which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish the Election Integrity Commission to study the integrity and administration of the general election for Federal office held in November 2020 and make recommendations to Congress to improve the security, integrity, and administration of Federal elections, and for other purposes.</official-title></form><legis-body id="H4877B06889494D08B86BDC3D8B1EA68E" style="OLC"><section id="H72B279FE0B8E4722AD420203BE98CA50" section-type="section-one"><enum>1.</enum><header>Establishment</header><text display-inline="no-display-inline">There is established in the legislative branch the Election Integrity Commission (referred to in this Act as the <quote>Commission</quote>).</text></section><section id="H8FFA237002104C3DBD947BFC27991C07"><enum>2.</enum><header>Membership</header><subsection id="HADB5723B95E84F4EA223E962637DC7A3"><enum>(a)</enum><header>Composition</header><paragraph id="H7184166701F24BB6A1207005F92B426B"><enum>(1)</enum><header>In general</header><text>The Commission shall be composed of 18 members as follows:</text><subparagraph id="HDAC03769AC9247D091D19D94B82246D2"><enum>(A)</enum><text>3 shall be Members of the House of Representatives from the majority party of the House who represent a congressional district in a State described in paragraph (2), who shall be appointed by the Speaker of the House.</text></subparagraph><subparagraph id="H9A78F2A2E8C3402297A73DE75E5EDE7E"><enum>(B)</enum><text display-inline="yes-display-inline">3 shall be Members of the House of Representatives from the minority party of the House who represent a congressional district in a State described in paragraph (2), who shall be appointed by the minority leader of the House.</text></subparagraph><subparagraph id="HA8BE93F39358407088B6E8F82913481F"><enum>(C)</enum><text display-inline="yes-display-inline">3 shall be Senators from the majority party of the Senate who represent a State described in paragraph (2), who shall be appointed by the majority leader of the Senate.</text></subparagraph><subparagraph id="HCC0FC99B8F6341428B29005D8F98ABD5"><enum>(D)</enum><text display-inline="yes-display-inline">3 shall be Senators from the minority party of the Senate who represent a State described in paragraph (2), who shall be appointed by the minority leader of the Senate.</text></subparagraph><subparagraph id="H3C1A33172F2146DCB5963E5DE3D64BB5"><enum>(E)</enum><text>6 individuals who are State or local election officials, of whom—</text><clause id="HB0FA3DBF355343A6914A7F9364D5F017"><enum>(i)</enum><text>3 shall be appointed jointly by the majority leader of the House and the majority leader of the Senate; and</text></clause><clause id="H1B53932C7C7B4FFEAB976E05D3F25246"><enum>(ii)</enum><text>3 shall be appointed jointly by the minority leader of the House and the minority leader of the Senate.</text></clause></subparagraph></paragraph><paragraph id="H31C5348A3FAF4852BF05C247FCECF4E2"><enum>(2)</enum><header>States described</header><text>A State described in this paragraph is a State in which the winning candidate for the office of President in the November 2020 general election won by a margin of 1.5 percentage points or less.</text></paragraph></subsection><subsection id="HC15801D883314A0E942B17917A9B3D2E"><enum>(b)</enum><header>Co-Chairs</header><text>Two of the members of the Commission shall serve as Co-Chairs, of whom—</text><paragraph id="H1AE19FC8ED944B6F8364EEF45057963E"><enum>(1)</enum><text display-inline="yes-display-inline">one shall be designated jointly by the leader of the Senate (majority or minority leader, as the case may be) of the Republican Party and the leader of the House of Representatives (majority or minority leader, as case may be) of the Republican Party; and</text></paragraph><paragraph id="H601425F1D9AA47E583231A0983739203"><enum>(2)</enum><text display-inline="yes-display-inline">one shall be designated jointly by the leader of the Senate (majority or minority leader, as the case may be) of the Democratic Party and the leader of the House of Representatives (majority or minority leader, as case may be) of the Democratic Party.