R. 6366</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220110">January 10, 2022</action-date><action-desc><sponsor name-id="G000559">Mr. Garamendi</sponsor> (for himself and <cosponsor name-id="T000460">Mr. Thompson of California</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To modify the boundary of the Berryessa Snow Mountain National Monument to include certain Federal land in Lake County, California, and for other purposes.</official-title></form><legis-body id="H2BF6A3E07517490DAC0DCA5D489AF1CF" style="OLC"><section id="H06EDE65289614A90954DEA742B2FFD55" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Berryessa Snow Mountain National Monument Expansion Act</short-title></quote>.</text></section><section id="HD957713463D44F14BF9A5F1CBAA26D02"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H412924118C3E4D26B2735E7B7C80CFF1" display-inline="no-display-inline"><enum>(1)</enum><header>Walker Ridge (Molok Luyuk) Addition</header><text display-inline="yes-display-inline">The term <term>Walker Ridge (Molok Luyuk) Addition</term> means the approximately 3,925 acres of Federal land administered by the Bureau of Land Management land in Lake County, California, and identified as <quote>Proposed Walker Ridge (Molok Luyuk) Addition</quote> on the Map and all lands and interest in lands therein and objects thereon.</text></paragraph><paragraph id="H04B9E13FE1C5453B9A7A9C764D71EEDB"><enum>(2)</enum><header>Map</header><text display-inline="yes-display-inline">The term <term>Map</term> means the map entitled <quote>Proposed Walker Ridge (Molok Luyuk) Addition Berryessa Snow Mountain National Monument</quote> and dated October 26, 2021.</text></paragraph><paragraph id="H9F4325CA94F148589D99E52C60BBD739"><enum>(3)</enum><header>Molok Luyuk</header><text display-inline="yes-display-inline">The term <term>Molok Luyuk</term> means Condor Ridge (in the Patwin language).</text></paragraph><paragraph id="HAB6C71257BC8405A89B6C7458B675D90"><enum>(4)</enum><header>National monument</header><text display-inline="yes-display-inline">The term <term>National Monument</term> means the Berryessa Snow Mountain National Monument established by Presidential Proclamation 9298 of July 10, 2015 (80 Fed. Reg. 41975 (July 15, 2015)), and all lands and interest in lands therein and all objects thereon identified by such Presidential Proclamation.</text></paragraph></section><section id="HECC2FF92CDC4479FB86BFA0E60F5E33D"><enum>3.</enum><header>National monument expansion</header><subsection id="H6A2934F8F2B349D9851AA3C5C1F4E053"><enum>(a)</enum><header>Boundary modification</header><text display-inline="yes-display-inline">The boundary of the National Monument is modified to include the Walker Ridge (Molok Luyuk) Addition.</text></subsection><subsection id="H9FE5FB52272E40DC9A942D45537117EB"><enum>(b)</enum><header>Map</header><paragraph id="H5A8601439C034F20ABD18E0BFC1835B0"><enum>(1)</enum><header>Corrections</header><text display-inline="yes-display-inline">The Secretary of the Interior may make clerical and typographical corrections to the Map. Such corrections shall have the same force and effect as if the revised Map were included as part of this Act.</text></paragraph><paragraph id="HE26147F0E9464860A5C2B0D0706FAC86"><enum>(2)</enum><header>Public availability</header><text>The Map, and any subsequent revised Map, shall be publicly available on the website of the Bureau of Land Management.</text></paragraph></subsection><subsection id="H9E6322D8F0684134A2BE3956C6203FAB"><enum>(c)</enum><header>Administration</header><text display-inline="yes-display-inline">Subject to valid existing rights, the Secretary of the Interior shall administer the Walker Ridge (Molok Luyuk) Addition—</text><paragraph id="H38170931A9D642D48A8B72A73343C0DA"><enum>(1)</enum><text>as part of the National Monument;</text></paragraph><paragraph id="HFC1EBEDF4CC447E49017866340A17D54"><enum>(2)</enum><text display-inline="yes-display-inline">in accordance with Presidential Proclamation 9298 of July 10, 2015 (80 Fed. Reg. 41975 (July 15, 2015)); and</text></paragraph><paragraph id="HC74B5B69A1FD4375B27BB6097EF6BC0C"><enum>(3)</enum><text>in accordance with applicable laws (including regulations).</text></paragraph></subsection></section><section id="H41F1CC5A79F44129B3A420DC5A6CA92F"><enum>4.</enum><header>Management Plan</header><subsection id="H2449747D000A43599DDDD435626C9378"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of the Interior and the Secretary of Agriculture shall jointly develop a comprehensive management plan for the National Monument in accordance with, and in a manner that fulfills the purposes specified in, Presidential Proclamation 9298 of July 10, 2015 (80 Fed. Reg. 41975 (July 15, 2015)).</text></subsection><subsection id="HEB204B6EE8754355B7D5408205061F00" commented="no"><enum>(b)</enum><header>Tribal Consultation</header><text display-inline="yes-display-inline">The Secretary of the Interior and the Secretary of Agriculture shall consult with affected federally recognized Indian Tribes—</text><paragraph id="HAE40D9EE53EC49E1AC8F01F4BEC4528B" commented="no"><enum>(1)</enum><text>in the development of the management plan; and</text></paragraph><paragraph id="HDB7368CB31F643438C4C73CC477F767C"><enum>(2)</enum><text>to inform subsequent management decisions regarding the National Monument.</text></paragraph></subsection><subsection id="HC017C9C4AF814A46985E49E98815A46A" commented="no"><enum>(c)</enum><header>Continued engagement with Indian Tribes</header><text display-inline="yes-display-inline">The management plan shall set forth parameters for continued meaningful engagement with affected federally recognized Indian Tribes in implementation of the management plan.