R. 609</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210128">January 28, 2021</action-date><action-desc><sponsor name-id="S001199">Mr. Smucker</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to require Amtrak to convey of certain properties to the Commonwealth of Pennsylvania, and for other purposes.</official-title></form><legis-body id="H029BE2C676CF4C70A6D3DB0E32CB4661" style="OLC"><section id="H7228AA991CD44B8B83A1A34CC7B3808A" section-type="section-one"><enum>1.</enum><header>Expedited property conveyance</header><text display-inline="no-display-inline">Section 24301 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H7B39D26361AF4C079D69DAAF8A5A8ED1" display-inline="no-display-inline"><subsection id="H3B5308FF6DAC4928B8D482437F3C9795"><enum>(p)</enum><header>Expedited property conveyance</header><paragraph id="H5003B0E98E4D4DC0B34C8F87519F4D80"><enum>(1)</enum><text display-inline="yes-display-inline">On or before June 30, 2021:</text><subparagraph id="H75FE3548CD1B43F48B0A00C027C8AD4C"><enum>(A)</enum><text display-inline="yes-display-inline">Amtrak shall convey to the Commonwealth of Pennsylvania all of its rights and title in—</text><clause id="HA2A2401B8D3143B69EF7C28E3C11A0CF"><enum>(i)</enum><text>the Keystone Line and stations between Harrisburg and Philadelphia, Pennsylvania, including all of Amtrak’s passenger stations along that line east of William H. Gray III 30th Street Station in Philadelphia, Pennsylvania;</text></clause><clause id="H85AC926F94DF4B8FACAEF6B305E90CAC"><enum>(ii)</enum><text>all of Amtrak’s other passenger stations, excluding Amtrak’s William H. Gray III 30th Street Station and North Philadelphia Station, located within the Commonwealth along Amtrak’s Northeast Corridor and used for commuter rail passenger service as of May 1, 2020;</text></clause><clause id="HBF6F6A3CAD7647D39C5B67236F9EB685"><enum>(iii)</enum><text>sections of track on or along Amtrak’s Northeast Corridor immediately south of William H. Gray III 30th Street Station in Philadelphia that are solely used by and maintained by Southeastern Pennsylvania Transportation Authority; and </text></clause><clause id="HC22FF38D0EF04AE28B9961CD0ABA5B0B"><enum>(iv)</enum><text>Amtrak’s obligations to the United States as determined by the Secretary under subparagraph (C).</text></clause></subparagraph><subparagraph id="HE6FDB53EB4C84219AFFD9E373E8973F0"><enum>(B)</enum><text display-inline="yes-display-inline">Amtrak shall be entitled to use the properties conveyed pursuant to subparagraph (A) on the same terms and conditions and right to determination by the United States Surface Transportation Board as afforded commuter authorities operating over Amtrak’s lines pursuant to section 24903. </text></subparagraph><subparagraph id="HB39A8DF6B9F047349482817E2FA1D84D"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary shall—</text><clause id="HB0E93FEF5CEB41C1BBB67916075665AA"><enum>(i)</enum><text>determine what portion of the note and mortgage the Secretary obtained from Amtrak to secure the amounts paid by the United States to acquire Amtrak’s Northeast Corridor should be allocated, based on the original purchase price paid by the United States, to the properties to be conveyed under subparagraph (A); and</text></clause><clause id="HA13E7729738F4E75A53BB7367C66D2DA"><enum>(ii)</enum><text>at the time of the conveyance under subparagraph (A), assign that portion of the note and mortgage to the Commonwealth of Pennsylvania.</text></clause></subparagraph></paragraph><paragraph id="H7952D2341445497083916F05B6097AC3"><enum>(2)</enum><text display-inline="yes-display-inline">Amtrak shall be entitled to no compensation for the conveyances mandated in paragraph (1)(A), and, exclusively for the purposes of this subsection, notwithstanding any other provision of the law, shall be deemed an agency of the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
