which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committees on <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, and <committee-name committee-id="HRU00">Rules</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Emergencies Act to provide that a national emergency declared by the President terminates 30 days after the declaration unless a joint resolution affirming such declaration is enacted into law, and for other purposes.</official-title></form><legis-body id="HB46EE3215814430BADB52FD2F65D56A4" style="OLC"><section id="HBFD373168F1841A4BC6670F1996BBD54" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Limiting Emergency Powers Act of 2021</short-title></quote>.</text></section><section id="H45A71EF0B2214A688D15CB66AF15B41D" section-type="subsequent-section"><enum>2.</enum><header>Limitation on duration of national emergency without congressional approval</header><subsection id="H8CA963DA4A0542139468A79F7620CFCA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 202 of the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1622">50 U.S.C. 1622</external-xref>) is amended—</text><paragraph id="HAFBE2D96B3EB4D18ADB5351B2408ACA7"><enum>(1)</enum><text>by striking subsection (a) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H5CB0A0ABFAE64C16B7B2F09AAB51F562" style="OLC"><subsection display-inline="no-display-inline" id="H6DA08B5FA28741F8A27EFAD54AADE23E"><enum>(a)</enum><text>Any national emergency declared by the President in accordance with this title shall terminate if—</text><paragraph id="H2D0990A14C204F76A43EE387E9777ECD"><enum>(1)</enum><text display-inline="yes-display-inline">there has not been enacted into law a joint resolution affirming the declaration of such national emergency before the date that is 30 days after the date on which such national emergency is declared;</text></paragraph><paragraph id="H5AF9C0D499FA41DDA58C84F72DAD54A3"><enum>(2)</enum><text>there is enacted into law a joint resolution terminating the emergency; or</text></paragraph><paragraph id="H194B3CE2B56D4E33B7D1B87EC52263E4"><enum>(3)</enum><text>the President issues a proclamation terminating the emergency.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H7137FF47134B40B795A59E2E48FC5E80"><enum>(2)</enum><text>by striking subsection (b) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H63E471C165A94EC5B85D5E562C41A277" style="OLC"><subsection id="H2B20F8ED49C940F2A97978BDA848AE66"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H43FBB82168424B49AFAB0D359DDE47EF"><enum>(1)</enum><text>The date on which a national emergency is terminated pursuant to subsection (a) shall be the first occurrence of any of the following dates:</text><subparagraph id="H9F1BEBB967774A7D9504365553D0B07C" indent="up1"><enum>(A)</enum><text>The last date of the period described in subsection (a)(1).</text></subparagraph><subparagraph id="H4FAE1372C6DA4F568721EE330A32597F" indent="up1"><enum>(B)</enum><text>The date specified in any joint resolution referred to in subsection (a)(2).</text></subparagraph><subparagraph id="H7B0D6CCD76494BECB06B477B53D82A55" indent="up1"><enum>(C)</enum><text>The date specified in a proclamation by the President terminating the emergency as provided in subsection (a)(3).</text></subparagraph></paragraph><paragraph id="H421219A921394CCA9AE81569C4FBFC1B" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Effective on the date of the termination of a national emergency under paragraph (1)—</text><subparagraph id="H4B43E71D433947618358B299545C7A9B"><enum>(A)</enum><text>any amounts reprogrammed or transferred under any provision of law with respect to the emergency that remain unobligated on that date shall be returned and made available for the purpose for which such amounts were appropriated;</text></subparagraph><subparagraph id="H6841FB45815046D9A4833F3308F2484D"><enum>(B)</enum><text>any contracts entered into under any provision of law for construction relating to the emergency shall be terminated unless construction commenced under the contract before that date; and</text></subparagraph><subparagraph id="HA466A7EA7FB343F6A3D19E1E05362525"><enum>(C)</enum><text>any powers or authorities exercised by reason of said emergency shall cease to be exercised after that date, except that a termination shall not affect—</text><clause id="H4A1A5AA2E0B3487CA06409F3CFDFC0FB"><enum>(i)</enum><text>any action taken or proceeding pending not finally concluded or determined on such date;</text></clause><clause id="H201E79FE2D9A42078F9B7FC855BA544C"><enum>(ii)</enum><text>any action or proceeding based on any act committed prior to such date; or</text></clause><clause id="H77634DAE61D34993AED1DF61B5A996B0"><enum>(iii)</enum><text>any rights or duties that matured or penalties that were incurred prior to such date.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H42B86191983D4E9BB914734AEEA48439"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="H9D6EF0E44FAE4EEE94A6D9A205FAF232"><enum>(A)</enum><text>in paragraph (1) by inserting <quote>or affirm</quote> after <quote>terminate</quote>; and</text></subparagraph><subparagraph id="HC0738E217F7D4B3AA1553B64122EC329"><enum>(B)</enum><text>in paragraph (5) by striking <quote>, subsection (b) of this section,</quote>; and</text></subparagraph></paragraph><paragraph id="HCD94AD998469470ABAE66E911230B1A1"><enum>(4)</enum><text>by striking subsection (d) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H465F92B1C6D5490AB1606CD0E8AEF92B" style="OLC"><subsection id="H91BF7437A4234A0799F23DAAF1F77B10"><enum>(d)</enum><text display-inline="yes-display-inline">A national emergency declared by the President under section 201, affirmed by a joint resolution under subsection (a)(1), and not otherwise previously terminated, shall terminate on the date that is 2 years after the President transmitted to Congress the proclamation declaring the emergency under section 201(a) or Congress affirms a previous renewal pursuant to this subsection, unless—</text><paragraph id="HFC29DE5B35FD43DC8F8A217570905A0E"><enum>(1)</enum><text>the President publishes in the Federal Register and transmits to Congress an Executive order renewing the emergency; and</text></paragraph><paragraph id="H5DE1363B0D0241798213E4B8D81E82E7"><enum>(2)</enum><text display-inline="yes-display-inline">there is enacted into law a joint resolution affirming the renewal of the declaration, according to the requirements of subsection (c), before the termination of the emergency or previous renewal of the emergency.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HFC30F800156B4BFBB9D8C2BE9A5E56DF"><enum>(b)</enum><header>Application to national emergencies previously declared</header><text display-inline="yes-display-inline">A national emergency declared under section 201 of the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1621">50 U.S.C. 1621</external-xref> et seq.) before the date of the enactment of this Act shall be unaffected by the amendments made by this Act except that such emergencies shall terminate on the date that is 2 years after such date of enactment unless the emergency is renewed under section 201(d) of the National Emergencies Act, as amended by this Act.</text></subsection></section></legis-body></bill>
