Maloney of New York</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 10, United States Code, to provide for the coverage of assisted reproductive technology services under the TRICARE program, and for other purposes.</official-title></form><legis-body id="H90A08A3856DD4267A238F7AAA85578D1" style="OLC"><section id="HBA552D950BFC44A3A8F1A23CB80D608D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Access to Fertility Care for Servicemembers and Dependents Act</short-title></quote>.</text></section><section id="HFD260E711A224D6F963D7E658EF8E8AD"><enum>2.</enum><header>Coverage of assisted reproductive technology services under TRICARE program</header><subsection id="H0D9111EF29AA436F8D0E81DCAE8D5F48"><enum>(a)</enum><header>Services covered</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/55">Chapter 55</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/1074o">section 1074o</external-xref> the following new section:</text><quoted-block style="USC" id="HC135C1C3D84D427BA19C810CA9964F61" display-inline="no-display-inline"><section id="H52D9D96C8DD74E5DAC2D34F0D26F64EE"><enum>1074p.</enum><header>Assisted reproductive technology services for certain members and dependents</header><subsection id="H796E35B2A63C4F9BB88D1F4C4B7BF9DB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any member of the armed forces (including the reserve components) performing active service who is entitled to medical care under the TRICARE program, and any dependent of such a member, shall be entitled to assisted reproductive technology services as part of such medical care, without regard to any of the following:</text><paragraph id="H41A9C58D25684891BD7DCEB169074A1D"><enum>(1)</enum><text>Whether the assisted reproductive technology service is related to the treatment of a service-connected disability.</text></paragraph><paragraph id="HEE66AF961B5D4CC8AA728D399D0F59E7"><enum>(2)</enum><text>Whether the member has a serious illness or injury resulting from a service-connected disability.</text></paragraph><paragraph id="H8ECE00F0B2FB489DAF1ABB5A6EC0979E"><enum>(3)</enum><text display-inline="yes-display-inline">The ability of the member or dependent, as applicable—</text><subparagraph id="H7BA35F383E804C17BA10EA117F4EDE3A"><enum>(A)</enum><text>to conceive a pregnancy or carry a pregnancy to live birth after an appropriate period of regular, unprotected sexual intercourse; or </text></subparagraph><subparagraph id="HF53FAC46478D4B69989FBCB51CB91910"><enum>(B)</enum><text>to reproduce, either as an individual or with a partner.</text></subparagraph></paragraph><paragraph id="HFDD6050AD2FA444E809C7195E0D4E9BC"><enum>(4)</enum><text>The sex, gender, sexual orientation, or marital status of the member or dependent, as applicable.</text></paragraph></subsection><subsection id="H5156A40946D74E0F86079E9594D62458"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HEA7D64845B004DA38F081AFCF6F48013"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>appropriate period</quote> means, with respect to an individual, a period of at least one year, unless the health care provider of the individual determines, based on medical history, age, or physical findings, that a shorter period is appropriate.</text></paragraph><paragraph id="HC9F01A500E0C4DD5B1420858EEAD7ADA"><enum>(2)</enum><text>The term <quote>assisted reproductive technology services</quote> includes the following services:</text><subparagraph id="HD5D3FE05791143A180C5310BE1C40F32"><enum>(A)</enum><text>Assisted reproduction, including intravaginal insemination, intracervical insemination, and intrauterine insemination.</text></subparagraph><subparagraph id="H9D04EDC500CF452AB079571772AC56C6"><enum>(B)</enum><text display-inline="yes-display-inline">In-vitro fertilization.</text></subparagraph><subparagraph id="HCB227B5D545B4405BE2F3CA1C22C3F93"><enum>(C)</enum><text>The preservation of embryos, eggs, or sperm for future use through cryopreservation.</text></subparagraph><subparagraph id="H2F8D7BC062174A7AA441969F7ABA3E69"><enum>(D)</enum><text>Such other forms of assisted reproductive technology as determined appropriate by the Secretary.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4D4D9D3C556946B1A64BBC7BFE2022DD"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/55">chapter 55</external-xref> of title 10, United States Code, is amended by inserting after the item relating to 1074o the following new item:</text><quoted-block style="USC" id="HE0484BE073084518AB88000760B51190" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">1074p. Assisted reproductive technology services for certain members and dependents.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
