R. 6280</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211214">December 14, 2021</action-date><action-desc><sponsor name-id="O000171">Mr. O'Halleran</sponsor> (for himself, <cosponsor name-id="S001192">Mr. Stewart</cosponsor>, and <cosponsor name-id="M001213">Mr. Moore of Utah</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Labor Standards Act of 1938 to exempt certain employees engaged in outdoor recreational outfitting or guiding services from maximum hours requirements.</official-title></form><legis-body id="H7E15A82C608A410EAF09278F93365E6D" style="OLC"><section id="HED5E2732855745A1AE91F648F50DBD83" section-type="section-one"><enum>1.</enum><header>Exemption with respect to certain employees engaged in outdoor recreational outfitting or guiding services</header><text display-inline="no-display-inline">Section 13(b) of the Fair Labor Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(b)</external-xref>) is amended by inserting after paragraph (3) the following:</text><quoted-block display-inline="no-display-inline" id="H5F553E2C0673456196F6785D13F98C2B" style="OLC"><paragraph id="H7807EAF9ED1E4918955B4B3222818C7E"><enum>(4)</enum><text display-inline="yes-display-inline">any employee principally engaged in outdoor recreational outfitting or guiding services and employed by an employer principally engaged in the business of providing such outfitting or guiding services that—</text><subparagraph id="HFE04036129A644CCB7E6FF71BDC9788F"><enum>(A)</enum><text>does not operate for more than seven months in any calendar year; or</text></subparagraph><subparagraph id="HB6AEA0FD6B44490F9F99C107A2526DB3"><enum>(B)</enum><text display-inline="yes-display-inline">had average receipts for any six months of the preceding calendar year that were not more than 33<fraction>1/3</fraction> per centum of its average receipts for the other six months of such year; or</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
