R. 6256</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>December 15, 2021</action-date><action-desc>Received</action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To ensure that goods made with forced labor in the Xinjiang Uyghur Autonomous Region of the People’s Republic of China do not enter the United States market, and for other purposes.</official-title></form><legis-body id="H431D345E4ADA4B70899DD394DC4BC41D" style="OLC"><section id="H8C0561FD3D394E5FBC2F32E5D7133F70" section-type="section-one"><enum>1.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text><paragraph id="H49350847FF8340F9B236CE42D871C929"><enum>(1)</enum><text>to strengthen the prohibition against the importation of goods made with forced labor, including by ensuring that the Government of the People’s Republic of China does not undermine the effective enforcement of section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>), which prohibits the importation of all <quote>goods, wares, articles, and merchandise mined, produced or manufactured wholly or in part in any foreign country by * * * forced labor</quote>;</text></paragraph><paragraph id="H51C7E497B8FF4DA9BE699900A206E5E2"><enum>(2)</enum><text>to lead the international community in ending forced labor practices wherever such practices occur through all means available to the United States Government, including by stopping the importation of any goods made with forced labor, including those goods mined, produced, or manufactured wholly or in part in the Xinjiang Uyghur Autonomous Region;</text></paragraph><paragraph id="H87A7ADA59E8F470B8C5C1F777048C35C"><enum>(3)</enum><text>to coordinate with Mexico and Canada to effectively implement Article 23.6 of the United States-Mexico-Canada Agreement to prohibit the importation of goods produced in whole or in part by forced or compulsory labor, including those goods mined, produced, or manufactured wholly or in part in the Xinjiang Uyghur Autonomous Region;</text></paragraph><paragraph id="H3AE974A683F3486EB3F19E00BF75FEF7"><enum>(4)</enum><text>to actively work to prevent, publicly denounce, and end human trafficking including with respect to forced labor, whether sponsored by the government of a foreign country or not, and to restore the lives of those affected by human trafficking, a modern form of slavery;</text></paragraph><paragraph id="H43AC30C91B2D430E91376DBA8D7E1B56"><enum>(5)</enum><text>to regard the prevention of atrocities as it is in the national interest of the United States, including efforts to prevent torture, enforced disappearances, severe deprivation of liberty, including mass internment, arbitrary detention, and widespread and systematic use of forced labor, and persecution targeting any identifiable ethnic or religious group; and</text></paragraph><paragraph id="H01E8B87F434E440F942201CE99A11B74"><enum>(6)</enum><text>to address gross violations of human rights in the Xinjiang Uyghur Autonomous Region—</text><subparagraph id="HFC4AE31E7EE6438D842AB04234BA49B5"><enum>(A)</enum><text>through bilateral diplomatic channels and multilateral institutions where both the United States and the People’s Republic of China are members; and</text></subparagraph><subparagraph id="HF2E811F78AF34BA0AB1ED34870A34B2F"><enum>(B)</enum><text>using all the authorities available to the United States Government, including visa and financial sanctions, export restrictions, and import controls.</text></subparagraph></paragraph></section><section id="H257A714932EF4F6AA5466B8109D4AF2B"><enum>2.</enum><header>Strategy to enforce prohibition on importation of goods made through forced labor in the Xinjiang Uyghur Autonomous Region</header><subsection id="H7B8B7136A773466DAF02D880D2714829"><enum>(a)</enum><header>Public comment</header><paragraph id="H2748FB98D6F94DC297EE0FF2BFB6EA10"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of this Act, the Forced Labor Enforcement Task Force, established under section 741 of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4681">19 U.S.C. 4681</external-xref>), shall publish in the Federal Register a notice soliciting public comments on how best to ensure that goods mined, produced, or manufactured wholly or in part with forced labor in the People’s Republic of China, including by Uyghurs, Kazakhs, Kyrgyz, Tibetans, and members of other persecuted groups in the People’s Republic of China, and especially in the Xinjiang Uyghur Autonomous Region, are not imported into the United States.