Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to expand refundability and increase simplification of the research credit for certain small businesses.</official-title></form><legis-body id="H2C1E0B6C5FB04604AC5E800F134AA5EC" style="OLC"><section id="H001203B504F24849B98C7C3CC6FEA683" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Research and Development Tax Credit Expansion Act of 2021</short-title></quote>.</text></section><section id="HD508A5CC53BB408691792C24492AB708" section-type="subsequent-section"><enum>2.</enum><header>Expansion of refundable research credit for new and small businesses</header><subsection id="HCD01635AEB1144388A14C29F78E18A96"><enum>(a)</enum><header>Doubling cap on refundable credit</header><paragraph id="H3077328E494F454B8EF83FE5ACF88CC8"><enum>(1)</enum><header>In general</header><text>Clause (i) of <external-xref legal-doc="usc" parsable-cite="usc/26/41">section 41(h)(4)(B)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>$250,000</quote> and inserting <quote>$500,000</quote>.</text></paragraph><paragraph id="H44DD680F2321434AB84B35C3528AF019"><enum>(2)</enum><header>Adjustment for inflation</header><text>Paragraph (4) of section 41(h) of such Code is amended—</text><subparagraph id="H47642143A2B64339A58535459ACFF7F7"><enum>(A)</enum><text>by redesignating subparagraph (C) as subparagraph (D),</text></subparagraph><subparagraph id="HBACAAB3F75AA4BB3B91420ED04E9550E"><enum>(B)</enum><text>by redesignating clause (ii) of subparagraph (B) as subparagraph (C), and by moving such subparagraph 2 ems to the left,</text></subparagraph><subparagraph id="H11CDEF25049B44A29E789F67459B39D5"><enum>(C)</enum><text>by striking <quote><header-in-text level="subparagraph" style="OLC">Limitations</header-in-text></quote> in the heading of subparagraph (B) and inserting <quote><header-in-text level="subparagraph" style="OLC">Limitation on amount of election</header-in-text></quote>,</text></subparagraph><subparagraph id="H5E5E0FD52DFB483B9D7E62FF059A9190"><enum>(D)</enum><text>by striking <quote><header-in-text level="clause" style="OLC">Amount</header-in-text></quote> in the heading of clause (i) of subparagraph (B) and inserting <quote><header-in-text level="clause" style="OLC">In general</header-in-text></quote>, and</text></subparagraph><subparagraph id="HE708ECBCD74E4B03AA9752D5C0C63B1F"><enum>(E)</enum><text>by adding at the end of subparagraph (B), as amended by the preceding subparagraphs of this paragraph, the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD0631762A8CB43C6A4AFBCA9869C5231"><clause id="H8D638C1338DE417B93FCB177536D87C6"><enum>(ii)</enum><header>Adjustment for inflation</header><text>In the case of a taxable year beginning after 2022, the $500,000 amount in clause (i) shall be increased by an amount equal to—</text><subclause id="H45724F935EEB4563B1778CFA906C775E"><enum>(I)</enum><text>such dollar amount, multiplied by</text></subclause><subclause id="H835FECF7AA554426A444FBC98A45D3DF"><enum>(II)</enum><text>the cost-of-living adjustment determined under section 1(f)(3) for the calendar year in which the taxable year begins, determined by substituting <quote>2021</quote> for <quote>2016</quote> in subparagraph (A)(ii) thereof.</text></subclause><continuation-text continuation-text-level="clause">If any increase under the preceding sentence is not a multiple of $100, such increase shall be rounded to the nearest multiple of $100.</continuation-text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H917146E461294039BD9222B33202FA60"><enum>(3)</enum><header>Conforming amendment</header><text>Clause (ii) of section 41(h)(5)(B) of such Code is amended by striking <quote>the $250,000 amount</quote> and inserting <quote>the amount in effect</quote>.</text></paragraph></subsection><subsection id="HA396289DF7A0446080D67E69BDCAAB57"><enum>(b)</enum><header>Credit refundable against Medicare and unemployment taxes</header><paragraph id="H60884466178D4AD597109FD26572F9F3"><enum>(1)</enum><header>In general</header><text>Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/26/3111">section 3111(f)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>subsection (a)</quote> and inserting <quote>subsections (a) and (b) and section 3301</quote>.