which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Small Business Act to address the participation of cooperatives in the program carried out under section 7(a) of that Act, and for other purposes.</official-title></form><legis-body id="H2B15118F2EA14E26ABBB18BA1E85064D" style="OLC"><section id="HB080239DDD394B278E7DF934959F1C7E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Capital for Cooperatives Act</short-title></quote>.</text></section><section id="HB77032A59F374D47B7BA70484B16DDB7"><enum>2.</enum><header>Findings</header><subsection id="H775AD8DA2BA64239B88BB8CA348B8B59"><enum/><text>Congress finds the following:</text><paragraph id="H2B8CE2A304304341800F7A31E2D40D0C"><enum>(1)</enum><text>Cooperative businesses operate on the basis of 1 member, 1 vote.</text></paragraph><paragraph id="HFF5EFE7AC202427383CC7D2D244A0720"><enum>(2)</enum><text>Cooperatives have helped to improve the economic conditions of the people of the United States for more than a century by increasing competition and helping small players gain parity in the market.</text></paragraph><paragraph id="HC5FA401C973A4B22A62D252BD2F3C8D1"><enum>(3)</enum><text>Research has shown that cooperatives are more resilient to economic business cycles than other business models because cooperatives require member-owners of the cooperative to work together and prepare for the future.</text></paragraph><paragraph id="H518E3E856725408DA3945EF00FD7CC16"><enum>(4)</enum><text>The mission of the Small Business Administration (referred to in this Act as the <quote>Administration</quote>) is to help the people of the United States start, build, and grow businesses.</text></paragraph><paragraph id="H577A7E64E313419A87AE4FC1C68C8571"><enum>(5)</enum><text>The requirement of the Administration that some borrowers provide a personal guarantee with respect to certain Administration loans has prevented cooperatives from accessing the safe and affordable financing available from the Administration.</text></paragraph></subsection></section><section id="HC490783BBCCF4B03A372E61DC59EC4F2"><enum>3.</enum><header>Cooperatives</header><subsection id="H72D412B206734130A8C8A6C53CBCD943"><enum>(a)</enum><header>In general</header><text>Section 7(a)(15)(B)(iv) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(15)(B)(iv)</external-xref>) is amended—</text><paragraph id="HEA7B99D8ED114E4B880A308A23DEA59E"><enum>(1)</enum><text>in the matter preceding subclause (I), by striking <quote>, or to a cooperative in accordance with paragraph (35)</quote>; and</text></paragraph><paragraph id="H0CF289DCBBF34F24BC6A81F321E9858A"><enum>(2)</enum><text>in subclause (I), by striking <quote>or cooperative</quote>.</text></paragraph></subsection><subsection id="H17C23D803CDA44B1B6241080A0D573D6"><enum>(b)</enum><header>SBA responsibilities</header><paragraph id="HAB85526BE9B74ABFBEAC9C712AC7BB96"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H2F299043875A470E86D50650DBAAE897"><enum>(A)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Administration.</text></subparagraph><subparagraph id="H16934FBF4A804D31958A076B6B81E655"><enum>(B)</enum><header>Cooperative</header><text>The term <term>cooperative</term> has the meaning given the term in section 7(a)(35) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(35)</external-xref>).</text></subparagraph><subparagraph id="H89BB2BD306B044138FB5D07541C315A8"><enum>(C)</enum><header>Program</header><text>The term <term>Program</term> means the program carried out under section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>).</text></subparagraph><subparagraph id="H75B661DF0A794269B8771C6516D4D84B"><enum>(D)</enum><header>Small business concern</header><text>The term <term>small business concern</term> has the meaning given the term in section 3(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(a)</external-xref>).</text></subparagraph><subparagraph id="H921BD6782E644EA987FBEB270FCE119E"><enum>(E)</enum><header>Working Group</header><text>The term <term>Working Group</term> means the interagency working group coordinated and chaired by the Secretary of Agriculture pursuant to section 310B(e)(12) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1932">7 U.S.C. 1932(e)(12)</external-xref>), as amended by subsection (c). </text></subparagraph></paragraph><paragraph id="HEC7AF4EC0BC6447BA8D626F0959FEFFF"><enum>(2)</enum><header>Coordination; amendments to rules; report</header><text>The Administrator shall—</text><subparagraph id="H29388D34DB59440AAE7315198DD1091A"><enum>(A)</enum><text>beginning not later than 60 days after the date of enactment of this Act, coordinate and participate with the Working Group to—</text><clause