</text></paragraph><paragraph id="HCC54C86563154405B5CA206A98673DFA"><enum>(2)</enum><header>Period for comment</header><text>The Forced Labor Enforcement Task Force shall provide the public with not less than 45 days to submit comments in response to the notice required by paragraph (1).</text></paragraph></subsection><subsection id="HD692FA313D3E42FBB4D882ED4D3353C5"><enum>(b)</enum><header>Public hearing</header><paragraph id="H697FD079ECF04923917D7278ADE99D25"><enum>(1)</enum><header>In general</header><text>Not later than 45 days after the close of the period to submit comments under subsection (a)(2), the Forced Labor Enforcement Task Force shall conduct a public hearing inviting witnesses to testify with respect to the use of forced labor in the People’s Republic of China and potential measures, including the measures described in paragraph (2), to prevent the importation of goods mined, produced, or manufactured wholly or in part with forced labor in the People’s Republic of China into the United States.</text></paragraph><paragraph id="H4BA03557B20B42E1BF2C2E674F893427"><enum>(2)</enum><header>Measures described</header><text>The measures described in this paragraph are—</text><subparagraph id="H368564DF15D04C949D156C7DD5236D40"><enum>(A)</enum><text>measures that can be taken to trace the origin of goods, offer greater supply chain transparency, and identify third country supply chain routes for goods mined, produced, or manufactured wholly or in part with forced labor in the People’s Republic of China; and</text></subparagraph><subparagraph id="H5593194856EC44EE8F61E926C5FD0F5A"><enum>(B)</enum><text>other measures for ensuring that goods mined, produced, or manufactured wholly or in part with forced labor do not enter the United States.</text></subparagraph></paragraph></subsection><subsection id="H440A41678E5148B4BCE00193E34F4BE6"><enum>(c)</enum><header>Development of strategy</header><text>After receiving public comments under subsection (a) and holding the hearing required by subsection (b), the Forced Labor Enforcement Task Force, in consultation with the Secretary of Commerce and the Director of National Intelligence, shall develop a strategy for supporting enforcement of Section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>) to prevent the importation into the United States of goods mined, produced, or manufactured wholly or in part with forced labor in the People’s Republic of China.</text></subsection><subsection id="H67DE4D8B9E064E41A641F34B3538BE36"><enum>(d)</enum><header>Elements</header><text>The strategy developed under subsection (c) shall include the following:</text><paragraph id="HD2992983662C4087BFF10ED72F2DF11E"><enum>(1)</enum><text>A comprehensive assessment of the risk of importing goods mined, produced, or manufactured wholly or in part with forced labor in the People’s Republic of China, including from the Xinjiang Uyghur Autonomous Region or made by Uyghurs, Kazakhs, Kyrgyz, Tibetans, or members of other persecuted groups in any other part of the People’s Republic of China, that identifies, to the extent feasible—</text><subparagraph id="HF9082473DC544DF5AD141D9DBA1806FC"><enum>(A)</enum><text>threats, including through the potential involvement in supply chains of entities that may use forced labor, that could lead to the importation into the United States from the People’s Republic of China, including through third countries, of goods mined, produced, or manufactured wholly or in part with forced labor; and</text></subparagraph><subparagraph id="H3E917740249340A8B05E9A919AFEA517"><enum>(B)</enum><text>what procedures can be implemented or improved to reduce such threats.