R. 6358</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220106">January 6, 2022</action-date><action-desc><sponsor name-id="C001111">Mr. Crist</sponsor> (for himself and <cosponsor name-id="M000194">Ms. Mace</cosponsor>) introduced the following bill</action-desc></action><action display="yes"><action-date date="20220110">January 10, 2022</action-date><action-desc> Referred to the Committee on Ways and Means</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title II of the Social Security Act to require the Commissioner of Social Security to enter into agreements with States to share data related to individuals subject to guardianship, and for other purposes.</official-title></form><legis-body id="HFF179CC27E3D49B8B7684D5C92E55289" style="OLC"><section id="HAF64A6D4F31F4D7AB7EB2D0B4E1ACF3F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Senior Guardianship Social Security Protection Act of 2022</short-title></quote>.</text></section><section id="H480E129D5805487196A6ED065AB4FEB9"><enum>2.</enum><header>Information sharing related to State guardianship status</header><subsection id="H9710B8351B994E139AE30832D76B4949"><enum>(a)</enum><header>In general</header><text>Section 205(j)(11) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/405">42 U.S.C. 405(j)(11)</external-xref>) is amended—</text><paragraph id="H4FBE722099F34D0D99ABE27069E9F6A4"><enum>(1)</enum><text>by redesignating subparagraph (B) as subparagraph (C) and by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" id="H006467412DB64B9595FFF848F39C026A" display-inline="no-display-inline"><subparagraph id="H026B500E8FEF4530882F1C9898596E05" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">The Commissioner of Social Security shall—</text><clause id="HAC7917713C064587ACE3DBCC55963F69"><enum>(i)</enum><text display-inline="yes-display-inline">enter into agreements with each State for the purpose of sharing and matching data, on an automated monthly basis, in the system of records of the Social Security Administration with the system of records of each State to identify individuals subject to guardianship in the State who, with respect to such month, are entitled to benefits under this title that are certified for payment to a representative payee; and</text></clause><clause id="H0161D5C19D9D4FEB85ABA2E57EBAFBD1"><enum>(ii)</enum><text>in any case in which the guardianship arrangement for such an individual has changed in such month, redetermine the appropriate representative payee for such individual.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H1E44DFA8455B4546885DBD93BF7A27C0"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (C) (as redesignated by paragraph (1)), by amending clause (i) to read as follows—</text><quoted-block style="OLC" id="H50D2E2623170410C861FFCA79E466DDB" display-inline="no-display-inline"><clause id="HA7BE9A2EB51141878EE30BBBC7DC008E" indent="up2"><enum>(i)</enum><text display-inline="yes-display-inline">the term <quote>State</quote>—</text><subclause id="H6B9D99F1944A4BC6BD846888B9DBB6F9"><enum>(I)</enum><text display-inline="yes-display-inline">when used in subparagraph (A), has the meaning given such term for purposes of part E of title IV; and</text></subclause><subclause id="H36A22F4AB0434194A9696732C236AD60"><enum>(II)</enum><text>when used in subparagraph (B), has the meaning given such term for purposes of subtitle B of title XX;</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H151B64F81715435CABFC17926930FDA3"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and every 6 months thereafter, the Administrator of the Social Security Administration shall submit to Congress a report containing the number of social security payments that are being diverted to non-family members as representative payees, broken down by State.</text></subsection><subsection id="H7DA76DB103A748929CFC28BCB6AD3F88"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply with respect to months beginning on or after the date that is 90 days after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
