<section id="H0EBFFB85ED784456BEF3B106C7E8B068" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Corporate Capture Act</short-title></quote>.</text></section> <section id="HD4CADF1E2AD44C83A0D7FFD69E3FBB1B"><enum>2.</enum><header>Disclosure of conflicts of interest</header> <subsection id="HCAECA843F18F4B93B20776884AE99522"><enum>(a)</enum><header>In general</header><text>Section 553 of title 5, United States Code, is amended—</text>
<paragraph id="H5C3E2BC02F934BB082A084784ABABD9D"><enum>(1)</enum><text>in subsection (c)—</text> <subparagraph id="H3F6BE21B8849473499C4B2BFD776BD3A"><enum>(A)</enum><text>by inserting after <quote>(c)</quote> the following: <quote><header-in-text level="subsection" style="USC">Notice requirement.—</header-in-text></quote>;</text></subparagraph>
<subparagraph id="H73CBAE0D513B46828E6A6F154F6B23B0"><enum>(B)</enum><text>by striking <quote>After notice required</quote> and inserting the following: </text> <quoted-block style="USC" id="HDFFFA033B9E246B1B724A853E30F4BAD" display-inline="no-display-inline"> <paragraph id="H47D76C01D61D4E3194D200C3FC16E9A3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">After notice required </text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="H9633FBB3119E4679BB2F41E8997199EB"><enum>(C)</enum><text>by adding at the end the following: </text> <quoted-block style="USC" id="HF8CB8BDA0EA8472293EB74D57B98654A" display-inline="no-display-inline"> <paragraph id="HA6207DFBE0A14FB0AF029A9DF2D5F167"><enum>(2)</enum><header>Submissions including scientific, economic, or technical materials</header><text display-inline="yes-display-inline">In the case of any submission by an interested person that includes a scientific, economic, or technical study, or the nonpublic results of any scientific research, the interested person shall disclose to the agency, the following:</text>
<subparagraph id="H485D5C397F07421593F94FD61DA03CF5"><enum>(A)</enum><text>What funds were received by the person who conducted the study or research.</text></subparagraph> <subparagraph id="H02EF5E1EA4394DA0A11C3786644B6338"><enum>(B)</enum><text>The entity that provided the funds referred to in subparagraph (A).</text></subparagraph>
<subparagraph id="H5F38F91DAFD3467CAA9ABB21B3A915C0"><enum>(C)</enum><text>Any entity that was allowed to review or revise the study or research, and the extent of that review or revision.</text></subparagraph> <subparagraph id="H9392B29DD94949CFAC27FA924367219D"><enum>(D)</enum><text>Any financial relationship between the person who conducted the study or research, and any party that would be affected by the proposed rule. </text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HA472E6EA41AE4E128258BB2CD87699A9"><enum>(2)</enum><text>in subsection (c), in the first sentence, by inserting <quote>, subject to subsections (f) and (h),</quote> after <quote>the agency shall</quote>; and</text></paragraph> <paragraph id="H71AE2D7682794191B62BEF0CF6A31A18"><enum>(3)</enum><text>by adding at the end the following:</text>
<quoted-block id="H038C57F9EA4A49C388CBEC12BAF3F5EC" style="OLC">
<subsection id="HDB13171BBDD441D4BE5FE106E6FA644A"><enum>(f)</enum><text>With respect to any submission by an interested person under subsection (c) or any other submission by an interested person relating to a proposed rule or final rule that incorporates or includes a scientific, economic, or technical study, or any other result of scientific research not published in a publicly available peer-reviewed publication, the interested person, in making that submission, shall disclose—</text> <paragraph id="H661BF3D867714B3D9B2E3223D53A8D29"><enum>(1)</enum><text>the source of the funding for that study or research, as applicable;</text></paragraph>
<paragraph id="H9B5873BE499B4FA4A7CEAA6AAFA8E97A"><enum>(2)</enum><text>any entity that sponsored the study or research;</text></paragraph> <paragraph id="H15E0BA254C014B4F9E5DDDEBBEE2351D"><enum>(3)</enum><text>the extent to which the findings of the study or research were reviewed by a party that may be affected by the rulemaking to which the submission relates;</text></paragraph>
<paragraph id="H5081E038F7EA41BA97831B6B08D41B88"><enum>(4)</enum><text>the identity of any party identified under paragraph (3); and</text></paragraph> <paragraph id="H15480B0651304868BF6AEA75C784C417"><enum>(5)</enum><text>the nature of any financial relationship, including a consulting agreement, the support of any expert witness, and the funding of research, between any person that conducted the study or research and any interested person with respect to the rulemaking to which the submission relates.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H11B80BB9A8AC4D1294A3EA3F15D043C7"><enum>(b)</enum><header>Application</header><text>Section 553(f) of title 5, United States Code, as amended by subsection (a), shall apply with respect to submissions made by interested persons on and after the date of enactment of this Act.</text></subsection></section> <section id="H755C1E33F6004963B845E305B8E1045A"><enum>3.</enum><header>Increasing disclosures relating to studies and research</header> <subsection id="H2FC72FACA52343B4B232E997A4C70E95"><enum>(a)</enum><header>In general</header><text>Section 553 of title 5, United States Code, as amended by section 1 of this Act, is amended by adding at the end the following:</text>
