R. 632</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210128">January 28, 2021</action-date><action-desc><sponsor name-id="Y000033">Mr. Young</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide limitations on maritime liens on fishing permits, and for other purposes.</official-title></form><legis-body id="HDAFEBDBA71504454B2C3509F846DD86D" style="OLC"><section id="HE0FF7AF5244C420189150FA38E9C333C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Maritime Lien Reform Act of 2021</short-title></quote>.</text></section><section id="H6558ECA5EDDA4382991C6EE33E1B8A5F"><enum>2.</enum><header>Limitation on maritime liens on fishing permit and permit description</header><subsection id="H9D247849133F49BFB0B5B7C842C3E6D0"><enum>(a)</enum><header>In general</header><text>Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/313">chapter 313</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H98067C77C77E4F9BB13BD80E03FD7984" style="USC"><section id="HB9A3005F0CF949819AFE9B97DA22734B"><enum>31310.</enum><header>Limitation on maritime liens on fishing permit and permit description</header><subsection id="HAF8E699FEF92430DBB5089E842CCCCBB"><enum>(a)</enum><header>In general</header><text>This chapter—</text><paragraph id="H1783094B08594FABABE1043847D3444D"><enum>(1)</enum><text>does not establish a maritime lien on a permit that—</text><subparagraph id="HACAE4B84413E40D2B7308A249D0636DD"><enum>(A)</enum><text>authorizes a person or use of a vessel to engage in fishing; and</text></subparagraph><subparagraph id="H0FE47096CC8C4C77B198278683FD0D9D"><enum>(B)</enum><text>is issued under State or Federal law; and</text></subparagraph></paragraph><paragraph id="H8B3959A0E0C84955AFBA8610F99A958C"><enum>(2)</enum><text>does not authorize any civil action to enforce a maritime lien on such a permit.</text></paragraph></subsection><subsection commented="no" id="HB299FAF7B4FB4D0295ECDD8FD67238AE"><enum>(b)</enum><header>Treatment of fishing permits</header><text>A fishing permit—</text><paragraph commented="no" id="H2CACCDA46C4B40C78E2D313499A796B8"><enum>(1)</enum><text>is governed solely by the State or Federal law under which it was issued; and</text></paragraph><paragraph commented="no" id="HD1F501D504314F5A98A0E452D0CD6D94"><enum>(2)</enum><text>is not included in the whole of a vessel or as an appurtenance or intangible of a vessel for any purpose.</text></paragraph></subsection><subsection id="H1E2C7D6A253A41E496ABF10E215DD92B"><enum>(c)</enum><header>Limitation on statutory construction</header><text>Nothing in subsections (a) and (b) shall be construed as imposing any limitation upon the authority of the Secretary of Commerce to modify, suspend, revoke, or sanction any Federal fishery permit issued by the Secretary of Commerce or to bring a civil action to enforce such modification, suspension, revocation, or sanction.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD39CADEEC8A74FEF8C4CFE71D220B8DE"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 31309 the following:</text><quoted-block display-inline="no-display-inline" id="H3402A378FC6F4FFF8A788C824BE25FCE" style="OLC"><toc><toc-entry bold="off" level="section">31310.