</text></paragraph></subsection><subsection id="H4942AC5A1B2442FBB3A23821A0ED1841"><enum>(c)</enum><header>Date</header><text>The appointments of the members of the Commission shall be made not later than 90 days after the date of enactment of this Act.</text></subsection><subsection id="HB25D727BAF734BE990653B7FD98145E0"><enum>(d)</enum><header>Period of appointment; vacancies</header><paragraph id="H6077507883B84A338EC14B556F7DBB43"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), a member of the Commission shall be appointed for the duration of the Commission.</text></paragraph><paragraph id="HB56D8B5B1B7D4CD9BA51A9A32C22475E"><enum>(2)</enum><header>Removal</header><text>A member may be removed from the Commission at any time at the upon concurrence of both of the Co-Chairs of the Commission.</text></paragraph><paragraph id="HA8313BA4A91C4227927C3A120AC66B93"><enum>(3)</enum><header>Vacancies</header><text>A vacancy in the Commission—</text><subparagraph id="H1B91F8C3B0DA476695D859CD4D2A8F97"><enum>(A)</enum><text>shall not affect the powers of the Commission; and</text></subparagraph><subparagraph id="HD121015CF9154633BE03088141D5E420"><enum>(B)</enum><text>shall be filled in the same manner as the original appointment.</text></subparagraph></paragraph></subsection><subsection id="H2F346A3D5394407AAB301A501C3E3726"><enum>(e)</enum><header>No compensation</header><text display-inline="yes-display-inline">The members of the Commission may not receive pay or benefits from the United States Government by reason of their service on the Commission, but may receive travel expenses, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></subsection></section><section id="HDBCBE9AEDA794528AFDA727B4793E878"><enum>3.</enum><header>Duties</header><subsection id="HFD58FD6995CD4D7CB5A4D8814663E359"><enum>(a)</enum><header>Study</header><paragraph id="H7BD045B8B6FA46108B5D51A8D6E079FA"><enum>(1)</enum><header>In general</header><text>The Commission shall, consistent with applicable law, study the integrity and administration of the general election for Federal office held in November 2020 and make recommendations to Congress to improve the security, integrity, and administration of Federal elections.</text></paragraph><paragraph id="HF5EC2614B200494BBADF20CD98CBBD4F"><enum>(2)</enum><header>Matters studied</header><text>The matters studied by the Commission shall include—</text><subparagraph id="H6C4290818FBC4D2792596F75FDDD7454"><enum>(A)</enum><text>the effects of the COVID–19 pandemic on the administration of the general election for Federal office held in November 2020;</text></subparagraph><subparagraph id="H216F973C4C5C484790047D4CAE4606AD"><enum>(B)</enum><text>the election practices adopted by Federal, State, and local governments in response to the COVID–19 pandemic, including—</text><clause id="H5977A095C0914A2797AE009D770BD8EC"><enum>(i)</enum><text>practices that undermined the security and integrity of the election; and</text></clause><clause id="HFD779D76DB914CF9AD6D14807B15BF2F"><enum>(ii)</enum><text>practices that strengthened the security and integrity of the election;</text></clause></subparagraph><subparagraph id="H906E1787E0E241F788802908343F2510"><enum>(C)</enum><text>the laws, rules, policies, activities, strategies, and practices regarding mail-in ballots, absentee ballots, and vote-by-mail procedures, including—</text><clause id="HCF8FD34EF7914A73BEAFCBE940022835"><enum>(i)</enum><text>measures that undermined the security and integrity of the election; and</text></clause><clause id="H419287EFFDF84CFDA9A6F600BA73DEA8"><enum>(ii)</enum><text>measures that strengthened the security and integrity of the election;</text></clause></subparagraph><subparagraph id="H3885146ADC4E4B8D8DD74CC8E38BA8F1"><enum>(D)</enum><text display-inline="yes-display-inline">any laws, rules, policies, activities, strategies, and practices that were inconsistent with or in violation of established State law and resulted in irregularities in the casting of ballots in the election; and</text></subparagraph><subparagraph id="HE03C7DDFAF21480BB2F6A676F3B91BE4"><enum>(E)</enum><text display-inline="yes-display-inline">any laws, rules, policies, activities, strategies, and practices that were inconsistent with or in violation of established State law and resulted in irregularities in voter registration for the election.