which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To secure the rights and dignity of marriage for Disabled Adult Children, and for other purposes.</official-title></form><legis-body id="H3E92E3444C104614A6CA6B9B445BF165" style="OLC"><section id="H60638A47A4E04E85AC369639FDFDDE08" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Marriage Equality for Disabled Adults Act</short-title></quote>.</text></section><section id="HD6538CFBA629418D8E0CE6EDF32A38DB"><enum>2.</enum><header>Elimination of marriage restriction for disabled adult children</header><subsection id="HC96B8D4CDA3A407C9F466087901D6837"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 202(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(d)</external-xref>) is amended—</text><paragraph id="H3E6EE4C136CE4159A383AC8382B0FAC0"><enum>(1)</enum><text>in clause (1)(B), by striking <quote>was unmarried and</quote>;</text></paragraph><paragraph id="HC387996AFBF140B291D36A9EB8E619F8"><enum>(2)</enum><text>by amending clause (1)(D) to read <quote>the month in which such child dies,</quote>; and</text></paragraph><paragraph id="HB30D250D63B14E74B8F42D1C84F0CC26"><enum>(3)</enum><text>by striking paragraph (5).</text></paragraph></subsection><subsection id="H20B7E10C2C724654A4DCCCB4380ECC0B"><enum>(b)</enum><header>Conforming amendment</header><text>Section 202(s)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/402">42 U.S.C. 402(s)(2)</external-xref>) is amended by striking <quote>(d)(5),</quote>. </text></subsection></section><section id="H101FAA0CF7CF4BCF8B1E71477832AF66"><enum>3.</enum><header>Modification of rules to determine marital relationships</header><subsection id="H6BF369A68F6B485C9C53C6E94BA62E5F"><enum>(a)</enum><header>In general</header><text>Section 1614(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382c">42 U.S.C. 1382c(d)</external-xref>) is amended by striking <quote>except that</quote> and all that follows through the end of the subsection and inserting <quote>except that if two individuals have been determined to be married under section 216(h)(1) for purposes of title II they shall be considered (from and after the date of such determination or the date of their application for benefits under this title, whichever is later) to be married for purposes of this title.</quote>.</text></subsection><subsection id="HE8DC96A64B2D46559CDC6B638DB85650"><enum>(b)</enum><header>Conforming amendments</header><text>Title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>) is amended—</text><paragraph id="HC5CC514DE3FB4E0994E760D79EA1858A"><enum>(1)</enum><text>in section 1611(e)(3)—</text><subparagraph id="H12A15B55252E4731A731DA9A084A6692"><enum>(A)</enum><text>by striking <quote>a husband and wife</quote> each place it appears and inserting <quote>two married individuals</quote>; and</text></subparagraph><subparagraph id="HB349A97485FE48788447FD72C2AF6C45"><enum>(B)</enum><text>by striking <quote>such husband and wife</quote> and inserting <quote>such married individuals</quote>;</text></subparagraph></paragraph><paragraph id="HB5D0F65529274B0CBD32E601D12FF83B"><enum>(2)</enum><text>in section 1614(b)—</text><subparagraph id="H596512E97DBA4DADA91E57DB7F6DBAB2"><enum>(A)</enum><text>in the first sentence, by striking <quote>the husband or wife of</quote> and inserting <quote>married to</quote>; and</text></subparagraph><subparagraph id="H0BFBB016FDFC4C0297ADD9BC4E2FEC42"><enum>(B)</enum><text>in the second sentence, by striking <quote>husband and wife</quote> and inserting <quote>married</quote>; and</text></subparagraph></paragraph><paragraph id="H807FC157A0584B7B806DECACA7AA5390"><enum>(3)</enum><text>in section 1631(b)(1)(A)(i), by striking <quote>husband or wife</quote> and inserting <quote>spouse</quote>.</text></paragraph></subsection></section><section id="HBBB607E5E67A4B2B88FFDA8EC5C41092"><enum>4.</enum><header>Income and resource deeming rules</header><text display-inline="no-display-inline">Section 1614(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382c">42 U.S.C. 1382c(f)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HDF5A141898A346A7A71B331712573632" style="OLC"><paragraph id="HE6F0A138DD8E48A6BED693B8629B045D"><enum>(5)</enum><text display-inline="yes-display-inline">Notwithstanding paragraph (1) of this subsection, for purposes of determining eligibility for, and the amount of, benefits for a married individual who is entitled to a child’s insurance benefit based on a disability under section 202(d), or for the spouse of such an individual, the income and resources of the one spouse is deemed to not include any income or resources of the other spouse.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HD756223ADBEF4370958657413FEEAD44"><enum>5.</enum><header>Retention of Medicaid for certain married individuals</header><text display-inline="no-display-inline">Section 1634 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1383">42 U.S.C. 1383(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H5F884E36FDA24582B4C4F566BECBB86E" display-inline="no-display-inline"><subsection id="HCC0CC23863C74DB5ACFA0C86AD82CA7E"><enum>(e)</enum><text>In the case of a State that exercises the option under section 1902(f), any individual who—</text><paragraph id="H3700AAEBB17248028FDFB434DA5625F3"><enum>(1)</enum><text display-inline="yes-display-inline">is a married individual who is entitled to a child’s insurance benefit based on a disability for any month under section 202(d) or the spouse of such an individual; and</text></paragraph><paragraph id="HBA9F18F68CAE4FBC8E42064CDE7B5F00"><enum>(2)</enum><text>would be eligible for medical assistance under the State plan approved under title XIX if the individual were unmarried,</text></paragraph><continuation-text continuation-text-level="subsection">shall remain eligible for medical assistance under such plan for so long as the individual satisfies the criteria described in paragraphs (1) and (2). </continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