</text></subparagraph></paragraph><paragraph id="H5BD93CA4B682444D8CC6C991BFF2398A"><enum>(2)</enum><text>A comprehensive description and evaluation—</text><subparagraph id="H498ADA044C8E49BF98FA3315E51BB9DC"><enum>(A)</enum><text>of <quote>pairing assistance</quote> and <quote>poverty alleviation</quote> or any other government labor scheme that includes the forced labor of Uyghurs, Kazakhs, Kyrgyz, Tibetans, or members of other persecuted groups outside of the Xinjiang Uyghur Autonomous Region or similar programs of the People’s Republic of China in which work or services are extracted from Uyghurs, Kazakhs, Kyrgyz, Tibetans, or members of other persecuted groups through the threat of penalty or for which the Uyghurs, Kazakhs, Kyrgyz, Tibetans, or members of other persecuted groups have not offered themselves voluntarily; and</text></subparagraph><subparagraph id="H3F9EAF3BEE324C6E986D7ADBB2D078A6"><enum>(B)</enum><text>that includes—</text><clause id="H5BE82FFEEA3149FFB6E4AAF93085068F"><enum>(i)</enum><text>a list of entities in the Xinjiang Uyghur Autonomous Region that mine, produce, or manufacture wholly or in part any goods, wares, articles and merchandise with forced labor;</text></clause><clause id="HEB85445476264D6788BEBDBDB75579BB"><enum>(ii)</enum><text>a list of entities working with the government of the Xinjiang Uyghur Autonomous Region to recruit, transport, transfer, harbor or receive forced labor or Uyghurs, Kazakhs, Kyrgyz, or members of other persecuted groups out of the Xinjiang Uyghur Autonomous Region;</text></clause><clause id="HC2D305DBC90B44709463F8B82E19D4A9"><enum>(iii)</enum><text>a list of products mined, produced, or manufactured wholly or in part by entities on the list required by clause (i) or (ii);</text></clause><clause id="HAB186E678479440DBAB8C622747CACBE"><enum>(iv)</enum><text>a list of entities that exported products described in clause (iii) from the People’s Republic of China into the United States;</text></clause><clause id="HB7ED7C7FB4844D419E19A615AFE0D5AA"><enum>(v)</enum><text>a list of facilities and entities, including the Xinjiang Production and Construction Corps, that source material from the Xinjiang Uyghur Autonomous Region or from persons working with the government of the Xinjiang Uyghur Autonomous Region or the Xinjiang Production and Construction Corps for purposes of the <quote>poverty alleviation</quote> program or the <quote>pairing-assistance</quote> program or any other government labor scheme that uses forced labor;</text></clause><clause id="H06B18F7EA03D4BA782CAA3EDE62C2F6F"><enum>(vi)</enum><text>a plan for identifying additional facilities and entities described in clause (v);</text></clause><clause id="H818B03970AED4E6F8CC9689E458CF2C5"><enum>(vii)</enum><text>an enforcement plan for each such entity whose goods, wares articles, or merchandise are exported into the United States, which may include issuing withhold release orders to support enforcement of section 4 with respect to the entity;</text></clause><clause id="H5B020EFAFA3448EDB1CF274D297A806E"><enum>(viii)</enum><text>a list of high-priority sectors for enforcement, which shall include cotton, tomatoes, and polysilicon; and</text></clause><clause id="H56E406D2BDE84F088E23C10B5897D3D1"><enum>(ix)</enum><text>an enforcement plan for each such high-priority sector.</text></clause></subparagraph></paragraph><paragraph id="H7722B741AB7F4C5ABE890E6BE2EB8492"><enum>(3)</enum><text>Recommendations for efforts, initiatives, and tools and technologies to be adopted to ensure that U.S. Customs and Border Protection can accurately identify and trace goods made in the Xinjiang Uyghur Autonomous Region entering at any of the ports of the United States.</text></paragraph><paragraph id="H46EEF56630BD4653B75C042C1FFD92B9"><enum>(4)</enum><text>A description of how U.S. Customs and Border Protection plans to enhance its use of legal authorities and other tools to ensure that no goods are entered at any of the ports of the United States in violation of section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>), including through the initiation of pilot programs to test the viability of technologies to assist in the examination of such goods.</text></paragraph><paragraph id="HB2F101C2A8A741698799E11239C86CFE"><enum>(5)</enum><text>A description of the additional resources necessary for U.S. Customs and Border Protection to ensure that no goods are entered at any of the ports of the United States in violation of section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>).