Competitive service examination credit.</toc-entry></toc></subsection></section><section id="HAE1E840B7D2C447B80F69A74104972AD"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H2C2161E34CF74B97BAC012DD80962644"><enum>(1)</enum><header>Civil service</header><text>The term <term>civil service</term> has the meaning given such term in section 2101 of title 5, United States Code.</text></paragraph><paragraph id="H314926C7E324417980179E03D3C6D10E"><enum>(2)</enum><header>Executive agency</header><text>The term <term>Executive agency</term> has the meaning given that term in section 105 of title 5, United States Code.</text></paragraph><paragraph id="H6724F16974CA488985F557372F43A576"><enum>(3)</enum><header>Fellowship</header><text>The term <term>fellowship</term> means a short-term position (other than a post-fellowship service requirement) that—</text><subparagraph id="HC3B11318D2D24DAC927C08C6FE75723A"><enum>(A)</enum><text>is not less than one year and not more than two year in length, or such other period as determined appropriate by the Director of the Office of Personnel Management for the purposes of this paragraph; and</text></subparagraph><subparagraph id="HD5216CD6E55740C8BE467ACA19C82B13"><enum>(B)</enum><text>is intended to provide the recipient with work experience with an Executive agency that is designed to prepare such recipient for potential permanent employment with an Executive agency.</text></subparagraph></paragraph><paragraph id="H3F068FE8512648EC801AAAFECAF037DA"><enum>(4)</enum><header>Fellow</header><text>The term <term>fellow</term> means an individual who receives a fellowship.</text></paragraph><paragraph id="H5422961EBB69485189BA363177E318D7"><enum>(5)</enum><header>Fellowship program</header><text>The term <term>fellowship program</term> means any sponsoring agency program or operation that recruits fellows and administers fellowships in the Federal Government.</text></paragraph><paragraph id="HDB98E1B43EA743FBAA5DB7B6FEEA7449"><enum>(6)</enum><header>Intern</header><text display-inline="yes-display-inline">The term <term>intern</term> means an individual serving in an internship. Interns employed by third-party internship providers and placed in Executive agencies may, to the extent permitted by law or regulation, be treated as participants in any federally sponsored internship programs.</text></paragraph><paragraph id="HC93F2E5A38DB42E682E5310F8D8C2777"><enum>(7)</enum><header>Internship</header><text display-inline="yes-display-inline">The term <term>internship</term> means a short-term position (other than a post-fellowship service requirement) for an individual enrolled in a high school, trade school, technical or vocational institute, junior college, college, university, or comparable recognized educational institution, or the Job Corps program, that is not less than one year and not more than two years in length (or such other period as determined appropriate by the Director of the Office of Personnel Management for the purposes of this paragraph), designed to prepare such individual for potential permanent employment with an Executive agency, and offered under an internship program. Interns at Executive agencies who are supported or administered by third-party internship providers may, to the extent permitted by law and regulations, be treated as participants in any federally sponsored internship program.</text></paragraph><paragraph id="HDEE396A0317E4F7E95443A99EBA2B830"><enum>(8)</enum><header>Internship program</header><text>The term <term>internship program</term> has the meaning given that term in section 3111a(c)(1) of title 5, United States Code.</text></paragraph><paragraph id="HF66B8FDDE5A9423DACE3809B9AA5847D"><enum>(9)</enum><header>Job Corps program</header><text display-inline="yes-display-inline">The term <term>Job Corps</term> means the Job Corps program authorized under section 143 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3193">29 U.S.C. 3193 et seq.</external-xref>).</text></paragraph><paragraph id="H3018FA085E0C4ED498F0597996022308"><enum>(10)</enum><header>Mission-critical skill</header><text display-inline="yes-display-inline">The term <term>mission-critical skill</term> means a skill or set of skills that are critical to effectively carrying out the mission of an Executive agency, as determined by the head of such Executive agency in consultation with the Comptroller General of the United States.</text></paragraph><paragraph id="H7B8018F628B24BFEA59C70DFF218A672"><enum>(11)</enum><header>Mission-critical skill gap</header><text>The term <term>mission-critical skill gap</term> means a shortage of mission-critical skills causing, or that poses a risk of causing, a substantial detrimental effect on the ability of an Executive agency to effectively carry out the mission of such Executive agency in a manner that is cost effective, as determined by the head of such Executive agency in consultation with the Comptroller General of the United States.</text></paragraph><paragraph id="HECE303148B334779BC07C6095E7BF7A5"><enum>(12)</enum><header>Scholarship</header><text>The term <term>scholarship</term> means financial support—</text><subparagraph id="H7A22C48E859546759CD0B12551923E19"><enum>(A)</enum><text>paid by an Executive agency towards—</text><clause id="H20AFFD999BF241578F69E412A301C959"><enum>(i)</enum><text>the cost of an individual to attend either a course of study leading to a credential that help reduce or eliminate a mission-critical skill gap or another program that requires the student to demonstrate an interest in or agreement to pursue a career in public service at an institution of higher education that is authorized to participate in a Federal student aid program under title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>); or</text></clause><clause id="H9B087DBA1DF84CA99FD3F67F8DD060C2"><enum>(ii)</enum><text>financial support paid by a Executive agency towards the cost of an individual to procure private instruction in a mission-critical skill; and</text></clause></subparagraph><subparagraph id="H0FA1387438894FBE8A7A403475C38643"><enum>(B)</enum><text>which may be paid directly to—</text><clause id="H3821D88C4E134BB1A3029D0607539279" display-inline="no-display-inline"><enum>(i)</enum><text>the individual whose costs the scholarship is intended to pay; or</text></clause><clause id="HF858B0B22E4445F5B3F63128BAF228AE"><enum>(ii)</enum><text>the institutions of higher education in which such individual is enrolled.</text></clause></subparagraph></paragraph><paragraph id="HB0A2DAA11134444FB969693073181061"><enum>(13)</enum><header>Sponsoring agency</header><text display-inline="yes-display-inline">The term <term>sponsoring agency</term> means any entity of the executive branch of the United States Government, including any Executive agency, any component of the Department of Veterans Affairs, and any other agency (as defined in section 551 of title 5, United States Code), that administers a fellowship or scholarship, or internship program.</text></paragraph></section><section id="H29FE5BFEE5724009BCD08534DA0720A0"><enum>3.</enum><header>Federal internship and fellowship center</header><subsection id="H0420BBB4C0B7464DB198815CACABFE5A"><enum>(a)</enum><header>Establishment of Federal internship and fellowship center</header><text>The Director of the Office of Personnel Management shall establish and maintain a Federal Fellowship and Scholarship Center to administer, manage, and promote all Government fellowship and internship programs within the executive branch to attract individuals to serve in the Federal Government in a civilian capacity and to facilitate the potential entry of those individuals into the civil service.</text></subsection><subsection id="H24251D6FEB59465D9D8D380ACFF6F7B8"><enum>(b)</enum><header>Management of Federal internship and fellowship center</header><paragraph id="HE7A67C4AAAB34C3BA28D32D572E7748F"><enum>(1)</enum><header>Chief Human Capital Officers Council guidance</header><text display-inline="yes-display-inline">The Chief Human Capital Officers Council shall provide strategic guidance to, and facilitate interagency cooperation with, the head of the Federal Internship and Fellowship Center to help such head more effectively—</text><subparagraph id="H46A3A4D008C04CF781B8E8D49009CCFF"><enum>(A)</enum><text>identify and attract interns to the civil service; and</text></subparagraph><subparagraph id="H3844A0D23353495AA8893A2E23BC5500"><enum>(B)</enum><text>recruit and hire interns who successfully complete internships into the civil service.</text></subparagraph></paragraph><paragraph id="H804D8FEED7744768B4CC61164AA81672"><enum>(2)</enum><header>Regulations</header><text>The Director shall issue such regulations as may be necessary to implement and manage the Federal Internship and Fellowship Center, including the regulations described in section 11(d).