<quoted-block id="H6078A5EFEF4D4A1E966EAA162DFE3DD0" style="OLC">
<subsection id="H7A7B32D5D9B74C91A3A07A337B6CD9E3"><enum>(g)</enum><text>With respect to a study or research that is submitted by an interested person to an agency under subsection (c), the agency shall ensure that the study or research is available to the public, unless disclosure is prohibited under section 552 of this title. </text></subsection> <subsection id="H00D7E4B8D5D04938AA69B1E9149E6ED6"><enum>(h)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="H1FE0CABE9F8B4E9FBC16EFF2275A871F"><enum>(1)</enum><text>If a study or research submitted by an interested person to an agency under subsection (c) presents a conflict described in paragraph (2), the agency shall disclose the conflict to the public by publication in the Federal Register and on the agency website, unless disclosure is prohibited under section 552 this title.</text></paragraph>
<paragraph id="HDD09CE8378B742CDAA7408F7EBDAA548" indent="up1"><enum>(2)</enum><text>A conflict described in this paragraph means a study or research for which—</text> <subparagraph id="H2D8F61CF14534753A1C6AC39F83F8615"><enum>(A)</enum><text>not less than 10 percent of the funding for the study or research is from an entity that is regulated by the agency; or</text></subparagraph>
<subparagraph id="H3C36C730234A42A5ADDCCEFBCFC1A83B"><enum>(B)</enum><text>an entity that is regulated by the agency exercises editorial control over the study or research.</text></subparagraph></paragraph></subsection> <subsection id="H61ABE983359C40C788350964DE92F219"><enum>(i)</enum><text>With respect to a rulemaking under this section, an agency shall include in the notice of proposed rulemaking required under subsection (b) and in the final rule published under subsection (d) a description of how the agency considered scientific evidence, including any study or research.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H0207E17460F14FAF83035C150CF42D09"><enum>(b)</enum><header>Application</header><text>Subsections (g), (h), and (i) of section 553 of title 5, United States Code, as added by subsection (a), shall apply with respect to submissions made by interested persons on and after the date of enactment of this Act.</text></subsection></section> <section id="H6198465E15E341ACA8BE37829F636A7B"><enum>4.</enum><header>Disclosure of inter-governmental rule changes</header> <subsection id="H1253B0CABA9048ABAF2F6844DB93729C"><enum>(a)</enum><header>Definitions</header><text>In this section—</text>
<paragraph id="HA74612766A82449695DD05966D784678"><enum>(1)</enum><text>the term <term>Administrator</term> means the Administrator of the Office;</text></paragraph> <paragraph id="H63DC568EB52A4496A1C5592072C397F4"><enum>(2)</enum><text>the terms <term>agency</term>, <term>regulatory action</term>, have the meanings given those terms in section 3 of the Executive Order;</text></paragraph>
<paragraph id="HA1DF013652D74FCAA00E319446AA18FE"><enum>(3)</enum><text>the term <term>Executive Order</term> means Executive Order 12866 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note; relating to regulatory planning and review); and</text></paragraph> <paragraph id="HE5309641FE5444F9A3AEE5A0998BFC9C"><enum>(4)</enum><text>the term <term>Office</term> means the Office of Information and Regulatory Affairs.</text></paragraph></subsection>
<subsection id="H1E55D0F490544A87809B9D265FEAEF97"><enum>(b)</enum><header>Requirement</header><text>With respect to any regulatory action that an agency provides to the Office under section 6(a)(3) of the Executive Order, the agency shall—</text> <paragraph id="H72A58D6BF30E4758A002F1D55ABF0AAD"><enum>(1)</enum><text>not later than the date on which the agency publishes the general notice of proposed rulemaking required under section 553(b) of title 5, United States Code, with respect to the action, place in the rulemaking docket—</text>
<subparagraph id="HC9229BAACCC84FCC8CC4037C77926E63"><enum>(A)</enum><text>the substance of any changes between the text of the draft regulatory action that the agency provided to the Office under section 6(a)(3)(B)(i) of the Executive Order and the text published in that general notice with respect to the action; and</text></subparagraph> <subparagraph id="HE723B37F06524C1B9C5A2054A1C67634"><enum>(B)</enum><text>a statement regarding whether any change described in subparagraph (A) was made at the request of—</text>
<clause id="HD4917FA9725C4019ACC66D30CD32BB36"><enum>(i)</enum><text>the Office;</text></clause> <clause id="HFAFF074D25234BF3B9FA4C6958887038"><enum>(ii)</enum><text>another agency; or</text></clause>
