For purposes of this Act, the term <term>home energy service</term> means a service to provide home energy, as such term is defined in section 2603 of the <short-title>Low-Income Home Energy Assistance Act of 1981</short-title>, and electric service, as that term is used in the Public Utility Regulatory Policies Act of 1978, and the term <term>public water system</term> has the meaning given that term in section 1401 of the Safe Drinking Water Act. Nothing in this Act shall be construed to require forgiveness of outstanding debt owed to an entity or to absolve an individual of any obligation to an entity for service.</text></section><section id="H419C6F9F79F24072AE1BF9C3848FD08E" section-type="subsequent-section"><enum>3.</enum><header>Low-income household drinking water and wastewater assistance</header><subsection id="H031F9075E76B4F6E9AAC89F05A86B8B3"><enum>(a)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated $1,500,000,000 to the Secretary to carry out this section. Such sums shall remain available until expended.</text></subsection><subsection id="H41C39F5D7D954D61817A96E9E7820B70"><enum>(b)</enum><header>Low-Income household drinking water and wastewater assistance</header><text>The Secretary shall make grants to States and Indian Tribes to assist low-income households, particularly those with the lowest incomes, that pay a high proportion of household income for drinking water and wastewater services.</text></subsection><subsection id="H00B27FC0A7A94B5280FDF55C00D4B58D"><enum>(c)</enum><header>Use of LIHEAP resources</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary, States, and Indian Tribes, as applicable, shall use the existing processes, procedures, policies, and systems in place to carry out the Low-Income Home Energy Assistance Act of 1981, as the Secretary determines appropriate, including by using the application and approval process under such Act to the maximum extent practicable.</text></subsection><subsection id="H558001AED9A6416F98D94EE969F1772B"><enum>(d)</enum><header>Allotment</header><paragraph id="H94C329518C124D57B8E1513FC934A65F"><enum>(1)</enum><header>Factors</header><text display-inline="yes-display-inline">The Secretary shall allot amounts appropriated pursuant to this section to a State or Indian Tribe taking into account—</text><subparagraph id="HCD0CEFCB5B1F40379271BBB8D7280971"><enum>(A)</enum><text display-inline="yes-display-inline">the percentage of households in the State, or under the jurisdiction of the Indian Tribe, that are low-income, as determined by the Secretary;</text></subparagraph><subparagraph id="H7FC75D3019D147DAB9B0AEC9B9986113"><enum>(B)</enum><text>the average State or Tribal drinking water and wastewater service rates; and</text></subparagraph><subparagraph id="H34EB35E300334A02BCBEA4FBB925ECCC"><enum>(C)</enum><text>the extent to which the State or Indian Tribe has been impacted by the public health emergency. </text></subparagraph></paragraph><paragraph id="H2F72CF6AEA3B4B37A1F57CEE006CA90A"><enum>(2)</enum><header>Notification to Congress</header><text>Not later than 15 days after determining an amount to allot to each State or Indian Tribe pursuant to paragraph (1), and prior to making grants under this section, the Secretary shall notify Congress of such allotment amounts.</text></paragraph></subsection><subsection id="H7513A8A149D046C1A24D1CF5910ACDD6"><enum>(e)</enum><header>Determination of low-Income households</header><paragraph id="H3C9BD001EB4046E0B222D9546B8D68F5"><enum>(1)</enum><header>Minimum definition of low-income</header><text>In determining whether a household is considered low-income for the purposes of this section, a State or Indian Tribe shall—</text><subparagraph id="HF1504A9692CE41CB8AFBE3CBC3059A6C"><enum>(A)</enum><text>ensure that, at a minimum, all households within 150 percent of the Federal poverty line are included as low-income households; and</text></subparagraph><subparagraph id="HD74E74F6FF7243B6BE9F154EAF17A57D" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">consider households that have not previously received assistance under the Low-Income Home Energy Assistance Act of 1981 in the same manner as households that have previously received such assistance.