which was referred to the <committee-name committee-id="HSY00">Committee on Science, Space, and Technology</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Director of the National Science Foundation to award grants for, and support research on, the development of makerspaces, and for other purposes.</official-title></form><legis-body id="H9C536B377B204B25B9DDAABC2832A579" style="OLC"><section id="H213848FE8FDA4829BE3B407A7DFE8BAF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Making Advances Kinetic Education, Research, and Skills Act</short-title></quote> or the <quote><short-title>MAKERS Act</short-title></quote>.</text></section><section id="H0957D628521648FEB92EF5B3FB99325A" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H5169CD2962B74C9DA87034BE3B898FA6"><enum>(1)</enum><text>Maker communities can be found in both rural and urban communities throughout the Nation.</text></paragraph><paragraph id="H4CA648E425FD4D40BFD3A3A9D0044AFF"><enum>(2)</enum><text>Making has been shown to engage and motivate children and adults in STEM disciplines.</text></paragraph><paragraph id="H18CC0841DD494B1E9CB5EA964627E0EA"><enum>(3)</enum><text>Informal education and makerspaces promote skills that employers desire, such as technical skills, problem-solving skills, teamwork, and analytical skills.</text></paragraph><paragraph id="H91962463E1514DBCB81438B5B8D0D1CE"><enum>(4)</enum><text>Studies have shown that underrepresented populations often have better successes in informal and out-of-school STEM than in formal STEM programs.</text></paragraph><paragraph id="H0B34F15313DE469E9DDE29F271323E0A"><enum>(5)</enum><text>Some studies have shown that makerspaces help to build not only technical hard skills but also collaboration and other soft skills that employers desire.</text></paragraph></section><section id="HA57B5D806D6B4E8DB64EEA25BB6D2BBC"><enum>3.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to encourage the formation and study of makerspaces to—</text><paragraph id="H67B6C9D3F90F4BB09F16072E1EFFCCA7"><enum>(1)</enum><text>engage populations within community colleges and community environments in STEM programs;</text></paragraph><paragraph id="HF7E373677B644C7CB9C80720B4A4559B"><enum>(2)</enum><text>develop desirable STEM technical and other skills including collaboration; and</text></paragraph><paragraph id="H769D69D57ED04BF4A816CAFA4BD5E6BD"><enum>(3)</enum><text>build a STEM-capable workforce.</text></paragraph></section><section id="H0D2C88251B61405AB87FA687088994D2"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions apply:</text><paragraph id="H33F806C6499645DDB6D7C5BE5648FEBF"><enum>(1)</enum><header>Historically Black college or university</header><text display-inline="yes-display-inline">The term “historically Black college or university” has the meaning given the term “part B institution” under section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>).</text></paragraph><paragraph id="HD6E2D6B28EAD4F21A8247ED9399D825D"><enum>(2)</enum><header>Makerspace</header><text>The term <quote>makerspace</quote> means a community space that—</text><subparagraph id="HE63EEFD40CDA4B49A8B9F95C3C542195"><enum>(A)</enum><text>provides access to tools, technology, and knowledge for learners and entrepreneurs;</text></subparagraph><subparagraph id="H8EF29EFF5E16472CBF7D99E1FCA4AB6E"><enum>(B)</enum><text>results in the prototyping or creation of physical goods, interdisciplinary learning, and educational innovation; and</text></subparagraph><subparagraph id="H43B51960981A4092907F306491EE2521"><enum>(C)</enum><text>supports the development of educational opportunities for personal growth, workforce training, and early stage business ventures.</text></subparagraph></paragraph><paragraph id="HD5660BDA973749A5B04AB51BB053F9A5"><enum>(3)</enum><header>Minority-serving institution</header><text display-inline="yes-display-inline">The term “minority-serving institution” means an institution listed in section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>).</text></paragraph><paragraph id="H8852F493EE534B178145A46765A95FEB"><enum>(4)</enum><header>Rural community</header><text display-inline="yes-display-inline">The term <quote>rural community</quote> has the meaning given the term <quote>rural area</quote> in section 520 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1490">42 U.S.C. 1490</external-xref>).</text></paragraph><paragraph id="H64C21845FE0F4661A6D10C0C0CC58B16"><enum>(5)</enum><header>STEM</header><text display-inline="yes-display-inline">The term <quote>STEM</quote> means the subjects of science, technology, engineering, and mathematics.