</text></subsection></section><section id="HCAF1A54A14F54FAE8EE744907DAB80CF"><enum>5.</enum><header>Agreements and partnerships</header><subsection id="HEA05CF36BE5349D9B7AA27220AD8C3FE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">To the greatest extent practicable and in accordance with applicable laws, the Secretary concerned shall enter into agreements, contracts, and other similarly cooperative and collaborative partnerships if requested by an affected federally recognized Indian Tribe regarding management of the National Monument pursuant to relevant Federal authority, including—</text><paragraph id="H69ACE1B60FF9444F91E87558DA30A7C0"><enum>(1)</enum><text display-inline="yes-display-inline">the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301 et seq.</external-xref>);</text></paragraph><paragraph id="H324AAD4213F447E19EA38D593DB621EC"><enum>(2)</enum><text>the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text></paragraph><paragraph id="HE4487EF0A9D5476A9374E194091641E9"><enum>(3)</enum><text>the Tribal Self-Governance Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5361">25 U.S.C. 5361 et seq.</external-xref>);</text></paragraph><paragraph id="H7D8DF21C7FF14586B7F6EED171431794"><enum>(4)</enum><text>Executive Order 13175 (dated November 6, 2000);</text></paragraph><paragraph id="HF028B026B81446A78ABCD7ED2CE14778"><enum>(5)</enum><text>the Tribal Forest Protection Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/25/3115a">25 U.S.C. 3115a et seq.</external-xref>);</text></paragraph><paragraph id="H5E062B6903734482AF2E55B6BD16F6C0"><enum>(6)</enum><text>section 8206 (good neighbor authority) of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/16/2113a">16 U.S.C. 2113a</external-xref>);</text></paragraph><paragraph id="H1FA326EAFA1F4CA0A674B7E7C1461830"><enum>(7)</enum><text>Secretarial Order 3342, dated October 21, 2016; or</text></paragraph><paragraph id="H467ABBBB80084405BA6D7B49095413C8"><enum>(8)</enum><text>Joint Secretarial Order 3403 (dated November 15, 2021).</text></paragraph></subsection><subsection id="HFDC58F31C3F8434BA6175AE3E7B5BD03"><enum>(b)</enum><header>Definition of secretary concerned</header><text>In this section, the term <term>Secretary concerned</term> means, as applicable—</text><paragraph id="HB990B2DF55FE45BEA7629866652D5146"><enum>(1)</enum><text>the Secretary of the Interior, acting through the Director of the Bureau of Land Management; or</text></paragraph><paragraph id="H8FB55769BF8648D483EF5D19BD111F4B"><enum>(2)</enum><text>the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph></subsection></section><section id="H6ACCD5375E084CEDA996A228A8A58272"><enum>6.</enum><header>Renaming of Walker Ridge in Lake and Colusa Counties, California</header><subsection id="H3CBA9AFE86D4444891A79347C0D9B81A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The parcel of Federal land administered by the Bureau of Land Management located in Lake and Colusa Counties in the State of California and commonly referred to as <quote>Walker Ridge</quote> before the date of enactment of this Act shall be known and designated as <quote>Condor Ridge (Molok Luyuk)</quote>.</text></subsection><subsection id="H7944696171274CFDAF32B288B984A87D"><enum>(b)</enum><header>References</header><text>Any reference in a law, map, regulation, document, paper, or other record of the United States to the parcel of Federal land described in subsection (a) shall be deemed to be a reference to <quote>Condor Ridge (Molok Luyuk)</quote>.</text></subsection><subsection id="H07DD38FC875843FE91D80DD2FE6640F7"><enum>(c)</enum><header>Map and legal description</header><paragraph id="H10E0C64401E440FDADCADF381B721C9E"><enum>(1)</enum><header>Preparation</header><subparagraph id="H148AFF2C59394C0D96712DC5DB86B9F8"><enum>(A)</enum><header>Initial map</header><text>The Board on Geographic Names (established by section 2 of the Act of July 25, 1947; <external-xref legal-doc="usc" parsable-cite="usc/43/364a">43 U.S.C. 364a</external-xref>) shall prepare a map and legal description of the parcel of Federal land designated in subsection (a) as Condor Ridge (Molok Luyuk).</text></subparagraph><subparagraph id="H081B5BA5744A48BB8861D0327B461E98"><enum>(B)</enum><header>Corrections</header><text display-inline="yes-display-inline">The Board on Geographic Names and the Director of the Bureau of Land Management may make clerical and typographical corrections to the map and legal description prepared under this subsection.</text></subparagraph></paragraph><paragraph id="H79F402549A4342D49E9B0C8CC0A3997C"><enum>(2)</enum><header>Consultation</header><text>In preparing the map and legal description under paragraph (1)(A), the Board on Geographic Names shall consult with—</text><subparagraph id="H709D638B839946AF999502798CD50CFB"><enum>(A)</enum><text>the Director of the Bureau of Land Management; and</text></subparagraph><subparagraph id="H9988528408D04595BC3D90D920F50952"><enum>(B)</enum><text>affected federally recognized Indian Tribes.</text></subparagraph></paragraph><paragraph id="H72B0F89194BB44C4A96D588D465DE503"><enum>(3)</enum><header>Public availability</header><text>The map and legal description and any subsequent revised map or legal description prepared pursuant to paragraph (1) shall be publicly available on the website of the Board on Geographic Names, the Bureau of Land Management, or both.</text></paragraph><paragraph id="H253FAF3D872B4B85A72DE7F68046E97A"><enum>(4)</enum><header>Legal effect</header><text>The map and legal description, and any subsequent revised map or legal description prepared pursuant to paragraph (1) shall have the same force and effect as if included in this Act.</text></paragraph></subsection></section></legis-body></bill>