</text></paragraph></subsection><subsection id="H8FBC163BF2A34519B1267D7E43F635B7"><enum>(c)</enum><header>Functions of the Federal internship and fellowship center</header><text display-inline="yes-display-inline">The head of the Federal Internship and Fellowship Center shall do the following:</text><paragraph id="HCE5506FD56EA4A1192141A962F03976E"><enum>(1)</enum><text>Establish, maintain, and operate an internet-based platform as part of the Platform established under section 5, that is accessible to the public and contains information regarding every internship and fellowship described in section 11(a), and every scholarship opportunity, available in the executive branch of the Federal Government, including information on how individuals may apply for each such opportunity.</text></paragraph><paragraph id="HE9B9541AAB1248A2BB6C52DC03CE3453"><enum>(2)</enum><text>Promote, and facilitate internship, fellowship, and scholarship programs at the request of any sponsoring agency to meet workforce requirements of such sponsoring agency, especially in mission-critical skill areas.</text></paragraph><paragraph id="H2AB4B8181CF547289FC48B61BBDEE7CB"><enum>(3)</enum><text>Develop a standard application for Federal internships and fellowships for use by applicants and sponsoring agencies as part of the Platform established under section 5, which may be supplemented by additional requirements of each sponsoring agency.</text></paragraph><paragraph id="H53CAC3E14455416ABE0FC8A2A9229F26"><enum>(4)</enum><text>Ensure eligibility for an appointment under subsection (d) to a position in the civil service for all individuals who—</text><subparagraph id="H56D202215C0A46D9B9951440C022F5DE"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H88E2B2F8B976452EAA54689B73F4467E"><enum>(i)</enum><text>successfully complete at least one year of an internship or fellowship that is part of an internship or fellowship program that is certified under subsection (f); or</text></clause><clause id="H52385EA5ECE84FFEACCBAA2698322BE7" indent="up1"><enum>(ii)</enum><text>are the recipients of scholarships; and</text></clause></subparagraph><subparagraph id="H07A094C13F344F78849FCBCB596D9741"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H4FE7CFA2A55341FEB1C10C67EB501AAF"><enum>(i)</enum><text>have obtained a qualifying degree or completed a qualifying career or technical education program, as determined by the Director; or</text></clause><clause id="H03D1D4786F4046C5AD07FF0647BC35C8" indent="up1"><enum>(ii)</enum><text>are graduates (as defined in section 142 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3192">29 U.S.C. 3192</external-xref>)).</text></clause></subparagraph></paragraph><paragraph id="HAC4FCC61E589461D887D6E7F093E42DA"><enum>(5)</enum><text>Develop a standard post-fellowship or post-internship exit interview for use by sponsoring agencies to solicit feedback and input from fellows and interns about their experiences while performing Federal service.</text></paragraph><paragraph id="H8370B49C59AC479FABD04EC581A0D53A"><enum>(6)</enum><text>Develop and promote best practices guidance for agencies on building effective internship and fellowship programs.</text></paragraph><paragraph id="H13CD4F838A7C465997D8E71B59BDA84D"><enum>(7)</enum><text>Take such actions as the Director determines necessary to help Federal agencies identify and recruit fellows and interns who could serve as the next generation of Federal public servants.</text></paragraph></subsection><subsection id="H6E72E0EAE7A148DFA5906464468D5E0C"><enum>(d)</enum><header>Limited noncompetitive eligibility</header><text display-inline="yes-display-inline">Under such regulations as the Director of the Office of Personnel Management shall prescribe, a sponsoring agency may make a noncompetitive appointment leading to conversion to career or career-conditional employment of each individual described in subsection (c)(4).</text></subsection><subsection id="H2F3C23E839A54219A9014051C431E1D8"><enum>(e)</enum><header>Sponsoring agency reporting</header><paragraph id="HBB5FF6027AC24E2D9BC9CF675D0B2E6F"><enum>(1)</enum><header>Office of Personnel Management</header><subparagraph id="HF00EA10A48D847C68618CBF8CCF36B78"><enum>(A)</enum><header>In general</header><text>The head of each sponsoring agency shall submit to the Director a report on the internship and fellowship programs of, and scholarship programs offered by, the sponsoring agency at such time, in such manner, and containing such information as the Director determines appropriate.</text></subparagraph><subparagraph id="HC9A219B744E54DDDB2F713991FA92BBD"><enum>(B)</enum><header>Regulations</header><text>Not later than 120 days after the date of the enactment of this Act, the Director shall issue regulations for the reports required by subparagraph (A).</text></subparagraph></paragraph><paragraph id="H8E045349FF9C4206BAE0DFFAA36D0952"><enum>(2)</enum><header>Federal Internship and Fellowship Center</header><subparagraph id="HD9A7C74D1E154AD8B586508652370060"><enum>(A)</enum><header>In general</header><text>Not later than 60 days after the date of the enactment of this Act, and not less than every two years thereafter, the head of each sponsoring agency shall submit to the head of the Federal Internship and Fellowship Center the plan of the sponsoring agency—</text><clause id="H26E8395460774496922173776FDC47EF"><enum>(i)</enum><text>regarding intern and fellow training and engagement; and</text></clause><clause id="HE846A1AD51494BF2973A818D3FAD31C9"><enum>(ii)</enum><text>for ensuring that interns and fellows who complete an internship or fellowship, respectively, of the sponsoring agency qualify for the competitive service examination credit under section 11.</text></clause></subparagraph><subparagraph id="HDA6C04F8F54649D08CBC8A93F2D3D7BD"><enum>(B)</enum><header>Plan approval</header><clause id="HC2093022024248D1990FA68EAE1E08F7"><enum>(i)</enum><header>In general</header><text>The head of the Federal Internship and Fellowship Center shall approve or disapprove each plan submitted under subparagraph (A).</text></clause><clause id="H6EA7E1F67F074BE28DC73A58A98DD0AF"><enum>(ii)</enum><header>Disapproval notice and support</header><text>If the head of the Federal Internship and Fellowship Center disapproves of a plan submitted under subparagraph (A), the head shall—</text><subclause id="H5A5B51DE34C041AAA4A1B2D0A175C30F"><enum>(I)</enum><text>provide notice of the disapproval and an explanation why the plan was disapproved to the head of the sponsoring agency that submitted the plan; and</text></subclause><subclause id="HA85A6469D9334B6D8AAD6D2810BAD63C"><enum>(II)</enum><text>provide technical assistance to such sponsoring agency to resolve the deficiencies of such plan and resubmit it for approval.</text></subclause></clause></subparagraph><subparagraph id="H7EA1A3CE09C84E6F9AD264AEA3338462"><enum>(C)</enum><header>Competitive service examination credit</header><clause id="H593C91E2464C4F7F9D05CC87C6FD8B37"><enum>(i)</enum><header>In general</header><text>If a sponsoring agency fails to submit a plan required under subparagraph (A) or that submits a plan that is disapproved under subparagraph (B), the interns and fellows participating in an internship or fellowship of such sponsoring agency shall be ineligible for competitive service examination credit under section 11 until the date on which such sponsoring agency submits a plan described in subparagraph (A) and the head of the Federal Internship and Fellowship Center approves such plan.</text></clause><clause id="HE0677F71D0454357821EE2BAC52901B5"><enum>(ii)</enum><header>Exception</header><text>Clause (i) does not apply with respect to a sponsoring agency that submits a plan that is disapprove under subparagraph (B) if, during the two-year period immediately preceding such disapproval, such sponsoring agency submitted a plan that was approved under subparagraph (B).</text></clause></subparagraph></paragraph></subsection><subsection id="H39E5AD6BCCD44BEBA4B6B85600077C68" commented="no"><enum>(f)</enum><header>Internship provider certification</header><paragraph id="HCB07F287ACF74AD9800F5538912E9314" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The head of the Federal Internship and Fellowship Center shall certify each internship or fellowship program of each sponsoring agency or third-party internship provider that the head determines—</text><subparagraph id="HF1F09B5672EF41479D27081F38FE9CCC" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">demonstrates a track record of recruiting diverse intern and fellow talent pools, as applicable, for at least the previous three years;</text></subparagraph><subparagraph id="H57E0B22FAD8040528D1FA139035D630D" commented="no"><enum>(B)</enum><text>possesses a meaningful training and development program for interns and fellows, as applicable;</text></subparagraph><subparagraph id="H714F4D2C692E421C9C10BB1841453702" commented="no"><enum>(C)</enum><text>uses a non-partisan, merit-based selection process;</text></subparagraph><subparagraph id="H5D2E09B158AF4B958DC3E2934F4668BC" commented="no"><enum>(D)</enum><text>provides career counseling services to interns and fellows, as applicable;</text></subparagraph><subparagraph id="HB9DFC8CFEEDB449E8892DE2328A002C0" commented="no"><enum>(E)</enum><text>in the case of a sponsoring agency, provides to the Office of Personnel Management the plans of such sponsoring agency described subsection (e)(2); and</text></subparagraph><subparagraph id="H6357AAF8883841A4B75055CA8815B884" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">any other standards that the head of the Federal Internship and Fellowship Center determines appropriate.