which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Help America Vote Act of 2002 to allow individuals to vote in an election for Federal office during an early voting period which occurs prior to the date of the election, and for other purposes.</official-title></form><legis-body id="H02D4C6A1337244458463570A7A8C6980" style="OLC"><section id="H17438180D8714908ACDFE3733521848A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Access to Early Voting Act of 2021</short-title></quote>.</text></section><section id="HE3F733CE317E4877A81D8A8843E309D5"><enum>2.</enum><header>Early voting</header><subsection id="H77E928CEAB764EC0B9F36109ED4BD1FE" commented="no"><enum>(a)</enum><header>Requirements</header><text>Subtitle A of title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/21081">52 U.S.C. 21081</external-xref> et seq.) is amended—</text><paragraph id="HDCFCF4488EDC40FAB2DE71300221C3B8" commented="no"><enum>(1)</enum><text>by redesignating sections 304 and 305 as sections 305 and 306; and</text></paragraph><paragraph id="HD9F75D75170047D287FA51B2DEB54A4D" commented="no"><enum>(2)</enum><text>by inserting after section 303 the following new section:</text><quoted-block id="H3333B1A1A4E74BA2A0F603EB6D5158E3"><section id="H5614E014D0464DCAB279F2E0E9B1A8F8" commented="no"><enum>304.</enum><header>Early voting</header><subsection id="H8116E877087A4D9C80758A6CE42EC198" commented="no"><enum>(a)</enum><header>Requiring Voting Prior to Date of Election</header><paragraph id="H0C32D9F9C31B494ABBCA50BAD55E9803" commented="no"><enum>(1)</enum><header>In general</header><text>Each State shall allow individuals to vote in an election for Federal office during an early voting period which occurs prior to the date of the election, in the same manner as voting is allowed on such date.</text></paragraph><paragraph id="H37AEF82A880345A89ADDF30989FD88CF" commented="no"><enum>(2)</enum><header>Length of period</header><text>The early voting period required under this subsection with respect to an election shall consist of a period of consecutive days (including weekends) which begins on the 15th day before the date of the election (or, at the option of the State, on a day prior to the 15th day before the date of the election) and ends on the date of the election.</text></paragraph></subsection><subsection id="HC0A16E34F5D64397B2F553E20A9B361F" commented="no"><enum>(b)</enum><header>Minimum early voting requirements</header><text>Each polling place which allows voting during an early voting period under subsection (a) shall—</text><paragraph id="HBC607998346A429AB85D0251781BBF86" commented="no"><enum>(1)</enum><text>allow such voting for no less than 10 hours on each day; </text></paragraph><paragraph id="H6BCD907C2E6845AF9B04F79E0E513D67" commented="no"><enum>(2)</enum><text>have uniform hours each day for which such voting occurs; and</text></paragraph><paragraph id="HBCBD059C94EA4762888FCF61818EF009"><enum>(3)</enum><text display-inline="yes-display-inline">allow such voting to be held for some period of time prior to 9:00 a.m (local time) and some period of time after 5:00 p.m. (local time).</text></paragraph></subsection><subsection id="HBC1EB31FA3664B848C4ECA2AC9918379"><enum>(c)</enum><header>Location of polling places</header><paragraph id="HB57A8320F05246B9A0B13F7CDFDFE3E1"><enum>(1)</enum><header>Proximity to public transportation</header><text display-inline="yes-display-inline">To the greatest extent practicable, a State shall ensure that each polling place which allows voting during an early voting period under subsection (a) is located within walking distance of a stop on a public transportation route.</text></paragraph><paragraph id="H9D6B465AB3A64516BE4FCF206D2D7FAE"><enum>(2)</enum><header>Availability in rural areas</header><text display-inline="yes-display-inline">The State shall ensure that polling places which allow voting during an early voting period under subsection (a) will be located in rural areas of the State, and shall ensure that such polling places are located in communities which will provide the greatest opportunity for residents of rural areas to vote during the early voting period.</text></paragraph></subsection><subsection id="H7FF0F696A3914001B7D0D44C25A087BB" commented="no"><enum>(d)</enum><header>Standards</header><paragraph id="HA2BD3EBFF3F64EC7ABF86BB4173E1A7E" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall issue standards for the administration of voting prior to the day scheduled for a Federal election. Such standards shall include the nondiscriminatory geographic placement of polling places at which such voting occurs.</text></paragraph><paragraph id="HE67B69F584834CBA91263E5CC6073606" commented="no"><enum>(2)</enum><header>Deviation</header><text>The standards described in paragraph (1) shall permit States, upon providing adequate public notice, to deviate from any requirement in the case of unforeseen circumstances such as a natural disaster, terrorist attack, or a change in voter turnout.</text></paragraph></subsection><subsection id="HAE58AD184C28410287DACD1B0CFA6E67"><enum>(e)</enum><header>Ballot processing and scanning requirements</header><paragraph id="H6D9AA30DA608482DBABC683081B799FF"><enum>(1)</enum><header>In general</header><text>The State shall begin processing and scanning ballots cast during early voting for tabulation at least 14 days prior to the date of the election involved.</text></paragraph><paragraph id="H099BA413B8DF47E6991D772DF1B40F60"><enum>(2)</enum><header>Limitation</header><text>Nothing in this subsection shall be construed to permit a State to tabulate ballots in an election before the closing of the polls on the date of the election.</text></paragraph></subsection><subsection id="H4E60FE245F8C4FB8B92A8DA6CFF9A9E5" commented="no"><enum>(f)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section shall apply with respect to the regularly scheduled general election for Federal office held in November 2022 and each succeeding election for Federal office.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H62DC429DFF234BB1B088D76A58D72440"><enum>(b)</enum><header>Conforming amendment relating to issuance of voluntary guidance by Election Assistance Commission</header><text display-inline="yes-display-inline">Section 311(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21101">52 U.S.C. 21101(b)</external-xref>) is amended—</text><paragraph id="H9ADA355ECAB946DCA7EBBBB01D6727E4"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (2);</text></paragraph><paragraph id="HF1B7A3E7D1DC4685A16E1F4B474B48B3"><enum>(2)</enum><text>by striking the period at the end of paragraph (3) and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H89A9D31A39ED44A2B7B9A8C220C969DA"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HB861919708F54D73954B6B5C5ABE820E" style="OLC"><paragraph id="HBD21798B57D740FFA5C3081A108E20AE"><enum>(4)</enum><text display-inline="yes-display-inline">in the case of the recommendations with respect to section 304, June 30, 2022.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1C0F8C23BA24450489821A7F1AC5569B"><enum>(c)</enum><header>Conforming amendment relating to enforcement</header><text>Section 401 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/21111">52 U.S.C. 21111</external-xref>) is amended by striking <quote>and 303</quote> and inserting <quote>303, and 304</quote>. </text></subsection><subsection display-inline="no-display-inline" id="HB295F768F91C43CA9DFAFAC429595C0F"><enum>(d)</enum><header>Clerical amendment</header><text>The table of contents of such Act, is amended—</text><paragraph id="H70EA644BCF9B412F9A90A443DF17A660"><enum>(1)</enum><text>by redesignating the items relating to sections 304 and 305 as relating to sections 305 and 306; and</text></paragraph><paragraph id="H2BB4C1D84A5F4397822D5F1117385140"><enum>(2)</enum><text>by inserting after the item relating to section 303 the following new item:</text><quoted-block display-inline="no-display-inline" id="HBA988520FAF043B38ABBAD8C83DD0225" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 304. Early voting.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
