which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Magnuson-Stevens Fishery Conservation and Management Act to encourage elimination of lionfish from United States waters by allowing individuals to exchange lionfish for tags authorizing fishing for certain species in addition to the number of such species otherwise authorized to be taken by such individuals, and for other purposes.</official-title></form><legis-body id="HACC9D2160BE64A35A7EA5D79B1EF5BC5" style="OLC"><section id="HF2EDDF8371464C47AE1973F6A2E0E66F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reef Assassin Act</short-title></quote>.</text></section><section id="H16BD39B779D846E494555CAA8C2AA1A8" section-type="subsequent-section"><enum>2.</enum><header>Encouraging elimination of lionfish</header><subsection id="HF142985614CD4F6CAD24564E9F8BF4C3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title III of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1851">16 U.S.C. 1851 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H67CBD6864B974174A8E6F33392FD1E22" style="OLC"><section id="HB5EC0FF7B16B42688A0278EC585EC82A"><enum>321.</enum><header>Encouraging elimination of lionfish</header><subsection id="H96969786D6EA42BCAE91A80B45A9DC37"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall issue regulations under which a participating State may issue to an individual submitting lionfish taken in Federal or State waters a tag authorizing the taking of a fish of a covered species in Federal waters in addition to any other fish of that species the individual is authorized to take in Federal waters.</text></subsection><subsection id="H1A3C89AC266745B095B7DBA8FB66FBBE"><enum>(b)</enum><header>Requirements for issuance of tag</header><text display-inline="yes-display-inline">The regulations shall require—</text><paragraph id="H12E7C69104944F06A3F5C0BFDD468599"><enum>(1)</enum><text>the submission of 100 lionfish for each tag issued;</text></paragraph><paragraph id="HAF4DEE45DFEB4DBFB9E45B0C8961D6B1"><enum>(2)</enum><text>that lionfish taken in State waters must be taken by an individual holding a valid license to engage in such fishing issued under the laws of such State; and</text></paragraph><paragraph id="H1E637F6DEE8D4BCAA1FAEBE08CF35D85"><enum>(3)</enum><text>that each lionfish shall be submitted by removing the tail, placing it in a resealable plastic bag, and submitting such bag to a participating State before the tail has significantly deteriorated.</text></paragraph></subsection><subsection id="H509AB9E4A7AF40ED88012B9D717566BF"><enum>(c)</enum><header>No limitation on number of tags</header><text>The regulations shall not limit the number of tags that may be issued to an individual.</text></subsection><subsection id="HC28354158E85471FB88430586921C2F5"><enum>(d)</enum><header>Use of tags</header><text display-inline="yes-display-inline">The regulations shall provide that a tag issued under the regulations—</text><paragraph id="HC3DE38B824E44908A3C41D9A502DDE88"><enum>(1)</enum><text>shall be valid for the 5-year period beginning on the date it is issued;</text></paragraph><paragraph id="HFE6E8601EFF548A5B816AE5FBEAFE8C6"><enum>(2)</enum><text>shall authorize only the recreational or commercial taking of a fish that complies with any size limit that otherwise applies to fishing for such fish in the waters in which it is taken;</text></paragraph><paragraph id="H0518DA24E9CF41EF98791F7F05C66D87"><enum>(3)</enum><text display-inline="yes-display-inline">shall authorize such taking without regard to any seasonal limitation that otherwise applies to the species of fish taken;</text></paragraph><paragraph id="H691702D3D1FD4297825F1F95600DF915"><enum>(4)</enum><text>shall authorize—</text><subparagraph id="HAD763D0C5B3F4E3CB921278CE1229F0A"><enum>(A)</enum><text>the transfer of tags to any other person; and</text></subparagraph><subparagraph id="HF0C7F4C690314BBD9434E9F6ACCB54C1"><enum>(B)</enum><text>use of transferred tags in the same manner as such tags may be used by the person to whom the tags were issued; and</text></subparagraph></paragraph><paragraph id="H381003D8AF374BF89C821F718B054989"><enum>(5)</enum><text>shall require that any fish taken under such tag outside any seasonal limitation that otherwise applies to such fish must have the tag fastened between the mouth and gill before being placed in any cooler.