</text></subparagraph></paragraph><paragraph id="HF951D474D1D64DC496783DF0219457C6"><enum>(2)</enum><header>Household documentation requirements</header><text>States and Indian Tribes shall—</text><subparagraph id="H2DDEC712B5DF4489ABF6E843F6BDC7EB"><enum>(A)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, seek to limit the income history documentation requirements for determining whether a household is considered low-income for the purposes of this section; and</text></subparagraph><subparagraph id="H22BF8F9DB74A44A6AE91C7E56AD2B8C6"><enum>(B)</enum><text display-inline="yes-display-inline">for the purposes of income eligibility, accept proof of job loss or severe income loss dated after February 29, 2020, such as a layoff or furlough notice or verification of application of unemployment benefits, as sufficient to demonstrate lack of income for an individual or household.</text></subparagraph></paragraph></subsection><subsection id="H9AB64BAB13D2408AA8ECFF1D6C613DEF"><enum>(f)</enum><header>Applications</header><text>Each State or Indian Tribe desiring to receive a grant under this section shall submit an application to the Secretary, in such form as the Secretary shall require.</text></subsection><subsection id="HFC6DF5C7C8854B4EB7A0DBC1F1931926"><enum>(g)</enum><header>State agreements with drinking water and wastewater providers</header><text>To the maximum extent practicable, a State that receives a grant under this section shall enter into agreements with public water systems, municipalities, nonprofit organizations associated with providing drinking water and wastewater services to rural and small communities, and Indian Tribes, to assist in identifying low-income households and to carry out this section.</text></subsection><subsection id="HCD6064D46BDA4F9893D7207389FD1DF0"><enum>(h)</enum><header>Administrative costs</header><text display-inline="yes-display-inline">A State or Indian Tribe that receives a grant under this section may use up to 15 percent of the granted amounts for administrative costs.</text></subsection><subsection id="H18E1B9D804B5403B8D5607FB65C8C721" commented="no"><enum>(i)</enum><header>Federal agency coordination</header><text>In carrying out this section, the Secretary shall coordinate with the Administrator of the Environmental Protection Agency and consult with other Federal agencies with authority over the provision of drinking water and wastewater services.</text></subsection><subsection id="H10DF48BA4EA749E284218F24937DCBD0"><enum>(j)</enum><header>Audits</header><text>The Secretary shall require each State and Indian Tribe receiving a grant under this section to undertake periodic audits and evaluations of expenditures made by such State or Indian Tribe pursuant to this section.</text></subsection><subsection id="HBA13E547CF764DDDBD39100856A8D109"><enum>(k)</enum><header>Reports to Congress</header><text>The Secretary shall submit to Congress a report on the results of activities carried out pursuant to this section—</text><paragraph id="H7809D5973606439E87D812AB09E1A346"><enum>(1)</enum><text>not later than 1 year after the date of enactment of this section; and</text></paragraph><paragraph id="HBB5C416336CF40E3B1188880DCDBB1C2"><enum>(2)</enum><text>upon disbursement of all funds appropriated pursuant to this section.</text></paragraph></subsection><subsection id="HF1FF1E6FC4074B22A39470A7619DA147"><enum>(l)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H629973FEFD054E1B92B4B4747B4F9E7A"><enum>(1)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> means any Indian Tribe, band, group, or community recognized by the Secretary of the Interior and exercising governmental authority over a Federal Indian reservation.</text></paragraph><paragraph id="H3B718C1368074FCBB333796B8EC45852"><enum>(2)</enum><header>Municipality</header><text display-inline="yes-display-inline">The term <term>municipality</term> has the meaning given such term in section 502 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>).</text></paragraph><paragraph id="HA53947A11763494282370B4CB160B9C6" commented="no"><enum>(3)</enum><header>Public health emergency</header><text display-inline="yes-display-inline">The term <term>public health emergency</term> means the public health emergency described in section 1135(g)(1)(B) of the Social Security Act.</text></paragraph><paragraph id="H581381676C414B1599C2FB8979AA9101"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services. </text></paragraph><paragraph id="HF317FC56ACFE42218A89A8555E37706B"><enum>(5)</enum><header>State</header><text>The term <term>State</term> means a State, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands of the United States, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands.</text></paragraph></subsection></section></legis-body></bill>
