which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to prohibit the Director of the National Institute of Allergy and Infectious Diseases from conducting or supporting research that causes significant pain or distress to a dog, and for other purposes.</official-title></form><legis-body id="H5C77AAB89F974B008FAE4378B30BC8D1" style="OLC"><section id="H3BB4D1ED46084F39BFE9C3103BCEA897" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Animal Abuse and Waste Act of 2021</short-title></quote> or the <quote><short-title>PAAW Act of 2021</short-title></quote>.</text></section><section id="H98536A026A644912A059878375788E9B"><enum>2.</enum><header>Prohibition on research causing significant pain or distress to dogs</header><subsection id="HFAC7D76872C94C3A916C8D93258BB208"><enum>(a)</enum><header>In general</header><text>Subpart 6 of part C of title IV of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/285f">42 U.S.C. 285f et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H42F9D00490EB47D3937A45DC47DC62DA" display-inline="no-display-inline"><section id="H347BD16AA66D405687405C7A0E878D2A"><enum>447D.</enum><header>Prohibition on research causing significant pain or distress to dogs</header><subsection id="H41ED089C10AE441D9FC4498D329D2F06"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Institute may not conduct or support any research that causes significant pain or distress to a dog.</text></subsection><subsection id="H7835522864DA45BF9C9BFB9DE81D933E"><enum>(b)</enum><header>Definition</header><text>In this section, the term <term>research that causes significant pain or distress</term> includes any study classified in pain category D or E by the Department of Agriculture.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H423982E3C0214C7F8B889C5C32964E0F"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) applies beginning on the date that is 90 days after the date of enactment of this Act.</text></subsection></section><section id="HB8AE6DD2CE1646BB862AC7EB00AFB319"><enum>3.</enum><header>Reporting</header><subsection id="HD51D7F572E6C4551A6E4EC98E5C1ABFD"><enum>(a)</enum><header>NIH study on research causing pain or distress to dogs</header><paragraph id="H5B9C232D89A343B2A4CC75A9915990EA"><enum>(1)</enum><header>In general</header><text>Not later than 6 months after the date of enactment of this Act, the Director of the National Institutes of Health shall—</text><subparagraph id="HBF3E3D33AB4C4F41A78EB7A677E2647C"><enum>(A)</enum><text>submit a report to the Congress on all ongoing or prospective research that causes significant pain or distress to a dog conducted or supported by the National Institute of Allergy and Infectious Disease; and</text></subparagraph><subparagraph id="H0EB7C1E6E90A499A90A83B7D0BFCCF3D"><enum>(B)</enum><text>include in such report the amount of funds obligated or estimated to be obligated for each such research.</text></subparagraph></paragraph><paragraph id="HD66EA9C1C6A9497EA2547DC88CB4A4B3"><enum>(2)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>research that causes significant pain or distress</term> includes any study classified in pain category C, D, or E by the Department of Agriculture.</text></paragraph></subsection><subsection id="HE768CD63E462427093B130C079A99958"><enum>(b)</enum><header>NIAID study on efforts To phase out use of dogs in testing</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, the Director of the National Institute of Allergy and Infectious Diseases shall submit a report to the Congress on—</text><paragraph id="H169533794A76459EB5D75A5B622CD327"><enum>(1)</enum><text>the efforts to phase out the use of dogs in studies that are conducted or supported by the Institute; and</text></paragraph><paragraph id="HFF800DD3C0C74DCC990BF34729E6735B"><enum>(2)</enum><text>any barriers to such phase out.</text></paragraph></subsection></section></legis-body></bill>