<clause id="H2D92CF4431114DFD87BDBED63AC1CD56"><enum>(iii)</enum><text>a Member of Congress; and</text></clause></subparagraph></paragraph> <paragraph id="H6166C0805E4349B89DE118A75539A4F3"><enum>(2)</enum><text>not later than the date on which the agency publishes the regulatory action in the Federal Register, place in the rulemaking docket—</text>
<subparagraph id="HF9B3DEDD119540A1B4AACDC14A6DFD1C"><enum>(A)</enum><text>the substance of any changes between the text of the regulatory action that the agency provided to the Office under section 6(a)(3)(B)(i) of the Executive Order and the text of the regulatory action that the agency published in the Federal Register; and</text></subparagraph> <subparagraph id="H3AD214A90E1544289B6F3040DC8F0273"><enum>(B)</enum><text>a statement regarding whether any change described in subparagraph (A) was made at the request of—</text>
<clause id="H24B47EE878634BCA9E0FA77D06F170CC"><enum>(i)</enum><text>the Office;</text></clause> <clause id="H178C98F9C1D6465B945B20804E51B275"><enum>(ii)</enum><text>another agency; or</text></clause>
<clause id="H24538D898FFF4CEB8BF18D73E49C000C"><enum>(iii)</enum><text>a Member of Congress.</text></clause></subparagraph></paragraph></subsection></section> <section id="HF403405705C64A1BB9A11921D3EFDC8B"><enum>5.</enum><header>Justification of withdrawn rules</header> <subsection id="HC2B31AC99DC84D06A61A2E5DAE902AFE"><enum>(a)</enum><header>Definitions</header><text>In this section—</text>
<paragraph id="HD3CB683FCE8E4A2890984E3784C29A8C"><enum>(1)</enum><text>the term <term>Administrator</term> means the Administrator of the Office;</text></paragraph> <paragraph id="HFBC521A10D1B4FB9AA498CBFA6F0E36C"><enum>(2)</enum><text>the terms <term>agency</term> and <term>regulatory action</term> have the meanings given those terms in section 3 of the Executive Order;</text></paragraph>
<paragraph id="H641A627D1B044436B921770012A20F53"><enum>(3)</enum><text>the term <term>Executive Order</term> means Executive Order 12866 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note; relating to regulatory planning and review); and</text></paragraph> <paragraph id="HC50E32B17ACC4A9F848366E3BF6EBB2F"><enum>(4)</enum><text>the term <term>Office</term> means the Office of Information and Regulatory Affairs.</text></paragraph></subsection>
<subsection id="HD0E0E72C341E46A19C8AD2CD5C64C23F"><enum>(b)</enum><header>Requirement</header>
<paragraph id="HE661EF189F104DA7BB7E1632ACFCDC3B"><enum>(1)</enum><header>In general</header><text>If an agency withdraws a regulatory action after providing the action to the Office under section 6(a)(3) of the Executive Order (or, if the agency does not provide the regulatory action to the Office under that section, after publishing the general notice of proposed rulemaking with respect to the action under section 553(b) of title 5, United States Code), the agency shall publish in the Federal Register and on the website of the agency a statement regarding the decision by the agency to withdraw the action.</text></paragraph> <paragraph id="H71BDCC8A753C4099A8BD73B7EB4DC283"><enum>(2)</enum><header>Contents</header><text>A statement required under paragraph (1) with respect to a decision by an agency to withdraw a regulatory action shall include, at a minimum—</text>
<subparagraph id="H2934E7498A714203BF4C4DAF4A5471DF"><enum>(A)</enum><text>a detailed explanation of the reasons that the agency withdrew the action; and</text></subparagraph> <subparagraph id="H161204AB22334DC59566590C7D82D6B5"><enum>(B)</enum><text>an explanation regarding whether the decision by the agency to withdraw the action was based, in whole or in part, on a request by, or input from—</text>
<clause id="H2A0DFBE93CC04020882915EC7D4C9077"><enum>(i)</enum><text>the Office;</text></clause> <clause id="H06D6B4D842424D179B4ECA5FE3222314"><enum>(ii)</enum><text>another agency;</text></clause>
<clause id="H402BF16407FC4462A3F87897BA4F7DF0"><enum>(iii)</enum><text>a Member of Congress;</text></clause> <clause id="HDF39E5F44D15461DA955C07C09789A7F"><enum>(iv)</enum><text>a State, local, or tribal government; or</text></clause>
<clause id="HEF0C5D248377483786CDE37295EFB35D"><enum>(v)</enum><text>an organization, a corporation, a member of the public, or another interested party.</text></clause></subparagraph></paragraph></subsection></section> <section id="HFACF28D0F40E465ABCDE0C72A366F1EA"><enum>6.</enum><header>Negotiated rulemaking</header> <subsection id="H4F827DB505C94C1C91E664D2AC834D96"><enum>(a)</enum><header>In general</header><text>Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, is amended—</text>
<paragraph id="H59B290B106A14C168F466DCA15EE275B"><enum>(1)</enum><text>in section 561, in the first sentence, by inserting <quote>between agencies and Federal, State, local, or tribal governments. This subchapter shall apply only to information negotiations between Federal, State, local, or tribal governments</quote> after <quote>informal rulemaking process</quote>;</text></paragraph> <paragraph id="H0BB128FB12AF49FFAD97F855BCC9EA66"><enum>(2)</enum><text>in section 563—</text>
