which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Administrator of the Small Business Administration to establish a pilot procurement program for military spouses, and for other purposes.</official-title></form><legis-body id="H86DC24A09BC441EE83CC15E2C7B65F75" style="OLC"><section id="H7753D04C0E664FBDA823B657C6C8C411" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Spouse Entrepreneurs Act of 2021</short-title></quote>.</text></section><section id="HB67FB792A6C44924BD1E71891BA0B48B" section-type="subsequent-section" commented="no"><enum>2.</enum><header>Pilot procurement program for military spouses</header><subsection id="HEC59E589964A4B458C5E8811741D4138"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator of the Small Business Administration shall carry out a pilot program to establish a procurement program for military spouses.</text></subsection><subsection id="H32575D1E75764D47BC3FA9B5B23A7918"><enum>(b)</enum><header>Authority To restrict competition</header><text>In accordance with this subsection, a contracting officer may restrict competition for any contract for the procurement of goods or services by the Federal Government to small business concerns owned and controlled by military spouses, if—</text><paragraph id="HF3BB609B70C746839EB41EC19776EE1E" commented="no"><enum>(1)</enum><text>each of the concerns is not less than 51 percent owned by one or more military spouses;</text></paragraph><paragraph id="H7E1ABF4F9ECA4399951A89C8F52B75EA"><enum>(2)</enum><text>the contracting officer has a reasonable expectation that two or more small business concerns owned and controlled by military spouses will submit offers for the contract;</text></paragraph><paragraph id="HBB45CBAD937141598E10B08E0DE3C546"><enum>(3)</enum><text>in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price; and</text></paragraph><paragraph id="H8750E95C34FF4A30A6DD573204F1133A"><enum>(4)</enum><text>each of the concerns is certified by the Administrator or a third party certifying entity as a small business concern owned and controlled by military spouses.</text></paragraph></subsection><subsection id="HBF832FB375C540978CA0F5F2890AB62F"><enum>(c)</enum><header>Authority for sole source contracts</header><text>A contracting officer may award a sole source contract under this subsection to any small business concern owned and controlled by military spouses described in subsection (b) if—</text><paragraph id="H2139F8162DFE48C287D40EA3B070BAE1"><enum>(1)</enum><text display-inline="yes-display-inline">such concern is determined to be a responsible contractor with respect to performance of the contract opportunity and the contracting officer does not have a reasonable expectation that 2 or more small business concerns owned and controlled by military spouses will submit offers for the contract; and</text></paragraph><paragraph id="H15D3E0A9B34141B98276E6895389B738"><enum>(2)</enum><text>in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price.</text></paragraph></subsection><subsection id="H2F8EB8E995374525ACF25E3CEBFAB7AE"><enum>(d)</enum><header>Governmentwide goal</header><text display-inline="yes-display-inline">The Administrator shall establish a Governmentwide goal for participation by small business concerns owned and controlled by military spouses at not less than 5 percent of the total value of all prime contract and subcontract awards for each year of the pilot program.</text></subsection><subsection id="H9573DEF15074447AB9354E5DF458742D"><enum>(e)</enum><header>Report</header><text>Not later than 1 year after the termination date described in subsection (f), the Administrator shall submit to Congress a report on the pilot program established under this section, including—</text><paragraph id="H0202C4AB4AFF4D4DA1592BE55E5AF952"><enum>(1)</enum><text display-inline="yes-display-inline">the number of small business concerns owned and controlled by military spouses that participated in the pilot program;</text></paragraph><paragraph id="HB694219D5DE543C7A2E1F306EE7D6375"><enum>(2)</enum><text display-inline="yes-display-inline">data on the effectiveness of the pilot program in encouraging contracting with small business concerns owned and controlled by military spouses;</text></paragraph><paragraph id="HF7EDCAE7EA2A4FF6A423E3D04369DE85"><enum>(3)</enum><text display-inline="yes-display-inline">information on whether the goal described in subsection (e) was met;</text></paragraph><paragraph id="H4E9A4985DBE44758AE445A471199E4BD"><enum>(4)</enum><text>data on oversight of the pilot program; and</text></paragraph><paragraph id="HC49AFD20EFD24F5984DCB122306A9A91"><enum>(5)</enum><text>recommendations for—</text><subparagraph id="H36927C8DB3BD4141A414C98D86BA9B85"><enum>(A)</enum><text>any improvements to the pilot program; and</text></subparagraph><subparagraph id="HFC4381D06E394F2194C41380B6F4FB66"><enum>(B)</enum><text>whether to make the pilot program permanent.</text></subparagraph></paragraph></subsection><subsection id="H0920652329444E188D44116B66DB8067"><enum>(f)</enum><header>Termination</header><text>The pilot program established under this section shall terminate not later than 5 years after the date of the enactment of this Act.</text></subsection><subsection id="H122D43F8F84041669E3415C2C129E431"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HD9E484CC7E144A7BB9DEA1FCC37352BA"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Small Business Administration.</text></paragraph><paragraph id="H328E46FC6A1542348939D185BFCE987D"><enum>(2)</enum><header>Contracting officer</header><text>The term <term>contracting officer</term> has the meaning given such term in section 27(f)(5) of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/423">41 U.S.C. 423(f)(5)</external-xref>).</text></paragraph><paragraph id="HD2C0A3EAC4014CC59704E05113A71CE7" commented="no"><enum>(3)</enum><header>Military spouse</header><text display-inline="yes-display-inline">The term <term>military spouse</term> means a current or former spouse of—</text><subparagraph id="HE27E8908E10E437B92DDDCA1CDFC5F17" commented="no"><enum>(A)</enum><text>a veteran; or</text></subparagraph><subparagraph id="H0F0FC2CE558547F4B35735773B21CA45" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a member of the Armed Forces (as those terms are defined in section 101 of title 10, United States Code).</text></subparagraph></paragraph><paragraph id="HC9087180DFD440E8831BF91F8D54C719" commented="no"><enum>(4)</enum><header>Small business concern owned and controlled by military spouses</header><text display-inline="yes-display-inline">The term <term>small business concern owned and controlled by military spouses</term> means a small business concern—</text><subparagraph id="H1B76022E72CB4C1C80EE448F5EE65FE1" commented="no"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HECE61E1986A64335AA8C2FECBBBBC451"><enum>(i)</enum><text>not less than 51 percent of which is owned by one or more military spouses or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more military spouses; and</text></clause><clause id="H40E0525AA8234FFBB8C29E5CEEEBF046" indent="up1"><enum>(ii)</enum><text>the management and daily business operations of which are controlled by one or more military spouses; or</text></clause></subparagraph><subparagraph id="H3C66FB6A39E24E41815008E5A253E270" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">that is 50 percent owned by a veteran and 50 percent owned by a military spouse of such veteran.</text></subparagraph></paragraph><paragraph id="HD227C3F19BC24B97B395D98D8126CAFE"><enum>(5)</enum><header>Veteran</header><text>The term <term>veteran</term> has the meaning given in section 101 of title 38, United States Code.</text></paragraph></subsection></section></legis-body></bill>