</text></subparagraph></paragraph></subsection><subsection id="H658F829BB4F947A3A9CFB75E55E84814"><enum>(b)</enum><header>Reports</header><paragraph id="HD5D8B6BA79D242F0A85EDD75AAFE0C55"><enum>(1)</enum><header>Initial report</header><text>Not later than 180 days after the date of the enactment of this Act, the Commission shall submit to the Election Assistance Commission and the appropriate Congressional committees a report on the matters studied under subsection (a). Such report shall include—</text><subparagraph id="HE11E86A1D8B7416BA98D20870807C5A0"><enum>(A)</enum><text>precinct-by-precinct data highlighting the number and incidence of any irregularities in the casting of ballots in the election; and</text></subparagraph><subparagraph id="H11DB7B03108D4C91AD47DEA601492EB7"><enum>(B)</enum><text>precinct-by-precinct data highlighting the number and incidence of any irregularities in voter registration for the election.</text></subparagraph></paragraph><paragraph id="H67CCC3C6BCC84393B16765EC0B142574"><enum>(2)</enum><header>Final report; recommendations</header><subparagraph id="H7C82B5FF85A049C2AF7884E4EA7F93D1"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the Commission shall submit to the Election Assistance Commission and the appropriate Congressional committees a final report on the matters studied under subsection (a), and shall include in such report recommendations on the following:</text><clause id="HE610403680F841A4A1555993BC0CDA67"><enum>(i)</enum><text>The best practices that should be adopted by at each level of local, State, and Federal Government for administering elections for Federal office—</text><subclause id="H13C1F6155F6C4081964A2BE8F9923B42"><enum>(I)</enum><text>during the COVID–19 pandemic; and</text></subclause><subclause id="H50AF0EDF58EB42B1AA02D6BE6DA3076D"><enum>(II)</enum><text>during other national emergencies.</text></subclause></clause><clause id="H3EAC82AE64ED42A1A0558CA2DF730480"><enum>(ii)</enum><text>The best practices that should be adopted at each level of local, State, and Federal Government to increase the integrity and security of mail-in ballots, absentee ballots, and vote-by-mail procedures.</text></clause><clause id="H499E40B1EBC844EA8D2064F4BE2F0DB7"><enum>(iii)</enum><text>The best practices that should be adopted at each level of local, State, and Federal Government to prevent irregularities in the casting of ballots.</text></clause><clause id="H413F2CD0553946E9A65CCC527F69DDC5"><enum>(iv)</enum><text>The best practices that should be adopted at each level of local, State, and Federal Government to prevent irregularities in voter registration.</text></clause></subparagraph><subparagraph id="HEC28B55AB39B46358410CBA3C7004147"><enum>(B)</enum><header>Minority views</header><text>In the case of any recommendation with respect to which one-third or more of the Committee does not concur, the report shall include a justification for why such members do not concur.</text></subparagraph></paragraph><paragraph id="HD5BD7E5CE9964C5C873D90B6922914EA"><enum>(3)</enum><header>Appropriate congressional committees</header><text>For purposes of this subsection, the term <term>appropriate Congressional Committees</term> means—</text><subparagraph id="H6DDE2B3646764010ADA120CE15AC754F"><enum>(A)</enum><text>the Committee on Rules and Administration of the Senate;</text></subparagraph><subparagraph id="HE4C91A28B1354D5FAFFDBFDA8751F458"><enum>(B)</enum><text>the Committee on the Judiciary of the Senate;</text></subparagraph><subparagraph id="H8F2E8CF1EB424ECDAEC6548C4A740733"><enum>(C)</enum><text>the Committee on House Administration of the House of Representatives; and</text></subparagraph><subparagraph id="HBAFE3D2534A545D195A6AF9952571846"><enum>(D)</enum><text>the Committee on the Judiciary of the House of Representatives.