</text></subparagraph></paragraph><paragraph id="HFFBEF9E6668E4EC0A4137A7912CFA4B7" commented="no"><enum>(2)</enum><header>Third-party provider additional requirements</header><text display-inline="yes-display-inline">To ensure the advancement of merit systems principles and efficient administration of internship and fellowship programs, the head of the Federal Internship and Fellowship Center may impose additional requirements on a third-party internship provider before certifying the internships or fellowships programs of such third-party internship provider under paragraph (1).</text></paragraph></subsection><subsection id="H2A7147D02ACF4A48A9412FCDE15E9BD3"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HD52026DCF5C04361B70D563DC9C925B7" commented="no"><enum>(1)</enum><header>Career appointee</header><text display-inline="yes-display-inline">The term <term>career appointee</term> has the meaning given such term in section 3132(a) of title 5, United States Code.</text></paragraph><paragraph id="HBA6BC9A5B08C4D2B90102293CCF84A72"><enum>(2)</enum><header>Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the Office of Personnel Management.</text></paragraph></subsection></section><section id="H61AF25DB8DF14EA2A6F3AE1936185F3A"><enum>4.</enum><header>Internship coordinator</header><subsection id="HD3B765145B944265B5499DD8E29EEE93"><enum>(a)</enum><header>Internship coordinator</header><text>Each internship coordinator appointed under section 3111a of title 5, United States Code, shall—</text><paragraph id="H5CE9A7143D84441EA4E4B0B575675DDF"><enum>(1)</enum><text>serve as the main point of contact at the sponsoring agency on all issues related to fellowships, scholarships, and internships;</text></paragraph><paragraph id="HD5719B37FFE740DAA5333E43BB07E37C"><enum>(2)</enum><text display-inline="yes-display-inline">establish a mentor program for interns and fellows at the agency that incorporates best practices as determined by the Federal Internship and Fellowship Center pursuant to section 2(c); and</text></paragraph><paragraph id="H62EBC0BAB229428DB86A5D9C91BB7F61"><enum>(3)</enum><text display-inline="yes-display-inline">generate and submit, in accordance with subsection (c)(1), an annual report for the one-year period ending on September 1 of the year in which such report is submitted including—</text><subparagraph id="H016F844E90014F21950C5D97D19F527B" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the number of interns and fellows who served at the sponsoring agency;</text></subparagraph><subparagraph id="HA4219467C2F04F4497C792AEECBDE044"><enum>(B)</enum><text>a list of third-party organizations that supplied internships or fellowships to the sponsoring agency;</text></subparagraph><subparagraph id="H267CC096AECD44E19F4F4AA0F68D824E"><enum>(C)</enum><text>information regarding the demographic characteristics of interns and fellows at such agency, including, but not limited to educational background, age, race, gender, and ethnicity, except that no intern or fellow may be required to provide such demographic characteristics for the purposes of such report;</text></subparagraph><subparagraph id="HD57E0A27A39B408BBD93EDD3BB144948"><enum>(D)</enum><text>a description of the steps taken by the sponsoring agency to prepare and recruit successful interns and fellows for positions in the civil service;</text></subparagraph><subparagraph id="H4A6E7B08E3004504850ADDB6963B5C81"><enum>(E)</enum><text>a description of any barriers to hiring interns or fellows who successfully complete their internships or fellowships, respectively;</text></subparagraph><subparagraph id="H79CEDD2C82C54624820628AA132921FE"><enum>(F)</enum><text>a description of activities engaged in the sponsoring agency to recruit new interns and fellows, including descriptions of locations visited, methods used, and schools and stakeholder organizations engaged;</text></subparagraph><subparagraph id="H518E0C14DC4D4C65B27B86F846BC1C22"><enum>(G)</enum><text>a list of the position descriptions for the internships and fellowships offered at each sponsoring agency;</text></subparagraph><subparagraph id="HD2C7FB4C54F2480A9E213B50AB22153A"><enum>(H)</enum><text>a description of the mentorship programs of such internship and fellowship programs;</text></subparagraph><subparagraph id="H39D58789AD044F2481637AAE30DC32D4"><enum>(I)</enum><text>a summary of exit interviews conducted and surveys administered by a sponsoring agency with respect to interns and fellows upon their completion of an internship or fellowship program at such agency; and</text></subparagraph><subparagraph id="HF436CA60C8694BF7A6693E6A7CBE93E3"><enum>(J)</enum><text>other information as determined necessary by the internship coordinator.</text></subparagraph></paragraph></subsection><subsection id="H6D3204F2DC2E41A691FEC1137144877A"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">The head of each sponsoring agency shall submit, in accordance with subsection (c)(1), an annual report for the one-year period ending on October 1 of the year in which such report is submitted assessing each fellowship and internship program of such sponsoring agency in which fellows or interns, respectively, participated during the reporting period.</text></subsection><subsection id="H9736966419574571892B580C03C3CB45"><enum>(c)</enum><header>Submission</header><paragraph id="H013B6FC330A744D7A865A331C4E45FAF"><enum>(1)</enum><header>Report to OPM</header><text>Each report required under subsection (a) or (b) shall be submitted to the Office of Personnel Management between October 1 and October 31 of each year.</text></paragraph><paragraph id="H436D5F376A9844AC8680E176D3E8C70D"><enum>(2)</enum><header>Congressional report</header><text>Not later than December 30 of each year, the Office of Personnel Management shall submit to Congress a report summarizing the information submitted to the Office of Personnel Management in accordance with paragraph (1) for such year.</text></paragraph></subsection><subsection id="H905D73F07AEC4EC6A427DD854F9DFA14" commented="no"><enum>(d)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed as overriding or otherwise permitting any action not permitted under section 552a of title 5, United States Code.</text></subsection></section><section id="H21EDF9E6527A47029AB4F6EACE6393D8"><enum>5.</enum><header>Online Federal Government internship platform</header><subsection id="HDABE65F9E03F4CEAA8B8B5ACD0B7CFC6"><enum>(a)</enum><header>Establishment of an online Federal Government internship platform</header><text>The Director of the Office of Personnel Management shall establish, maintain, and promote an interactive and integrated internet-based platform (in this section referred to as the <quote>Platform</quote>) to serve as a centralized resource and database for the public to learn about and connect with agencies and internship opportunities in Federal public service and for agencies with internship needs and opportunities to identify skill sets and individuals with the skills necessary to address their needs.</text></subsection><subsection id="H5F1FCD64A9EF4BF78BA20676D1C8D6CB"><enum>(b)</enum><header>Use of the service platform</header><paragraph id="H160CA1218CE34DE4BF16239D293ABE96"><enum>(1)</enum><header>Public accessibility</header><text>The Director shall determine, and make accessible to the public on the Platform, information about Federal internship, fellowship, and scholarship service organizations and opportunities, without any requirement that a person seeking such access become a member of the Platform.</text></paragraph><paragraph id="H52FF12FD17AA467AA0F10A7616B345C4"><enum>(2)</enum><header>Information on Federal agency</header><text>Each Executive agency that hosts interns or fellows shall make available on the Platform—</text><subparagraph id="HEB7E4AEA15794A87B22E3C71BC71B454"><enum>(A)</enum><text>information sufficient for the public to identify and understand the internship and fellowship opportunities and mission of the Executive agency;</text></subparagraph><subparagraph id="HF32117A1D0F94810AB4AB6D38C94A159"><enum>(B)</enum><text>information on the availability of internship, fellowship, and scholarship opportunities of the Executive agency, including location and duration;</text></subparagraph><subparagraph id="HB2B766B6D1F74CF7B4EAF4470646B82F"><enum>(C)</enum><text>internet links to the hiring and recruiting websites of the Executive agency; and</text></subparagraph><subparagraph id="HCAE9D5DAAE7A4E429569DDB84A8BBEE1"><enum>(D)</enum><text>such additional information as the Director may determine.</text></subparagraph></paragraph></subsection><subsection id="H869F68C27E6A466BA52AE921C956E77C"><enum>(c)</enum><header>Minimum design requirements</header><text>In addition to the requirements set forth in this section, the Platform shall do the following:</text><paragraph id="H25887C6468E4439BA748D1B1218A9EC3"><enum>(1)</enum><text>Provide the public with access to information on internship, fellowship, and scholarship opportunities that is user-friendly, interactive, accessible, and fully functional through mobile applications and other widely used communications media, without a requirement that any person seeking such access register as a member.