Short title

This Act may be cited as the No Mandates for Healthcare Workers Act.

Limitation on conditions of participation in Medicare and Medicaid

Part A of title XI of the Social Security Act (42 U.S.C. 1301 et seq.) is amended by adding at the end the following new section:

1150D.

Prohibition on conditions of participation in Medicare and Medicaid

The Secretary shall not have the authority to require any drug (as defined in section 201(g)(1) of the Federal Food, Drug, and Cosmetic Act) or vaccine or other biological product (as defined in section 351(i)(1) of the Public Health Service Act) be administered to employees of a provider of services as a condition of participation in the Medicare and Medicaid programs.