</text></paragraph><paragraph id="H8EDDF5FBC7684E479D3B70A2D1B868AA"><enum>(2)</enum><header>Conforming amendments</header><subparagraph id="H388656B5EBD047BD87A173A1B49BD5B1"><enum>(A)</enum><text>Paragraph (2) of section 3111(f) of such Code is amended by striking <quote>the tax imposed by subsection (a)</quote> and inserting <quote>the sum of the taxes imposed by subsection (a), subsection (b), and section 3301</quote>.</text></subparagraph><subparagraph id="H8A4328A0D7AF494BBA1C6989441E451D"><enum>(B)</enum><text>Section 3302 of such Code is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HADF1F5A053824A7FA7BE06BB457A45D5"><subsection id="HC096CDC07DEF497BB77D96B3A01895CA"><enum>(i)</enum><header>Credit for research expenditures of qualified small businesses</header><text>Any portion of the credit under section 3111(f) which is credited under such section to the tax under section 3301 shall be treated as a credit under this section. Subsection (c) shall not apply to any such credit.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H803F11862D34482DBB5A3CE992F864F4"><enum>(c)</enum><header>Doubling eligibility threshold</header><text>Subclause (I) of <external-xref legal-doc="usc" parsable-cite="usc/26/41">section 41(h)(3)(A)(i)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>$5,000,000</quote> and inserting <quote>$10,000,000</quote>.</text></subsection><subsection id="H0408DA7898334157BDED07CBDE6019DF"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2021.</text></subsection></section><section id="H0913DB6DB3FD46DF933D519F67381017"><enum>3.</enum><header>Modifications to alternative simplified credit for new and small businesses</header><subsection id="H8876B05124CD44C39D21D1C16BA28D0D"><enum>(a)</enum><header>In general</header><text>Paragraph (4) of <external-xref legal-doc="usc" parsable-cite="usc/26/41">section 41(c)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4A43FC3C76D046D4BC59369E6FF6A03C"><subparagraph id="H21744BCB2DC04E279A07B215012E644C"><enum>(D)</enum><header>Special rules for qualified small businesses</header><text>In the case of a qualified small business (as defined in subsection (h)(3))—</text><clause id="H456649F528F94D3C982BB9ADA0BEDAE1"><enum>(i)</enum><header>Credit rate</header><text>Subparagraph (A) shall be applied by substituting <quote>20 percent</quote> for <quote>14 percent</quote>.</text></clause><clause id="H4FFDD75D811342F790245BA4C34A78FA"><enum>(ii)</enum><header>Special rule for 1st year of qualified research expenses</header><text>If the taxpayer has no qualified research expenses in any taxable year preceding the taxable year for which the credit is being determined, subparagraph (B)(ii) shall be applied by substituting <quote>20 percent</quote> for <quote>6 percent</quote>.</text></clause><clause id="H5D7BB498B29C43F4BDEB48D2D9064589"><enum>(iii)</enum><header>Special rule for other years</header><text>If the taxpayer is not described in clause (ii) for the taxable year, and subparagraph (B) applies to such taxpayer for such year, at the election of the taxpayer—</text><subclause id="H4091766280DD43F195ACAC581E32547A"><enum>(I)</enum><text>subparagraph (B)(ii) shall be applied by substituting <quote>10 percent</quote> for <quote>6 percent</quote>, or</text></subclause><subclause id="HA75589549B4E4829B83E37908A150D5E"><enum>(II)</enum><text>subparagraph (B) shall not apply, and the average under subparagraph (A) shall be determined by disregarding any taxable year in the 3-year period described in such subparagraph in which there were no qualified research expenses.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H121D3BC54D2C4FB79E91C77E9E11A670"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to taxable years beginning after December 31, 2021.</text></subsection></section></legis-body></bill>