</text></paragraph><paragraph id="H7CB9FB1B10274E6DBED6B80CE3D5088E"><enum>(2)</enum><text>Provide individuals with the ability to register as members to customize their experience, including mechanisms to connect members with agency internship coordinators and internship, fellowship, and scholarship opportunities that match the interests of the members, and ensure robust search capabilities to facilitate the ability of members to explore Federal internship, fellowship, and scholarship opportunities.</text></paragraph><paragraph id="HFA08AC67FAA64FEDB9D46D0C98BC9E5E"><enum>(3)</enum><text>Include mechanisms to enable agencies to connect with members who have consented to be contacted and meet the needs of sponsoring agencies.</text></paragraph><paragraph id="HA8528A2EF23E4525BB9B8589E8134FBC"><enum>(4)</enum><text>Incorporate, to the extent permitted by law and regulation, the ability of members to securely upload information on education, employment, and skills, knowledge, and abilities, consistent with security requirements.</text></paragraph><paragraph id="H1B777FAA61C5454ABC1A6B0D6F3FAA48"><enum>(5)</enum><text>Ensure compatibility, to the greatest extent possible, with relevant information systems of Executive agencies.</text></paragraph><paragraph id="H7B4F7BEE475E45258D0F107BA8FEA09A"><enum>(6)</enum><text>Retain all personal information in a manner that protects the privacy of members in accordance with section 552a of title 5, United States Code, and other applicable law, provide access to information relating to a member only in accordance with the consent of the member, and incorporate data security and control policies that are adequate to ensure the confidentiality and security of information provided and maintained on the internet-based platform.</text></paragraph></subsection><subsection id="H77AC62E3144A40A0A1F61353C313C285"><enum>(d)</enum><header>Development of service platform plan</header><paragraph id="HC06F9B2C419347FE8B9260D50E755150"><enum>(1)</enum><header>Implementation plan</header><text>Not later than 180 days after the date of the enactment of this Act, the Director shall develop a detailed plan to implement the internet-based platform that complies with all the requirements of this section.</text></paragraph><paragraph id="H5FD4102CE10C48EEB9AD1CFA4B20BFEB"><enum>(2)</enum><header>Consultation required</header><text>In developing the plan under this subsection, the Director shall consult with the head of the United States Digital Service, the Chief Human Capital Officers Council, and as needed, the heads of other Executive agencies. Such consultation may include seeking assistance in the design, development, and creation of the internet-based platform.</text></paragraph></subsection><subsection id="H68B12F1EBE844121A2FF93BCE49DA44F"><enum>(e)</enum><header>Reports to Congress</header><text>Not later than 12 months after the date of the enactment of this Act, and every 12 months thereafter, the Director shall provide a report to Congress on the internet-based platform. Such report shall include information on the following:</text><paragraph id="H47CB1252F81D4C92A0FCE976284FADEC"><enum>(1)</enum><text>Details on the status of implementation of the internet-based platform and plans for further development of it.</text></paragraph><paragraph id="H686C4947C1914BF3AF15125886C3B674"><enum>(2)</enum><text>Participation rates of sponsoring agencies and members.</text></paragraph><paragraph id="H6AF3FB627FA841FD96EEEC30A82E4B18"><enum>(3)</enum><text>The number of individuals visiting the internet-based platform, the number of agencies participating in the platform, and the number of internship opportunities posted on the internet-based platform in the preceding 12-month period.</text></paragraph><paragraph id="HAE6D36FB4C454D2B9B43E2AE5140F536"><enum>(4)</enum><text>Any cybersecurity or privacy concerns associated with the internet-based platform.</text></paragraph><paragraph id="HDA7F72BCB0AA499F991BDDA82A72F6F0"><enum>(5)</enum><text>The results of any surveys or studies undertaken to increase the use and efficacy of the internet-based platform.</text></paragraph><paragraph id="H400816B8E0F941ABA6413800C2527599"><enum>(6)</enum><text>Any additional information the Director considers appropriate.</text></paragraph></subsection><subsection id="H84FEDDF5727B46E6BC627AC2E0B900D6"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Office of Personnel Management for each fiscal year such funds as may be necessary for the development, maintenance, improvement, and promotion of the internet-service platform.</text></subsection></section><section id="HF201930A98614BDD9B5822E5AA7C4848"><enum>6.</enum><header>Underserved markets and demographics recruitment pilot program</header><subsection id="H633B50FCE4DF46179DF32689503F7DD8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Office of Personnel Management shall, in coordination with the components of Executive agencies and sponsoring agencies responsible for recruiting individuals, carry out a pilot program to engage individuals from demographic populations, such as those defined by gender, geography, socioeconomic status, and mission-critical skills (as determined by a head of a sponsoring agency), that the Director determines are underrepresented in the Federal workforce for possible participation in the civil service.</text></subsection><subsection id="H2C17D5ADB370424BBFCFE6DD80691E8C"><enum>(b)</enum><header>Consultation</header><text>In developing a pilot program under this section, the Director of the Office of Personnel Management shall consult with the head of the Federal Internship and Fellowship Center, the Chief Human Capital Officers Council, and the Equal Employment Opportunity Commission to develop best practices for engaging individuals described in subsection (a).</text></subsection></section><section id="HA5B273D6173449B6AD8108CB711CF268"><enum>7.</enum><header>Compensation for Federal interns</header><subsection id="HF4A409DF9AFA4066BFD067220E6A0844"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3111 of title 5, United States Code, is amended—</text><paragraph id="HBA43408976C1429DA88C108B5579164B"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="section" style="USC">volunteer</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">student</header-in-text></quote>;</text></paragraph><paragraph id="HFB1B38439B6147C8A85D2FC03C29A881"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HCD188B829D2B40E49B33CF411576E88F"><enum>(A)</enum><text>in the matter preceding paragraph (1)—</text><clause id="HB4270598B2C24D51880D352720637190"><enum>(i)</enum><text>by striking <quote>Notwithstanding section 1342 of title 31, the</quote> and inserting <quote>The</quote>; and</text></clause><clause id="H7514BAD8B5A948A6904DA0C64A572D0C"><enum>(ii)</enum><text>by striking <quote>voluntary service</quote> and inserting <quote>service from a student under this section</quote>;</text></clause></subparagraph><subparagraph id="H7A96859205754D99BF919865775E55AC"><enum>(B)</enum><text>in paragraph (1)—</text><clause id="HB205BE7362D744B1B4B5CEE9EC1FC2E8"><enum>(i)</enum><text>by inserting before the semicolon the following: <quote>, but only insofar as the institution provides academic credit to the student for the service</quote>; and</text></clause><clause id="H0A30AE92028643D8A90E272E456090CE"><enum>(ii)</enum><text>by inserting <quote>and</quote> at the end;</text></clause></subparagraph><subparagraph id="H0C1690A0B171446589F9F5EE5F69CDB7"><enum>(C)</enum><text>by striking paragraph (2); and</text></subparagraph><subparagraph id="H5D0C0EC062734529A1916D5AC2DB555F"><enum>(D)</enum><text>by redesignating paragraph (3) as paragraph (2);</text></subparagraph></paragraph><paragraph id="H57DC00527A6641118DE82C023C912EF0"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="H472C700E2D6D45A8B1858591EC239946"><enum>(A)</enum><text>by striking <quote>voluntary</quote> each place it appears; and</text></subparagraph><subparagraph id="HB4C98D86AA164501894585E1B5FFCB63"><enum>(B)</enum><text>in paragraph (1), by inserting <quote>, section 717 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-16">42 U.S.C. 2000e–16</external-xref>),</quote> after <quote>for injury)</quote>;</text></subparagraph></paragraph><paragraph id="HED557C2B0FA441498043026012C7C860"><enum>(4)</enum><text>in subsection (e)(2)(A), by striking <quote>voluntary service</quote> and inserting <quote>service</quote>; and</text></paragraph><paragraph id="H4AAEA07B01CB4A07940174BF514264FA"><enum>(5)</enum><text>by adding at the end the following new subsections:</text><quoted-block style="OLC" id="HA2976311A47A4844B33617D45532A198" display-inline="no-display-inline"><subsection id="H7CC05F37C1BA427BBC100074628E6A96"><enum>(f)</enum><text display-inline="yes-display-inline">An agency may provide reimbursement for transportation and subsistence expenses for any student who provides service under subsection (b), pursuant to regulations issued by the Office of Personnel Management.