which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name>, and in addition to the Committee on <committee-name committee-id="HAS00">Armed Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 10 and title 41, United States Code, to amend the compliance procedures for the prohibition on criminal history inquiries by Federal contractors prior to conditional offers, and for other purposes.</official-title></form><legis-body id="H03B5F9058F26461589F24CEFCB526105" style="OLC"><section id="H8B61A1B9BBD5489197DCB47EBACA8C03" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Chance Improvement Act</short-title></quote>.</text></section><section id="HB5BC4607863C4789BF272E7145E9F6FB"><enum>2.</enum><header>Compliance Procedures for investigating the prohibition on criminal history inquiries by Federal contractors prior to conditional offer</header><subsection id="H4C0B37E03EE64E4DA2675B77BC9A0AEE"><enum>(a)</enum><header>Civilian agency contracts</header><text>Section 4714(b) of title 41, United States Code, is amended—</text><paragraph id="H69D7A9B05A4343158ACB4A1E79A049D9" commented="no"><enum>(1)</enum><text>by amending subsection (b) to read as follows: </text><quoted-block style="OLC" id="HAAECA004A04F4574AD41433D8F2E5397" display-inline="no-display-inline"><subsection id="H8583218031E4418DAB56905CB4E33CFE" commented="no"><enum>(b)</enum><header>Compliance</header><paragraph id="H731D1423C7134A03A2A49235D723F4D8"><enum>(1)</enum><header>Procedures for submission of complaint</header><text display-inline="yes-display-inline">The Secretary of Labor shall establish, and make available to the public, procedures under which an applicant for a position with a Federal contractor may submit to the Secretary a complaint, or any other information, relating to compliance by the contractor with subsection (a)(1)(B).</text></paragraph><paragraph id="H89556CFEFEA84681AED154805FBE5091" commented="no"><enum>(2)</enum><header>Investigation of compliance</header><text display-inline="yes-display-inline">In addition to the authority to investigate compliance by a contractor with subsection (a)(1)(B) pursuant to a complaint submitted under paragraph (1) of this subsection, the Secretary of Labor may investigate compliance with subsection (a)(1)(B) in conducting a compliance evaluation under section 60–1.20, 60–300.60, or 60–741.60 of title 41, Code of Federal Regulations (or any successor regulation). </text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H03EB654528F14474B6795DD026A31FB6"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="H519FF96CE32F4EA6B10A3654E042F79B"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="HFFA9F63D135140FE8AA807934E4BB63F"><enum>(i)</enum><text>by striking <quote>head of an executive agency</quote> and inserting <quote>Secretary of Labor</quote>;</text></clause><clause id="H44649FA3BDD749AB9273C7ABCAF7AEE7"><enum>(ii)</enum><text>by inserting <quote>, based upon the results of a complaint investigation or compliance evaluation conducted by the Secretary of Labor under section 60–1.20, 60–300.60, or 60–741.60 of title 41, Code of Federal Regulations (or any successor regulation)</quote> after <quote>determines</quote>;</text></clause><clause id="HD03D5713CB4441C38003A3522EDA9C77"><enum>(iii)</enum><text>by striking <quote>such head</quote> and inserting <quote>the Secretary of Labor</quote>; and</text></clause><clause id="HC6A103168EBA41CD8785286D6D778461"><enum>(iv)</enum><text>in subparagraph (C), by striking <quote>warning</quote> and inserting <quote>notice</quote>; and</text></clause></subparagraph><subparagraph id="H830F51CAC3564311BC62603E1CCD927E"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="HDC8C3C5C58AF49789E9128A82A45AC06"><enum>(i)</enum><text>by striking <quote>head of an executive agency</quote> and inserting <quote>Secretary of Labor</quote>;</text></clause><clause id="H52DC526F3C8C4DF4BF6AF9BAA06611E0"><enum>(ii)</enum><text>by inserting <quote>, based upon the results of a complaint investigation or compliance evaluation conducted by the Secretary of Labor under section 60–1.20, 60–300.60, or 60–741.60 of title 41, Code of Federal Regulations (or any successor regulation),</quote> after <quote>determines</quote>;</text></clause><clause id="H2EBC39E70AFF4FB6BE08DBDDC58333E3"><enum>(iii)</enum><text>by striking <quote>such head</quote> and inserting <quote>the Secretary of Labor</quote>;</text></clause><clause id="HF2B79CCD2FF74DDD8CA5D33A1B93AA1E"><enum>(iv)</enum><text>by inserting <quote>as may be necessary</quote> after <quote>Federal agencies</quote>; and</text></clause><clause id="H6C1BEA1A4D704D90B7746EE35AC31B19"><enum>(v)</enum><text>by striking subparagraph (C) and inserting the following:</text><quoted-block id="H2FDC5BF638174EA29B0B4077A4DDF5FB" style="OLC"><subparagraph id="H761BE7E641FF4E3D84514DD203666783"><enum>(C)</enum><text display-inline="yes-display-inline">taking an action to impose a sanction described under section 202(7) of Executive Order 11246 (related to equal employment opportunity) and section 60–1.27 of title 41, Code of Federal Regulations (or any successor regulation).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection id="HE5B05CBD455C4DBE92D5E4295FEDE033" display-inline="no-display-inline" commented="no"><enum>(b)</enum><header>Defense contracts</header><text display-inline="yes-display-inline">Section 2339 of title 10, United States Code, is amended—</text><paragraph id="H793BC0E7F8B14EC2AA70931AF2727DBC" commented="no"><enum>(1)</enum><text>by amending subsection (b) to read as follows: </text><quoted-block style="OLC" id="H7F68ED466EF643A78A8FC10D5CCA193E" display-inline="no-display-inline"><subsection id="H55BA1EDF823C4C58B28805E1BC352287" commented="no"><enum>(b)</enum><header>Compliance</header><paragraph id="HF9E1DEE10E4742DBAD15F5F95525CD2B" commented="no"><enum>(1)</enum><header>Procedures for submission of complaint</header><text display-inline="yes-display-inline">The Secretary of Labor shall establish, and make available to the public, procedures under which an applicant for a position with a Federal contractor may submit to the Secretary a complaint, or any other information, relating to compliance by the contractor with subsection (a)(1)(B).</text></paragraph><paragraph id="H02E8166FD1B647179ACCD7372E161D87" commented="no"><enum>(2)</enum><header>Investigation of compliance</header><text display-inline="yes-display-inline">In addition to the authority to investigate compliance by a contractor with subsection (a)(1)(B) pursuant to a complaint submitted under paragraph (1) of this subsection, the Secretary of Labor may investigate compliance with subsection (a)(1)(B) in conducting a compliance evaluation under section 60–1.20, 60–300.60, or 60–741.60 of title 41, Code of Federal Regulations (or any successor regulation).</text></paragraph></subsection><after-quoted-block>; and</text></clause><clause id="H4D295B3716B84799B932CE3A3819FA39" commented="no"><enum>(v)</enum><text>by striking subparagraph (C) and inserting the following:</text><quoted-block id="HA4FE712BDBBC42D2A4BBCD33F4E4495B" style="OLC"><subparagraph id="H4C2C2F52FADC467ABF8F52659B0C3CD2" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">taking an action to impose a sanction described under section 202(7) of Executive Order 11246 (related to equal employment opportunity) and section 60–1.27 of title 41, Code of Federal Regulations (or any successor regulation).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection id="H31D4F131BE4F4E2BB28CB37732FA3511" commented="no"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">This Act, and the amendments made by this Act, shall apply with respect to contracts awarded on or after December 20, 2022.</text></subsection></section></legis-body></bill>