</text></paragraph><paragraph id="H0A308CB238DD4359A17967B5F12B3FDC"><enum>(6)</enum><text>Guidance to importers with respect to—</text><subparagraph id="HF1B51EC5C60746808487BA5895C8C23F"><enum>(A)</enum><text>due diligence, effective supply chain tracing, and supply chain management measures to ensure that such importers do not import any goods mined, produced, or manufactured wholly or in part with forced labor from the People’s Republic of China, especially from the Xinjiang Uyghur Autonomous Region;</text></subparagraph><subparagraph id="H4C6456BBC12C43D6A52CFE18B2DEF7D6"><enum>(B)</enum><text>the type, nature, and extent of evidence that demonstrates that goods originating in the People’s Republic of China were not mined, produced, or manufactured wholly or in part in the Xinjiang Uyghur Autonomous Region; and</text></subparagraph><subparagraph id="H922C59DE35CD454EB6A309776D04DDFD"><enum>(C)</enum><text>the type, nature, and extent of evidence that demonstrates that goods originating in the People’s Republic of China, including goods detained or seized pursuant to section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>), were not mined, produced, or manufactured wholly or in part with forced labor.</text></subparagraph></paragraph><paragraph id="H269F08E21D4240E28B69F8CA24425EA7"><enum>(7)</enum><text>A plan to coordinate and collaborate with appropriate nongovernmental organizations and private sector entities to implement and update the strategy developed under subsection (c).</text></paragraph></subsection><subsection id="HCC1F2DBBE15D4DAFAD8272C96F942CD3"><enum>(e)</enum><header>Submission of strategy</header><paragraph id="H75D9F73A6E9F40FCB6FD4B02B170869D"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Forced Labor Enforcement Task Force, in consultation with the Department of Commerce and the Director of National Intelligence, shall submit to the appropriate congressional committees a report that—</text><subparagraph id="HB0E01496928A400291466071E9E6BDBF"><enum>(A)</enum><text>in the case of the first such report, sets forth the strategy developed under subsection (c); and</text></subparagraph><subparagraph id="H7A7E54ECEF964C70A5E3C583188A4144"><enum>(B)</enum><text>in the case of any subsequent such report, sets forth any updates to the strategy.</text></subparagraph></paragraph><paragraph id="HE4EBB0EA37F94EEDA1C340993EF3935A"><enum>(2)</enum><header>Updates of certain matters</header><text>Not less frequently than annually after the submission under paragraph (1)(A) of the strategy developed under subsection (c), the Forced Labor Enforcement Task Force shall submit to the appropriate congressional committees updates to the strategy with respect to the matters described in clauses (i) through (ix) of subsection (d)(2)(B).</text></paragraph><paragraph id="H44F26F6F9FE148B094FEABC75E5A6814"><enum>(3)</enum><header>Form of report</header><text>Each report required by paragraph (1) shall be submitted in unclassified form, but may include a classified annex, if necessary.</text></paragraph><paragraph id="HE501A95C4D1F4D2DA996AC345A9C97F7"><enum>(4)</enum><header>Public availability</header><text>The unclassified portion of each report required by paragraph (1) shall be made available to the public.</text></paragraph></subsection><subsection id="H82266A1EB28A4AD49D9D4F5D06667E5A"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to limit the application of regulations in effect on or measures taken before the date of the enactment of this Act to prevent the importation of goods mined, produced, or manufactured wholly or in part with forced labor into the United States, including withhold release orders issued before such date of enactment.</text></subsection></section><section id="H9037B3EDD38B423FBD3656481AA359AB"><enum>3.</enum><header>Rebuttable presumption that import prohibition applies to goods mined, produced, or manufactured in the Xinjiang Uyghur Autonomous Region or by certain entities</header><subsection id="H9CE6BDF775A2487D8DC8CE882D88BBD6"><enum>(a)</enum><header>In general</header><text>The Commissioner of U.S. Customs and Border Protection shall, except as provided by subsection (b), apply a presumption that, with respect to any goods, wares, articles, and merchandise mined, produced, or manufactured wholly or in part in the Xinjiang Uyghur Autonomous Region of the People’s Republic of China or produced by an entity on a list required by clause (i), (ii), (iv) or (v) of section 2(d)(2)(B)—</text><paragraph id="H98459858A181410989491ABC76C3E0CA"><enum>(1)</enum><text>the importation of such goods, wares, articles, and merchandise is prohibited under section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>); and</text></paragraph><paragraph id="H2DC8678EF55E4CC2AB297D658CEA2B40"><enum>(2)</enum><text>such goods, wares, articles, and merchandise are not entitled to entry at any of the ports of the United States.