<subparagraph id="H8A8EF5704DAD4A2983C4FA372AF2943D"><enum>(A)</enum><text>in subsection (a)—</text> <clause id="H3F0C77453493487F8382E69AB8303097"><enum>(i)</enum><text>in paragraph (2), by inserting <quote>Federal, State, local, or tribal government</quote> after <quote>identifiable</quote>; and</text></clause>
<clause id="H7B020241EEE842CB9F6147255DA9C2C3"><enum>(ii)</enum><text>in paragraph (3), by striking <quote>persons who</quote> and inserting <quote>representatives of Federal, State, local, and tribal governments that</quote>; and</text></clause></subparagraph> <subparagraph id="HCE0DBC0BA06C456083E92A9A44380B02"><enum>(B)</enum><text>in subsection (b)—</text>
<clause id="H3DC0C327A7DF40B2A14F7D817F97E865"><enum>(i)</enum><text>in paragraph (1)—</text> <subclause id="HEEE20D97A3794650A4861C810B893CEC"><enum>(I)</enum><text>in subparagraph (A)—</text>
<item id="H4B65D97308384C5BBE3B40C96E538D56"><enum>(aa)</enum><text>by striking <quote>persons who</quote> and inserting <quote>Federal, State, local, or tribal governments that</quote>; and</text></item> <item id="H607E0F41D8AB443CBC831F639BBFD957"><enum>(bb)</enum><text>by striking <quote>, including residents of rural areas</quote>; and</text></item></subclause>
<subclause id="H1BFCE138C01949248AFCE465A5163D5D"><enum>(II)</enum><text>in subparagraph (B)—</text> <item id="HE5DE7BD95F8F4157A101B45EA2811C38"><enum>(aa)</enum><text>by striking <quote>with such persons</quote> and inserting <quote>with representatives of those governments</quote>; and</text></item>
<item id="H371DBBAC82AC42A5A61E19D7CCA2F20E"><enum>(bb)</enum><text>by striking <quote>to such persons</quote> and inserting <quote>to those governments</quote>; and</text></item></subclause></clause> <clause id="H1755B8C51E614FC59A62939F80ACA969"><enum>(ii)</enum><text>in paragraph (2), in the second sentence—</text>
<subclause id="H17ECC4D65570431F9EC0A23DC9897092"><enum>(I)</enum><text>by striking <quote>persons who</quote> and inserting <quote>representatives of Federal, State, local, or tribal governments that</quote>; and</text></subclause> <subclause id="H9469E841C0CE4874AFF16E0828ADC23C"><enum>(II)</enum><text>by striking <quote>, including residents of rural areas</quote>;</text></subclause></clause></subparagraph></paragraph>

<clause id="H0863CB73EBA7454E9312252A8520C71A"><enum>(i)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">and applications</header-in-text></quote>; and</text></clause> <clause id="H35E37B2CA22946CAAECA8A5C20B3E960"><enum>(ii)</enum><text>by striking <quote>and applications</quote>;</text></clause></subparagraph></paragraph>

<subparagraph id="HB4A9CC253ABE4E3AB8323B96CBAC7DB5"><enum>(A)</enum><text>by striking <quote>and encourage agency use of</quote>; and</text></subparagraph> <subparagraph id="H098CE193B86D4FFCB12859C754657707"><enum>(B)</enum><text>by inserting <quote>between Federal, State, local, and tribal governments</quote> after <quote>negotiated rulemaking</quote>.</text></subparagraph></paragraph></subsection>
<subsection id="HE82BD89270D74CC3A00D219F5106D76A"><enum>(b)</enum><header>Technical and conforming amendments</header>

<subsection id="H2BAA748284CF4E2B831AD9B9AEEAFA7C"><enum>(b)</enum><header>Prohibitions</header><text display-inline="yes-display-inline">With respect to a regulatory action of an agency that may be subject to review by the Office under section 6(b) of the Executive Order, the Office may not engage in communications or meetings with the agency before the date on which the agency submits the regulatory action to the Office under section 6(a)(3) of the Executive Order.</text></subsection> <subsection id="HFC77F4D6FA2A4ECEB15B09F59A2FFDC5"><enum>(c)</enum><header>Time period for OIRA review</header> <paragraph id="H9687FD7CB5324C0BA260B57626715412"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Office shall complete a review of a significant regulatory action under section 6(b) of the Executive Order not more than 45 days after the date on which the Office receives the significant regulatory action under section 6(a)(3) of the Executive Order.</text></paragraph>
<paragraph id="H76D060057B1F4606821D9426FAC0CDDB"><enum>(2)</enum><header>Extension</header><text>The Office may extend the 45-day period described in paragraph (1) by a single 45-day period if the Office provides the agency with, and makes publicly available, a written justification for the extension.</text></paragraph> <paragraph id="H3712BCEF933D4FF3B9150CEF85197B03"><enum>(3)</enum><header>Publication of regulatory action</header><text>If the Office waives review of a significant regulatory action of an agency under section 6(b)(2) of the Executive Order without a request for further consideration or does not notify the agency in writing of the results of the review under section 6(b) of the Executive Order within the time frame described in paragraph (1) or (2), the agency may publish the significant regulatory action in the Federal Register.</text></paragraph></subsection></section>