id="H18F28476E0BF42C28AFDF868581C372B"><enum>(i)</enum><text>develop recommendations regarding how the Administrator can coordinate with the heads of other Federal agencies to promote, support, and increase the number of cooperatives; and</text></clause><clause id="HAF7358DE6E3546F9B8960EEDCE1EB988"><enum>(ii)</enum><text>ensure coordination between the Administrator and— </text><subclause id="HD5324A48A2004025917E07800A941D79"><enum>(I)</enum><text>other Federal agencies; and </text></subclause><subclause id="H3644AFAA46F14386B48F8E6A77886151"><enum>(II)</enum><text>national and local organizations representing cooperatives and small business concerns; </text></subclause></clause></subparagraph><subparagraph id="HA5E33FA9B7674FD0B714EFCAB8B8E3C1"><enum>(B)</enum><text>not later than 180 days after the date of enactment of this Act— </text><clause id="HA8A7E2DD066F4F4CA9694F7ADC3AE11A"><enum>(i)</enum><text>amend the rules of the Administration with respect to guarantees for loans made to cooperatives under the Program, which may include—</text><subclause id="HA8B4E700B29C4906974C57A13B62AA09"><enum>(I)</enum><text>requiring the Administrator to guarantee a loan made to a cooperative under the Program if the lender with respect to the loan can demonstrate that the cooperative is able to repay the loan; and</text></subclause><subclause id="H56D7A3A640764102838F98203778255F"><enum>(II)</enum><text>establishing lending criteria for cooperatives under the Program that are not based on personal or entity guarantees provided by the member-owners of the cooperative; and</text></subclause></clause><clause id="HC356183BE7064B3393FA697E122BCDD4"><enum>(ii)</enum><text>submit to Congress a report documenting the amendments made under clause (i); and</text></clause></subparagraph><subparagraph id="H5C494A7CAAA947818E64C39BF543C0FF"><enum>(C)</enum><text>not later than 1 year after the date of enactment of this Act, submit to Congress a report regarding—</text><clause id="HB701A7BB773F47E3B255C66210AD9719"><enum>(i)</enum><text>education regarding cooperatives that the Administrator has provided to— </text><subclause id="H2EA0B8FB2055415B8AE98C12BE8DC2EE"><enum>(I)</enum><text>officials of the Administration; </text></subclause><subclause id="H4F2C8A63B561421EAE9A95C4219200A2"><enum>(II)</enum><text>lenders participating in the Program; and </text></subclause><subclause id="H3462D8571855438181736C6E81FD93AF"><enum>(III)</enum><text>small business development centers described in section 21 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648</external-xref>); and</text></subclause></clause><clause id="H0AB37FFF721E48298C3D7D6CD54A05C6"><enum>(ii)</enum><text>during the period beginning on the date of enactment of this Act and ending on the date on which the report is submitted—</text><subclause id="H41A33C8C9DDE486E818EE6B2F7D0F802"><enum>(I)</enum><text>the number of applications submitted by cooperatives for loans under the Program; and</text></subclause><subclause id="H1397C5C38B46414688612BD7CAECC802"><enum>(II)</enum><text>the number of applications received under subclause (I) that were approved by the Administrator.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H6131FC80F2114FDF820ED54BDCD01949"><enum>(c)</enum><header>Interagency Working Group on Cooperative Development</header><text>Section 310B(e)(12) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1932">7 U.S.C. 1932(e)(12)</external-xref>) is amended—</text><paragraph id="HD672B60F6D5142F6BFEA7B46ADA6BC54"><enum>(1)</enum><text>by striking <quote>Not later</quote> and inserting the following:</text><quoted-block id="HDD002D84277142B28A797C3292659E7C" style="OLC" act-name=""><subparagraph id="HA7D1415600DA438A98F9A4CD1AC8A785"><enum>(A)</enum><header>In general</header><text>Not later</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HEE42F479A92843A1A415AAFD07386BE2"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="HEAD077BC005E46CB9B74592D6EE216EA" style="OLC" act-name=""><subparagraph id="H0A9E5B2033A74F4B8983CCC4EBA8C456"><enum>(B)</enum><header>Meetings</header><text>The interagency working group described in subparagraph (A)—</text><clause id="HBB46ECD7841A488C977F9B66109CDE12"><enum>(i)</enum><text>shall meet—</text><subclause id="H6E685DF24D17403CACD5CC89D6254752"><enum>(I)</enum><text>at such times determined necessary by the Secretary; and</text></subclause><subclause id="HDAB34F76460F4E0AA1B65AEE675740C2"><enum>(II)</enum><text>not less frequently than biannually; and</text></subclause></clause><clause id="H93F24453DB9042EAB94F86A315FC4B7C"><enum>(ii)</enum><text>may conduct meetings in person or through the use of electronic resources.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
