which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Defense to establish a working group for the reform of the casualty assistance officer program, and for other purposes.</official-title></form><legis-body id="H408FC21D3FA54E33B53D43C5CC68D48F" style="OLC"><section id="H29FD9C8C4637400A9E3E701ADB79C96A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Casualty Assistance Reform Act of 2021</short-title></quote>.</text></section><section id="H02077162C56F4296A8573E32FDFACD42"><enum>2.</enum><header>Casualty assistance program: reform; establishment of working group</header><subsection id="H7A11084C010C43DBB6CA6D6DB5363B50"><enum>(a)</enum><header>Casualty assistance reform working group</header><paragraph id="HC0AE9B8AFD0F471C99A6DC9684C4F091"><enum>(1)</enum><header>Establishment</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Defense shall establish a working group to be known as the <quote>Casualty Assistance Reform Working Group</quote> (in this section referred to as the <quote>Working Group</quote>).</text></paragraph><paragraph id="H691ED4E3C0EB4B06A9BD2D9FB16A60CF"><enum>(2)</enum><header>Duties</header><text>The Working Group shall perform the following duties:</text><subparagraph id="H29C590DD117B4D2D8FCE5F46043A5B87"><enum>(A)</enum><text>Create standards and training for CAOs across the military departments.</text></subparagraph><subparagraph id="HB9F370A139C3465DB991A632CC2D2653"><enum>(B)</enum><text>Explore the possibility of establishing a unique badge designation for—</text><clause id="H2637541790254A499252B87D496E1A12"><enum>(i)</enum><text>CAOs who have performed CAO duty more than five times; or</text></clause><clause id="HB587BBE08BC347809CF0DDEFA32B7D4B"><enum>(ii)</enum><text>professional CAOs.</text></clause></subparagraph><subparagraph id="H6798E634F3E349AD9A7BC6C34B940BEE"><enum>(C)</enum><text>Examine the current workflow of casualty affairs support across the military departments, including administrative processes and survivor engagements.</text></subparagraph><subparagraph id="H367B4D2D7F13419294D0CA609DBB5B8E"><enum>(D)</enum><text>Perform a gap analysis and solution document that clearly identifies and prioritizes critical changes to modernize and professionalize the casualty experience for survivors.</text></subparagraph><subparagraph id="H1A264866EAA84F68844F79083B94F9E7"><enum>(E)</enum><text>Review the organization of the Office of Casualty, Mortuary Affairs and Military Funeral Honors to ensure it is positioned to coordinate policy and assist in all matters under its jurisdiction, across the Armed Forces, including any potential intersections with the Defense Prisoner of War and Missing in Action Accounting Agency.</text></subparagraph><subparagraph id="HCF7E815212C44805AC8AB639198D3207"><enum>(F)</enum><text>Explore the establishment of—</text><clause id="H0A4F79BE1E1A4E62A9C5447BB3379249"><enum>(i)</enum><text>an annual meeting, led by the Secretary of Defense, with gold star families; and</text></clause><clause id="H236A1FE7575745CBA1B2B95B5283BBB5"><enum>(ii)</enum><text>a surviving and gold star family leadership council.</text></clause></subparagraph><subparagraph id="H336859AC4ABC48D0A66CBE2CEC346D5B"><enum>(G)</enum><text>Recommend improvements to the family notification process of Arlington National Cemetery.</text></subparagraph><subparagraph id="H75B3C9D0413F44A1B0AFA40F5259ED23"><enum>(H)</enum><text>Explore the redesign of the Days Ahead Binder, including creating an electronic version.</text></subparagraph><subparagraph id="H723051FC59C74B68ABE1A9D052A40365"><enum>(I)</enum><text>Consider the expansion of the DD Form 93 to include more details regarding the last wishes of the deceased member.</text></subparagraph><subparagraph id="HAD896818E01A45C691A03C8BE945DEC5"><enum>(J)</enum><text>Assess coordination between the Department of Defense and the Office of Survivors Assistance of the Department of Veterans Affairs.</text></subparagraph></paragraph><paragraph id="H0569917077844AB5A1DD57021BC59028"><enum>(3)</enum><header>Membership</header><text>The membership of the Working Group shall be composed of the following:</text><subparagraph id="H4F858BF15DC5479CB617E1B248E5A939"><enum>(A)</enum><text>The Under Secretary of Defense for Personnel and Readiness, who shall serve as Chair of the Working Group.</text></subparagraph><subparagraph id="H6AEF8041E69A4E9BBE8A4DCED6FB713C"><enum>(B)</enum><text>At least one person furnished with a gold star lapel button under section 1126 of title 10, United States Code, by each Secretary of a military department.</text></subparagraph><subparagraph id="H0DC693368D7340FEB5CC7A15C5DB10A6"><enum>(C)</enum><text>Other members of the Armed Forces or civilian employees of the Department of Defense, appointed by the Secretary of Defense, based on knowledge of, and experience with, matters described in paragraph (2).</text></subparagraph></paragraph><paragraph id="H3D0F847260884677B71648CF49E88FFA"><enum>(4)</enum><header>Report</header><text>Not later than September 30, 2022, the Working Group shall submit to the Secretary of Defense a report containing the determinations and recommendations of the Working Group.</text></paragraph><paragraph id="H0DC241A376C34392828A9E0C7628BBEE"><enum>(5)</enum><header>Termination</header><text>The Working Group shall terminate upon submission of the report under paragraph (4).</text></paragraph></subsection><subsection id="H666D03767EC044C993B81E5A0DE73557"><enum>(b)</enum><header>Report required</header><text>Not later than November 1, 2022, the Secretary of Defense shall submit to the Committees on Armed Services of the Senate and the House of Representatives a report setting forth the results of a review and assessment of the casualty assistance officer program, including the report of the Working Group.</text></subsection><subsection id="HD4D6C9945333417798FB7D680171AFBE"><enum>(c)</enum><header>Establishment of certain definitions</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Defense, in coordination with the Secretaries of the military departments, shall publish an interim rule that establishes standard definitions, for use across the military departments, of the terms <quote>gold star family</quote> and <quote>gold star survivor</quote>.</text></subsection><subsection id="H9C57119F4BA5449498B86C5ADAD19D78"><enum>(d)</enum><header>CAO defined</header><text>In this section, the term <quote>CAO</quote> means a casualty assistance officer of the Armed Forces.</text></subsection></section></legis-body></bill>