<section id="HA3440503879849AF8DF48276C0172207"><enum>8.</enum><header>Penalizing public companies that submit false information to agencies</header><text display-inline="no-display-inline">Section 553 of title 5, United States Code, as amended by section 3 of this Act, is amended by adding at the end the following:</text> <quoted-block id="H3E4CB62759A74A0A907600700EA815F2" style="OLC"> <subsection id="HBCED6D40132B43748FCBFD6C3375F085" display-inline="no-display-inline"><enum>(j)</enum><text>Any entity required to file an annual report under section 13 of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78m">15 U.S.C. 78m</external-xref>) that uses any false writing or document knowing the same to contain any materially false, fictitious, or fraudulent statement or entry with respect to a rulemaking under this section shall be fined a minimum of $250,000 for their first violation; fines shall double per violation for each subsequent violation.</text></subsection>
<subsection id="HC348978B13BA49849626E5E84EDC8CAD"><enum>(k)</enum><text>Any entity required to file an annual report pursuant to section 13 of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78m">15 U.S.C. 78m</external-xref>), shall include in a submission under subsection (c)(2) the annual report filed in the year previous to such submission.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H02DA307E8B5B4846B3326C654ECDAF78"><enum>9.</enum><header>Establishment of the office of the public advocate</header><text display-inline="no-display-inline">Section 401 of the Ethics in Government Act of 1978 (5 U.S.C. App.) is amended by adding at the end the following:</text>

<clause id="HDEF00D3F009C440B9EFD08E5A9D8F833"><enum>(iii)</enum><text>be entitled to compensation at the same rate as the highest rate of basic pay established for the Senior Executive Service under section 5382 of title 5, United States Code;</text></clause> <clause id="H416E160834DD46CFA80B0359D827BC64"><enum>(iv)</enum><text>have a background in customer service, consumer protection, and administrative law;</text></clause>
<clause id="HD12490CF6E124C4E9253442A0CEAA7A9"><enum>(v)</enum><text>have experience representing the public in cases involving rules (as defined in section 551 of title 5, United States Code);</text></clause> <clause id="HD9099AE9113C43FCA8B1442EECD4071C"><enum>(vi)</enum><text>not have worked as an officer or employee in any Federal agency during the 2-year period preceding appointment under this subparagraph; and</text></clause>
<clause id="HCB597375A37A41C9986B54259BD8E075"><enum>(vii)</enum><text>agree not to accept an offer of employment with a Federal agency for not less than 5 years after ceasing to serve as the National Public Advocate.</text></clause></subparagraph></paragraph> <paragraph id="HB10BD1E78BA74D3793E9BB9F912DA8E3" indent="up1"><enum>(2)</enum><text>The duties of the Office of the Public Advocate shall include—</text>
<subparagraph id="HFA93459386EA456BA969B8802E3D6B57"><enum>(A)</enum><text>assisting individuals in resolving conflicts with agencies;</text></subparagraph> <subparagraph id="H8E29F5EE776447DAAA2C2FCD7DD2BCDE"><enum>(B)</enum><text>assisting agencies in soliciting public participation in the rulemaking process;</text></subparagraph>
<subparagraph id="H5C2A20E9DAD649859568DFEA52B53BFA"><enum>(C)</enum><text>assisting individuals in participating in the rulemaking process;</text></subparagraph> <subparagraph id="HC063FE3E1D2F46C08765F3C6D7AB0C39"><enum>(D)</enum><text>identifying areas in which the public has problems in dealing with agencies and proposing changes to mitigate those problems;</text></subparagraph>
<subparagraph id="H76AC25668C06498AA4D0910CFFB3CD1D"><enum>(E)</enum><text>conducting research on social equity impacts of the rulemaking process;</text></subparagraph> <subparagraph id="HE15166BB092B45A3854E222D54E59901"><enum>(F)</enum><text>developing and coordinating social equity definitions across the executive branch;</text></subparagraph>
<subparagraph id="H7E08C8BE6AA340B09B0F677870AD960E"><enum>(G)</enum><text>performing a social equity assessment for rules when requested by the public through comments submitted through the process described in section 553 of title 5, United States Code; and</text></subparagraph> <subparagraph id="H53C2595769C544AFAFC5E20006E8FAC7"><enum>(H)</enum><text>facilitating means by which individuals and populations that have not traditionally been invited into the rulemaking process may be better included in the rulemaking process, including by recommending and implementing new outreach plans, partnering with community-based organizations to propagate information about rules changes, and ensuring rules change information is written in clear, accessible language that is accessible in multiple languages.</text></subparagraph></paragraph>