</text></subsection><subsection id="HC5259AA7E20B47F9B2A0C9990CEAE594"><enum>(g)</enum><text>A scholarship that is awarded by the agency to which a student is providing services under subsection (b) and that is awarded based at least in part on such services shall be deemed to be compensation paid to such student for such services.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H22ABC1344B9B46CDB983F94F95BA4308"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/31">chapter 31</external-xref> of title 5, United States Code, is amended in the item relating to section 3111 by striking <quote>volunteer</quote> and inserting <quote>student</quote>.</text></subsection><subsection id="HAE35C806CCAD41358A2C2D76F25A5D44"><enum>(c)</enum><header>Conforming amendments</header><paragraph id="HB5D3961608D84C46A0509FC33718E2B4"><enum>(1)</enum><header>Section <enum-in-header>3111a</enum-in-header></header><text>Section 3111a(c)(1)(A) of title 5, United States Code, is amended by striking <quote>volunteer service</quote> and inserting <quote>student service</quote>.</text></paragraph><paragraph id="H599D76ED3568424EB710E960AD663A6C"><enum>(2)</enum><header>Section 7905</header><text>Section 7905(a)(1) of title 5, United States Code, is amended by striking <quote>voluntary</quote>.</text></paragraph></subsection><subsection id="HCF1DDA4EB68645598DEC5BD21EEB1845"><enum>(d)</enum><header>Current students</header><paragraph id="H180E1641F84F46168C9B8C7FEFC82117"><enum>(1)</enum><header>In general</header><text>Notwithstanding the amendments made by this Act and section 1342 of title 31, United States Code, the head of an Executive agency may accept voluntary services from any student (as defined in section 3111(a) of title 5, United States Code) who, immediately prior to the enactment of this Act, provides such services to such Executive agency under a program established under section 3111(b) of title 5, United States Code, until the earliest date on which such student ceases to participate in such program.</text></paragraph><paragraph id="H02FD225E683441ACB3E63324188B4039"><enum>(2)</enum><header>Controlling law</header><text>The acceptance of voluntary service under this subsection shall be in accordance with the law as in effect immediately prior to the date of the enactment of this Act.</text></paragraph></subsection></section><section id="HCB812E09045A4AD5B1885037859E4F4A"><enum>8.</enum><header>Establishment of pathways program</header><subsection id="H2B8E044CEEBE40D693BF2FF69620245D"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H23380236FEDF40FBB8A92BA5FF1D39E3"><enum>(1)</enum><header>Competitive service</header><text>The term <term>competitive service</term> has the meaning given that term in section 2102 of title 5, United States Code.</text></paragraph><paragraph id="H511F563F1928445F9FB796B1F408C744"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Personnel Management.</text></paragraph><paragraph id="HF9C7E40EE2854BCE9C7640E2EF881693"><enum>(3)</enum><header>Excepted service</header><text>The term <term>excepted service</term> has the meaning given that term in section 2103 of title 5, United States Code.</text></paragraph></subsection><subsection id="H4D5CB722EBFA4F1A89AB1B938E9927AF"><enum>(b)</enum><header>Establishment</header><text>The Director shall establish a program, to be known as the Pathways Program, which shall—</text><paragraph id="H8C546DBAF0D540A1B6803DF78AD9B83E"><enum>(1)</enum><text display-inline="yes-display-inline">promote employment opportunities for students and recent graduates in the Federal workforce by excepting participants in the Program from the competitive service requirements for certain competitive service positions in the civil service; and</text></paragraph><paragraph id="H17829BC654DD435C9D7AC086A01C81AC"><enum>(2)</enum><text>consist of an Internship Program as described in subsection (d), a Recent Graduates Program as described in subsection (e), and a Presidential Management Fellows Program as described in subsection (f).</text></paragraph></subsection><subsection id="HD8BC96B310AC46898A31207B8DB29DED"><enum>(c)</enum><header>Regulations</header><text>The Director shall issue regulations for the Pathways Program, including—</text><paragraph id="H315B619EF5364D4BAA81D049A19EAE73"><enum>(1)</enum><text>a description of the positions that Executive agencies may fill through the Pathways Program because conditions of good administration necessitate excepting those positions from the competitive hiring rules;</text></paragraph><paragraph id="H60E3E63D8BD24AEF82B295EB6C8326F3"><enum>(2)</enum><text>rules governing whether, to what extent, and in what manner public notice should be provided of job opportunities in the Pathways Program;</text></paragraph><paragraph id="H68ADF3F5732E4C77B05FCBA538EAE402"><enum>(3)</enum><text>a description of career-development, training, and mentorship opportunities for participants in the Pathways Program;</text></paragraph><paragraph id="H70DA77A87D4A4875A8B14A516D0F4C1A"><enum>(4)</enum><text>requirements that managers assess the performance of participants in the Pathways Program to identify those individuals who should be considered for conversion to career appointments in the civil service;</text></paragraph><paragraph id="H9C143490DFF74EFEBA1B4ED742DFE9A4"><enum>(5)</enum><text>a description of oversight by the Office of Personnel Management of the use by Executive agencies of the Pathways Program to ensure that—</text><subparagraph id="HFC64BC9B5294430FB68D6F33CDE53E60"><enum>(A)</enum><text>the Pathways Program serves as a supplement to, and not a substitute for, the competitive hiring process; and</text></subparagraph><subparagraph id="H107E9C1A6BE44B5390C6F5D16BBC9941"><enum>(B)</enum><text>Executive agencies are using the Pathways Program to develop talent for careers in the civil service;</text></subparagraph></paragraph><paragraph id="HB3AEBE7154FD44AE82B21BBEE7551996"><enum>(6)</enum><text>a description of plans by the Office of Personnel Management to evaluate—</text><subparagraph id="HF480CC6508B14C73B81CAFD78E85F582"><enum>(A)</enum><text>competitive service requirements for certain positions in the civil service;</text></subparagraph><subparagraph id="H9DA864ADAEE94BCE8EEB612967868876"><enum>(B)</enum><text>the effectiveness of Executive agencies in recruiting and retaining talent using the Pathways Program; and</text></subparagraph><subparagraph id="H2DADC490AD1A4AFAB331FD8027AD9A3E"><enum>(C)</enum><text>the satisfaction of those students, graduates, and hiring managers participating in the Pathways Program; and</text></subparagraph></paragraph><paragraph id="H5B7E30160D68469AA34CE862648ED78E"><enum>(7)</enum><text>standard naming conventions across Executive agencies, so that students and recent graduates can clearly understand and compare the career pathway opportunities available to them in the Federal Government.</text></paragraph></subsection><subsection id="H058562A5250F46F5A6B66EC307F31B81"><enum>(d)</enum><header>Internship Program</header><paragraph id="H6849667FB0714B91A57DE9AA89FC52CF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Internship Program shall provide students in high schools, community colleges, four-year colleges, trade schools, career and technical education programs, the Job Corps program, and other qualifying educational institutions and programs, as determined by the Director, with paid opportunities to work in agencies and explore Federal careers while still in school.</text></paragraph><paragraph id="HDEEBBE3CBC844CD4977DA33B0EB1EC01"><enum>(2)</enum><header>Requirements and policies</header><text>The following requirements and policies shall apply to the Internship Program:</text><subparagraph id="H310BEDEE48404D2DA553A0B058191705"><enum>(A)</enum><text>Participants in the Program shall be students enrolled, or accepted for enrollment, at institution or program described in paragraph (1).</text></subparagraph><subparagraph id="H52377ECEF22A4AEA8657F039CFC58E3F"><enum>(B)</enum><text>Subject to such exceptions as may be provided by regulation, Executive agencies shall provide participants in the Internship Program with meaningful developmental work and set clear expectations regarding the work experience of the participant.</text></subparagraph><subparagraph id="H10B881AAB4344E7EA45C6FBD843FD2E1"><enum>(C)</enum><text>Students employed by third-party, non-federal internship providers but placed in Executive agencies may, to the extent permitted by regulation, be treated as participants in the Internship Program.</text></subparagraph><subparagraph id="HEB22366D1BA3458280AB068992D24D4E"><enum>(D)</enum><text>Executive agencies shall participate in the Internship Program for the primary purpose of developing and evaluating talent for future permanent employment with the Federal Government.</text></subparagraph></paragraph></subsection><subsection id="H4D511474A7164C9498623C702C07ADD1"><enum>(e)</enum><header>Recent graduates program</header><paragraph id="HAEBBA720FAF34E099CDB5CBEDF17D8F3"><enum>(1)</enum><header>In general</header><text>The Recent Graduates Program shall provide individuals who have recently graduated from qualifying educational institutions or programs with developmental experiences in the Federal Government intended to promote possible careers in the civil service.