which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name>, and in addition to the Committee on <committee-name committee-id="HAP00">Appropriations</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the head of each Federal agency, within 100 calendar days, to complete all pending Freedom of Information Act requests related to a drug or medical device to prevent, diagnose, mitigate, or treat COVID–19, gain-of-function or potential pandemic pathogen research, or a policy, rule, or standard requiring COVID–19 vaccination of individuals, and for other purposes.</official-title></form><legis-body id="H5F2465FCA76045F6976475980B62663D" style="OLC"><section id="HFC4F099F97A54951909FEEDAAC4AE99F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Answer COVID FOIAs Now Act</short-title></quote>.</text></section><section id="H437A2F975C1B4584AD0C906FF4A146D7"><enum>2.</enum><header>Completion of FOIA requests relating to drugs and medical devices to prevent, diagnose, mitigate, or treat COVID–19</header><subsection id="H0336470D79EE492AA689BA929B60FB5A"><enum>(a)</enum><header>In general</header><paragraph id="H5B2998BFE42D40AA94B14A9B496A061D"><enum>(1)</enum><header>Completion of requests</header><text>Notwithstanding any other provision of law, the head of each Federal agency shall, not later than 100 calendar days after the date of enactment of this Act, complete all requests for records made under section 552(a) of title 5, United States Code, that are—</text><subparagraph id="HD23F13BC346C42408F50739883C12860"><enum>(A)</enum><text>made to the Federal agency;</text></subparagraph><subparagraph id="HB086415BE7104F2DA649A48691B2C479"><enum>(B)</enum><text>pending as of the date of enactment of this Act; and</text></subparagraph><subparagraph id="HAA3AF4F896A74B59AAAFB488C84687A7"><enum>(C)</enum><text display-inline="yes-display-inline">related to—</text><clause id="H9534F3863473450F96D50A3CF5A26615"><enum>(i)</enum><text>a drug or medical device to prevent, diagnose, mitigate, or treat COVID–19;</text></clause><clause id="HCB32E252A786481A8C67900D2634F9F7"><enum>(ii)</enum><text>gain-of-function research or potential pandemic pathogen research; or</text></clause><clause id="H729B7EF0DC5D49C795A4780AF081B31E"><enum>(iii)</enum><text>a policy, rule, or standard requiring COVID–19 vaccination of individuals.</text></clause></subparagraph></paragraph><paragraph id="H016B0448A7DC4313AB0BC29C4868A5FE"><enum>(2)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to require the disclosure of information that is exempt from disclosure under section 552(b) of title 5, United States Code.</text></paragraph></subsection><subsection id="HCF6CA2DD89E4429BA72C01B3710F64E8"><enum>(b)</enum><header>List of pending requests</header><text>The head of a Federal agency shall publicly and electronically make available a list of all requests described in subsection (a)(1).</text></subsection><subsection id="H1D5B67A2B5364F669FCD975D565379D9"><enum>(c)</enum><header>Reports</header><paragraph id="H01CD0359990C457AB2AC62A0EB4B74EF"><enum>(1)</enum><header>Initial report</header><text>Not later than 7 business days after the date of enactment of this Act, the head of each Federal agency shall provide the list required by subsection (b) to—</text><subparagraph id="H4C35EA119C18484AAC3D8B083EFA6A17"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on the Judiciary, the Committee on Energy and Commerce, and the Committee on Oversight and Reform of the House of Representatives;</text></subparagraph><subparagraph id="HAC6744896C3744E8AC244A99659856D2"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on the Judiciary, the Committee on Health, Education, Labor, and Pensions, and the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></subparagraph><subparagraph id="H067C97A5158741A484D5E9B01B909047"><enum>(C)</enum><text>the Secretary of the Treasury.</text></subparagraph></paragraph><paragraph id="HEE04AC467C3B4BEE8EB9A53AE7C0CC78"><enum>(2)</enum><header>Subsequent report</header><text display-inline="yes-display-inline">Not later than 100 calendar days after the date of enactment of this Act, the head of each Federal agency shall provide a list of all requests described in subsection (a)(1) that remain pending, if any, to—</text><subparagraph id="HC7B793B14DF644E7898DBE287B145DE6"><enum>(A)</enum><text display-inline="yes-display-inline">the committees referred to in paragraph (1); and</text></subparagraph><subparagraph id="H23B5704ACBAD460F893B8F58521670F7"><enum>(B)</enum><text>the Secretary of the Treasury.</text></subparagraph></paragraph></subsection><subsection id="H69197013B7AA43EBAD904C74197211CE"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H9A098AE07F084A7EBE35B45A8D8F1440"><enum>(1)</enum><text>The term <term>Federal agency</term> means an agency as that term is defined in section 551 of title 5, United States Code.</text></paragraph><paragraph id="H98338569FAA54391BB20B2560E1D43B0"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>gain-of-function research</quote> means any research that may be reasonably anticipated to confer an attribute to a pathogen such that the pathogen would have enhanced pathogenicity or transmissibility in mammals.</text></paragraph><paragraph id="H47C0AF0A27E2483D85F2C30EE4D51360"><enum>(3)</enum><text>The term <quote>potential pandemic pathogen</quote> means a pathogen that, prior to any gain-of-function research—</text><subparagraph id="H224527D104024379A8027FEDE4FEDB79"><enum>(A)</enum><text>is likely highly transmissible and likely capable of wide and uncontrollable spread in human populations; and</text></subparagraph><subparagraph id="HA7FB244650984EEF8F3CD1E3FDFC560C"><enum>(B)</enum><text>is likely highly virulent and likely to cause significant morbidity or mortality in humans.</text></subparagraph></paragraph></subsection></section><section id="HA8BA5B1AA4AD49BC983685B3048682F0"><enum>3.</enum><header>Penalty for failure to dispose of pending FOIA requests</header><text display-inline="no-display-inline">Beginning on the day that is 101 calendar days after the date of enactment of this Act, the Secretary of the Treasury shall transfer from the appropriations account of the office of the head of a Federal agency (as defined in section 2(d)) to the Countermeasures Injury Compensation Program of the Health Resources and Services Administration $1,000,000 for each calendar day on which any request described in section 2(a)(1) remains pending with such Federal agency.</text></section><section id="H0DAF218FBDBF4DA98485885B7995166E"><enum>4.</enum><header>Compelling need for expedited processing</header><text display-inline="no-display-inline">With respect to affirming or denying a request for expedited processing of a record under section 552(a)(6)(E) of title 5, United States Code, a person submitting such request to a Federal agency (as defined in section 2(d)) shall be deemed to have demonstrated a compelling need for such record if such record is related to—</text><paragraph id="H251D44E9F5FA49399265D40E440D203F"><enum>(1)</enum><text>a drug or medical device to prevent, diagnose, mitigate, or treat COVID–19;</text></paragraph><paragraph id="HA9065D9E176741389E9247C4AE5FEEF5"><enum>(2)</enum><text>gain-of-function research or potential pandemic pathogen research (as such terms are defined in section 2(e)); or</text></paragraph><paragraph id="H904C864477E44C7BB26E854F03FAFA16"><enum>(3)</enum><text display-inline="yes-display-inline">a policy, rule, or standard requiring COVID–19 vaccination of individuals.</text></paragraph></section></legis-body></bill>