</text></paragraph></subsection><subsection id="HC4E666F1A72B4BCBACD8D54B37555C60"><enum>(b)</enum><header>Exceptions</header><text>The Commissioner shall apply the presumption under subsection (a) unless the Commissioner determines—</text><paragraph id="H42D901664C1A440996973B89E8CA0320"><enum>(1)</enum><text>that the importer of record has—</text><subparagraph id="H286C1E5BBD5242289FC3314A778B300A"><enum>(A)</enum><text>fully complied with the guidance described in section 2(d)(6) and any regulations issued to implement that guidance; and</text></subparagraph><subparagraph id="H4A816A1A5A2F4AE1BACE830BB7BD128F"><enum>(B)</enum><text>completely and substantively responded to all inquiries for information submitted by the Commissioner to ascertain whether the goods were mined, produced, or manufactured wholly or in part with forced labor; and</text></subparagraph></paragraph><paragraph id="HFFD8B2353D754CBDA4193581A7698A74"><enum>(2)</enum><text>by clear and convincing evidence, that the good, ware, article, or merchandise was not mined, produced, or manufactured wholly or in part by forced labor.</text></paragraph></subsection><subsection id="H5925D9E7CFCD420B9F3AF4C5971176DF"><enum>(c)</enum><header>Report required</header><text>The Commissioner shall submit to the appropriate congressional committees and make available to the public, not later than 30 days after making a determination of an exception under subsection (b), a report identifying the good and the evidence considered under subsection (b).</text></subsection><subsection id="H5DCCA04A6CAB42AE874754578AC136BB"><enum>(d)</enum><header>Regulations</header><text>The Commissioner may prescribe regulations—</text><paragraph id="H633EF5C0486F4CC1A277734E204294D5"><enum>(1)</enum><text>to implement paragraphs (1) and (2) of subsection (b); or</text></paragraph><paragraph id="H04E54421CAF840CC964022227E71BEDD"><enum>(2)</enum><text>to amend any other regulations relating to withhold release orders in order to implement this section.</text></paragraph></subsection><subsection id="H6C58CB15C8B74C0F9195CC1E34B327A7"><enum>(e)</enum><header>Effective date</header><text>This section takes effect on the date that is 180 days after the date of the enactment of this Act.</text></subsection></section><section id="H396CD1914DE4475E814EB629B991B651"><enum>4.</enum><header>Diplomatic strategy to address forced labor in the Xinjiang Uyghur Autonomous Region</header><subsection id="HF62006099FCA426EBA1A0849904FABC0"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of State, in coordination with the heads of other appropriate Federal departments and agencies, shall submit to the appropriate congressional committees a report that contains a United States strategy to promote initiatives to enhance international awareness of and to address forced labor in the Xinjiang Uyghur Autonomous Region of the People’s Republic of China.</text></subsection><subsection id="H58B124475A104765B33B7336A500E030"><enum>(b)</enum><header>Matters To be included</header><text>The strategy required by subsection (a) shall include—</text><paragraph id="H7A62D90BCAE6461996038CF51CFD62E4"><enum>(1)</enum><text>a plan to enhance bilateral and multilateral coordination, including sustained engagement with the governments of United States partners and allies, to end forced labor of Uyghurs, Kazakhs, Kyrgyz, Tibetans, and members of other persecuted groups in the Xinjiang Uyghur Autonomous Region;</text></paragraph><paragraph id="H29E7C69FF4824269A9D5FECC75AF5DB2"><enum>(2)</enum><text>a description of public affairs, public diplomacy, and counter-messaging efforts to promote awareness of the human rights situation, including forced labor in the Xinjiang Uyghur Autonomous Region; and</text></paragraph><paragraph id="H82714B25ECE544B7BC6167B8E3BEF0FA"><enum>(3)</enum><text>a plan—</text><subparagraph id="HC524955CA5C346E0881ED1514FBBBA78"><enum>(A)</enum><text>to coordinate and collaborate with appropriate nongovernmental organizations and private sector entities to raise awareness about goods mined, produced, or manufactured wholly or in part with forced labor in the Xinjiang Uyghur Autonomous Region; and</text></subparagraph><subparagraph id="HF2B3FDF45E214153BF5EB9578F108102"><enum>(B)</enum><text>to provide humanitarian assistance, including with respect to resettlement and advocacy for imprisoned family members, to Uyghurs, Kazakhs, Kyrgyz, Tibetans, and members of other persecuted groups, including members of such groups formerly detained in mass internment camps in the Xinjiang Uyghur Autonomous Region.