</text></paragraph><paragraph id="H850B6F332F844EEFB815EFCD11BE75CE"><enum>(2)</enum><header>Requirements and policies</header><text display-inline="yes-display-inline">The following requirements and policies shall apply to the Recent Graduates Program:</text><subparagraph id="H6AF129B65D2A41C3AAB1D05904056DD8"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided in subparagraph (B), participants in the Recent Graduates Program shall have obtained a qualifying degree or completed a qualifying career or technical education program, as determined by the Director, within the 3-year period immediately preceding participation in the Recent Graduates Program.</text></subparagraph><subparagraph id="H25CDFD589D8544FAA29AE7ECDCB8C5C4"><enum>(B)</enum><text>Any veteran who, due to the military service obligation of such veteran, was precluded from participating in the Recent Graduates Program during the 3-year period described in subparagraph (A) shall be eligible to participate in the Program within 6 years after obtaining a qualifying degree or completing a qualifying career or technical education program.</text></subparagraph><subparagraph id="HA616798182574DDA9643859C6E7A5F99"><enum>(C)</enum><text>A veteran with respect to which subparagraph (B) applies may participate not more than once in the Recent Graduates Program.</text></subparagraph><subparagraph id="H84CF3189F0BF4264BB17BC92E75666C9"><enum>(D)</enum><text display-inline="yes-display-inline">Responsibilities assigned to a participant in the Recent Graduates Program shall be consistent with the qualifications, educational background, and career interests of such participant, the purpose of the Recent Graduates Program, and the needs of Executive agencies.</text></subparagraph><subparagraph id="H1E6F90FB477841A19C2724A4C3D8269B"><enum>(E)</enum><text display-inline="yes-display-inline">Appointments to the Recent Graduates Program may not exceed two years, except that the employing Executive agency may extend the appointment for up to 120 days.</text></subparagraph></paragraph><paragraph id="H9244370F672B4CF182425C77A56542FE"><enum>(3)</enum><header>Pre-graduation appointments offers</header><subparagraph id="H5954FFB48DA644F1B6473357868C8141"><enum>(A)</enum><header>In general</header><text>Executive agencies may, in accordance with subparagraph (B), offer appointments to participate in Recent Graduates Program to individuals who, not later than 182 days after such offer is made, will obtain a qualifying degree or complete a qualifying career or technical education program described in paragraph (2)(A).</text></subparagraph><subparagraph id="H3EE162E3753245E0827E1576EEA915E8"><enum>(B)</enum><header>Appointment limitations</header><text>An appointment offered under paragraph (A) shall—</text><clause id="HCA5407AAA0D44B7EA012F7A205A41E6B"><enum>(i)</enum><text display-inline="yes-display-inline">be effective on or after the date on which the offer recipient obtains a qualifying degree or completes a qualifying career or technical education program described in paragraph (2)(A); and</text></clause><clause id="HA26D8E84A1214D9DBE043983EEB21285"><enum>(ii)</enum><text display-inline="yes-display-inline">be rescinded if the offer recipient does not obtain such a qualifying degree or complete such a qualifying career or technical education program prior to the end of the 182 day period beginning on the date on which the offer is made.</text></clause></subparagraph></paragraph></subsection><subsection id="HC34B1D108F7F4C3883855A8989DA0502"><enum>(f)</enum><header>Presidential management fellows program</header><paragraph id="H731147ECD0F0425087AD23B57F8D6B9D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Presidential Management Fellows Program shall provide opportunities to individuals from various academic disciplines at the graduate level who have an interest in, and commitment to, leading and managing public programs and policies.</text></paragraph><paragraph id="HB167EC7F3B284FAB8F834ACC97C54085"><enum>(2)</enum><header>Requirements and policies</header><text>The following requirements and policies shall apply to the Presidential Management Fellows Program:</text><subparagraph id="H31B5A8200E604E54A0AA50CCE17B6E8C"><enum>(A)</enum><text display-inline="yes-display-inline">Participants in the Presidential Management Fellows Program must have received a qualifying advanced degree, as determined by the Director, within the 2-year period immediately preceding participation in the Presidential Management Fellows Program.</text></subparagraph><subparagraph id="H285357807E294623B6AD51F0908E1F32"><enum>(B)</enum><text display-inline="yes-display-inline">Responsibilities assigned to a Presidential Management Fellow shall be consistent with the qualifications, educational background, and career interests of the fellow, the purposes of the Presidential Management Fellows Program, and Executive agency needs.</text></subparagraph><subparagraph id="H8692F1E07E184367B6DA901A09178EE1"><enum>(C)</enum><text display-inline="yes-display-inline">The Office of Personnel Management shall establish the eligibility requirements and minimum qualifications for the Presidential Management Fellows Program, as well as a process for assessing eligible individuals for consideration for appointment to participate in the Presidential Management Fellows Program.</text></subparagraph></paragraph></subsection><subsection id="HAB2AD245194A43BD8C9F81A071AEE1CD"><enum>(g)</enum><header>Pathway program appointments</header><text>The following requirements shall apply to appointments in the Pathways Program:</text><paragraph id="H7226CFC2BA314E4A86E3311A5CD6DB4F"><enum>(1)</enum><text>Appointments to the Pathways Program shall be under the excepted service.</text></paragraph><paragraph id="HF13209A8A50F436DB3AFAF28A59E6BEC"><enum>(2)</enum><text>Appointments to the Pathways Program shall not confer any right to further Federal employment in either the competitive service or the excepted service upon the expiration of the appointment.</text></paragraph></subsection><subsection id="H5A007DAB3AE54813B5F06BCF6A5B63F1" display-inline="no-display-inline"><enum>(h)</enum><header>Conversions</header><paragraph id="H236F4D44468D4DE5A6196E35986D19D9"><enum>(1)</enum><header>In general</header><text>The head of an Executive agency may, in accordance with this subsection and without regard to any provision of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, and any other provision of law relating to the examination, certification, and appointment of individuals in the competitive service—</text><subparagraph id="H87157C0CFA3C453B9DFA27D63783BBE8"><enum>(A)</enum><text display-inline="yes-display-inline">convert the appointments of participants in the Pathways Program (other than participants in the Presidential Management Fellows Program described in subsection (f)) to term, career, or career-conditional appointments in the competitive service; and</text></subparagraph><subparagraph id="H6E71366D5DAC4A88ACED32F8B4307ED9"><enum>(B)</enum><text display-inline="yes-display-inline">convert the appointments of such participants who are initially converted to a term appointment under subparagraph (A) to a career or career-conditional appointment in the competitive service before the term appointment expires.</text></subparagraph></paragraph><paragraph id="H7BF60ED52E834DBCB0715B35CAB5C280"><enum>(2)</enum><header>Conversion requirements</header><subparagraph id="H2170E6D7C3AF4F3092926DD459EEDDDA"><enum>(A)</enum><header>In general</header><text>In addition to the requirements under this subsection, the Director may establish requirements for converting an appointment under paragraph (1).</text></subparagraph><subparagraph id="HE021AC9C74EA4B0B93C7F519E780D891"><enum>(B)</enum><header>Internship Program participant</header><text display-inline="yes-display-inline">The appointment of a participant in the Internship Program described in subsection (d) may be converted to a career or career-conditional appointment under paragraph (1) only if the participant—</text><clause id="HF96568237C9643598047DDCF9F0573C2"><enum>(i)</enum><text>is a citizen of the United States;</text></clause><clause id="H49A8BD5EF3B64DCEA3F0AD7E96F152FB"><enum>(ii)</enum><text>has completed not less than one year as a participant in the Internship Program while enrolled as a half- or full-time degree- or certificate-seeking student at an institution or program described in subsection (d)(1);</text></clause><clause id="HD15292C27F3842DAA1AABB42D8981942"><enum>(iii)</enum><text>in the 180-day period ending on the date on which the appointment of such participant is converted under paragraph (1), has completed a course of study at an institution or program described in subsection (d)(1);</text></clause><clause id="HE1230D74CC3B44A3A06134DEFCC048EB"><enum>(iv)</enum><text>meets the qualification standards for the position to which the participant will be converted, including any requirements of the Executive agency in which such position is located; and</text></clause><clause id="H1E76012B4C4D4E2DA4665765501C37D4"><enum>(v)</enum><text>receives a favorable recommendation from an official of the Executive agency or agencies in which the participant serves under the Internship Program.