which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food and Nutrition Act of 2008 to limit the use of business integrity and reputation factors in determining the eligibility of a retail food store or wholesale food concern to be approved to accept and redeem supplemental nutrition assistance program benefits.</official-title></form><legis-body id="H4E88FBAC21A548E7A14687A85C1C3A37" style="OLC"><section section-type="section-one" id="H66C7EF6086DA49229054920F0951C8B8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>SNAP Second Chance Act of 2022</short-title></quote>.</text></section><section section-type="subsequent-section" id="HBC4A3D43CD0D4C67970952BDDE5B2F08"><enum>2.</enum><header>Business integrity and reputation under supplemental nutrition assistance program</header><text display-inline="no-display-inline">Section 9(a)(1)(B) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2018">7 U.S.C. 2018(a)(1)(B)</external-xref>) is amended—</text><paragraph id="HA4B3FF3FDB9D46DAA91B4581860DD2FD" commented="no"><enum>(1)</enum><text>in clause (v), by inserting <quote>, in accordance with clause (ii)</quote> before the period at the end; </text></paragraph><paragraph commented="no" id="H78B5E18954B44489892A2FEB3543557C"><enum>(2)</enum><text>by redesignating clauses (i) through (v) as subclauses (I) through (V), respectively, and indenting appropriately;</text></paragraph><paragraph commented="no" id="HB9FE0A48BF0E4B9FA9C255E1FA2A7973"><enum>(3)</enum><text>in the matter preceding subclause (I) (as so redesignated), by striking <quote>In determining</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H69E638F5A7B841149C3ABA2B91E1980E"><clause commented="no" id="H79D8305F375949BFAEE3196598429CC8"><enum>(i)</enum><header>In general</header><text>In determining</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HB7D0C490840D427FA453AEF53443EC29"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5982D50DAD2B426CBAE5558197561015"><clause id="HC6B5D92B520946E28828CF1D75C1A207"><enum>(ii)</enum><header>Treatment of criminal convictions under business integrity and reputation</header><subclause commented="no" id="HBD4D29685F0E41259FF5854DD9A773C0"><enum>(I)</enum><header>Definition of crime of financial fraud or deception</header><text>In this clause, the term <quote>crime of financial fraud or deception</quote> means a crime involving—</text><item commented="no" id="H2AFDF9B6554D4BB5ABBD2EAE902868C1"><enum>(aa)</enum><text>fraud;</text></item><item commented="no" id="H4AF42856EBF64D889F787E8D927E2CD7"><enum>(bb)</enum><text>bribery;</text></item><item commented="no" id="H19DB9910460942B9B48A26AA9320C1B2"><enum>(cc)</enum><text>embezzlement; or </text></item><item commented="no" id="HA21CDA6097A349D38486F52398D78715"><enum>(dd)</enum><text>a false statement in—</text><subitem commented="no" id="HA3465C6CF56F4139AF4E40052A74BC4E"><enum>(AA)</enum><text>a private loan application; or</text></subitem><subitem commented="no" id="H2EB428643EAA4691A025776DA97F6D4F"><enum>(BB)</enum><text>an application for a Federal loan or other Federal financial assistance.</text></subitem></item></subclause><subclause id="H9146F8D70B8D47589304144C4BCBDEF4"><enum>(II)</enum><header>Treatment</header><text>In considering the business integrity and reputation of the applicant under clause (i)(V), a conviction of an applicant shall be taken into account only if the conviction is for—</text><item id="H7661CE393EEC488D93EFEF9EF88C9B50"><enum>(aa)</enum><text display-inline="yes-display-inline">a crime of financial fraud or deception under Federal, State, or Tribal law, that occurred during the 5-year period preceding the date of application, or</text></item><item id="H5F763B551D764AEF80CD227309F78ED9"><enum>(bb)</enum><text>a crime under section 15 of this Act.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H0B5184BBAECB409BB1EA6C7B308CDA38"><enum>3.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 18 months after the date of enactment of this Act, the Secretary shall promulgate regulations to carry out the amendments made by section 2.</text></section></legis-body></bill>
