R. 6282</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211214">December 14, 2021</action-date><action-desc><sponsor name-id="P000605">Mr. Perry</sponsor> (for himself and <cosponsor name-id="G000552">Mr. Gohmert</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title III of the Public Health Service Act to eliminate immunity for manufacturers of COVID–19 vaccines, and for other purposes.</official-title></form><legis-body id="H5B6487186A1C4D968688DF00AF95DE74" style="OLC"><section id="HAE47B071164243089537C991A21F003E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>COVID–19 Vaccine Accountability Act</short-title></quote>. </text></section><section id="HE0A7AE8AFE294580BCC6D6BFFEB3DF8F"><enum>2.</enum><header>Liability of COVID–19 vaccine manufacturers</header><subsection id="H0553FE6FE6394CDAAB9CCF324E256520"><enum>(a)</enum><header>Covered countermeasure</header><text display-inline="yes-display-inline">Section 319F–3(i)(1) of the Public Health Service Act (42 U.S.C. 247d–6d(i)(1)) is amended by adding at the end the following: </text><quoted-block style="OLC" id="HC0B61FBF53374AD08BEBC60AC3BE573C" display-inline="no-display-inline"><quoted-block-continuation-text quoted-block-continuation-text-level="subparagraph">Such term does not include vaccines for COVID–19 that are required (directly or as a condition of employment, schooling, or otherwise) under Federal, State, or local law to be administered to individuals eligible to receive such a vaccine.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8E05EAEE28A843FBBD32BD43E2E3EF56"><enum>(b)</enum><header>Covered person</header><text display-inline="yes-display-inline">Section 319F–3(i)(2) of the Public Health Service Act (42 U.S.C. 247d–6d(i)(2)) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HDBAAF1086B404B858515B659D7350A1F" display-inline="no-display-inline"><quoted-block-continuation-text quoted-block-continuation-text-level="subparagraph">Such term does not include a manufacturer of a vaccine described in the matter following subparagraph (D) of paragraph (1).</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H21DC8BC73C4F4506A00A6501119B8A7A"><enum>(c)</enum><header>Limitation of liability</header><text display-inline="yes-display-inline">Section 319F–3 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-6d">42 U.S.C. 247d–6d</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="HAE2E96B061F64CA7B8CAC5C1D4D8EB2A" display-inline="no-display-inline"><subsection id="H94903D5CE30A4AFCB1C86AC95019F90C"><enum>(j)</enum><header>Limitation on liability</header><text display-inline="yes-display-inline">Pursuant to, and consistent with, the sovereign immunity reservation specified in subsection (f), the liability of the United States for a death or injury caused by the administration of a vaccine for COVID–19 occurring on or after January 1, 2020 shall not exceed $10,000. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