</text></clause></subparagraph><subparagraph id="HE76DEB7E66394ADABB4EEC926F53E5DE"><enum>(C)</enum><header>Recent Graduates Program participant</header><text display-inline="yes-display-inline">The appointment of a participant in the Recent Graduates Program described in subsection (e) may be converted to a career or career-conditional appointment under paragraph (1) only if the participant—</text><clause id="HBDFB2277F86F4506B23C81C041A02362"><enum>(i)</enum><text display-inline="yes-display-inline">is a citizen of the United States;</text></clause><clause id="H124ADA84401746A380CF378FF6C2180F"><enum>(ii)</enum><text>has completed not less than one year of continuous service as a participant in the Recent Graduates Program, except that such one-year requirement shall be reduced by the amount of time, if any, the participant spent as a participant in the Internship Program described in subsection (d);</text></clause><clause id="H81F3378C447B4FCE92AF8F46B8D85C97"><enum>(iii)</enum><text>has demonstrated successful performance of the responsibilities of each position to which the participant has been assigned under the Recent Graduates Program;</text></clause><clause id="HEEC2A2D81F0C4B64B1B04F55E1E50515"><enum>(iv)</enum><text>meets the qualification standards for the position to which the participant will be converted, including any requirements of the Executive agency in which such position is located; and</text></clause><clause id="H3BCF4746B24541A58F8E70B3E651E478"><enum>(v)</enum><text>receives a recommendation for conversion from the immediate supervisor of the participant under the Recent Graduates Program.</text></clause></subparagraph><subparagraph id="H80CFC3483520428384D5E31D65A5FFF4"><enum>(D)</enum><header>Other agency appointment</header><text display-inline="yes-display-inline">The head of an Executive agency may exercise the authority under paragraph (1) with respect to a participant in the Pathways Program not appointed to a position in such Executive agency only if the appointment of such participant is converted to an appointment to a position in such Executive agency.</text></subparagraph></paragraph><paragraph id="H5604B2EE7666492BA13319F3328EA236"><enum>(3)</enum><header>Conversion eligibility database</header><subparagraph id="H20A43D2C0EE7461294CD58255B2F509F" display-inline="no-display-inline"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Director shall establish and maintain a database of participants in the Pathways program whose appointments are eligible for conversion to career or career-conditional appointments under paragraph (1).</text></subparagraph><subparagraph id="HD99F635DF76F455883204E3DD96A43B4"><enum>(B)</enum><header>Availability</header><text display-inline="yes-display-inline">The Director shall make the database established under subparagraph (A) available to each Executive agency.</text></subparagraph><subparagraph id="H7F904481211D4558B295F8CB98821B6A"><enum>(C)</enum><header>Conversion eligibility reporting</header><clause id="H218D1EE601214380BF78F3716D71BD8E"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The head of each Executive agency shall submit to the Director such information as determined by the Director regarding each participant in the Pathways program appointed to a position within such Executive agency whose appointment is eligible for conversion to career or career-conditional appointments under paragraph (1).</text></clause><clause id="H20CD788C364A4F3094F784431A7B0D9E"><enum>(ii)</enum><header>Form</header><text>The head of each Executive agency shall submit the information required under clause (i) at such time and in such manner and form as determined appropriate by the Director of the Office of Personnel Management.</text></clause></subparagraph><subparagraph id="H3CBEEFA7B7C540D7BE8CB112B7CBC061"><enum>(D)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Office of Personnel Management for each fiscal year such funds as may be necessary to carry out this paragraph.</text></subparagraph></paragraph></subsection><subsection id="HEB1D94AC0E6C42298C3D110399BADFBA"><enum>(i)</enum><header>Subsequent appointments</header><paragraph id="H368FA7036A814F0490C8958127A447C2"><enum>(1)</enum><header>In general</header><text>The head of an Executive agency may, in accordance with this subsection and without regard to any provision of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, (other than sections 3303 and 3328), appoint current and previous participants in the Pathways Program to positions in the competitive service.</text></paragraph><paragraph id="H2BF9D54E5D3942A592E30BC04BEE716E"><enum>(2)</enum><header>Appointment requirements</header><subparagraph id="H3F83E9BD66474AB082CD1FB61C909688"><enum>(A)</enum><header>In general</header><text>In addition to the requirements under this subsection, the Director may establish requirements for appointments under paragraph (1).</text></subparagraph><subparagraph id="HE232EB54BC77402BA7E0449F2FE55E03"><enum>(B)</enum><header>Internship Program</header><text display-inline="yes-display-inline">A current or previous participant in the Internship Program described in subsection (d) may be appointed under paragraph (1) only if the participant—</text><clause id="H8BEC96CCFE4C409F817515118DF61267"><enum>(i)</enum><text>is a citizen of the United States;</text></clause><clause id="HCDE494F3AEAB4D55B0F0366B8BD17F01"><enum>(ii)</enum><text>has completed not less than one year as a participant in the Internship Program while enrolled as a half- or full-time degree- or certificate-seeking student at an institution or program described in subsection (d)(1);</text></clause><clause id="H6CABF60CF06D42B498EA1D7D02F74E1D"><enum>(iii)</enum><text>in the 120-day period ending on the date on which such participant is appointed under paragraph (1), has completed a course of study at an institution or program described in subsection (d)(1);</text></clause><clause id="HDFF7EEF7A93F4767BBC1D3EEF705EF4C"><enum>(iv)</enum><text>meets the qualification standards for the position to which the participant will be appointed, including any requirements of the Executive agency in which such position is located; and</text></clause><clause id="HE8F641AF74B34477A514A5192EBE74E8"><enum>(v)</enum><text>receives a favorable recommendation from an official of the Executive agency or agencies in which the participant served under the Internship Program.</text></clause></subparagraph><subparagraph id="H31E326FDF35D4286BC9B3042D309E729"><enum>(C)</enum><header>Recent Graduates Program participant</header><text display-inline="yes-display-inline">A current or previous participant in the Recent Graduates Program described in subsection (e) may be appointed under paragraph (1) only if the participant—</text><clause id="HEEB5789E9A4D4DADB778F2B44FBF5AC9"><enum>(i)</enum><text display-inline="yes-display-inline">is a citizen of the United States;</text></clause><clause id="H89FC0A02A8FA4DD0A0E9519B2B239BCE"><enum>(ii)</enum><text display-inline="yes-display-inline">has completed not less than one year of continuous service as a participant in the Recent Graduates Program, except that such one-year requirement shall be reduced by the amount of time, if any, the participant spent as a participant in the Internship Program described in subsection (d);</text></clause><clause id="H12AA64635AF14FC08F252118C9855617"><enum>(iii)</enum><text>has demonstrated successful performance of the responsibilities of each position to which the participant was assigned under the Recent Graduates Program;</text></clause><clause id="H9C75AF321956454DA6FB7A5D672B0145"><enum>(iv)</enum><text>meets the qualification standards for the position to which the participant will be appointed, including any requirements of the Executive agency in which such position is located; and</text></clause><clause id="H06032F94419040639657AE34AC453B7A"><enum>(v)</enum><text>receives a recommendation for such appointment from the immediate supervisor of the participant under the Recent Graduates Program.