<paragraph id="H96089F46BA0C491C8A6EE68A84B34EE8" indent="up1"><enum>(3)</enum><text>Not later than 180 days after the date on which the National Public Advocate is appointed under this subsection or 180 days after the date of enactment of this subsection, whichever is later, the National Public Advocate shall propose regulations to carry out this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HE96229A7AA88421BABAC66B4067655C1"><enum>10.</enum><header>Actions by private persons</header> <subsection id="HA3256499592747F581D495909C5C3A44"><enum>(a)</enum><header>Definitions</header><text>In this section, the terms <term>agency</term> and <term>rule</term> have the meanings given those terms in section 551 of title 5, United States Code.</text></subsection>
<subsection id="H5392F157B3934ACE8B467509782FFE72"><enum>(b)</enum><header>Actions</header>
<paragraph id="H8B8216EFE8EA4BECA68AB6EDFACBCE7C"><enum>(1)</enum><header>In general</header><text>A person may bring a civil action for the person and for the United States Government, in the name of the Government, against any person, including the United States Government and any other governmental instrumentality or agency to the extent permitted by the Eleventh Amendment to the Constitution of the United States, for—</text> <subparagraph id="HE725E33B2A22458DABFFA88ABE04A1F8"><enum>(A)</enum><text>a violation of a final rule issued by an agency; or</text></subparagraph>
<subparagraph id="H4CB7ACF4CD744118B21B77F9542A6E8E"><enum>(B)</enum><text>the failure of the head of an agency to comply with any requirement under this Act; or</text></subparagraph> <subparagraph id="H9AB63BA00B594CED812C844D46B389CA"><enum>(C)</enum><text>a violation of Section 8 of this Act.</text></subparagraph></paragraph>
<paragraph id="H3D3FF6C0AA77418D890655B21CDCACD2"><enum>(2)</enum><header>Notice</header><text>A copy of the complaint and written disclosure of substantially all material evidence and information the person possesses shall be served on the Government pursuant to rule 4(d)(4) of the Federal Rules of Civil Procedure. The Government may elect to intervene and proceed with the action within 60 days after it receives both the complaint and the material evidence and information.</text></paragraph> <paragraph id="HE7956A00905940A59BBC9B59E18324A2"><enum>(3)</enum><header>Party conducting the action</header><text>Before the expiration of the 60-day period under paragraph (2), the Government shall—</text>
<subparagraph id="H7175EFD4EC924450A4706EA880C5A0C0"><enum>(A)</enum><text>proceed with the action, in which case the action shall be conducted by the Government; or</text></subparagraph> <subparagraph id="H479C8C0BDBF04F239699CF001B0E9681"><enum>(B)</enum><text>notify the court that it declines to proceed with the action, in which case the person bringing the action shall have the right to conduct the action.</text></subparagraph></paragraph>
<paragraph id="H5E7655A4845D44178E789343E7769FB0"><enum>(4)</enum><header>Award to plaintiff</header>
<subparagraph id="H7C3F188F8C7D491C8E473C986D0693BF"><enum>(A)</enum><header>Government proceeds with action</header><text>If the Government proceeds with an action brought by a person under this subsection, the person shall receive at least 15 percent but not more than 25 percent of the proceeds of the action or settlement of the claim, depending upon the extent to which the person substantially contributed to the prosecution of the action. Any payment to a person under this subparagraph shall be made from the proceeds. The person may also receive an amount for reasonable expenses that the court finds to have been necessarily incurred, plus reasonable attorney’s fees and costs. The expenses, fees, and costs may be awarded against the defendant.</text></subparagraph> <subparagraph id="H8287663327BE4A39A6FB8AE14B3ACB83"><enum>(B)</enum><header>Government does not proceed with action</header><text>If the Government does not proceed with an action under this subsection, the person bringing the action or settling the claim shall receive an amount which the court decides is reasonable for collecting the civil penalty and damages. The amount may not be less than 25 percent and not more than 30 percent of the proceeds of the action or settlement and shall be paid out of the proceeds. The person shall also receive an amount for reasonable expenses that the court finds to have been necessarily incurred, plus reasonable attorney’s fees and costs. The expenses, fees, and costs may be awarded against the defendant.</text></subparagraph></paragraph></subsection></section>
<section id="H7C75C8CF320E4F30B863FC5BE089512F"><enum>11.</enum><header>Scope of review</header><text display-inline="no-display-inline">Section 706 of title 5, United States Code, is amended—</text> <paragraph id="HA787DDB953B64E9DB6BC0600CB98756A"><enum>(1)</enum><text>in the first sentence of the matter preceding paragraph (1)—</text>
