Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of State to report to Congress on evacuation operations in Afghanistan, and for other purposes.</official-title></form><legis-body id="H4710B22AB18F4DB9BF35B0CE7DA8F240" style="OLC"><section id="H6E821A690AA3447D93A83C94B492CA82" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rescue Endangered SIVs and Citizens and Urgently Evacuate to Safety Act of 2022</short-title></quote> or the <quote><short-title>RESCUES Act of 2022</short-title></quote>.</text></section><section id="H6EDCFE7F83864EBCA28E4CBF38752CB4"><enum>2.</enum><header>Reporting requirements on evacuation operations</header><subsection id="HB307978E7EEA444BA10F5C781EA530F6"><enum>(a)</enum><header>Report</header><text>On the date that is 180 days after the date of enactment of this Act, the Secretary of State shall submit to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate a report on funding provided by the Department of State to nongovernmental entities for the purposes of evacuating covered individuals from Afghanistan.</text></subsection><subsection id="HFC16216DC4504DE7B4D7161746BAF3E7"><enum>(b)</enum><header>Contents of report</header><text>The report under subsection (a) shall include the following:</text><paragraph id="H2722858775B3484E95DFE67C8311E177"><enum>(1)</enum><text>The total amount allocated for expenditure and the total amount expended by the Department of State during the period beginning on August 15, 2021, and ending on the date that is 180 days after the date of enactment of this Act, to nongovernmental entities for purposes of evacuating covered individuals from Afghanistan, including for the provision of flights, visa and passport fees, and housing and food costs.</text></paragraph><paragraph id="H3D293EEAC1E84F7AAC843790E1F22088"><enum>(2)</enum><text>A list of each nongovernmental entity that received funding from the Department of State for the purposes of evacuating covered individuals from Afghanistan during the period described in paragraph (1).</text></paragraph><paragraph id="HFB190A587E744E168B688B9EF3DFBFE7"><enum>(3)</enum><text>A breakdown of how funding provided to each nongovernmental entity by the Department of State during the period described in paragraph (1) was used by each entity, including breakdowns of any taxes, duties, or fees paid to the Taliban (including any entity of the Taliban-controlled government).</text></paragraph><paragraph id="HF92477BD3A7144199374D5DA08FE9701"><enum>(4)</enum><text>The number of covered individuals who were evacuated from Afghanistan during the period described in paragraph (1), disaggregated by the categories of covered individuals described in paragraphs (1) through (5) of section 4.</text></paragraph><paragraph id="H5ADB2C3B69FA41C5BF2E1D76620E5C6E"><enum>(5)</enum><text>The number of covered individuals described in paragraphs (1) and (2) of section 4 who, on the date that is 180 days after the date of enactment of this Act, are still seeking evacuation from Afghanistan.</text></paragraph><paragraph id="H8068FBFEC20143E2BBB1A5BBB63A3CBE"><enum>(6)</enum><text>The requirements put in place by the Department of State for nongovernmental entities to receive funding from the Department for purposes of evacuating covered individuals from Afghanistan.</text></paragraph></subsection></section><section id="HB13164E329BD4B5C9ACFA0E2230B4D3E"><enum>3.</enum><header>Report on provision of funding</header><text display-inline="no-display-inline">On the date that is 180 days after the date of enactment of this Act, the Secretary of State shall submit to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate a report on methods used by the Department of State to prevent waste, fraud, abuse, or diversion to unintended beneficiaries of funding provided to a nongovernmental entity for purposes of evacuating covered individuals from Afghanistan.</text></section><section id="HAF4400E422BD435B8C6A29A9B37A80FF"><enum>4.</enum><header>Covered individual defined</header><text display-inline="no-display-inline">In this Act, the term <term>covered individual</term> means—</text><paragraph id="HBF7E666570B4404083651B09BA44B68C"><enum>(1)</enum><text>a national of the United States;</text></paragraph><paragraph id="HE523FF5E38574745AF491F04A8D61844"><enum>(2)</enum><text>an alien lawfully admitted for permanent residence in the United States;</text></paragraph><paragraph id="H4C11634252F74C2F8F413361B639A1C2"><enum>(3)</enum><text>a national of Afghanistan who has been issued a special immigrant visa;</text></paragraph><paragraph id="HC3A9BAD2F2B04DFBADB922091BEF4DEB"><enum>(4)</enum><text>a national of Afghanistan who has applied for a special immigrant visa; and</text></paragraph><paragraph id="H9F1890677A4F4DC5B1ED2E5847733F6A"><enum>(5)</enum><text>a national of Afghanistan who is eligible for Priority 1, Priority 2, or Priority 3 processing under the U.S. Refugee Admissions Program.</text></paragraph></section></legis-body></bill>