</text></paragraph><paragraph id="H9F04E964875941B79180640018CD9260"><enum>(6)</enum><header>Workforce development component</header><text>The term <quote>workforce development component</quote> means—</text><subparagraph id="HA1E037F7368B41BDBF6A4DF5DF74E220"><enum>(A)</enum><text display-inline="yes-display-inline">an economic development board or corporation, including a State board or local workforce board;</text></subparagraph><subparagraph id="H4BC187046E6446B6A8A61E49643D6F36"><enum>(B)</enum><text>an internship program;</text></subparagraph><subparagraph id="HA2B84CF7A9764669BA4E1396EE697E13"><enum>(C)</enum><text>a certificate program;</text></subparagraph><subparagraph id="H3842553609BE4415B6AA7C24399B14C9"><enum>(D)</enum><text display-inline="yes-display-inline">employers or an employer or industry partnership representing multiple employers;</text></subparagraph><subparagraph id="HB40A10B36CEC474D9040BC863DBF12A9"><enum>(E)</enum><text display-inline="yes-display-inline">a community-based organization; or</text></subparagraph><subparagraph id="H67A8314815594C1DA2DE3798C2DA4F08"><enum>(F)</enum><text>any other program considered acceptable by the Director of the National Science Foundation.</text></subparagraph></paragraph></section><section id="H1F983E039535479E99BC12F9E7281FB3"><enum>5.</enum><header>Grant program for research and capacity building of makerspaces</header><subsection id="HA6B23D42BB1448A3B088763A52BC3C5D"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Director of the National Science Foundation shall award grants on a competitive basis to institutions of higher education, or consortia of such institutions, to support the research and development of makerspaces to assist in the formation of a STEM-capable workforce.</text></subsection><subsection id="H6AC789B2344B428781A588424B6B6949"><enum>(b)</enum><header>Use of funds</header><text display-inline="yes-display-inline">A grant awarded under this section may be used for—</text><paragraph id="H747DC68CAA3C4F95B2F7AB4F50BB5372"><enum>(1)</enum><text display-inline="yes-display-inline">research on the effectiveness of makerspaces in engaging students and the community in STEM skills and in teaching and learning, and the development, compilation, and dissemination of best practices on the use of makerspaces for STEM learning and workforce preparedness;</text></paragraph><paragraph id="HC3A2F370EE9148AA8D4555D2AA2371F2"><enum>(2)</enum><text>equipment to achieve the purpose under paragraph (1); and</text></paragraph><paragraph id="HD5BA810454A848EA8E1FC9781BC396DF"><enum>(3)</enum><text>any other activities the Director considers appropriate.</text></paragraph></subsection><subsection id="HA4F0D27BB8474F44974BB07CEF4D19BD"><enum>(c)</enum><header>Priority</header><text display-inline="yes-display-inline">In selecting grant recipients under this section, the Director shall give priority to applicants that—</text><paragraph id="H755ED902C8CF46AFABE50BC4335ECF45"><enum>(1)</enum><text>apply in partnership with 1 or more entities that are—</text><subparagraph id="HAEC19EC470D448248955F7E856E1D09B"><enum>(A)</enum><text>a workforce development component;</text></subparagraph><subparagraph id="H25C8633168EA4AE288CDEF26FB880019"><enum>(B)</enum><text display-inline="yes-display-inline">a high-need local education agency as described in section 9(b)(3) of the National Science Foundation Authorization Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/1862n">42 U.S.C. 1862n(b)(3)</external-xref>); or</text></subparagraph><subparagraph id="HCD8EA4F02C9C4695935DAF68A326950E"><enum>(C)</enum><text display-inline="yes-display-inline">an independent nonprofit or academic makerspace;</text></subparagraph></paragraph><paragraph id="H2A692E68137F4A52A6E8D2E421CF2167"><enum>(2)</enum><text>consist of 1 or more entities that are—</text><subparagraph id="H645BF1155ADB49F5A211B7713BE38297"><enum>(A)</enum><text>a community college; or</text></subparagraph><subparagraph id="HB797998F970041819AAA20ABE2560F9D"><enum>(B)</enum><text display-inline="yes-display-inline">a historically Black college or university or other minority-serving institution of higher education; or</text></subparagraph></paragraph><paragraph id="H3742374C3B264FAFAD1C2DFDD74B5FB3"><enum>(3)</enum><text>apply in partnership with or consist of an entity that is—</text><subparagraph id="H4AFAA8ECAD0248DF84D04A2849BDD4B1"><enum>(A)</enum><text>described in paragraph (1) or (2); and</text></subparagraph><subparagraph id="H4235915ECF2F4DD997C2012841DCB474"><enum>(B)</enum><text>operates within a rural community.</text></subparagraph></paragraph></subsection><subsection id="H222F094BCB0E4A1D93D1036D1BF6EE1D"><enum>(d)</enum><header>Limitation</header><text display-inline="yes-display-inline">Funds provided through a grant under this section may not be used for the construction of a physical building or facility to hold a makerspace unless the Director determines that such construction is necessary for reasons of safety or the use of relevant equipment.</text></subsection><subsection id="H1B79BFDB3B2143BA91FF96C6FA1E8DA1"><enum>(e)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Director may provide to entities receiving a grant or entities seeking such a grant under this section with technical assistance.</text></subsection></section></legis-body></bill>