<subparagraph id="HE8287044668345FB9F7D0E83190542FA"><enum>(A)</enum><text>by striking <quote>agency action.</quote> and inserting <quote>agency action. If a statute that an agency administers is silent or ambiguous, and an agency has followed the procedures in section 553 or 554 of this title, as applicable, a reviewing court shall defer to the agency’s reasonable or permissible interpretation of that statute.</quote>; and </text></subparagraph> <subparagraph id="HCFA5C30229484F449583AABA10500D8C"><enum>(B)</enum><text>by striking <quote>To the extent necessary</quote> and inserting: </text>

<subsection id="H37C9D7E28A9A4C9CAE92EA803AE4B14E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">To the extent necessary</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H93DCF93A76B3451188C16E756FB89AAE"><enum>(2)</enum><text>by adding at the end the following:</text>
<quoted-block id="HE80D938B959444FBB753245E7154664C" style="OLC">
<subsection id="H3405ABB0D46A4DC1A559A340E4DF7F4B"><enum>(b)</enum><header>Unreasonable delay</header><text>For purposes of subsection (a)(1), unreasonable delay shall include—</text> <paragraph id="HF0198C505C2A4C2AB7AB29AC54E665D6"><enum>(1)</enum><text>when an agency has not issued a notice of proposed rulemaking before the date that is 1 year of the date of enactment of the legislation mandating the rulemaking, where no deadline for the rulemaking was specified in the enacted law;</text></paragraph>
<paragraph id="H6084725233054204B4842EBD7A25B737"><enum>(2)</enum><text>when an agency has not issued a final version of a proposed rule before the date that is 1 year of the date on which the proposed rule was published in the Federal Register; and</text></paragraph> <paragraph id="H925870E68AD54E23AC84F80B5E10D774"><enum>(3)</enum><text>when an agency has not implemented a final rule before the date that is 1 year of the implementation date published in the Federal Register or, if no implementation date was provided, before the date that is 1 year of the date on which the final rule was published in the Federal Register.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H3BC5A7F5CF024C2E9CE69214A81B5552"><enum>12.</enum><header>Expanding rulemaking notifications</header><text display-inline="no-display-inline">Section 553 of title 5, United States Code, as amended by section 8 of this Act, is amended by adding at the end the following:</text> <quoted-block id="H932734A92EB44626BEC9E634A6E6C455" style="OLC"> <subsection id="H0C4A23230ADB49FB84B9A59F2663AE0D"><enum>(l)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="H255F6826C1F84103AB31C2B5D33BC3C5"><enum>(1)</enum><text>Not later than 2 business days after the date on which an agency publishes a notice of proposed rulemaking or a final rule under this section, the agency shall notify interested parties of the publication.</text></paragraph>
<paragraph id="H0D44599C15AE4C65B20942E2709C734B" indent="up1"><enum>(2)</enum><text>The Director of the Government Publishing Office shall establish a process under which an agency shall notify interested parties under paragraph (1) through email or postal mail.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H332566AC593B457EA411CDC773859C20"><enum>13.</enum><header>Public petitions</header><text display-inline="no-display-inline">Section 553(e) of title 5, United States Code, is amended—</text>
<paragraph id="H88C8164EBBF444E6ABD6F64DD4219928"><enum>(1)</enum><text>by inserting <quote>(1)</quote> before <quote>Each agency</quote>; and</text></paragraph> <paragraph id="H99C608BE2EC44E0EA34D83A02C5B5925"><enum>(2)</enum><text>by adding at the end the following:</text>
<quoted-block id="HC1189BE7068F4074B0DE421F3E70C888" style="OLC">
<paragraph id="H8C03F80E1A114A46821D4F135B037E8D"><enum>(2)</enum><text>If, during a 60-day period, an agency receives more than 100,000 signatures on a single petition under paragraph (1), the agency shall, not later than 30 days after the date on which the agency receives the petition, provide a written response that includes—</text> <subparagraph id="H7F7EC64E023F4734BE2DDB60D27AD5FD"><enum>(A)</enum><text>an explanation of whether the agency has engaged or is engaging in the requested issuance, amendment, or repeal of a rule; and</text></subparagraph>
<subparagraph id="HEDC706C061904BB2A70D8AE1AA0D7FFC"><enum>(B)</enum><text>if the agency has not engaged in the requested issuance, amendment, or repeal of a rule, a written explanation for not engaging in the requested issuance, amendment, or repeal.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H9CE5AE12D11F45C0BE7EE887463D7D83"><enum>14.</enum><header>Amendment to congressional review act</header><text display-inline="no-display-inline">Section 801(b) of title 5, United States Code, is amended—</text>
