R. 6203</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211209">December 9, 2021</action-date><action-desc><sponsor name-id="B001298">Mr. Bacon</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food and Nutrition Act of 2008 to allow for blended workforces to carry out the supplemental nutrition assistance program under certain conditions.</official-title></form><legis-body id="HAA9878488C5D4E858D8A290DD6E867BE" style="OLC"><section id="H2E673958065049CDA2DD8A4E520EFB18" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency SNAP Staffing Flexibility Act of 2021</short-title></quote>.</text></section><section id="H88BA7C6F4CB04A6BB31209E9D082B6EB"><enum>2.</enum><header>Temporary emergency SNAP staffing flexibility</header><subsection id="H5583434BBBB24599BA9CBD1180D5EB70"><enum>(a)</enum><header>In general</header><text>Notwithstanding section 11(e)(6)(B) of the Food and Nutrition Act of 2008, a State agency (as defined in section 3 of the Food and Nutrition Act of 2008) may, by contract with the State agency at a reasonable cost in accordance with the State agency’s standard contracting rules, hire a contractor to undertake supplemental nutrition assistance program certification or carry out any other function of the State agency under such program.</text></subsection><subsection id="HA9E79F16D1E545D3A4C4D8ACB203F1FB"><enum>(b)</enum><header>Use</header><text>A State agency may use the authority provided in subsection (a) when the State experiences increases in supplemental nutrition assistance program applications or an inability to timely process such applications from causes that include—</text><paragraph id="H27B740047A264B02A9A2F1FB3BD67E1D"><enum>(1)</enum><text>pandemics and other health emergencies,</text></paragraph><paragraph id="H5C12940ED8AC46D5B93A996C6EF3817B"><enum>(2)</enum><text>seasonal workforce cycles,</text></paragraph><paragraph id="H2EA16F164BFD4206B380D6726A8E680B"><enum>(3)</enum><text>temporary staffing shortages, and</text></paragraph><paragraph id="H37D6F6A2E491488CA5AF45D46B7D6D0E"><enum>(4)</enum><text>weather or other natural disasters.</text></paragraph></subsection><subsection id="H76B0495F8993400AA3D90B26628EF5D9"><enum>(c)</enum><header>Requirements</header><text>A State agency that hires a contractor under subsection (a) shall ensure such action—</text><paragraph id="HD85B6AEAC42045009D69D4554BA08474"><enum>(1)</enum><text>is consistent with all principles under section 900.603 of title 5 of the Code of Federal Regulations; and</text></paragraph><paragraph id="H6E6973F89E0042EA97E8CDFFCF25699E"><enum>(2)</enum><text>does not supplant existing merit-based personnel in the State.</text></paragraph></subsection><subsection id="H7AC80940C7DF43019BE18AEF881B0005"><enum>(d)</enum><header>Notification</header><text>A State agency shall notify the Secretary of Agriculture of the intent to use the authority provided in this section.</text></subsection><subsection id="H0016A97EC595464F954D8768B7565E18"><enum>(e)</enum><header>Duration</header><text>To the maximum extent practicable, any new contract entered into, or any contract modified, under subsection (a) shall terminate not later than the date on which the cause for the increase in supplemental nutrition assistance program applications or an inability to timely process such applications subsides.</text></subsection><subsection id="HB829F98BAB954DEA9390DA7706DF8A3F"><enum>(f)</enum><header>Program design</header><text>Any action taken by a State agency under subsection (a) shall not be—</text><paragraph id="H0818332EB7E14D1AA3AC87D0F3530AF3"><enum>(1)</enum><text>considered to be a major change in the operations of such State agency for the purposes of section 11(a)(4) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020(a)(4)</external-xref>), or</text></paragraph><paragraph id="H252C717935C744C496136FB9ABB55784"><enum>(2)</enum><text>subject to any requirement specified in such section.</text></paragraph></subsection></section></legis-body></bill>
