header>Succeeding fiscal years</header><text>For each fiscal year thereafter, of any amounts made available from the Fund for grants under this section—</text><clause id="H64F60DDDFE8D4420B4647C97435B06BC"><enum>(i)</enum><text>80 percent shall be allocated for grants to continua of care according to the formula established pursuant to paragraph (2); and</text></clause><clause id="H2F805903693F43EFA4D67159C8EA93CD"><enum>(ii)</enum><text>20 percent shall be allocated for grants to continua of care according to a competition pursuant to paragraph (3).</text></clause></subparagraph></paragraph><paragraph id="H588D6213A4C0483EB93AE49055F0B814"><enum>(2)</enum><header>Formula</header><subparagraph id="H43ABB0CA18FE48819126457C67A470F6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall, by regulation, establish a formula for use to allocate amounts in the Fund for grants for a fiscal year, in accordance with paragraph (1), for continua of care whose applications for such year for such assistance have been approved pursuant to subsection (e).</text></subparagraph><subparagraph id="HE58A9F757AFD446C90B93E400C6045C9"><enum>(B)</enum><header>Factors</header><text>The formula required by subparagraph (A) shall be designed to take into consideration, for the area served by a continuum of care—</text><clause id="H6113C44DF2824EE889B6B6BC63829118"><enum>(i)</enum><text display-inline="yes-display-inline">the extent of the population that are extremely low-income families, including the homeless population that is unsheltered, who are severely cost-burdened by housing-related costs, including obligations described in subsection (d);</text></clause><clause id="H32ED3510694140EE9E5EC1D04EBFD7B0"><enum>(ii)</enum><text>such other factors as the Secretary may provide.</text></clause><continuation-text continuation-text-level="subparagraph">The Secretary shall determine data to be used for the factors considered under the formula based on the most recently conducted Point-In-Time Homeless Count administered by the Secretary. </continuation-text></subparagraph></paragraph><paragraph id="HC5A89FFC6D9E4160B6F60786E8841302"><enum>(3)</enum><header>Competition</header><text display-inline="yes-display-inline">The Secretary shall, by regulation, establish a competition for use to allocate amounts in the Fund for grants for a fiscal year for continua of care pursuant to paragraph (1)(B)(ii), which shall be based on measurable criteria that—</text><subparagraph id="H8A2B91140B8D40CB81248B45BA99B78A"><enum>(A)</enum><text>to the greatest extent possible, are required to be collected and reported to the Department of Housing and Urban Development or any other Federal agency under other provisions of law already in effect or otherwise do not impose new burdens on continua of care;</text></subparagraph><subparagraph id="H85EFB1387F904BFB922E5C4343F1079C"><enum>(B)</enum><text>provide for targeting of assistance made available under an emergency housing assistance program to households having the lowest incomes;</text></subparagraph><subparagraph id="HD6F1320EC4494D9CBAC5BFC2FB07EE1F"><enum>(C)</enum><text display-inline="yes-display-inline">encourage the leveraging of other non-Federal funds for providing assistance under an emergency housing assistance program;</text></subparagraph><subparagraph id="H78FF621815E24EF585C004742C7D61E5"><enum>(D)</enum><text display-inline="yes-display-inline">encourage emergency housing assistance programs assisted with grants under this section to provide preventive assistance to avoid homelessness; and</text></subparagraph><subparagraph id="HA84B0A8C0A914012A4564F98E122CD2F"><enum>(E)</enum><text display-inline="yes-display-inline">encourage problem-solving and diversion methods, including the applicant’s capacity and interest in providing innovative delivery of housing stability interventions and connecting households to other public benefits that promote housing stability.</text></subparagraph></paragraph></subsection><subsection id="H07B694344C9D4FBCB8C7853B43C7D827"><enum>(g)</enum><header>Definitions</header><text>For purposes of this Act, the following definitions shall apply:</text><paragraph id="HDF2E4B443C1C413A999DF6495417C2B5"><enum>(1)</enum><header>Continuum of care</header><text>The term <term>continuum of care</term> means a collaborative applicant established and operating for a geographic area for purposes of the Continuum of Care Program under subtitle C of title IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11381">42 U.S.C. 11381 et seq.</external-xref>).</text></paragraph><paragraph id="H71E61C37386041E1A6FE2BF6F37101C6"><enum>(2)</enum><header>Fund</header><text>The term <term>Fund</term> means the Housing Stabilization Fund established under subsection (a). </text></paragraph><paragraph id="H750392B4024A4C8EBE463F6CE4AF3534"><enum>(3)</enum><header>Extremely low-income family</header><text display-inline="yes-display-inline">The term <term>extremely low-income family</term> has the meaning given such term in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>)</text></paragraph><paragraph id="H339AA0DEC06F45C3956A270D331B013D"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph></subsection><subsection id="HF591468ED09447F188306B02E07BCFB4"><enum>(h)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated for the Fund $100,000,000 for each of fiscal years 2023 through 2027.</text></subsection></section></legis-body></bill>