</text></subparagraph></paragraph></subsection><subsection id="H664309528A6D436D90E76382D3D813A3"><enum>(c)</enum><header>Additional matters To be included</header><text>The Secretary shall include in the report required by subsection (a), based on consultations with the Secretary of Commerce, the Secretary of Homeland Security, and the Secretary of the Treasury, the following—</text><paragraph id="H26DFFE40BBBB403CAF4F095684475B66"><enum>(1)</enum><text>to the extent practicable, a list of—</text><subparagraph id="H7877DB0FFDAE4FC78AF35C90995B4084"><enum>(A)</enum><text>entities in the People’s Republic of China or affiliates of such entities that use or benefit from forced labor in the Xinjiang Uyghur Autonomous Region; and</text></subparagraph><subparagraph id="H34275DF949CB40F09F28196411380897"><enum>(B)</enum><text>Foreign persons that acted as agents of the entities or affiliates of entities described in subparagraph (A) to import goods into the United States.</text></subparagraph></paragraph><paragraph id="HFE9E160484794C4DBCE4B283D2A5B665"><enum>(2)</enum><text>A plan for working with private sector entities seeking to conduct supply chain due diligence to prevent the importation of goods mined, produced, or manufactured wholly or in part with forced labor into the United States.</text></paragraph><paragraph id="H2E5C4B78DC684CC2968CA35DF9D72F19"><enum>(3)</enum><text>A plan of actions taken by the United States Government to address forced labor in the Xinjiang Uyghur Autonomous Region under existing authorities, including—</text><subparagraph id="H571CFD0BAA6F4688BC355C0E2E3D9AA0"><enum>(A)</enum><text>the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/386">Public Law 106–386</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note); and</text></subparagraph><subparagraph id="H8D9F39F06D3649BABFBC215B1FDF511C"><enum>(C)</enum><text>the Global Magnitsky Human Rights Accountability Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2656">22 U.S.C. 2656</external-xref> note).</text></subparagraph></paragraph></subsection><subsection id="H4970364899274A00A7F266D65AD4305C"><enum>(d)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in unclassified form, but may include a classified annex, if necessary.</text></subsection><subsection id="HAA07352844494344B9930CA43AF47DA1"><enum>(e)</enum><header>Updates</header><text>The Secretary of State may include any updates to the strategy required by subsection (a) in the annual Trafficking in Persons report required by section 110(b) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7107">22 U.S.C. 7107(b)</external-xref>).</text></subsection></section><section id="H31027171DCE4407A948492ED82927B8B"><enum>5.</enum><header>Imposition of sanctions relating to forced labor in the Xinjiang Uyghur Autonomous Region</header><subsection id="HE865E887367A4E3BB0B0D65608395527"><enum>(a)</enum><header>In general</header><text>Section 6(a)(1) of the Uyghur Human Rights Policy Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/145">Public Law 116–145</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/6901">22 U.S.C. 6901</external-xref> note) is amended by adding at the end the following:</text><quoted-block id="H8DD93B47FB6941078C4540A79E725753" style="OLC"><subparagraph id="HAE106D92B93947A2B5BC6088505BD5D7"><enum>(F)</enum><text>Serious human rights abuses in connection with forced labor.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4580331B49B6436CAD8A426854F21096"><enum>(b)</enum><header>Effective date; applicability</header><text>The amendment made by subsection (a)—</text><paragraph id="HF3109B2317CF48499952A6E54D473CBB"><enum>(1)</enum><text>takes effect on the date of the enactment of this Act; and</text></paragraph><paragraph id="H2A1C0A30D92D4AF7AAD7ABF57595F3B8"><enum>(2)</enum><text>applies with respect to the first report required by section 6(a)(1) of the Uyghur Human Rights Policy Act of 2020 submitted after such date of enactment.