<paragraph id="H059A6DCA87D34325A3284807D37C4CDE"><enum>(1)</enum><text>in paragraph (1), by striking <quote>(1)</quote>; and</text></paragraph> <paragraph id="HC83F4140160E4E9AAB197947493642D5"><enum>(2)</enum><text>by striking paragraph (2).</text></paragraph></section>
<section id="H932EAF6BF30949A19D5983091A9D0A52"><enum>15.</enum><header>Reinstatement of disapproved rules</header>
<subsection id="HBB85565B1AB54841967D0126B4955B24"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="H11C932D3954F4DD1A3040BAF0B50D688"><enum>(1)</enum><text>the term <term>covered rule</term> means a rule for which a joint resolution of disapproval was enacted under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/8">chapter 8</external-xref> of title 5, United States Code, before the date of enactment of this Act; and</text></paragraph>
<paragraph id="H383B2E56C7084C4B96B9EA0D049BB207"><enum>(2)</enum><text>the term <term>Federal agency</term> has the meaning given the term <term>agency</term> in section 551(1) of title 5, United States Code.</text></paragraph></subsection> <subsection id="H7318CBDB2C6149AAAB556987D1CA3AA4"><enum>(b)</enum><header>Fast track reinstatement</header><text>A Federal agency may reinstate a covered rule by publishing the covered rule in the Federal Register during the 1-year period beginning on the date of enactment of this Act.</text></subsection>
<subsection id="H43A530EF509C479CA494A3B5D3392F2C"><enum>(c)</enum><header>Reinstatement after 1-Year period</header><text>After the end of the 1-year period beginning on the date of enactment of this Act, a Federal agency may reinstate a covered rule using the rulemaking procedures described in section 553 of title 5, United States Code.</text></subsection></section> <section id="H357F280AE56E448CB7AEDC479E544D6F"><enum>16.</enum><header>Cost-benefit analysis</header> <subsection id="HC83C29D0554E49789CBDEBB72C32452B"><enum>(a)</enum><header>Definitions</header><text>In this section, the terms <term>agency</term> and <term>regulation</term> have the meanings given those terms in section 3 of Executive Order 12866 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note; relating to regulatory planning and review).</text></subsection>
<subsection id="H2FD1E7BEA4F74D059D4C980A34D829A7"><enum>(b)</enum><header>Requirement</header><text display-inline="yes-display-inline">If an agency is performing a cost-benefit or regulatory impact analysis in the course of issuing a regulation, the agency shall—</text> <paragraph id="H116D92E4A8A6492DAE9CCC332DD9A266"><enum>(1)</enum><text>take into account the benefits of the regulation to the public, including the nonquantifiable benefits of the regulation; and</text></paragraph>
<paragraph id="H7AFA0C55306843809B2D44ACB67478F0"><enum>(2)</enum><text>adopt a regulation that prioritizes benefits to the public, including nonquantifiable benefits.</text></paragraph></subsection></section> <section id="H8E5AB12FA3F44C39AC487F67425F3631"><enum>17.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
<paragraph id="HBA641E22C9FC4D0D81E394D16FCDFCF0"><enum>(1)</enum><text>agency economic analyses of regulatory actions commonly underestimate the benefits of regulatory actions that protect public health and safety and overestimate the costs of regulatory action to industry; and</text></paragraph> <paragraph id="HE643AEC7BCC64B0789E79ABF635840A9"><enum>(2)</enum><text display-inline="yes-display-inline">an agency should primarily consider the statutory direction of Congress when taking regulatory action. </text></paragraph></section>
<section id="HB2165727D72640ACBB28CA2589B309C9" commented="no"><enum>18.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HC3F0D404663742DBA169909920D37C58" commented="no"><enum>(1)</enum><header>Social equity impacts</header><text>The term <term>social equity impacts</term> shall mean any impacts of a proposed regulation, whether intended or unintended, that might reasonably be expected to disproportionately affect a group or population of persons who share a common characteristic that is part of a protected class or set of protected classes, based on the regulation’s plain language, stated intention, and based on credible statistical projections and data on the impacts of similar regulations, laws and policies.</text></paragraph>
<paragraph id="HA2A4F9AB03C6441C8F6CFF4BB539B03A" commented="no"><enum>(2)</enum><header>Social equity assessment</header><text>The term <term>social equity assessment</term> shall mean a written and publicly available report that shall specifically consider any social equity impacts, positive or negative, that the proposed policy might have on a group or population of persons who share a common characteristic that renders them part of a protected class, where that group or population was previously subjected to discriminatory or exclusionary practices by the agency promulgating the regulation or where credible demographic evidence demonstrates significant disparities experienced by different populations within a protected class.</text></paragraph></section> </legis-body> </bill>
