R. 6245</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211213">December 13, 2021</action-date><action-desc><sponsor name-id="B001298">Mr. Bacon</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require a review of the system used by the Department of Defense for categorizing unmanned aircraft systems, and for other purposes.</official-title></form><legis-body id="H45A9F4FB5846464AA9A2015F49382C0D" style="OLC"><section id="H1BC55E7B56EB4108809792997560BD08" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Unmanned Aircraft Systems Review Act of 2021</short-title></quote>.</text></section><section id="H8CE11F579A1F4647BF4E4EBCBE6F213F"><enum>2.</enum><header>Required review of department of defense unmanned aircraft systems categorization</header><subsection id="HE74AB5B0E6CF4516AF0916782D9463CC"><enum>(a)</enum><header>In general</header><text>The Under Secretary of Defense for Acquisition and Sustainment shall initiate a process—</text><paragraph id="H84A4D5050A9144F69F2D5C54C2FB8655"><enum>(1)</enum><text>to review the system used by the Department of Defense for categorizing unmanned aircraft systems, as described in Joint Publication 3–30 titled <quote>Joint Air Operations</quote>; and</text></paragraph><paragraph id="H404A0071C17F432C8DFD6DE5E96B1179"><enum>(2)</enum><text>to determine whether modifications should be made in the Department of Defense grouping of unmanned aerial systems into five broad categories, as in effect on the date of the enactment of this Act.</text></paragraph></subsection><subsection id="HB2007E310034412895F5E887C5BCF122"><enum>(b)</enum><header>Required elements for revision</header><text>If the Under Secretary determines under subsection (a) that the characteristics associated with any of the five categories of unmanned aircraft systems should be revised, the Under Secretary shall consider the effect a revision would have on—</text><paragraph id="HE025734E195044DAA585367C2AD9BE3D"><enum>(1)</enum><text>the future capability and employment needs to support current and emerging warfighting concepts;</text></paragraph><paragraph id="HF62F750968AC4DF59652D04BF53A3F8C"><enum>(2)</enum><text>advanced systems and technologies available in the current commercial marketplace;</text></paragraph><paragraph id="HD6BC26C4269F41FE8382E304A0BA799A"><enum>(3)</enum><text>the rapid fielding of unmanned aircraft systems technology; and</text></paragraph><paragraph id="H3CA2B7E80FB041969A3C3A1548136C7F"><enum>(4)</enum><text>the integration of unmanned aircraft systems into the National Airspace System.</text></paragraph></subsection><subsection id="H472D4B78081C4A5A8F01D24722B1906F"><enum>(c)</enum><header>Consultation requirements</header><text>In carrying out the review required under subsection (a), the Under Secretary shall consult with—</text><paragraph id="HD881A554874F4CB2BE636E95521ADCED"><enum>(1)</enum><text>the Secretary of each of the military departments;</text></paragraph><paragraph id="H1F963414755F487589641372B2D01FA7"><enum>(2)</enum><text>the Chairman of the Joint Chiefs of Staff;</text></paragraph><paragraph id="HA25B288794E4422493248E185F783121"><enum>(3)</enum><text>the Secretary of State; and</text></paragraph><paragraph id="HB57BC0B2A3964EC796E1EB71DAED52A3"><enum>(4)</enum><text>the Administrator of the Federal Aviation Administration.</text></paragraph></subsection><subsection id="HA04D8D3D69894FFC9D89EDB90F6D434F"><enum>(d)</enum><header>Report required</header><text>Not later than October 1, 2022, the Under Secretary shall submit to the congressional defense committees, the Committee on Transportation and Infrastructure and the Committee on Foreign Affairs of the House of Representatives, and the Committee on Commerce, Science, and Transportation and the Committee on Foreign Relations of the Senate a report that includes a description of—</text><paragraph id="H8CE88BD86448442D86EEF5DA35BA354B"><enum>(1)</enum><text>the results of the review initiated under subsection (a);</text></paragraph><paragraph id="H9FFAED293BA64EB38F2A6678048EE9A6"><enum>(2)</enum><text>any revisions planned to the system used by the Department of Defense for categorizing unmanned aircraft systems as a result of such review;</text></paragraph><paragraph id="HEED41C67BE564B038A32F592B5ACABBA"><enum>(3)</enum><text>the costs and benefits of any planned revisions; and</text></paragraph><paragraph id="H63FFA4C49F414118928CA03CAF9F8616"><enum>(4)</enum><text>a proposed implementation plan and timelines for such revisions.</text></paragraph></subsection></section></legis-body></bill>