</text></subparagraph></paragraph></subsection></section><section id="H9E3D5232458140698DF4B309F4019DC3"><enum>4.</enum><header>Powers</header><subsection id="HE8CEDC82F5904958A8D55F63AF4C4766"><enum>(a)</enum><header>Hearings and sessions</header><text>The Commission may, for the purpose of carrying out this Act, hold hearings, sit and act at times and places, take testimony, and receive evidence as the Commission considers appropriate. The Commission may administer oaths or affirmations to witnesses appearing before it.</text></subsection><subsection id="HFF1C9424D5D7467F8DD41F6ABDB5C498"><enum>(b)</enum><header>Powers of members and agents</header><text>Any member or agent of the Commission may, if authorized by the Commission, take any action which the Commission is authorized to take by this section.</text></subsection><subsection id="H59C031ED09C0496E9743D3C42D746392"><enum>(c)</enum><header>Obtaining official data</header><text display-inline="yes-display-inline">The Commission may secure directly from any department or agency of the United States information necessary to enable it to carry out this Act. Upon request of the chair or the staff director of the Commission, the chair of any subcommittee created by a majority of the Commission, or any member designated by a majority of the Commission, the head of that department or agency shall furnish that information to the Commission.</text></subsection><subsection id="H613F77EA70C54E2CBA540E24A2F5C8C1"><enum>(d)</enum><header>Gifts, bequests, and devises</header><text display-inline="yes-display-inline">The Commission may accept, use, and dispose of gifts, bequests, or devises of services or property, both real and personal, for the purpose of aiding or facilitating the work of the Commission.</text></subsection><subsection id="HA6F4F381C26B47D58EB6A4667169BB06"><enum>(e)</enum><header>Mails</header><text display-inline="yes-display-inline">The Commission may use the United States mails in the same manner and under the same conditions as other departments and agencies of the United States.</text></subsection><subsection id="H1F3AF5B897934ADEB7A51CC5F7B1C07F"><enum>(f)</enum><header>Administrative support services</header><text display-inline="yes-display-inline">Upon the request of the Commission, the Architect of the Capitol shall provide to the Commission, on a reimbursable basis, the administrative support services necessary for the Commission to carry out its responsibilities under this Act.</text></subsection><subsection id="HD3DC172792274BB5AF0B2823D21F19D1"><enum>(g)</enum><header>Subpoena power</header><paragraph id="H42CDF634F7BF49EE9D0EA03B3AC6453A"><enum>(1)</enum><header>In general</header><text>The Commission may issue subpoenas requiring the attendance and testimony of witnesses and the production of any evidence relating to any matter which the Commission is empowered to investigate under this Act. The attendance of witnesses and the production of evidence may be required from any place within the United States at any designated place of hearing within the United States.</text></paragraph><paragraph id="HE0E71B743E9342E79D4862A19EF1F8F8"><enum>(2)</enum><header>Failure to obey a Subpoena</header><text>If a person refuses to obey a subpoena issued under paragraph (1), the Commission may apply to a United States district court for an order requiring that person to appear before the Commission to give testimony, produce evidence, or both, relating to the matter under investigation. The application may be made within the judicial district where the hearing is conducted or where that person is found, resides, or transacts business. Any failure to obey the order of the court may be punished by the court as civil contempt.</text></paragraph><paragraph id="H623C6377BD28494C84F3C51960B12DD1"><enum>(3)</enum><header>Service of subpoenas</header><text>The subpoenas of the Commission shall be served in the manner provided for subpoenas issued by a United States district court under the Federal Rules of Civil Procedure for the United States district courts.