</text></paragraph></subsection><subsection id="HB6B0F9290CED4C33BC731005E83D8D3C"><enum>(e)</enum><header>Approval of State To participate</header><paragraph id="H676E72A8C06442FA9BBE476EBDBA1DAA"><enum>(1)</enum><header>Conditions</header><text display-inline="yes-display-inline">The regulations shall require that as a condition of approving a State to issue tags under this section the Secretary shall require the State to designate a repository for lionfish submitted for such tags.</text></paragraph><paragraph id="H77F1ECAB3D204276A226AE55E7225904"><enum>(2)</enum><header>Provision of freezer</header><text>The Secretary shall provide to each participating State freezers in which to store submitted lionfish, at a cost of not more than $500 for each freezer.</text></paragraph></subsection><subsection id="HF83FFAE6CF414BAD84D8B38A859C40D0"><enum>(f)</enum><header>Additional requirements</header><text>The Secretary shall—</text><paragraph id="HE0E83498392D44AB861B985BA72EF157"><enum>(1)</enum><text>encourage participating States to use existing infrastructure and staff or volunteers to conduct the State’s program under this section;</text></paragraph><paragraph id="H1B77171B2DA54EE0B375437CF60B6CBE"><enum>(2)</enum><text>include on the webpage of the National Marine Fisheries Service information about the program under this section; and</text></paragraph><paragraph id="H0A5542C763794835B7FC8D780BAE7B0F"><enum>(3)</enum><text display-inline="yes-display-inline">encourage State and local governments to work with retailers and distributors to advance the purchasing and consumption of lionfish.</text></paragraph></subsection><subsection id="HAB175E0E612645B1AE87F6E9D1F6A919"><enum>(g)</enum><header>Other provisions not affected</header><paragraph id="HC7F7950A89A94D8A97461D023036E6D5"><enum>(1)</enum><header>In general</header><text>This section—</text><subparagraph id="H6D7A75B27164418B83A8D8B1839D9FDD"><enum>(A)</enum><text>is intended to protect species of fish that are native to waters of the United States or the exclusive economic zone; and</text></subparagraph><subparagraph id="H05C8D34C638C4F2D8C26265333F3056D"><enum>(B)</enum><text>shall not be construed to constrain any fishery, fishing quota, or fishing allocation.</text></subparagraph></paragraph><paragraph id="H9EA5E660DB2B4AC0BF330F0EEA59FA57"><enum>(2)</enum><header>Limitation on consideration of tags</header><text>This section and tags issued or authorized to be issued under this section shall not be considered in any determination of fishing levels, quotas, or allocations.</text></paragraph></subsection><subsection id="HED7B2B4CCE4348A19EBCBD5A20BE3A6E"><enum>(h)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section—</text><paragraph id="HAD63D7C507F9488E80180569149DAAB8"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>covered fish</quote>—</text><subparagraph id="HB2218F9DDE22423E8C353B0084625DBE"><enum>(A)</enum><text>except as provided in subparagraph (B), means red snapper, gag grouper, triggerfish, and amberjack; and</text></subparagraph><subparagraph id="H54D76B6CB0D0459998A0038DF1626D39"><enum>(B)</enum><text display-inline="yes-display-inline">does not include any species included in a list of endangered species or threatened species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text></subparagraph></paragraph><paragraph id="HA609502C45E444F5A754D97EF7E7A13A"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>participating State</quote> means a State that has applied and been approved by the Secretary to issue tags under regulations under this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA2CB19DA816D4EFCA252EC1773F38D49"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in the first section of such Act is amended by adding at the end of the items relating to title III the following:</text><quoted-block display-inline="no-display-inline" id="H5F0DEDF324404ABF958D47EA6B3FE73D" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 321. Encouraging elimination of lionfish.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC891D28C649A4CC582A1535C898C0DD9"><enum>(c)</enum><header>Deadline for regulations</header><text>The Secretary of Commerce shall issue regulations under the amendment made by subsection (a) by not later than 60 days after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