</text></clause></subparagraph><subparagraph id="H49D43CD99E2442B0987318C086F5E158" display-inline="no-display-inline"><enum>(D)</enum><header>Presidential Management Fellows Program participant</header><text display-inline="yes-display-inline">A previous participant in the Presidential Management Fellows Program described in subsection (f) may be appointed under paragraph (1) only if the participant—</text><clause id="H8BF45C00AFB540A285CA1CDDAD823033"><enum>(i)</enum><text display-inline="yes-display-inline">is a citizen of the United States;</text></clause><clause id="H899DA66630914F75ADF6FF137B563BD2"><enum>(ii)</enum><text display-inline="yes-display-inline">successfully completed the Presidential Management Fellows Program in accordance with the standards set by the Office of Personnel Management and the relevant agency;</text></clause><clause id="H2FFC91C6C58247C4994CC7DCF0EA1D7B"><enum>(iii)</enum><text display-inline="yes-display-inline">for each position to which the participant was assigned under the Presidential Management Fellows Program—</text><subclause id="HFE8191B608254A3EA99D29AAAFC87D2D"><enum>(I)</enum><text>if the performance of the participant for such position was assessed under the performance appraisal program of the Executive agency in which this position was located, received a rating for such performance that is not less than fully successful or an equivalent rating; and</text></subclause><subclause id="H1D19BC47CF1B4A818DC5F9E0A67A490C"><enum>(II)</enum><text display-inline="yes-display-inline">for any other such position, demonstrated successful performance of the responsibilities of such position;</text></subclause></clause><clause id="HC9931A8FF1484581AB98CF3596812466"><enum>(iv)</enum><text display-inline="yes-display-inline">meets the qualification standards for the position to which the participant will be appointed, including any requirements of the Executive agency in which such position is located; and</text></clause><clause id="H540FDD59F07B4816B31DECCD9507C5D4"><enum>(v)</enum><text display-inline="yes-display-inline">receives a recommendation for such appointment from the immediate supervisor of the participant under the Presidential Management Fellows Program.</text></clause></subparagraph></paragraph></subsection><subsection id="H0EEF9300DDD049BBB7A1FEDE0A29B781"><enum>(j)</enum><header>Interaction with other law</header><text>Beginning one year after the date of the enactment of this Act, any program that may be established or operated under this section, Executive Order 13562 (75 Fed. Reg. 82583, relating to recruiting and hiring students and recent graduates), or Executive Order 13318 (68 Fed. Reg. 66317, relating to the Presidential Management Fellows Program) and any authority provided under this section and such Executive Orders, shall be deemed to be established, operated, and provided, as applicable, under this section.</text></subsection><subsection id="HC8E9D6F561B8406DB57C16EA1427980D"><enum>(k)</enum><header>Definition of Federal internship program</header><text>Section 3111a(c)(1) of title 5, United States Code, as amended by this Act, is further amended—</text><paragraph id="H684A0BB2FABE4166B329114FA560E386"><enum>(1)</enum><text>by redesignating subparagraphs (B), (C), and (D) as subparagraphs (C), (D), and (E), respectively;</text></paragraph><paragraph id="H5760FD5F7F4F45E1AC59B2DB9F090903"><enum>(2)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" id="H592E5AF814244067825CDAF7714F8C0E" display-inline="no-display-inline"><subparagraph id="H3F9981CAF4EE4610A2A144C8D9D39C5A"><enum>(B)</enum><text display-inline="yes-display-inline">the Internship Program established under section 8 of the Building the Next Generation of Federal Employees Act;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H313F37BD9FBF4D2892D850831ABBA37A"><enum>(3)</enum><text>in subparagraph (D), as so redesignated, by inserting after <quote>(75 Federal Register 82525)</quote> the following: <quote>or the Internship Program established under section 8 of the Building the Next Generation of Federal Employees Act</quote>; and</text></paragraph><paragraph id="H4FF63B8FD185440B88C6C7C76BB6E0BE"><enum>(4)</enum><text display-inline="yes-display-inline">in subparagraph (E)(i), as so redesignated, by inserting after <quote>(75 Federal Register 82525)</quote> the following: <quote>or the Internship Program established under section 8 of the Building the Next Generation of Federal Employees Act</quote>.</text></paragraph></subsection></section><section id="H5704293C2B01411F8293AD381E51D28F"><enum>9.</enum><header>Enhanced hiring for recent college graduates and post-secondary students</header><subsection id="HF374DDDF87EE44E7AD1CC9F9C50544BB"><enum>(a)</enum><header>Recent graduate hiring authority</header><text>Section 3115(e)(1) of title 5, United States Code, is amended by striking all that follows <quote>exceed</quote> and inserting <quote>the greater of either 15 percent of the number of individuals that the agency head appointed during the previous fiscal year to permanent employment or 1 percent of the average number of permanent employees in the agency during the previous fiscal year.</quote>.</text></subsection><subsection id="H62C73A6D22A64974916E9C53E828F453"><enum>(b)</enum><header>Post-Secondary student hiring authority</header><text>Section 3116 of title 5, United States Code, is amended—</text><paragraph id="HA7677A15E0DF4AC883E4805DFE2952F5"><enum>(1)</enum><text>in subsection (d)(1), by striking all that follows <quote>exceed</quote> and inserting <quote>the greater of either 15 percent of the number of individuals that the agency head appointed during the previous fiscal year to permanent employment or 1 percent of the average number of permanent employees in the agency during the previous fiscal year.</quote>; and</text></paragraph><paragraph id="H98371EAC38D54C6682D518501EBDE479" commented="no"><enum>(2)</enum><text>in subsection (e)(2), by striking <quote>640</quote> and inserting <quote>400</quote>.</text></paragraph></subsection></section><section id="H25346A536311411E9D423E3A97E668F5"><enum>10.</enum><header>Information on use of expedited hiring authority for college graduates</header><subsection id="HDDCE5E867178495DBF1C3951EA78D096"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The head of each Executive agency shall submit to the Director of the Office of Personnel Management information on the use of the authority under section 3115 of title 5, United States Code, by such Executive agency at such time, in such manner, and containing such information as the Director determines appropriate.</text></subsection><subsection id="H8231F63E6D6540DAA2C76F41015506E6" commented="no"><enum>(b)</enum><header>Publication</header><paragraph id="H0EAA1DBC89464DEE9085647CB484B838" commented="no"><enum>(1)</enum><header>In general</header><text>Not less than once each fiscal-year quarter, the Director of the Office of Personnel Management shall publish on a database described in paragraph (2) the information received under subsection (a), including—</text><subparagraph id="HBE349D3E38174B4A83B4CAC30BEB2817"><enum>(A)</enum><text>the number individuals appointed under section 3115 of title 5, United States Code;</text></subparagraph><subparagraph id="H718C911365574371857B9C6523127E2F"><enum>(B)</enum><text>the demographic information of such individuals;</text></subparagraph><subparagraph id="HCF7E4A9DDE644D67A31F5FA725239DA0"><enum>(C)</enum><text>the occupational series of the positions to which such individuals were appointed; and</text></subparagraph><subparagraph id="H16C6F05CEA37442392B2A0F9F2996DA4"><enum>(D)</enum><text>the rates of pay for such individuals.</text></subparagraph></paragraph><paragraph id="H22C7E9A552104A77A97B8D56AC6E5B18" commented="no"><enum>(2)</enum><header>Existing database use</header><text display-inline="yes-display-inline">The database described in this paragraph is a publicly available online database that is publicly available online as of the date of the enactment of this Act.</text></paragraph></subsection></section><section id="H3C845FA8E86F43689A83C06C7BDE3A0C"><enum>11.</enum><header>Competitive service examination credit</header><subsection id="H49A4CAF4122645F9AE8290D397A99CF4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in section 3(e)(2)(C), in examinations for the competitive service in which experience is an element of qualification, a fellow or intern shall be entitled to 5 additional points above the earned rating of such fellow or intern if such fellow or intern completes a fellowship or internship, respectively, that—</text><paragraph id="H9AC65E9920FC46C9A6132C1E0EC73E4D"><enum>(1)</enum><text>is not less than six months in duration;</text></paragraph><paragraph id="HD46D41B05BD14BBCA307E046FE96A792"><enum>(2)</enum><text display-inline="yes-display-inline">the Director of the Office of Personnel Management has approved as entitling the individuals who complete such fellowship or internship to such credit.</text></paragraph></subsection><subsection id="HA90534749BF64727A55B2F758B54586C"><enum>(b)</enum><header>Credit availability</header><text display-inline="yes-display-inline">The credit under subsection (a) shall remain available for a period of 12 months beginning on the later of the date on which the fellowship or internship of the fellow or intern ends or the date on which the fellow or intern graduates from a qualifying institution, as determined by the Director of the Office of Personnel Management.</text></subsection><subsection id="H4EEF52C93FE14D508B8E33FC82B37333"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">A sponsoring agency or third-party internship provider seeking the approval described in subsection (a)(2) for a fellowship or internship offered by such entity shall submit to the Director of the Office of Personnel Management an application at such time, in such manner, and containing such information as the Director determines appropriate.</text></subsection><subsection id="HCDC10FCCA336401ABF4F44942CBB3A05"><enum>(d)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director shall issue regulations carrying out this section.</text></subsection></section></legis-body></bill>
