R. 6308</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211216">December 16, 2021</action-date><action-desc><sponsor name-id="K000381">Mr. Kilmer</sponsor> (for himself, <cosponsor name-id="S001172">Mr. Smith of Nebraska</cosponsor>, <cosponsor name-id="G000579">Mr. Gallagher</cosponsor>, and <cosponsor name-id="R000602">Miss Rice of New York</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to improve the way beneficiaries are assigned under the Medicare shared savings program by also basing such assignment on primary care services furnished by nurse practitioners, physician assistants, and clinical nurse specialists.</official-title></form><legis-body id="H9466CABDAC4E47B2A00CEA5B67A99180" style="OLC"><section id="HD4095410DED348B9B9DE8EE243A1AEAC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>ACO Assignment Improvement Act of 2021</short-title></quote>.</text></section><section id="H206F47658F91441CAC6D5BF86C97807D"><enum>2.</enum><header>Improvements to the assignment of beneficiaries under the Medicare shared savings program</header><text display-inline="no-display-inline">Section 1899(c)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395jjj">42 U.S.C. 1395jjj(c)(1)</external-xref>) is amended—</text><paragraph id="H7A3D069A97E14312A895FFBA21EFBF1E"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H5C3FB4BFF9F84D1F9C91C25B73305AEB"><enum>(2)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H28509744B1324A3E9A55D45D8ADB65F9"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="HACFED1DED0E845878AF01D1780D4C7EF" style="OLC"><subparagraph id="H18DE7955A5A0472093EBF877B343A6FE"><enum>(C)</enum><text>in the case of performance years beginning on or after January 1, 2022, primary care services provided under this title by an ACO professional described in subsection (h)(1)(B).</text></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