</text></paragraph></subsection><subsection id="HAB72556DF4CF4B29AF20FC4807C05ED6"><enum>(c)</enum><header>Transition rule</header><paragraph id="H6058697D24E1444D8E396E2FB9CEDF2E"><enum>(1)</enum><header>Interim report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the President shall submit to the committees specified in section 6(a)(1) of the Uyghur Human Rights Policy Act of 2020 a report that identifies each foreign person, including any official of the Government of the People’s Republic of China, that the President determines is responsible for serious human rights abuses in connection with forced labor with respect to Uyghurs, Kazakhs, Kyrgyz, or members of other persecuted groups, or other persons in the Xinjiang Uyghur Autonomous Region.</text></paragraph><paragraph id="H6E97D1570B2D415EAC7AB3FF99D1D8BF"><enum>(2)</enum><header>Imposition of sanctions</header><text>The President shall impose sanctions under subsection (c) of section 6 of the Uyghur Human Rights Policy Act of 2020 with respect to each foreign person identified in the report required by paragraph (1), subject to the provisions of subsections (d), (e), (f), and (g) of that section.</text></paragraph></subsection></section><section id="HC128923E79C34080AB217E54559896F1"><enum>6.</enum><header>Sunset</header><text display-inline="no-display-inline">Sections 3, 4, and 5 shall cease to have effect on the earlier of—</text><paragraph id="H69D0687D6AF842B387FD494A6AB6EB13"><enum>(1)</enum><text>the date that is 8 years after the date of the enactment of this Act; or</text></paragraph><paragraph id="HF915340F73384D30B8DAAB72BB326487"><enum>(2)</enum><text>the date on which the President submits to the appropriate congressional committees a determination that the Government of the People’s Republic of China has ended mass internment, forced labor, and any other gross violations of human rights experienced by Uyghurs, Kazakhs, Kyrgyz, Tibetans, and members of other persecuted groups in the Xinjiang Uyghur Autonomous Region.</text></paragraph></section><section id="HC04AC143066745B2B1E91029B13BEEE3"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H88409B5E3AD44B4F9C42F7B7226A2CA5"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means—</text><subparagraph id="H78307AD6ABF540F1A0DF5540325FB6A2"><enum>(A)</enum><text>the Committee on Foreign Affairs, the Committee on Financial Services, the Committee on Ways and Means and the Committee on Homeland Security of the House of Representatives; and</text></subparagraph><subparagraph id="H68AAE101E2FA45F5B5428B654C2EAC0A"><enum>(B)</enum><text>the Committee on Foreign Relations, the Committee on Banking, Housing, and Urban Affairs, the Committee on Finance and the Committee on Homeland Security and Governmental Affairs of the Senate.</text></subparagraph></paragraph><paragraph id="HEE0BB6D21B0A4F90839443E9558D1274"><enum>(2)</enum><header>Forced labor</header><text>The term <quote>forced labor</quote>—</text><subparagraph id="H35CC8391F19C41E5AF9ED97370453272"><enum>(A)</enum><text>has the meaning given that term in section 307 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1307">19 U.S.C. 1307</external-xref>); and</text></subparagraph><subparagraph id="H678BB13A77A642D49FEA72137A9AA011"><enum>(B)</enum><text>includes convict labor and indentured labor under penal sanctions.</text></subparagraph></paragraph><paragraph id="HD4B217E3FFC34075B6FA665B694B193A"><enum>(3)</enum><header>Foreign person</header><text>The term <quote>foreign person</quote> means a person that is not a United States person.</text></paragraph><paragraph id="H4373E6AC62884D529B0844F98FD9C859"><enum>(4)</enum><header>Person</header><text>The term <quote>person</quote> means an individual or entity.</text></paragraph><paragraph id="HB3CC74A3B59144EEA67248ABAC9343CF"><enum>(5)</enum><header>United states person</header><text>The term <quote>United States person</quote> means—</text><subparagraph id="H902DAD48469C4CE2AFFC788C9218F378"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States;