</text></paragraph><paragraph id="HDF8110B8177548D987D18FDB7FB36DAC"><enum>(4)</enum><header>Service of process</header><text>All process of any court to which application is made under paragraph (2) may be served in the judicial district in which the person required to be served resides or may be found.</text></paragraph></subsection><subsection id="HAD689F92365C429489042E3EA3A3F065"><enum>(h)</enum><header>Contract authority</header><text display-inline="yes-display-inline">The Commission may contract with and compensate government and private agencies or persons to enable the Commission to discharge its duties under this Act.</text></subsection></section><section id="HC9E948C038FD438092E8150E2106262E"><enum>5.</enum><header>Personnel matters</header><subsection id="HD9BE79CBADCD4D88922CB2DF0383D09D"><enum>(a)</enum><header>Staff</header><text>The Co-Chairs of the Commission may appoint and fix the compensation of such staff as may be appropriate to enable the Commission to carry out its duties, without regard to chapter 51 and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, relating to classification of positions and General Schedule pay rates, except that the rate of pay for the staff may not exceed the rate payable for level V of the Executive Schedule under section 5316 of that title.</text></subsection><subsection id="H563D4EA50BA54871A10D24C4B0658B9B"><enum>(b)</enum><header>Staff of Federal agencies</header><text display-inline="yes-display-inline">Upon request of the Commission, the head of any Federal department or agency may detail, on a nonreimbursable basis, any of the personnel of that department or agency to the Commission to assist it in carrying out its duties under this Act.</text></subsection><subsection id="HAF2B3167AF3341A7A9371408396B68E0"><enum>(c)</enum><header>Experts and consultants</header><text display-inline="yes-display-inline">The Commission is authorized to procure temporary and intermittent services under section 3109 of title 5, United States Code, but at rates for individuals not to exceed the daily equivalent of the maximum annual rate of basic pay under level IV of the Executive Schedule under section 5315 of title 5, United States Code.</text></subsection><subsection id="HF6D7A5719EFC46CA87C7BE64FD2FBAF8"><enum>(d)</enum><header>Use of existing staff</header><text>Notwithstanding the previous provisions of this section, to the greatest extent practicable and consistent with applicable laws, rules, and regulations, the Commission is encouraged to carry out its functions utilizing the services of existing staff of offices of the legislative branch.</text></subsection></section><section id="HDA8EDE265F064C09BDFD803C2ED4298C"><enum>6.</enum><header>Authorization of appropriations</header><subsection id="H2D409840A4BE4FECA1D034CD9D2234F3"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">There are authorized to be appropriated $1,000,000 to carry out this Act, of which—</text><paragraph id="H3025FA5C0C2B44AE95951C5C51892C74"><enum>(1)</enum><text>50 percent shall be derived from the applicable accounts of the House of Representatives; and</text></paragraph><paragraph id="HBD89336A87CD4B9FB959B9FD22643897"><enum>(2)</enum><text>50 percent shall be derived from the contingent fund of the Senate.</text></paragraph></subsection><subsection id="HAF9ACBB483894174A55C5C5140530CCB"><enum>(b)</enum><header>Continuing availability of funds</header><text>Funds appropriated pursuant to the authorization under this section shall remain available until expended.</text></subsection></section><section id="H5877322061B04B689F6F9AEF38D62665"><enum>7.</enum><header>Termination; Nonapplicability of Federal Advisory Committee Act</header><subsection id="HA05F9E5BDD9E4FD2A273096CE4B7C428"><enum>(a)</enum><header>Termination</header><text>The Commission shall terminate 30 days after the date on which it submits the final report required under section 3(b)(2).</text></subsection><subsection id="HD70D693447B34665B4C4DAD38C14CD1D"><enum>(b)</enum><header>Nonapplicability of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Commission.</text></subsection></section></legis-body></bill>
