which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To facilitate contacts and cooperation, including commercial relationships, between Native American Tribes and Indigenous peoples in the Western Hemisphere, and for other purposes.</official-title></form><legis-body id="H9249960229384672AC221D231E3FDB60" style="OLC"><section id="H8EFD2FB3CDAE416C8619817F3356E261" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Indigenous Peoples Exchange and Economic Cooperation Act</short-title></quote>.</text></section><section id="HBA467D5C83E44690897250304A16B40B"><enum>2.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States to facilitate contacts and cooperation, including commercial relationships, between Native American Tribes and Indigenous peoples in the Western Hemisphere, in accordance with regional trade agreements and the Presidential memorandum titled <quote>Memorandum on Tribal Consultation and Strengthening Nation-to-Nation Relationships</quote>, dated January 26, 2021, which directs executive branches to engage in <quote>regular, meaningful, and robust consultation with Tribal officials</quote>.</text></section><section id="H92542147866E44DD80622D384C1B11AA"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HB928EA688A8E44B89FEDA533244FA001"><enum>(1)</enum><header>Native American Tribes</header><text>The term <term>Native American Tribe</term> means any federally recognized Tribe.</text></paragraph><paragraph id="H8B083C45B2024FEEBAFE2D9935319F87"><enum>(2)</enum><header>Indigenous peoples</header><text>The term <term>Indigenous peoples</term> means peoples residing in foreign countries and territories in the Western Hemisphere who have historical ties to a particular territory and are culturally or historically distinct from the politically dominant population.</text></paragraph></section><section id="H0E5DAB4E5F714A6AA3C887BE2AAF2D13"><enum>4.</enum><header>Strategy</header><subsection id="H86ACE50DCDB24454922CDFC312865E0B"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Commerce, in coordination with the Secretary of Interior, shall submit to the appropriate congressional committees a strategy, in consultation with the individuals listed in subsection (b), to promote and facilitate—</text><paragraph id="HDB65CF1D30CD4EAF830F2BDF9D5EC8A5"><enum>(1)</enum><text>cross-investments and export opportunities between Native American Tribes and Indigenous peoples in Tribal businesses and commercial enterprises that involve Indigenous peoples, such as sustainable natural resource management, agricultural development, timber, fish and other seafood, energy, handicraft and art production, or entrepreneurship for economic growth and diversification; and</text></paragraph><paragraph id="HA79CFA59BE1D4357B3439F655831CB3F"><enum>(2)</enum><text>the development of supply chains for United States entities that include certified products produced by Native American Tribes and Indigenous peoples.</text></paragraph></subsection><subsection id="H27E871DF9F7D4ACA88325B1FB4281F06"><enum>(b)</enum><header>Consultation required</header><text>The individuals referred to in subsection (a) are the following:</text><paragraph id="H01A2E331DE89445FACC496CC7393C88F"><enum>(1)</enum><text>The President of the Inter-American Foundation.</text></paragraph><paragraph id="H26A494522DEC482BBB3D04B84491D140"><enum>(2)</enum><text>The Secretary of State.</text></paragraph><paragraph id="HDE708DC1098D4F7CA98244DD15ED2948"><enum>(3)</enum><text>The United States Trade Representative.</text></paragraph><paragraph id="H5BA94FDEB2BC432CBBB1778D69A4F037"><enum>(4)</enum><text>The Secretary of Agriculture.</text></paragraph><paragraph id="H1B9BEF6FE62846D28C0513333BBBA437"><enum>(5)</enum><text>The Secretary of Energy.</text></paragraph><paragraph id="HA4593AAE634445AFB3270EE00F7A6E2A"><enum>(6)</enum><text>The Administrator of the Small Business Administration.</text></paragraph><paragraph id="HFFDF340A8BCD49D48F08A5648F85DF31"><enum>(7)</enum><text>The Administrator and the Advisor for Indigenous Peoples Issues of the United States Agency for International Development.</text></paragraph><paragraph id="H8182A8F6AB7941D49CDAB7A29CBF4A6D"><enum>(8)</enum><text>The Chief Executive Officer of the United States International Development Finance Corporation.</text></paragraph><paragraph id="H320146446F36461F9B1E265DFE1ADBFD"><enum>(9)</enum><text>The Chief Executive Officer of the Millennium Challenge Corporation.</text></paragraph><paragraph id="HA46C53263A114B8E9D34E8210CB6C3F9"><enum>(10)</enum><text>Representatives of Native American Tribes.</text></paragraph><paragraph id="H99902805AF69472793D0AF07B348FBCD"><enum>(11)</enum><text>Representatives of civil society organizations advocating for the rights or interests of Indigenous peoples.</text></paragraph></subsection><subsection id="HCD1FBF08B29E42A5AF87554444529D6A"><enum>(c)</enum><header>Appropriate congressional committees</header><text>In this section, the term <term>appropriate congressional committees</term> means—</text><paragraph id="H20345E3673B140A29F2A0EE7C3AF3A5F"><enum>(1)</enum><text>the Committee on Appropriations, the Committee on Foreign Affairs, and the Committee on Natural Resources of the House of Representatives; and</text></paragraph><paragraph id="H610DD8A886534DA29330A0E3D014FA5F"><enum>(2)</enum><text>the Committee on Appropriations, the Committee on Foreign Relations, the Committee on Energy and Natural Resources, and the Committee on Indian Affairs of the Senate.</text></paragraph></subsection></section><section id="H79CBB80450A74E03A5474B54A7916F6E"><enum>5.</enum><header>United states assistance to support indigenous peoples</header><text display-inline="no-display-inline">In order to improve the capacity of Indigenous peoples to engage in and benefit from increased trade and investment relationships, the Inter-American Foundation, Secretary of State, United States Agency for International Development, and Millennium Challenge Corporation shall—</text><paragraph id="H426F4732E99A40EFB05173857FCBA462"><enum>(1)</enum><text>consult with representatives of civil society organizations, especially organizations comprised of or representing the interests of Indigenous peoples; and</text></paragraph><paragraph id="HACB367CD73CD4F17B7B305B7AE5C4D5E"><enum>(2)</enum><text>provide assistance to countries in the Western Hemisphere in a manner that promotes and facilitates entrepreneurship among Indigenous peoples—</text><subparagraph id="H5DDF5E2C7AEA4FEFB5036960B5E84BCC"><enum>(A)</enum><text>by strengthening the capacity of civil society organizations and local governments; and</text></subparagraph><subparagraph id="H55512862224048DAB19DC42A5A7ABAF1"><enum>(B)</enum><text>by supporting community-led and community-based projects including sustainable natural resource management, agricultural development, and handicraft production.</text></subparagraph></paragraph></section><section id="H3C21F17780084866B8CE9D2D8AC8EEA9"><enum>6.</enum><header>Assistance to support activities</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Secretary of Commerce $3,000,000 to carry out this Act.</text></section></legis-body></bill>
